1 AmBank M-Card Credit Card Acquisition Programme Terms & Conditions Definitions Except where the context otherwise requires, or unless these Terms and Conditions otherwise provide, all words, names and expressions defined in the Cardmember Agreement when used or referred to in these Terms and Conditions shall have the same meaning as that provided in the Cardmember Agreement. Card means any MBF Credit Cards and AmBank M-Card Credit Card The Bank means AmBank (M) Berhad Eligible Cardmember means the the Customers of The Bank who has applied and has been issued with Principal Card and/or Supplementary Card during the Programme Period as herein described. The Programme means Apply and Spend Programme & 5X on Fridays & Weekends ( Programme ) organized by the Bank in accordance with the Terms and Conditions stipulated herein. Words denoting person shall include living persons and, if and where applicable, body or persons incorporated or unincorporated. Words importing the singular shall also include the plural and vice-versa. Words importing the masculine gender shall include the feminine and neuter gender. The Apply and Spend Programme ( Apply Programme ) 1. The Apply Programme commences from 1 November 2015 and ends on 31 December 2015 ( Apply Programme Period ), both dates inclusive or such other period(s) as may be determined at the sole and absolute discretion of the Bank with at least 21 days prior notice. 2. This Programme is only applicable for New-to-Bank AmBank M-Card Credit Card customers approved during the Apply Programme Period. 3. All applicants must SMS YESCC to within the Apply Programme Period to be eligible for this programme. Standard telco charges apply. 4. All application form with complete documents must reach the Bank within the Apply Programme Period, i.e. latest by 31 December Proof of date sent and/or postage does not constitute receipt of application form by the Bank. The Bank s date of receipt of application form shall prevail. 5. By applying for the Credit Card during the Apply Programme Period, the applicants agree to the sharing of information between and the Bank for fulfillment purposes. 6. Apply Programme is not applicable to: a. Existing AmBank / AmBank Islamic Cardmembers; b. Existing AmBank cardmembers who apply for new AmBank Islamic Credit Card (or vice versa); c. Existing Supplementary cardmembers apply for new Principal Card; d. AmBank Group staff;

2 e. A former AmBank / AmBank Islamic Cardmember whose credit card was cancelled less than six (6) months from the date of the application and re-apply AmBank M-Card Credit Card under this Apply Programme; f. All standalone Supplementary Card applicants; AND g. Customer who is in default of payment of sums due / suspected of committing any fraudulent, unlawful and illegal acts in relation to the Customer s AmBank / AmBank Islamic Credit Card Account, and/or any other facilities or services with AmBank / AmBank Islamic. 7. For every newly approved and activated AmBank M-Card Credit Card within the Apply Programme Period, cardmember will receive 10,000 which will be credited to their Household Account. 8. In addition, if cardmembers spend RM in total within the first 2 months from the card approval date, they will get additional 30, The will be credited into the Eligible Cardmember s Account within 6-8 weeks after the Apply Programme ends. The 5X on Fridays & Weekends ( Fridays & Weekends Programme ) 10. The Fridays & Weekends Programme commences from 1 June 2015 to 31 December 2016 ( Fridays & Weekends Programme Period ), both dates inclusive or such other period(s) as may be determined at the sole and absolute discretion of the Bank with at least 21 days prior notice. 11. Both Principal and Supplementary Eligible Cardmembers are entitled to participate with the exception of: a. Cardmembers of Corporate Card(s), Commercial Card(s), and Insurance Card(s) issued by the Bank; b. Cardmembers whose Card accounts have been suspended, cancelled or terminated for whatsoever reasons during the Fridays & Weekends Programme Period or during the fulfilment of Bonuslink. 12. Fridays & Weekends Programme is applicable to Eligible Cardmembers who hold a valid MBF Credit Cards and AmBank M-Card Credit Card and use their Card to perform any retail transaction. Retail transaction shall mean purchase of transactions for goods and services incurred for personal consumption and excludes transactions incurred for business purposes, for betting or gaming transactions. 