1 Foreign Workers Compensation Scheme Policy Whereas the Insured by a proposal and declaration which shall be the basis of this contract and is deemed to be incorporated herein has applied to Zurich General Insurance Malaysia Berhad (the Company) for the insurance hereinafter contained and in consideration of the payment by the Insured to the Company of the Premium. Now this Policy witnesseth that in respect of events occurring during the Period of Insurance and subject to the terms limitations exceptions and conditions contained herein or endorsed hereon hereinafter collectively referred to as the Terms of this Policy, the Company will indemnify the Insured as per the Terms stated in the various Sections of the Policy. SECTION 1 WORKMEN S COMPENSATION INSURANCE If at any time during the Period of Insurance any foreign workers employed by the Insured as stated in the Schedule shall sustain personal injury by accident or disease arising out of and in the course of his employment by the Insured and if the Insured shall be liable to pay compensation for such injury under the Law(s) set out in the Policy then subject to the Terms of this Policy contained herein or endorsed hereon the Company will indemnify the Insured against all sums for which the Insured shall be so liable and will in addition be responsible for all costs and expenses incurred with its consent in defending any claim for such compensation. PROVIDED ALWAYS that in the event of any change in the Law(s) or the substitution of other legislation therefore this Section shall remain in force but the liability of the Company shall be limited to such sum as the Company would have been liable to pay if the Law(s) had remained unaltered. LAW (S) As amended up to the date of commencement of this Policy. WORKMEN S COMPENSATION ACT 1952 WORKMEN S COMPENSATION (AMENDMENT) ACT 1956 WORKMEN S COMPENSATION (AMENDMENT) ACT 1976 MODIFICATION OF LAWS ( WORKMEN S COMPENSATION) (EXTENSION AND MODIFICATION) ORDER 1981 WORKMEN S COMPENSATION (AMENDMENT) ACT 1996 WORKMEN S COMPENSATION (Foreign Workers Compensation Scheme) (Insurance) (Amendment) (No. 2) Order 2002 WORKMEN S COMPENSATION (Foreign Workers Compensation Scheme) (Insurance) Order 2004 And any subsequent amendments to the said Act and Enactments made effective prior to the date of issue of the Policy. SPECIAL CONDITION TO SECTION 1 In the event of death of the Insured Workman resulting from personal injury by accident in the course of employment, the Company shall pay an extra sum of RM7, /9/P/G/S/M QF/GTS/PJ/3-003/03 Rev 04

2 EXCEPTIONS TO SECTION 1 The Company shall not be liable under this Section in respect of a) the Insured s liability to employees of contractors to the Insured b) any employee who is not a workman within the meaning of the Law(s) COMMON LAW LIABILITY EXCLUSION Notwithstanding anything herein contained to the contrary, it is hereby declared and agreed that the indemnity granted by this Section does not include Common Law Liability. SECTION 2 REPATRIATION EXPENSES The Company will subject to the Terms of this Section indemnify the Insured for the repatriation expenses (defined below) incurred: a) if during the Period of Insurance, the Insured Person dies or suffers permanent total disablement; b) if the Insured Person dies or suffers permanent total disablement within twelve months of the accident or sickness occurring during the Period of Insurance. DEFINITION TO SECTION 2 The repatriation expenses shall be the actual expenses incurred or RM4,800 whichever is the lesser, for the transportation of the Insured Person to his/her country of origin. SECTION 3 PERSONAL ACCIDENT INSURANCE ( Off Work Hours) The Company shall, subject to the Terms of this Section, pay to the Insured Person or his legal personal representative, in respect of personal injury sustained in an accident which occurs during the Period of Insurance and outside the working hours of the Insured Person: a) a sum of RM23,000 in the event of death or permanent total disablement occuring within 12 months of the accident; and/or b) a sum of money based on the capital sum of RM23,000 calculated in accordance with the First Schedule of the Workmen s Compensation (Amendment) Act 1996 in respect of Permanent Partial Disablement; and/or c) a sum of money calculated in accordance with Section 8(e) of the Workmen s Compensation Act 1952 in respect of Temporary Disablement; and/or d) Medical Expenses in accordance to the provisions of the Workmen s Compensation Act Territorial Limit: Malaysia SPECIAL PROVISIONS TO SECTION 3 1. Loss of a limb or member or part thereof shall mean loss by actual physical severance or total and permanent loss of use. 2. The total sum payable for Permanent Disablement in respect of injury to more than one portion of a limb or member or part thereof shall not exceed the sum payable in respect of such injury to the whole of that limb or member or part thereof. 3. The maximum benefit payable under (a) and (b) above shall be RM23,000 SPECIAL CONDITIONS TO SECTION 3 1. This insurance shall not apply to an Insured Person who has attained the age of 65 years. 2. Notice in writing must be given to the Company of any accident to an Insured Person which may give rise to a claim under this Section within ten (10) days of the accident. All reports certificates and information required by the Company shall be furnished by the Insured. The Insured Person shall from time to time submit himself to medical examination at the expense of the Company as may be required in connection with any claim.

