Definition 1.1 For the purpose of this Terms and Conditions, the following words and expressions shall have the meanings assigned to them except where the context otherwise requires:- Bank means AmBank (M) Berhad (Company No D), company incorporated in Malaysia under the Companies Act 1965 and having its registered address at Level 22, Bangunan AmBank Group, No. 55, Jalan Raja Chulan, Kuala Lumpur. AmBank Group means all the related Corporations and Associate Corporations of the Bank whether incorporated inside or outside Malaysia, existing now or in the future and reference to AmBank Group in this Terms and Conditions herein, shall include all or any entity within the AmBank Group. Day means Monday to Friday, and whereby the registered office of the Bank is open, unless stated otherwise. Prior Notice means notice by the Bank of certain facts or of a particular state of affairs of at least three (3) calendar days. Eligible Products for The Campaign means all Current/Savings accounts ( CASA ) offered and issued by the Bank. Existing Customer means an individual who has any one of the Eligible Products prior to the commencement of the Campaign Period. New Customer means an individual who does not have any of the Eligible Products with the Bank prior to the commencement of the Campaign Period. Eligible Participant means a New or Existing Individual Customer being the primary/principal accountholder who opens or maintains the Eligible Product(s) during the Campaign Period. Fresh Funds means monies or funds that are:- (a) (b) not transferred from any existing Bank or AmBank Islamic deposit account; or funds transferred from another bank/financial institution into the customer s Bank deposit account not more than seven (7) calendar days prior to deposit placement. The Campaign means organised by the Bank in accordance with the Terms and Conditions stipulated herein. 1.2 Words denoting person shall include living persons and, if and where applicable, body or persons incorporated or unincorporated. Words importing the singular shall also include the plural and vice versa. Words importing the masculine gender shall include the feminine and neuter gender. 1.3 The term Associate Corporations shall have the meaning assigned to it under Section 2(1) of the Financial Services Act 2013, as the case may be. The term Related Corporations shall have the same meaning assigned to it under Section 6 of the Companies Act Campaign Period 2.1 The Campaign shall run from 16 December 2015 until 31 March 2016 (both dates are inclusive) ( Campaign Period ): 2.2 The Bank reserves the right to vary or amend the duration of the Campaign Period at its sole and absolute discretion, with Prior Notice. 1 Current Account/Saving Account Campaign_I Love Savings T&C

Eligibility Terms & Conditions 3.1 Any Eligible Participant may participate in this Campaign except for:- a) Individuals below the age of eighteen (18) years old ; b) Sole-proprietorships/partnerships; and/or c) SMEs (Small Medium Enterprises with annual turnover of less than RM25million) 3.2 Non-individual customers are not eligible to participate in this Campaign. 3.3 If Eligible Products held in joint accounts, only the first named joint accountholder i.e. primary account holder shall be eligible to participate in the Campaign. 3.4 For Eligible Products held as trustee account, the Eligible Participant will be the parents/legal guardians of the beneficiaries (those who age 18 and above). 3.5 This Campaign is open to all new and existing accountholders of the following accounts as stipulated in the Table A below: ( Participating Account ) (Eligible for Protection by PIDM) Table A: Current Account (CA) product or; Basic Current Saving AmStar AmStar Extreme TRUE Transact Family First Account (Everyday Account) Savings Account (SA) product Basic Savings Account Everyday Savings Account TRUE Savers Family First Account (Special Savings Account) 4 Campaign Mechanics 4.1 Eligible Participant is required to deposit or top up a minimum Fresh Fund amount into their Participating Accounts and keep this amount earmarked for four (4) months ( Earmark Period ) during the Campaign Period in order to be entitled for the following gifts as stipulated in Table B:- 2 Current Account/Saving Account Campaign_I Love Savings T&C