13. Eligible Cardmembers who participate in Fridays & Weekends Programme will stand to receive during the Fridays & Weekends Programme Period: a. 2X on eligible retail transactions performed on Fridays & weekends ( Eligible Spend defined in Clause 15), if their monthly cumulative retail transaction ( Qualifying Spend defined in Clause 14) is between RM500 and RM 999. b. 5X on eligible retail transactions performed on Fridays & weekends ( Eligible Spend defined in Clause 15), if their monthly cumulative retail transaction ( Qualifying Spend defined in Clause 14) is equal to or greater than RM1, Qualifying spend includes all local and overseas retail transactions which will be taken into consideration in arriving at the cumulative monthly retail transaction EXCEPT for

3 a. cash advance/quasi-cash and all on-going instalment payments including Balance Transfer/ Quickcash/ AmFlexi-Pay b. standing instructions / auto bill payments c. insurance / takaful transactions with MCC codes 5960 & 6300 d. transactions made to government bodies/ education institutions e. all direct selling / trade financing / transactions under special corporate arrangement where rebate is applicable/ Corporate Bill Payment / Corporate GIRO transactions f. qualifying retail transactions which are subsequently cancelled or refunded, disputed, unauthorized or fraudulent transactions; and g. all fees, charges or penalties whether imposed by the Bank or otherwise. 15. The 2X or 5X will be awarded to Eligible Cardmembers for their Eligible Spend which is defined as all local and overseas retail transactions performed on Friday & weekends EXCEPT for transactions listed in Clause 14 and transactions carried out at petrol stations. For retail transactions which are not within the Eligible Spend for Fridays & Weekends programme, the standard awarded remains status quo unless otherwise notified. For overseas retail transactions, the maximum received will be 2X/5X respectively depending on card type. All Eligible Spend must be successfully posted to the Eligible Cardmember s Card account to be eligible for the 2X or 5X. The Bank will allow five (5) calendar days for the eligible spend made to be posted into the Eligible Cardmember s Card account. The Bank is not responsible in any manner whatsoever for any late posting to Eligible Cardmember s account by merchants and/or third party. 17. All Eligible Spend made by the Principal Cardmember and their Supplementary Cardmember(s) will be consolidated and will not be viewed individually. Eligible Spend by Supplementary Cardmembers will also be entitled to the 2X or 5X and any will be awarded to their respective Principal Cardmember s account. 18. There is a monthly maximum of 20 million to be awarded during the Fridays & Weekends Programme Period which will commence from 1 June 2015 until 31 December 2016 (both dates inclusive). Each Fridays & Weekends Programme Period will be based on the English Roman calendar months i.e. 1 June to 30 June There is a maximum of 380 million to be awarded during the Fridays & Weekends Programme Period of 19 months. 19. The unutilized (if any) allocated in the respective month will be brought forward to the next month. 20. The 2X or 5X will be awarded at the end of each month based on the Bank s system date and time and shall be awarded on a first-come-first served basis to Eligible Cardmembers based on their Eligible Spend. 21. Eligible Cardmember i.e. Principal Cardmember and their Supplementary Cardmember(s) are entitled to a maximum of 30,000 extra points per month (notwithstanding the standard awarded). 22. The 2X or 5X will be credited into the Eligible Cardmember s Account within 6 weeks from the end date of each month. 23. The Bank will notify all Eligible Cardmembers via SMS /telephone / /mail of the awarded during the programme period for which the contact information used shall be the contact number /mailing address / address maintained in the Bank s system. Eligible Cardmembers are responsible to ensure that the details of their contact information maintained in the Bank s system is updated and complete. 24. The are not exchangeable for cash and/or any other kind of products and not transferable to any parties.