3 In the case of death where any reasonable doubt exists as to the cause thereof a qualified medical practitioner appointed by the Company shall be allowed to make a post-mortem examination of the body of the Insured Person at the Company s expense. 3. For the purpose of this Scheme, General Condition 6 (Other Insurances) shall not apply to (a), (b) & ( c ) under this Section 4. This Section is not assignable and payment of any Benefit under this Section shall only be made to the Insured Person or his beneficiary / estate and whose receipt shall be a discharge to the Company. EXCEPTIONS TO SECTION 3 1. No payment will be made under this Section for bodily injury consequent upon: a) any unlawful act of the Insured Person or wilful exposure to danger (other than in an attempt to save human life) suicide or attempted suicide or intentional self-injury. b) the effect or influence (temporary or otherwise) of alcohol or drugs not prescribed by a qualified medical practitioner, venereal disease, insanity, or AIDS c) pregnancy or childbirth, miscarriage or abortion d) rock climbing, mountaineering (which requires the use of ropes or guides), skin diving, parachuting, polo, steeplechasing, big game hunting or hunting other than on foot, racing of any kind other than on foot. e) flying as a member of an aircrew or in any aircraft for the purpose of any trade or technical operation therein or thereon or air travel other than as a fare-paying passenger in any properly certified or licensed power-driven aircraft constructed to carry passengers. f) riding on motorcycle, motor scooter, moped or mechanically assisted pedal cycle (whether as driver or passenger) for sports, exhibition, competition or racing. g) works carried out in relation to the Insured Person s employment with the insured. GENERAL EXCEPTIONS The Company will not indemnify the Insured and/or the Insured Person against: 1. any actions for compensations brought in the Courts of Law of any territory outside Malaysia 2. loss damage injury by accident or disease directly or indirectly occasioned by or happening through or in consequence of a) war invasion act of foreign enemy hostilities (whether war be declared or not) civil war mutiny rebellion revolution insurrection or military or usurped power. b) any act of any person or persons acting on behalf of or in connection with any organisation with activities directed towards the overthrow by forces of any de jure or de facto Government or to influencing of it by terrorism or violence 3. any loss damage injury or liability directly or indirectly caused by or arising from or in consequence of or contributed to by a) ionising radiations or contaminations by radioactivity from any nuclear fuel or from any nuclear waste from the combustion of nuclear fuel. Solely for the purpose of this Exception combustion shall include any self-sustaining process of nuclear fission b) nuclear weapons material GENERAL CONDITIONS 1. DEFINITION Period of Insurance shall mean the period specified in the Schedule and during which the Insured Person is in immediate employment of the Insured BUT EXCLUDING the period when the Insured Person returns to his/her home country. Cover ceases from the time the Insured Person leaves Malaysia and resumes upon his return to Malaysia.