For the earmarking purposes, Eligible Customer is required to acknowledge the Letter of Indemnity provided by the branch upon successful deposit placement or top up of their Current/Savings Account. 4.4 Deposit placement or top up placed in the Participating Account shall be earmarked by the Bank for a period of time as stipulated in Table B from the date of placement ( Earmark Period ). 4.5 All gifts will be given based on each earmarked Eligible Fresh Funds made by Eligible Participant throughout the Campaign Period. 4.6 The gifts are valid on a first-come-first-serve basis and subject to the stock availability, limited to three (3) gift for each gift category for each Eligible Participant throughout the Campaign Period. 4.7 The gifts shown in the advertisements and other marketing materials (if any) are for illustration purposes only and the actual design may differ. 5. Earmarked Fund 5.1 In the event the earmarked amount in the Participating Account (in part or full) is cancelled, withdrawn or released during the earmarking period for any reason whatsoever, the Bank reserves the absolute right to deduct the following penalty fee from the applicable Eligible Participant s Participating Account as stipulated in Table C below on the withdrawal date. 5.2 The following penalty fee amounts are equivalent to the cost price of the gifts in the event the gifts have already been redeemed. 3 Current Account/Saving Account Campaign_I Love Savings T&C

4 Table C: Category Minimum Eligible Fresh Fund Deposit (RM) 1 30, , ,000 Gifts Penalty Fee (RM) Samsung Galaxy V Plus worth up to RM Samsung Galaxy J1 Ace worth up to RM Samsung Tab 3V worth up to RM Deposit placements made by way of cheque(s) are subject to their clearance and will only be considered as deposit placements by the Eligible Participants after the cheques are paid or cleared and will only be considered good if not returned dishonoured. 5.4 For the avoidance of doubt, the Bank may cease to offer any of the Eligible Products and/or convert the existing affected Eligible Products for any reason whatsoever, including but not limited to ensure compliance with any applicable laws and/or regulations. 6. Gift Redemption 6.1 Successful Eligible Participant will be announced at our Bank s official website, at within ninety (90) days after end of Campaign Period. 6.2 The gift will be available for collection by the Eligible Participant within ninety (90) days after end of Campaign Period failing which, Eligible Participant shall be deemed to have forfeited the gift. The collection of the gift is to be collected from the branch where the Current/Savings Account placement is made. 6.3 Notification of the successful Eligible Participant will be given via Short Message Service (SMS) or any other methods deem appropriate by Bank within ninety (90) days after end of Campaign Period. As example: RM0.00:TQ participating in I Love Savings Campaign. Please collect your gift at your earmark branch. For info call Gift(s) will be given or issued as per selected by Eligible Participant according to the placement deposit category been made. Eligible Participant is also not allowed to choose color of the gift. The decision on this shall be final, no correspondence or appeal will not be entertained to change the gift. 6.5 Gift(s) will be given or issued in the name of the Eligible Participant and it is non transferable. 6.6 In the event of joint account holders, the gifts shall be given to the primary account holders only. 6.7 The Bank reserve full right to add/remove and to substitute any gifts with items of similar retail value with Prior Notice to the Eligible Participant. 6.8 Until and including the day the gifts is given out to the Eligible Participant, the Participating Account(s) must remain active and valid to the satisfaction of the Bank, failing which the Eligible Participant shall be deemed to have forfeited the gifts and the Bank shall retract the said gifts. 4 Current Account/Saving Account Campaign_I Love Savings T&C

