3 Contingency is a niche insurance market that covers a wide variety of risks all tailored to protect businesses and individuals working in today s highly competitive and marketing driven environment. Our contingency specialists Richard Woods and Robert Barron handle business for clients ranging from event organisers, sponsors, broadcasters, merchandisers and exhibitors through to sporting companies, organisations and private individuals. Richard and Robert work with them to develop bespoke insurance programmes allowing clients the freedom to achieve the maximum impact from their marketing budgets, whilst protecting their costs, expenses and revenues should something go wrong. 4 Products Weather Risks Adverse weather can interrupt business growth, lead to unbudgeted expenditure and cause volatility in earnings. Lockton can tailor a flexible insurance package that gives the insured control over the key elements of their insurance; Peril (precipitation, snow & temperature) Trigger level Duration Protecting expenses Weather Insurance can be used to provide financial certainty across a wide variety of circumstances for example: Stabilizing income - Income stabilization products are of particular interest to companies whose business income is directly impacted by weather conditions. Unseasonal rain A theme park is concerned that unseasonably bad weather during it s busiest time of year in the summer vacation school months is likely to result in reduced visitor numbers and a subsequent knock-on impact of revenues. To address this, the insurance can be structured so that if there is a pre-agreed amount of rain between certain hours over a specified period, and visitor numbers drop by more than a certain percentage compared with the previous year, then the policy may provide coverage for this weather related impact on revenue. Extra expenses cover: film-shoot wash-out A film director requires at least eight rain free hours, either consecutively or non-consecutively to shoot an outdoor scene for a film. If there are less than eight rain free hours then the shoot would be a wash-out and considerable expense would be incurred rescheduling the shoot for an alternative date. The policy can insure the days shoot, and cover the rescheduling costs should the weather conditions disrupt or prevent filming.

5 Cost containment: white out An airport operator or local municipality may purchase enough grit or road salt to cover up to five feet of snow during a specific period in the winter, but there is no additional budget for buying more grit or road salt during this time. We can tailor a product to cover the cost of the airport operator or local municipality having to purchase additional grit or road salt should it snow more than five feet during the covered period. The above are examples of how weather insurance products can be used to protect revenues for businesses that are directly affected by unseasonal weather. This can be applied to many sectors including but not limited to; leisure, tourism, agriculture, energy and retail. Prize Indemnity Prize Indemnity Insurance provides cover for prizes that are awarded for achieving certain criteria, such a hole in one, football kicks, basketball shots, number games and other probability based prize games. Prize Indemnity risks can therefore be split into two areas, games of skill and games of chance. With games of chance the risk can be assessed on a probability basis. These will include lotteries, pick and win, scratch cards, game shows and internet based gaming. Games of skill include such things as hole in one, half-court basketball shots, football goals predict and win and other skill based promotions. Prize Indemnity - Saracens cross bar challenge. In 2009, a Rugby fan won 250,000 when he punted a ball from 30 metres directly onto the crossbar. Contractual Bonuses Corporate sponsorship is a key source of finance in the world of sport, either for an individual athlete or a major sporting club or organisation. The aim of sporting sponsorship is to raise the profile of a company or product as a direct result of their link with an individual athlete or sporting club or organisation. The majority of sponsorship contracts are on a basic retainer and performance related bonus basis. In short, Contractual Bonus insurance can cover a sponsor, brand, club or organiser for their contractually assumed liability to award bonuses to professional sporting individuals or teams for attaining certain levels of success or achievement. We can look at solutions for most major sports including but not limited to; football (soccer and American football), golf, tennis, rugby, cricket, athletics and motor sports.

6 Event Cancellation and Non Appearance Events including conferences and exhibitions We can arrange comprehensive coverage for cancellation, abandonment, postponement, interruption, curtailment or relocation of any insured event due to a consequence beyond the control of the Insured. Cover can be extended to include the non-appearance of key person(s) such as; a key speaker or seminar presenter. Cover is provided based upon the Insured s loss of total expenditure or gross revenue, additionally, pre contracted profits can also be covered due to the: Damage or destruction of the venue Adverse Weather if required Enforced Reduced Attendance Communicable Disease Unavoidable Travel Delay National Mourning In 2009 and 2010 due the eruption of Icelandic Volcanoes the subsequent Ash Cloud that was generated grounded flights across Europe and the United States causing the cancellation of many events due to the unavoidable travel delay caused. Entertainment Technology is turning the entertainment industry on its head - Take music, for instance, where even the biggest names in the business are putting their work on the web, whilst almost anyone can record and distribute their own efforts at will. Pocket gadgetry means we can listen to whatever we want, wherever we like, while the explosive growth of specialist TV has given us dozens of dedicated channels broadcasting every minute of the day. In this virtual world of download and DIY what is the future for big budget promotional tours and stadium filling rock concerts? Well, as anyone in the business knows, the increased exposure that comes with technology means that live entertainment is more popular than ever, both here and widely abroad. And, of course, as audiences become increasingly sophisticated they demand bigger, more complex and more costly shows. That s why non-appearance and event cancellation cover has never been more important. Promoters, tour managers, venue owners, agents, sponsors and merchandisers all invest big money in big name tours, but in the event that any of the major recording artists, or even the less well known ones, are unable to perform, it can all go horribly and expensively wrong. Of course, music isn t the only live action that can drag us away from our flat screen tellies and browsers. Sport is big business too and increasingly involves an entertainment package surrounding the main event. The modern Olympics, often dubbed the greatest show on earth, football s World and European Cups, the Pan American Games, the ever growing programme of International Rugby and Cricket fixtures, the list is endless, and they all involve substantial commercial risk. Then there are the awards ceremonies, to celebrate the best of everything. The Oscars, the Grammy s and the BRITS, for example, have become big events in their own right, but can be costly dramas if it isn t all right on the night.