4 2. INTERPRETATION This Policy and the Schedule shall be read together as one contract and any word or expression to which a specific meaning has been attached in any part of this Policy or of the Schedule shall bear such meaning where ever it may appear. 3. OBSERVANCE The liability of the Company shall be conditional on the observance by the Insured and the Insured Person of the Terms of this Policy. 4. PRECAUTION The insured and the Insured Person shall comply with all statutory obligations 5. CLAIMS PROCEDURE a) On the happening of any accident which may give rise to a claim under this Policy the Insured shall i) report the accident immediately to the labour Department as provided under Section 13 (1) & (2) of the Workmen s Compensation Act 1952 ii) give notice in writing within 10 days of the accident to the Company stating the circumstances of the accident and the nature of injury b) Compensation payable as assessed by the Commissioner in accordance with the Act shall be paid within 7 days of receipt by the Company of such assessment. 6. OTHER INSURANCES If at the time of any loss damage or liability hereby insured there be any other subsisting insurance or insurances whether effected by the Insured or by any other person or persons covering such loss damage or liability the Company shall not be liable to pay or contribute more than its rateable proportion of such loss damage or liability 7. War and Terrorism Exclusion Endorsement Notwithstanding any provision to the contrary within this insurance or any endorsement thereto it is agreed that this insurance excludes loss, damage, cost or expense of whatsoever nature directly or indirectly caused by, resulting from or in connection with any of the following regardless of any other cause or event contributing concurrently or in any other sequence to the loss; (1) war, invasion, acts of foreign enemies, hostilities or warlike operations (whetherwar be declared or not), civil war, rebellion, revolution, insurrection, civil commotion assuming the proportions of or amounting to an uprising, military or usurped power; or (2) any act of terrorism. For the purpose of this endorsement an act of terrorism means an act, including but not limited to the use of force or violence and/orthethreat thereof, of any person orgroup(s) of persons, whether acting alone or on behalf of or in connection with any organisation(s) or government(s), committed for political, religious, ideological or similar purposes including the intention to influence any govemment and/or to put the public, or any section of the public, in fear. This endorsement also excludes loss, damage, cost or expense of whatsoever nature directly or indirectly caused by, resulting from or in connection with any action taken in controlling, preventing, suppressing or in any way relating to (1 ) and/or (2) above. If the Insurers allege that by reason of this exclusion, any loss, damage, cost or expense is not covered by this insurance the burden of proving the contrary shall be upon the Insured. In the event any portion of this endorsement is found to be invalid or unenforceable, the remainder shall remain in full force and effect

