AFTER ACTION AGENDA INDIAN ROCKS BEACH REGULAR CITY COMMISSION MEETING TUESDAY, JULY 8, 2014 Mayor Johnson called e meeting to order at 7:00 p.m., followed by e Pledge of Allegiance and a moment of silence. PRESENT: Mayor-Commissioner Johnson, Vice Mayor-Commissioner Labadie, Commissioner Hamilton-Wollin, Commissioner Hanna, Commissioner Kennedy, City Attorney Daigneault, City Manager Mims, City Clerk O Reilly, Librarian Talerico, Assistant Public Services Director Warren, Planning and Zoning Director Taylor. 1A. RESOLUTION NO APPOINTED Jay Daigneault, Esquire, of Trask Metz Daigneault, LLP, as e City Attorney; and auorizing e Mayor-Commissioner to enter into an Agreement for Legal Services wi Jay Daigneault, Esquire, Trask Metz Daigneault, LLP. Unanimous 1B. OATH OF OFFICE Jay Daigneault, City Attorney. City Clerk O Reilly administered an Oa of Office to Jay Daigneault, City Attorney. 2. REPORTS OF e Pinellas County Sheriff s Office (PCSO). (See minutes for details.) PCSO Deputy Patrick Kruger reviewed e June 2014 Crime Analysis Report, and addressed e City Commission questions and/or concerns. 3. PUBLIC COMMENTS. (See minutes for details.) Donna Valery, Avenue, expressed her concern wi vehicles parking right up to, or undernea, e stop signs. Donna Valery, Avenue, expressed her concern wi fishermen using large barred fishing lures and fishing lines at are hidden in e seaweed and casting when ere are swimmers in e area, stating is is a safety issue. Bert Valery, Avenue, announced at e Indian Rocks Beach Adult Softball League is starting eir summer season on Tuesdays at 6:00 p.m. Bert Valery, Avenue, expressed his concern wi e number of cigarette butts on e beach and e lack of enforcement of e litter ordinance by e PCSO. Don House, 2104 Beach Trail, stated he has learned at e beach gator does not go on e beach unless ere are ree deputies in town. He suggested at e Community Policing Deputy work weekends to enforce e rules on e beach, i.e., cigarette butts, parking, drinking, and etc. Becky Griffin, 375 La Hacienda Drive, expressed concern wi dogs on e beach, sleeping on e beach, cigarette butts, drinking, and, etc., and e lack of enforcement by e PCSO. She reported at on June 6, she called e PCSO to report at ere were beachgoers climbing, flashing eir flash lights on a sea turtle Page 1 of 6
2 who was laying her eggs on e beach. She stated ere was no response by e PCSO; not even a courtesy call back. Nancy Obarski, 708 Beach Trail, #B, advised at she is having problems wi people trespassing on her property to get to e beach and stated at oer gulf front property owners are experiencing e same ing. She inquired if e City could design an official looking sign at has e City seal and Ordinance Number, stating ere is no beach access, no trespassing, and e signs could be purchased by e residents from e City. She stated she will never call e PCSO again because of her past dealings wi em. Jason Sinclair and Kay Vindra, of Get Fitness, Walsingham Road, requested permission from e City Commission to use Indian Rocks Beach as an event space for Family Fit Fest every Saturday at 9:00 a.m.. Mayor Johnson recommended at is issue be added under Deletions/Additions on e Agenda. Michael Alea, Avenue, expressed his concern wi e number of cigarette butts and barred fishing lures on e beach, and e lack of enforcement by e PCSO. Andy Massaro, 310 Gulf Boulevard, expressed his concern wi trespassers at use his and his neighbors decks, outside showers, and pools when ey are not home. He stated e trespassers walk rough eir properties to gain access to e beach. He stated e rules need to be enforced by e PCSO. Diane and Tom Busboom, Avenue, stated ey moved to Indian Rocks Beach because it is peaceful and for e quality of life, and she does not want at quality of life to be eroded by beach visitors. She stated most beach visitors do not go to e restaurants, as ey bring eir own refreshments, and ey do not respect e beach or ey do not abide by e City s rules and regulations. She stated e City Commission should listen to e people who pay property taxes. David Gardella, property owner of 2207 and 2307 Bay Boulevard, stated he would like for e City Commission to reconsider e renting of boat slips to nonresidents. Bill Dotson, 1 Windrush Boulevard, stated beach visitors are disrespecting e beach, ere is a lack of garbage cans on e beach, and suggested having volunteers to handout garbage bags to beachgoers on e holiday weekends. He stated most of e concerns can be handled rough e PCSO by working closer wi em on ese issues. Chad Hopple, 1201 Bay Boulevard, expressed his concerns wi fishing lures and fishing lines being left on e beach as it is a safety hazard for his children. He recommended at ere be a designated area for fishermen. 