5 6.9 The Eligible Participant shall be responsible to pay all and any tax, incidental cost not limited to any applicable taxes, and all other personal expenses and/or any other charges relating to the gifts and/or Campaign The Bank shall not be held liable for any tax, incidental cost, charges and/or damages caused by the gift and non-fulfilment by any of its agents / distributors The Bank shall not be liable nor shall it accept any form of liability of whatsoever nature and howsoever arising or suffered by the Eligible Participant (including negligence) with respect to death, injury, any losses, damages or accidents arising from the use of the gift by the Eligible Participant The Bank expressly excludes and disclaims any representations, warranties or endorsements, expressed or implied, written or oral with respect to the quality or suitability of the gift. The Bank will also bear no responsibility for resolving disputes with the manufacturer or supplier of the gift and the Eligible Participant are to deal directly with the manufacturer or supplier for all warranty information The Bank shall not be responsible to replace any gift damaged or stolen after it is collected by the Eligible Participant The Bank reserves the right to disqualify or retract the gift awarded to Eligible Participant if such person has committed fraudulent or wrongful acts in relation to their account. 7. General 7.1 The Bank shall have the right to use, publish or display in any form as it deems necessary and appropriate the selected Eligible Participant s details (including but not limited to) the name(s), picture(s), and city of residence(s) of the selected Eligible Participant for advertising and publicity purposes (if any). By participating in this Campaign, the selected winner hereby expressly consents to and agrees for the Bank to exercise the aforesaid rights. The Eligible Participants shall have the discretion to access and update their personal details by notifying the Bank in writing throughout the Campaign Period. 7.2 The Bank s decision on all matters and/or disputes relating to this Campaign shall be final, binding on all Eligible Participants, no correspondence or appeal will not be entertained. 7.3 All transactions recorded by the Bank are final and conclusive. 7.4 The Bank shall have the absolute right to cancel, terminate or suspend this Campaign at any time without assigning any reason with Prior Notice via the Bank s official website or at its branches. 7.5 The Bank shall have the right and absolute discretion to vary, amend, delete or add to any of the Terms and Conditions specifically set out herein, in whole or in any part from time to time including to vary the Campaign s tenure as it deems necessary and appropriate with Prior Notice via the Bank s official website, at or at the Bank s branches. Unless stated otherwise in this Terms and Conditions, any notice given by the Bank shall be deemed given when so posted at its official website or its branches, whichever is earlier. 7.6 The Bank shall have the right to alter, remove, substitute, add or cancel any of the Campaign gifts at any time without assigning any reason with Prior Notice via the Bank s official website or at its branches. 7.7 The Bank shall have the right and absolute discretion to disqualify any Eligible Participant that it finds or determines to have tampered or be tampering with the entry process and/ or the 5 Current Account/Saving Account Campaign_I Love Savings T&C

6 operation of the Campaign, to be acting in breach or potential breach of the Terms and Conditions herein. 7.8 This Terms and Conditions shall prevail over any other provisions and/or representations contained in any other promotional materials advertising this Campaign. 7.9 By participating in this Campaign, Participants and/or any parties related herein agree to be bound by this Terms and Conditions Under no circumstances will the Bank be held liable for any loss or damages, including without limitation to loss of income, profits, goodwill, direct or indirect, incidental, consequential, exemplary, punitive or special damages of any party including third parties, howsoever arising whether in contract, tort, negligence or otherwise, in connection with participation in this Campaign, or any of the Campaign gifts, or the Bank having exercised its rights and entitlement under this Terms and Conditions, including but not limited to pursuant to clauses 3, 4, 5, 6, and 7. Even if the Bank has been advised of the possibility of such damages in advance, all such damages are expressly excluded The Bank shall not be liable for any default in respect of the Campaign due to any act of God, war, riot, strike, lockout, industrial action, fire, flood, drought, storm, technical or system failures or any event beyond the reasonable control of the Bank All Terms and Conditions stipulated herein shall be governed by and construed in accordance with the laws of Malaysia In the event of any discrepancies or conflict in the interpretation of this Terms and Conditions, the English and Bahasa Malaysia versions of each of this Terms and Conditions shall be construed as equivalent and each of the Terms and Conditions stipulated shall carry the same meaning All customers/participants are required to log on to the Bank s corporate website for promotion updates at for the latest Terms & Conditions, if any. 6 Current Account/Saving Account Campaign_I Love Savings T&C