5 8. procedures for making insurance complaints Please examine your insurance policy to ensure that it meets your requirement. To avoid misunderstanding, it is very important that the Policy, the Schedule and any Endorsements attached therein be read thoroughly. If you have any complaints or grievances pertaining to your policy, please contact your agent, if any or get in touch with our issuing office. We assure you that your complaints will be attended to promptly As a responsible insurer, we wish to bring to your attention that you could also address your dissatisfaction to the Ombudsman for Financial Services (OFS) or to Bank Negara Malaysia s Customer Service Bureau (CSB) as listed below. DEFINITION-TAX Tax shall mean any present or future, direct or indirect, tax, levy or duty, including consumption tax or any tax of similar nature, which is imposed on goods and services by government or tax authority. TAX PROVISION All premium and fees payable under this Policy may be subject to Tax. If Tax is imposed, it will be stated in the invoice and Zurich General Insurance Malaysia Berhad reserves the right to claim or collect the Tax from the Insured in addition to the premium and/or fees payable under this Policy. Procedures for complaint to OFS If you are not satisfied with the decision of the Company, you may write to the Mediator with details of the dispute and particulars of your policy. If the Mediator makes an award against the Company, you are required to inform the Mediator of your decision to accept or deny the award within 14 (fourteen) days. If you do not accept the award, you may reject the decision of the Mediator. You are free to institute a court proceedings against the Company or refer it to Arbitration. 7 Polisi Skim Pampasan Pekerja Asing Bahawasanya Yang Diinsuranskan menerusi satu cadangan dan perakuan yang menjadi asas bagi kontrak ini dan dianggap sebagai terkandung di dalamnya, telah memohon kepada Zurich General Insurance Malaysia Berhad (seterusnya dirujuk sebagai Syarikat ) untuk Insurans yang terkandung seterusnya dan sebagai pertimbangan untuk pembayaran Premium oleh Pemegang Insurans kepada Syarikat. Maka Polisi Ini Memperakui bahawa berkaitan dengan kejadian-kejadian yang berlaku dalam Tempoh Insurans dan tertakluk kepada Peraturan-Peraturan, had-had, pengecualian dan syarat-syarat yang terkandung dalam polisi ini atau diendors kepadanya yang seterusnya secara kolektif dirujuk sebagai Peraturan-Peraturan Polisi ini, Syarikat akan menanggung kerugian Yang Diinsuranskan seperti ditetapkan oleh Peraturan-Peraturan yang dinyatakan dalam pelbagai Seksyen Polisi ini. BAHAGIAN 1 INSURANS PAMPASAN PEKERJA Jika pada bila-bila masa dalam Tempoh Insurans mana-mana pekerja asing yang digajikan oleh Yang Diinsuranskan seperti yang dinyatakan dalam Jadual, mengalami kecederaan peribadi akibat kemalangan atau penyakit yang berpunca daripada dan berlaku semasa bertugas dengan Yang Diinsuranskan dan jika Yang Diinsuranskan dikehendaki membayar pampasan untuk kecederaan sedemikian di bawah Undang-Undang yang disenaraikan dalam Polisi, maka tertakluk kepada Peraturan-Peraturan Polisi ini yang terkandung dalam polisi ini atau diendors kepadanya, Syarikat akan menanggung kerugian Yang Diinsuranskan terhadap semua jumlah yang ditanggung oleh Yang Diinsuranskan dan di samping itu akan bertanggungjawab terhadap segala kos dan perbelanjaan yang ditanggung dengan kebenarannya dalam pembelaan terhadap sebarang tuntutan pampasan sedemikian. DENGAN SYARAT bahawa jika berlaku sebarang perubahan dalam Undang-Undang atau penggantiannya oleh undang-undang lain, Polisi ini akan terus berkuatkuasa tetapi tanggungan Syarikat akan terhad kepada jumlah seperti mana perlu dibayar oleh Syarikat jika Undang-Undang tersebut tidak diubah. AKTA PAMPASAN PEKERJA 1952 AKTA PAMPASAN PEKERJA (PINDAAN) 1956 AKTA PAMPASAN PEKERJA (PINDAAN) 