4. ORGANIZATIONAL REMARKS. None. 5A. REPORTS OF THE CITY ATTORNEY: None. 5B. REPORTS OF THE CITY MANAGER: (See minutes for details.) City Manager Mims announced e following meetings: July 9, 2014 Finance & Budget Review Committee at 5:00 p.m. July 17, 2014 City Commission Budget Work Session at 4:00 p.m., to discuss e General Fund. July 24, 2014 City Commission Budget Work Session at 4:00 p.m., to discuss e Sewer and Solid Waste Enterprise Funds. City Manager Mims reported e City has applied for two grants in connection wi e landscaping for e Gulf Boulevard/Walsingham Road Signature Intersection. Page 2 of 6
3 City Manager Mims stated e City has received approximately $440,000 in outside revenue from various sources in e past seven mons. 5C. REPORTS OF THE CITY COMMISSION: (See minutes for details.) Rezoning certain real property located at Gulf Boulevard consisting of 0.14 acres, more or less, and legally described as New Haven Beach Block C, Lot 1; from Commercial Tourist to Commercial Tourist 1: Gulf Boulevard. Unanimous 8J. ORDINANCE NO APPROVED ON FIRST READING. Amending Chapter 110, Zoning; Article III, District Designation and Regulations; Division 1, Generally; by adding a section to be numbered (13), High Density Commercial Tourist Zoning District 1-CT-1: Gulf Boulevard. Unanimous 9. RESOLUTIONS: None. 10. ORDINANCES, first reading: None. 11A. DISCUSSION OF beach parking. [Vice Mayor Labadie] (See minutes for details.) The City Commission received input from e citizenry regarding eir concerns wi beach parking. The following concerns were expressed by e citizenry: Page 4 of 6
5 Parking too close or undernea stop signs. Parking on e side streets. Parking on vacant lots. Dogs on e beach. Cigarette butts on e beach. Drinking alcohol on e beach. Lack of access for emergency vehicles to enter side streets due to parking on bo sides. Lack of respect for e beach by beachgoers. Trespassing on private property to gain access to e beach. Lack of enforcement by e PCSO. The following ideas were presented by e citizenry: Establish a Beach Parking Ad Hoc Committee. Limit e time to one hour parking in e Nature Preserve. Stronger enforcement of parking, littering, and drinking on e beach by e PCSO. Limitations on parking, such as no side street parking during daytime hours. Institute a sticker program whereby only residents can park on side streets. Hire non-sworn officers to write citations for: dogs on e beach, alcohol on e beach, illegal parking, and littering on e beach. Establish tow away zones. More law enforcement visibility on e beach. Community Policing Deputy to work e weekends to monitor e beach and parking situation. Increase parking fines. Resident parking spaces in e Nature Preserve. CONSENSUS FOR THE CITY MANAGER TO REVIEW THE IDEAS PRESENTED, AND REPORT BACK TO THE CITY COMMISSION WITH HIS FINDINGS. 12. CITIZEN PARTICIPATION. None. 13A OTHER BUSINESS FAMILY FIT FEST. [See minutes for details.] Jason Sinclair, of Get Fitness, Walsignham Road, requested permission from e City Commission to use Indian Rocks Beach (e beach) as an event space for Family Fit Fest every Saturday at 9:00 a.m., at e 4 Avenue Beach Access. The goal of Family Fit Fest is to bring e Indian Rocks Beach community togeer in an active setting at is comfortable for all fitness levels and ages. He stated is would be a free event wi approximately 100 to 150 in attendance. City Manager recommended at e event be held in Chic-A-Si Park, so at ere will be no parking or noise issues wi is event. CONSENSUS OF THE CITY COMMISSION TO AUTHORIZE THE CITY MANAGER TO CONSIDER ISSUING A PERMIT TO FAMILY FIT FEST TO USE CHIC-A-SI PARK EVERY SATURDAY AT 9:00 A.M., AND ON SPECIAL OCCASIONS THE USE OF THE TH BEACH BY THE 4 AVENUE BEACH ACCESS. 14.