5 Disqualification 25. The Bank reserves the absolute right to disqualify any of the Eligible Transactions for the purpose of this Programme without having to notify or alert the Eligible Cardmember based on the following:- a. All transactions received before and after the stipulated Programme Period. b. The Eligible Cardmember s Card account shall not be in default of facilities granted at any time during the Programme period, subject to the Bank s discretion; and/or holder(s) of the Bank s credit card(s) whose accounts have been closed before the notification of the eligibility. General Terms and Conditions 26. By participating in this Programme, all participants consent to and agree to be bound by the Terms and Conditions herein, and the decisions of the Bank. 27. In the event the Cardmember is not able to participate in the Programme due to the invalidity, inaccessibility or system failure (including but not limited to the Bank s or third party system, any electronic, mechanical, system failure or corruption, computer viruses, bugs or related problems, operating system malfunction, telecommunication network or internet failure, power breakdown or UPS or other delivery breakdown) the Cardmember should call the Customer Service Officer at the number set out in Clause 38 below for assistance. To the extent permitted by law and the Bank not being in breach of this Programme or is negligent, the Bank will not be liable to the Cardmember if the Cardmember is unable to participate in this Programme caused by the unforeseeable and unavoidable circumstances herein mentioned. 28. All Eligible Cardmembers shall be required to adhere to the Programme Terms and Conditions. The Bank reserves the right to forfeit the points in the event that any of the Terms and Conditions are not adhered to. 29. All transactions and decision by the Bank on all matters relating to this Programme shall be final and binding on the Cardmember. 30. The Bank may disclose the Cardmember s information only to third parties appointed by the Bank for the purpose of banking operations that provide for this service and Promotion (excluding for marketing purposes). Upon participation in and acceptance of the Programme, the Cardmember hereby consents to and agree that the Bank shall be at liberty for such disclosure. 31. The Programme is valid only up to the date stated in Programme Period above or such other date as may be extended by the Bank. Nothing herein contained shall be construed as imposing an obligation on the Bank to extend the validity period of the Programme and the Bank disclaims all liabilities in respect of any actions, claims, damages, costs, charges and expenses which the Cardmember may suffer, sustain or incur by reason of his/her participation in the Programme. 32. The Bank reserves the right to vary, modify, change, add, delete, cancel, terminate or suspend any of the features of this Programme with at least 21 calendar days prior notice given by announcement made at AmBank s website at ambank.com.my or any other channel that the Bank deems appropriate. For the avoidance of doubt, cancellation, termination or suspension by the Bank of this Programme shall not entitle the Eligible Cardmember(s) to any claim or compensation against the Bank for any

6 and all losses or damage suffered or incurred by the Eligible Cardmember(s) as a direct or indirect result of the act of cancellation, termination or suspension. 33. To the extent permitted by law and the Bank not being in breach of this Programme or is negligent, the Cardmember will indemnify the Bank for any loss or damage, costs and expenses, fees and charges which the Bank may incur due to breach by the Cardmember of any terms and conditions of this Programme (including out of the enforcement of such terms and conditions against the Cardmember). 34. To the extent permitted by law, the Bank shall not be liable to the Cardmember for any losses or costs (including loss of business opportunities or profits) caused by abnormal and unforseeable circumstances outside the banks reasonable control which is unavoidable, including any natural disasters, war (whether declared or undeclared), strike, riot, civil commotion, acts of terrorists, industrial dispute, labor unrest, lock-out, fire, accident, breakdown of machinery, data processing system or transmission link or telecommunication system failure of electrical failure. 35. All terms and conditions stipulated herein, shall be governed by and construed in accordance with the laws of Malaysia. 36. In the event of any discrepancy or conflict in the interpretation of these Terms and Conditions, the English and Bahasa Malaysia versions of each of these Terms and Conditions shall be construed as equivalent and each of the Terms and Conditions stipulated shall carry the same meaning. 37. The Cardmember is required to check the Bank s website periodically for the most recent updates of term and conditions as any changes or updates to these terms and conditions published on the Bank s website will be binding on the Cardmember. 38.