1976 PERINTAH PENGUBAHSUAIAN UNDANG-UNDANG (PAMPASAN PEKERJA) (LANJUTAN DAN PENGUBAHSUAIAN) 1981 AKTA PAMPASAN PEKERJA (PINDAAN) 1996 PERINTAH PAMPASAN PEKERJA (Skim Pampasan Pekerja Asing) (Insurans) (Pindaan) (No. 2) Perintah 2002 PERINTAH PAMPASAN PEKERJA (Skim Pampasan Pekerja Asing) (Insurans) Perintah 2004 Dan sebarang pindaan selanjutnya kepada Akta dan Enakmen tersebut yang dikuatkuasakan sebelum tarikh pengeluaran Polisi. SYARAT KHAS KEPADA BAHAGIAN 1 Sekiranya Pekerja Yang Diinsuranskan meninggal dunia disebabkan oleh kecederaan peribadi akibat kemalangan semasa menjalankan tugas, Syarikat hendaklah membayar jumlah tambahan sebanyak RM7, /9/P/G/S/M QF/GTS/PJ/3-003/03 Rev 04

8 PENGECUALIAN KEPADA BAHAGIAN 1 Syarikat tidak akan bertanggungjawab di bawah Seksyen ini terhadap a) tanggungan Yang Diinsuranskan terhadap kakitangan kontraktor Yang Diinsuranskan b) mana-mana kakitangan yang tidak dianggap sebagai pekerja di bawah Undang-Undang PENGECUALIAN TANGGUNGAN UNDANG-UNDANG UMUM Walau apa pun yang terkandung dalam Polisi ini yang menyatakan sebaliknya, dengan ini diperakui dan dipersetujui bahawa perlindungan kerugian yang diberikan oleh Seksyen ini tidak termasuk Tanggungan Di Bawah Undang-Undang Umum (Common Law). BAHAGIAN 2 PERBELANJAAN PENGHANTARAN PULANG Syarikat akan, tertakluk kepada Peraturan-Peraturan Seksyen ini, menanggung kerugian Yang Diinsuranskan bagi perbelanjaan penghantaran pulang (ditafsirkan di bawah) yang ditanggung: a) jika dalam Tempoh Insurans, Orang Yang Diinsurans meninggal dunia atau mengalami kehilangan upaya penuh dan kekal; b) jika Orang Yang Diinsuranskan meninggal dunia atau mengalami kehilangan upaya penuh dan kekal dalam tempoh dua belas bulan selepas kemalangan atau penyakit yang berlaku dalam tempoh Insurans. TAFSIRAN KEPADA BAHAGIAN 2 Perbelanjaan penghantaran pulang haruslah merupakan perbelanjaan sebenar yang ditanggung atau RM4,800 yang mana lebih rendah, untuk pengangkutan Orang Yang Diinsuranskan ke negara asalnya. BAHAGIAN 3 INSURANS KEMALANGAN PERIBADI (Luar Waktu Kerja) Syarikat hendaklah, tertakluk kepada Peraturan-Peraturan Seksyen ini, membayar kepada Orang Yang Diinsuranskan atau wakil peribadinya yang sah di sisi undang-undang, berkaitan dengan sebarang kecederaan peribadi yang dialami dalam kemalangan yang berlaku dalam Tempoh Insurans dan di luar waktu kerja Orang Yang Diinsuranskan: a) wang berjumlah RM23,000 sekiranya kematian atau kehilangan upaya penuh dan kekal berlaku dalam tempoh 12 bulan selepas kemalanagan; dan/atau b) sejumlah wang berasaskan jumlah besar RM23,000, dihitung mengikut Jadual Pertama pada Akta Pampasan Pekerja (Pindaan) 1996, bagi Kehilangan Sebahagian Upaya Kekal; dan/atau c) sejumlah wang yang dihitung mengikut Seksyen 8(e) Akta Pampasan Pekerja 1952 bagi Kehilangan Upaya Sementara; dan/atau d) Perbelanjaan Perubatan mengikut peruntukan-peruntukan Akta Pampasan Pekerja Had Wilayah: Malaysia PERUNTUKAN-PERUNTUKAN KHAS KEPADA BAHAGIAN 3 1. Kehilangan anggota atau bahagian tubuh atau sebahagian daripadanya hendaklah bermakna kehilangan akibat terputus secara fizikal atau kehilangan penggunaan penuh dan kekal. 2. Jumlah wang yang boleh dibayar untuk Kehilangan Upaya Kekal berkaitan dengan lebih daripada satu kecederaan kepada anggota atau bahagian tubuh atau sebahagian daripadanya tidak boleh melebihi jumlah yang boleh dibayar bagi kecederaan kepada seluruh anggota atau bahagian tubuh atau sebahagian daripadanya. 3. Faedah maksimum yang boleh dibayar di bawah (a) dan (b) di atas ialah RM23,000.