7 Booking refund cover What is Refund? When a customer cancels a booked hotel room due to unforeseen circumstances this can be a problem for both the hotel and the individual. Recognising this difficulty Lockton Companies LLP have developed this insurance product which has been designed specifically for the hotel and leisure sector which provides your customer with the peace of mind that they can claim the costs of their cancelled hotel booking. Insured events Incapacity of the customer through accident, bodily injury or sickness first commencing prior to the booked stay at the hotel. Death of the customer or the customers immediate family within 30 days of the booked stay at the hotel. Travel delay due to mechanical failure or accident damage to the transport in which the customer is travelling or due to a cause outside the control of the customer that solely and directly prevents the customers continued safe transit to the hotel. Unavoidable requirement of the individual person to perform Jury Service. Restricted access to the conference and/or exhibition caused by flood, fire or explosion or through the act of a constituted authority to protect Public Health and Safety. Adverse weather including snow, fog, frost or storm preventing attendance at the conference and/or exhibition. Unavoidable requirement for the customer to remain at home due to serious damage at their home or place of business caused by fore, aircraft, explosion, storm, flood, subsidence, earthquake, falling trees, burst pipes, lightning, malicious persons or theft. We can look at solutions for many sectors where tickets and services are pre booked, including but not limited to hotels, ticketing agencies, car hire firms, airlines, travel agents, event promoters and the conference and Exhibition sector.

8 Death, Disablement, Disgrace As with Contractual Bonus Insurance sponsors, brands, clubs and event organisers look to use a sports star or celebrity to raise the profile of events and products. Naturally, when arranging a campaign surrounding a sport star or celebrity, significant costs are usually incurred. What happens if the contracted sports star or celebrity dies gets injured or is publicly disgraced? The campaign may have to be withdrawn with all incurred costs lost as a direct result. Death, Disablement and Disgrace insurance provides protection for the costs surrounding a promotional campaign involving a celebrity or sporting star. The Policy will provide cover in the event of the following: Death of the Insured Person - during the campaign. Disablement of the Insured Person - an accident or illness to the insured Sports Star or Celebrity causing the cancellation or withdrawal of the campaign. Disgrace of the Insured Person Any criminal act or any offence against public taste or decency committed by the insured Sports Star or Celebrity. Any situation or occurrence directly involving the insured Sports Star or Celebrity, which degrades or brings that person into disrepute, or provokes insult or shock to the community and reflects unfavourably upon the insured campaign. In 1988, a major milk product signed a professional athlete to appear in an advert - however following the Olympic Games in Seoul, he was branded as a drug cheat.

9 Over Redemption Insurance It s often forgotten that a company is legally obliged to show any potential liability from promotions on its books. A promotion which over-redeems can be a costly exercise. In the event of an over performing promotion this can impact profits, retailer relationships and potentially erode customer loyalty. However, brands do not have to reserve large sums on their balance sheets or commit it all to a fixed fee contract. Instead, brands can use over-redemption insurance. This provides the most efficient and effective way of protecting the balance sheet. It is straightforward insurance product that works for any promotional medium and with any mechanic. In the event of over-redemption, the insurance allows the brand to retain control of the budget and to apply that knowledge to future campaigns.

10 Claims There is a very strong claims ethos within Lockton. Our Claims approach is built upon an inclusive and integrated basis, thus ensuring that our claims specialists have been involved in the programme design well before a major loss occurs. This allows for any potential problems to be addressed before, rather than after the event. Strategic claims management is essential in handling any loss for our clients, whether on a layered or single policy programme. Of course, our ultimate role in the claims arena is heavily dependent upon the final programme structure, level of self-insured retention and similar considerations but notwithstanding any such factors, we are above all our clients advocates in the Insurance market. Our Role in claims management is to support and partner your in-house team. We have dedicated teams with expertise and knowledge to work with our Clients to enhance the claims process. Our objectives are: To manage and resolve claims in the manner which achieves the best result within the shortest possible timeframe. To provide appropriate support, guidance and advice from notification until claim conclusion in a timely, proactive and efficient manner. To draw on our relationships with insurers and loss adjustors as necessary with the aim of ensuring that our client s losses are appropriately investigated, reserved and managed to fair and appropriate conclusion.
