Opening o f the sessio n The Commission, at it s fifth sessio n, decided that i t s sixth session should be held in Geneva from 2 to 13 April 1973, with the p o ssib ility of an extension u n til 18 April ٠ The sixth session w ill be held at the United Nations O ffice at Geneva (Palais des Nations) and w ill be opened on 2 April 1973, at a.m.٠ by the representative of the Secretary-General, who w ill also preside over the electio n o f a chairman. Item 2. Election o f o fficers ' Pursuant to a decision taken by the Commission at it s f ir s t sessio n, the Commission e le c t s a chairman, three vice-chairm en and a rapporteur. Item 3. Adoption o f the agenda; te n ta tiv e schedule o f meetings A ten tative schedule o f meetings appears herein as section I I I. It contemplates that the Commission may find i t p ossib le to terminate the work o f the sixth session oo. 13 April It i s expected that i t w ill not be necessary for the Commission to set up a committee of the whole; consequently, the ten tative schedule o f meetings does not make p rovision for such a committee. Item U. The study also indicates the present status o f the work on the preparation o f a d ra ^ se t o f such general con ditions. Copies 'of General Assembly reso lu tio n 2929 (XXVII) w ill be a vailab le at the six th se ssio n (c),at the Commission's f if t h sessio n, the representative of Spain introduced a proposal o f h is d elegation regarding the working methods o f the Commission (A/CN.9/L.22). The Commission agreed to consider th is question further at i t s sixth session. (d) In d iscu ssin g i t s future work, the Commission may a lso wish to agree - upon a schedule o f sessions o f it s working groups for the period between i t s sixth' and seventh sessio n s. In th is connexion, the individual working groups have, in their reports on the work of th eir la te s t sessio n s, made the follow ing recommendations: ( i ) Working Group on the In tern ation al Sale o f Goods:, "The Working Group took note o f the views expressed at the f if t h session 7 o f the Commission and in the h Six1 Committee during the twenty-seventh session o f the General Assembly, suggesting that in order to accelerate i t s work the Working Group should hold, i f p o ssib le, longer and more frequent sessions. "The Working Group agreed that the frequency and length o f i t s sessions could only be decided in view o f the frequency and length o f the sessions of other subsidiary bodies o f the Commission, and the fin an cial im plications of extended or further sessions o f th is Working Group. I t therefore decided to submit t h is question to the Commission fo r consideration at i t s six th s e s s io n.1 (A/CN.9/75, paras. 179 and ) ' ( i i ) Working Group on In tern ation al L eg isla tio n on Shipping: This Working Grojip recommended to the Commission "that, subject to the consideration /by the Commission/ o f fin an cial im p lications, the sixth session o f the Working Group be held in Geneva from 27 August to 7 September 1973 and that the Working Group s seventh session be held in Hew York in February 1973" (A/CN.9/76, para. 78). ( i i i ) Working Group on In tern ation al N egotiable Instrum ents: "The Working Group gave consideration to the timing o f i t s second session The Group was o f the unanimous opinion that in view o f the progress achieved at the present sessio n, i t s second session should be held as soon as p ossib le. Some representatives expressed the view that the second session should be held in the course o f Others were of the opinion that consideration o f the time and place for the second session should be le f t for decision by the Commission at i t s forthcoming six th s e s s io n, which w ill convene on 2 A pril 1973." (A/CN.9/7 7, para. 139.) In considering the schedule o f future sessions o f working groups, the Commission w ill wish to take into account the date and place o f i t s seventh session (item 13) and the date o f the international conference on prescription (lim itation ) -in the international sa le of goods.
7 Item 12. Other business The Commission may wish, under th is item, to discuss points o f in terest,th a t were not considered under other items o f the agenda. The Commission w ill no doubt wish to d iscu ss the note by the Secretary **General (A /di 9/L.24) regarding the proposal by the International, In stitu te for the U nification o f Private Law (UNIDROIT) that the Commission consider including in i t s programme o f work the u n ification of rules governing the v a lid ity o f contracts. o f international sale o f goods. The Commission's attention is drawn to the Secretary-General's report on current a c tiv itie s o f other organizations (A/CN.9/82). Item 13. Date and place o f the seventh session In accordance with paragraph 6 o f General Assembly resolution 2205 (XXI), the sessio n s o f the Commission are held a lte r n a te ly in New York and in Geneva. The seventh session o f the Commission is therefore expected to be held at United Nations Headquarters in New York. Item lu. Adoption o f the report o f the Commission The General Assembly, in paragraph 10 o f resolution 2205 (XXI), decided that the Commission should submit an annual report, including it s recommendations, to the General Assembly, and that the report should be submitted simultaneously to the United Nations Conference on Trade and Development for comments. Under a decision by the Sixth Committee, b/ the report o f the Commission is introduced to the General Assembly by the Chairman o f the Commission or by another o ffic e r designated by him. I I I.