9 SYARAT-SYARAT KHAS KEPADA BAHAGIAN 3 1. Insurans ini tidak akan meliputi Yang Diinsuranskan yang telah mencapai usia 65 tahun. 2. Notis secara bertulis mesti diberikan kepada Syarikat mengenai sebarang kemalangan kepada Orang Yang Diinsuranskan yang boleh menimbulkan tuntutan di bawah Seksyen ini dalam tempoh (10) hari selepas kemalangan. Segala laporan, sijil, dan maklumat yang diperlukan oleh Syarikat hendaklah disediakan oleh Yang Diinsuranskan. Orang Yang Diinsuranskan hendaklah dari masa ke masa menjalani pemeriksaan perubatan atas perbelanjaan Syarikat sebagaimana yang diperlukan berkaitan dengan sebarang tuntutan. Sekiranya berlaku kematian di mana terdapat sebarang keraguan mengenai punca kematian tersebut, seorang pegawai perubatan berkelayakan yang dilantik oleh Syarikat hendaklah dibenarkan membuat pemeriksaan bedah siasat ke atas jenazah Orang Yang Diinsuranskan atas perbelanjaan Syarikat. 3 Untuk tujuan Skim ini, Syarat Am 6 (Insurans Lain) tidak meliputi (a), (b) & (c) di bawah Seksyen ini. 4 Seksyen ini tidak boleh diserah hak dan pembayaran sebarang Faedah di bawah Seksyen ini akan dibuat hanya kepada Orang Yang Diinsuranskan atau benefisiari/harta pusakanya dan penerimaan olehnya hendaklah merupakan pelepasan kepada Syarikat. PENGECUALIAN KEPADA BAHAGIAN 3 Pembayaran tidak boleh dibuat di bawah Seksyen ini bagi kecederaan akibat daripada: a) sebarang tindakan oleh Orang Yang Diinsuranskan yang melanggar undang-undang atau sengaja mendedahkan diri kepada bahaya (melainkan pecubaan untuk menyelamatkan nyawa), membunuh diri atau percubaan membunuh diri atau sengaja mencederakan diri sendiri. b) kesan atau pengaruh (sementara atau sebaliknya) alkohol atau dadah yang diambil bukan atas nasihat pegawai perubatan yang berkelayakan, penyakit kelamin, tidak siuman atau AIDS. c) kehamilan atas kelahiran anak, keguguran, atau menggugurkan anak. d) memanjat permukaan batu, mendaki gunung (yang memerlukan penggunaan tali atau tanda), menyelam tanpa peralatan, terjun dengan payung terjun, bermain polo, perlumbaan berhalangan, memburu binatang buas atau memburu selain daripada menggunakan kaki, dan sebarang jenis perlumbaan melainkan yang menggunakan kaki. e) terbang sebagai kakitangan penerbangan atau menaiki sebarang pesawat untuk tujuan melakukan sebarang tugas atau operasi teknikal didalamnya atau kepadanya atau perjalanan udara selain daripada sebagai penumpang yang membayar tambang dalam sebarang pesawat yang dibina untuk membawa penumpang dan yang mempunyai sijil atau lesen yang sah. f) menunggang motosikal, motor skuter, motosikal kecil atau basikal kayuh bantuan mekanikal (sama ada sebagai pemandu atau pembonceng) untuk tujuan sukan, pertunjukan, pertandingan atau perlumbaan. g) kerja-kerja yang dijalankan berkaitan dengan perkhidmatan Orang Yang Diinsuranskan dengan Yang Diinsuranskan. PENGECUALIAN AM Syarikat tidak akan menanggung kerugian Yang Diinsuranskan dan/atau Orang yang Diinsuranskan terhadap: 1. sebarang tindakan bagi pampasan yang dikemukakan di Mahkamah Undang-Undang di luar Malaysia 2. kerugian, kerosakan, kecederaan akibat kemalangan atau penyakit yang secara langsung atau tidak langsung disebabkan oleh atau berlaku kerana atau akibat daripada a) peperangan, serangan, tindakan musuh asing, pertempuran (sama ada peperangan diisytiharkan atau tidak), perang saudara, pemberontakan tentera, pemberontakan, revolusi, penderhakaan, kuasa tentera atau rampasan kuasa; b) sebarang tindakan oleh mana-mana orang atau orang-orang yang bertindak bagi pihak atau berkaitan dengan mana-mana pertubuhan yang kegiatannya bertujuan untuk menggulingkan dengan kekerasan sebarang kerajaan yang wujud secara sah atau secara hakikatnya atau untuk mempengaruhinya melalui keganasan dan kekacauan.

