3 ORDNANCE NO. 29- ORDNANCE OF THE BOARD OF COUNTY COMMSSONERS OF PALM BEACH COUNTY, FLORDA, AMENDNG ORDNANCE NO. 85-4, AS AMENDED, ESTABLSHNG AN AMENDED FVE YEAR ROAD PROGRAM; PROVDNG FOR TTLE; PURPOSE; ADOPTON OF REVSED FVE YEAR ROAD PLAN AND REVSED LST OF PROJECTS CONTANED N EXHBT A; MPLEMENTATON OF PLAN; MODFCATON OF PLAN; FUNDNG OF OTHER ROADWAY MPROVEMENTS, NTERPRETATON OF EXHBT; REPEAL OF LAWS N CONFLCT; SEVERABLTY; NCLUSON N THE CODE OF LAWS AND ORDNANCES; EFFECTVE DATE. WHEREAS, by Ordnance 85-4, the County establshed a fve-year road program settng forth the road projects to be funded, desgned and constructed by the County v,.thn the next fve years; and WHEREAS, Ordnance 85-4 requred armual updates of the road projects by December of each year and pennts modfcatons of the plan no more than twce n a one year perod; and WHEREAS, the Board of County Commssoners annually updated Ordnance 85-4 by enactng Ordnances 87-24, 88-29, 89-36, 9-39, 91-43, 92-21, 93-3\,94-14,94-28,95-32,96-2,96-21, 96-43, 97-22, 97-39, 98-24, 99-3, 99-39, 2-6, 2-22, 2-62, 21-32, 21-98, 22-27, 22-7, 23-28, 23-69, 24-55, 25-17,26-18, 26-44, 27-16, 27-22; and by amendng the attachment dentfed as Exhbt A to each of the Ordnances; and WHEREAS, the Board has consdered the fundng and tn1ng of road projects for the next fve years as set forth n Exhbt A to Ordnance and desres to revse Exhbt A of Ordnance to reflect such changes; and WHEREAS, the Board wshes to amend the Fve Year Road Program Ordnance by amendng Exhbt A and enactng a new Exhbt A to ths Ordnance. 4 NOW, THEREFORE, BE T ORDANED BY THE BOARD OF COUNTY COMMSSONERS OF PALM BEACH COUNTY, FLORDA, THAT: SECTON Ordnance 85-4, as amended by Ordnances 87-14, 88-29, 89-36, 9-39, 91-43, 92-21, 93-31, 94-14, 94-28, 95-32, 96-2, 96-2, 96-43, 97-22, 97-39, 98-24, 99-3, 99-39, 2-6, 2-22, 2-62, 21-32, 21-98, 22-27, 22-7, 23-28, 23-69, 24-55, 25-17, 26-18, 26-44, 27-16, 27-22, and 28-46, and s hereby amended. TTLE Ths Ordnance shall be known as the Palm Beach County Fve Year Road Program Ordnance. PURPOSE The Palm Beach County Comprehensve Plan, Transportaton Element, s desgned to be used as a gude to meet exstng and future ground transportaton needs of the County ncludng major roadways wthn ncorporated muncpaltes. The element analyzes the prmary transportaton network wthn the County to detennne system defcences and dentfy mprovements. The Board of County Commssoners now desres to codfy n ths Ordnance a reasonably attanable program of roadway constructon for the next fve years and match the constructon of the projects wth a,alable fundng. The further purpose of ths Ordnance s to encourage the prortzaton of projects, provde for better tmng of rght-of-way acquston and provde mproved plannng for fnancal fundng mechansms. ADOPTON OF REVSED FVE YEAR ROAD PLAN The lst of projects for the Fve Year Road Program set forth n Exhbt A, of Ordnance 85-4, as amended, s hereby modfed as set forth n anew Exhbt A, attached hereto and ncorporated heren, and s hereby adopted as the Fve Year Road Plan. Exhbt A of Ordnance s hereby deleted and replaced wth the new Exhbt A, attached hereto. Page 2 of5

5 MPLEMENTATON OF PLAN The County Admnstrator and the County Engneer are drected 1 mplemem the Fve Year Road Plan by takng such actons as are necessary to cause the constructon of the roadway segments ndcated on the Plan, make perodc reports to the Board of County Commssoners wth regard to the progress of the projects and to brng all necessary agreements and budget amendments to accomplsh the project to the Board of County Commssoners for consdera1on. MODFCATON OF PLAN Each year pror to December, the Board of County Commssoners shall consder an amendment to ths Ordnance modfyng the lst of projects contaned on Exhbt A to create a vable lst of funded projects for the succeedng fve years. From tme to tme durng each year, the Board of County Commssoners, by resolmon, may shft fundng wthn the program to promote the more effcent constructon of the projects. Deletons, substtutons and addtons of emre constructon projects from Exhbt A may only be accomplshed by Ordnance of the Board of County Commssoners. Deletons of projects may be accomplshed no more frequently than twce a year. FUNDNG OF OTERROADWA Y MPROVEMENTS, NTERPRETATON OF EXHBT Ths Ordnance shall not be construed to prevent the Board of County Commssoners from constructng other roadway mprovements whch are not lsted on Exhbt A, provded the projects are funded from sources whch wll not delete or delay projects ncluded on Exhbt A. 6 t s recognzed that Exhbt A depctng lmts of the varous projects, length of projects, type of work, tmetables and costs are approxmatons that wll requre modfcaton and updatng by the County Admnstrator based upon more detaled nformaton and bddng results; provded that the followng changes may only be made by the County Commsson: (a) Changes that ncrease or decrease the total approved appropratons of the program, (b) (c) Changes requrng fundng from a reserve accowu. Changes ncreasng a Board approved project budget by more than fve percent. (d) Changes whch sgnfcantly affect the scope, namre, or phasng of a captal project. REPEAL OF LAWS N CONFLCT All local laws and ordnances applyng to the unncorporated area of Palm Beach County n conflct wth any provsons of ths Ordnance are hereby repealed. SEVERABLTY f any secton, paragraph, sentence, clause, phrase, or word of ths Ordnance s for any reason held by the Court to be unconsttutonal, noperatve, or vod, such holdng shall not affect the remander of ths Ordnance. NCLUSON N THE CODE OF LAWS AND ORDNANCES The provsons of ths Ordnance shall become and be made a part of the Code of Laws and Ordnances of Palm Beach County, Florda. The sectons of ths Ordnance may be renumbered or relettered to accomplsh such, and the word ordnance may be changed to secton, artcle, or any other approprate word. Page4of5