10 3. sebarang kerugian, kerosakan, kecederaan atau tanggungan yang secara langsung atau tidak langsung disebabkan oleh atau timbul daripada atau akibat daripada atau antara lain disebabkan oleh a) radiasi pengionan atau pencemaran radioaktif dari sebarang bahan api nuklear atau dari sebarang sisa nuklear daripada pembakaran bahan api nuklear. Khusus bagi tujuan pengecualian ini, pembakaran hendaklah termasuk sebarang proses pembelahan nuklear yang berkekalan sendiri. b) bahan-bahan senjata nuklear. SYARAT-SYARAT AM 1. DEFINISI Tempoh Insurans bermakna tempoh yang dinyatakan dalam Jadual Polisi dan dimana Orang Yang Diinsuranskan bekerja secara langsung untuk Yang Diinsuranskan TETAPI TIDAK TERMASUK tempoh apabila Orang Yang Diinsuranskan kembali ke negara asalnya. Perlindungan tamat dari masa Orang Yang Diinsuranskan meninggalkan Malaysia dan disambung semula apabila beliau kembali ke Malaysia. 2. PENTAFSIRAN Polisi ini dan Jadualnya hendaklah dibaca bersama sebagai satu kontrak dan sebarang perkataan atau penyataan yang disertakan dengan makna khusus dalam mana-mana bahagian Polisi atau Jadual hendaklah membawa makna khusus yang sama di mana juga ia digunakan. 3. PEMATUHAN Tanggungan akan diterima oleh Syarikat dengan syarat Yang Diinsuranskan dan Orang Yang Diinsuranskan mematuhi Peraturan-Peraturan Polisi ini. 4. PERINGATAN Yang Diinsuranskan dan Orang Yang Diinsuranskan hendaklah mematuhi segala kewajipan undang-undang. 5. PROSIDUR TUNTUTAN a) Apabila berlaku sebarang kemalangan yang boleh menimbulkan tuntutan di bawah Polisi ini, Yang Diinsuranskan hendaklah i) serta-merta melaporkan kemalangan itu kepada Jabatan Buruh seperti yang ditetapkan di bawah Seksyen 13 (1) & (2) Akta Pampasan Pekerja ii) memberikan notis secara bertulis dalam tempoh 10 hari selepas kemalangan kepada Syarikat menyatakan bagaimana kemalangan itu berlaku dan keadaan kecederaan. b) Pampasan yang perlu dibayar seperti dinilai oleh Pesuruhjaya selaras dengan keperluan Akta hendaklah dibayar oleh Syarikat dalam tempoh 7 hari selepas Syarikat menerima penilaian tersebut. 6. INSURANS LAIN Jika pada waktu berlakunya sebarang kerugian, kerosakan atau tanggungan yang diinsuranskan di bawah polisi ini, terdapat sebarang insurans atau insurans-insurans lain, sama ada diambil oleh Yang Diinsuranskan atau oleh mana-mana orang lain, yang melindungi kerugian, kerosakan atau tanggungan yang sama, Syarikat tidak akan bertanggungjawab membayar lebih daripada bahagian perkadarannya bagi kerugian, kerosakan atau tanggungan tersebut. 7. PENGENDORSAN PENGECUALIAN PEPERANGAN DAN KEGANASAN Walaupun terdapat sebarang peruntukan sebaliknya yang terkandung dalam insurans ini atau sebarang pengendorsan padanya, adalah dipersetujui bahawa insurans ini mengecualikan kerugian, kerosakan, kos atau perbelanjaan dalam apa juga bentuk yang secara langsung atau tidak langsung disebabkan oleh, akibat daripada atau berkaitan dengan mana-mana sebab berikut tanpa mengira sebarang sebab lain atau kejadian yang menyumbang secara serentak atau dalam sebarang urutan lain kepada kerugian sedemikian: (1) peperangan, serangan, tindakan musuh asing, pertempuran atau operasi seperti peperangan (sama ada peperangan diisytiharkan atau tidak) perang saudara, pemberontakan, revolusi, penentangan, kekacauan awam yang berlarutan sehingga atau dianggap sebagai kebangkitan awam, kebangkitan tentera, penderhakaan atau rampasan kuasa; atau (2) sebarang tindakan keganasan. Untuk tujuan pengendorsan ini tindakan keganasan bermakna tindakan, termasuk tetapi tidak terhad kepada penggunaan paksaan atau kekerasan dan/atau ancaman kepada mana-mana orang atau kumpulan (kumpulan-kumpulan) orang, sama ada yang bertindak sendirian atau bagi pihak atau berkaitan dengan mana-mana pertubuhan (pertubuhan-pertubuhan) atau kerajaan (kerajaan-kerajaan), yang dilakukan atas sebab politik, agama, ideologi atau sebab yang serupa termasuk yang bertujuan untuk mempengaruhi mana-mana kerajaan dan/atau meletakkan orang ramai, atau mana-mana bahagian daripada orang ramai, dalam ketakutan.

11 Pengendorsan ini juga mengecualikan kerugian, kerosakan, kos atau perbelanjaan dalam apa juga bentuk yang secara langsung atau tidak langsung disebabkan oleh, akibat daripada atau berkaitan dengan sebarang tindakan yang diambil untuk mengawal, mencegah, menumpas atau dalam sebarang cara berkaitan kejadian (1) dan/atau (2) di atas. Jika Syarikat Insurans mengatakan bahawa atas sebab pengecualian ini, sebarang kerugian, kerosakan, kos atau perbelanjaan tidak dilindungi oleh insurans ini maka tanggungjawab untuk membuktikan sebaliknya terletak pada Pemegang Insurans. Sekiranya mana-mana bahagian daripada pengendorsan ini didapati tidak sah atau tidak dapat dikuatkuasakan, bakinya tetap sah dan berkuatkuasa sepenuhnya. 8. TATACARA UNTUK MEMBUAT ADUAN INSURANS Sila periksa polisi insurans anda untuk memastikan bahawa ia memenuhi keperluan anda. Bagi mengelakkan salah tafsiran, adalah penting bahawa Polisi, Jadual dan sebarang Endorsemen yang dilampirkan di sini dibaca keseluruhannya. Jika anda mempunyai sebarang aduan atau ketidakpuasan hati berkenaan polisi anda, sila hubungi ejen anda, sekiranya ada, atau hubungi pejabat di mana polisi dikeluarkan. Sebagai penginsurans yang bertanggungjawab, kami ingin memaklumkan bahawa anda juga boleh meny uarakan ketidakpuasan hati anda kepada Ombudsman for Financial Services (OFS), Bank Negara Malaysia yang disenaraikan di bawah. Tatacara aduan kepada OFS Jika anda tidak berpuashati dengan keputusan pihak Syarikat, anda boleh menulis kepada pihak Pengantara dengan menyertakan maklumat mengenai percanggahan dan butir-butir polisi anda. Jika pihak Pengantara membuat keputusan menyangkal tindakan Syarikat, anda dikehendaki memaklumkan pihak Pengantara mengenai keputusan anda untuk menerima atau menolak keputusan pihak Pengantara dalam masa 14 ( empat belas ) hari. Jika anda tidak bersetuju dengan keputusan berkenaan, anda boleh menolak keputusan Pengantara. Anda bebas untuk mengambil tindakan mahkamah terhadap pihak Syarikat atau merujukkannya kepada pihak Penimbangtaraan. DEFINISI CUKAI Cukai ialah apa-apa bayaran semasa atau akan datang, langsung atau tidak langsung, cukai, levi atau duti termasuk cukai penggunaan atau apa-apa cukai seumpamanya, yang dikenakan kepada barangan atau perkhidmatan oleh kerajaan atau pihak berkuasa percukaian. PERUNTUKAN CUKAI Semua premium dan yuran di bawah Polisi ini mungkin tertakluk kepada Cukai. Sekiranya Cukai dikenakan, ia akan dinyatakan dalam invois dan Zurich General Insurance Malaysia Berhad berhak untuk menuntut atau mengutip Cukai daripada pemilik polisi yang Diinsuranskan sebagai tambahan kepada premium dan/atau yuran yang perlu dibayar di bawah Polisi ini.
