2 Workmen s Compensation Act 1952 The Workmen s Compensation Act 1952 was amended in August Under Section 26(2) of the Amended Act, it is mandatory for every employer to insure all the foreign workers employed by him under an approved insurance scheme in respect of any liability he may incur under the Workmen s Compensation Act Any employer who fails to insure the foreign workers under the approved insurance scheme shall be guilty of an offence and shall be liable, on conviction, to a fine not exceeding RM20,000 or to imprisonment for a term not exceeding 2 years or both. Approved insurance scheme Zurich General Insurance Malaysia Berhad has been appointed by the Ministry of Human Resources to administer the insurance scheme to provide coverage for employment accidents to foreign workers as provided under Section 26(2) of the Workmen s Compensation Act All employers are therefore required by the Act to insure all their foreign workers under the insurance scheme known as Foreign Worker Compensation Scheme (FWCS). FWCS also provides coverage for Repatriation Expenses and Personal Accident outside of working hours. Foreign Worker Compensation Scheme FWCS provides coverage for accidents to the foreign workers with the following benefits: Benefits as provided under the Workmen s Compensation Act 1952: a) Accidental Death due to employment injury (benefit increased to RM25,000 maximum under FWCS) (Workmen s Compensation up to RM18,000. Personal Accident for Death & Permanent Disablement up to RM7,000) b) Permanent Total Disablement c) Permanent Partial Disablement - As per Permanent Disablement Table under First Schedule of the Act d) Temporary Total Disablement e) Temporary Partial Disablement f) Hospitalisation and Medical Expenses g) Occupational Diseases as per Second Schedule of the Act Repatriation Expenses to send back the foreign workers to their country of origin up to an amount of RM4,800 in the event of Death or Permanent Total Disablement. Personal Accident outside working hours for Death and Permanent Disablement up to RM23,000. FWCS will also provide each foreign worker an identification card (ID Card) on the insurance coverage. 2
3 Premium rate The annual premium charged under the FWCS is RM72 (before Tax (where applicable) and Stamp Duty) per foreign worker as approved by the Ministry of Human Resources. Enrollment under FWCS To enroll under FWCS, kindly complete the FWCS Proposal Form and return to Zurich together with: a) Copy of passport of each foreign worker b) Copy of work permit of each foreign worker c) Premium cheque Claim procedure In the event of an accident covered under the FWCS: 1. Report the accident immediately to the Labour Department (applicable to employment accident only) (Failure to report the employment accident shall render the employer guilty of an offence under the Section 13(5) of the Act and shall be liable to a fine not exceeding RM5,000 for a first offence, and a fine not exceeding RM10,000 for any subsequent offence) 2. Report the accident immediately to Zurich and submit the following documents for claims processing: a) Complete Claim Form b) Labour Assessment c) Medical Report d) Medical Receipts e) Death Certificate (for death claim) f) Post-mortem Report (for death claim) g) Police Report (for death claim) h) Other Claims Documents as required The Company Zurich is one of the world s largest insurance groups, and one of the few to operate on a truly global scale. 5 Akta Pampasan Pekerja 1952 Akta Pampasan Pekerja 1952 telah dipinda pada bulan Ogos Di bawah Akta 26(2) Akta Pindaan, adalah mandatori bagi setiap majikan untuk menginsuranskan semua pekerja asing yang diambil berkerja dengannya di bawah suatu skim insurans yang diluluskan untuk mana-mana liabiliti yang beliau tanggung di bawah Akta Pampasan Pekerja Mana-mana majikan yang gagal menginsuranskan pekerja-pekerja asing di bawah skim insurans yang diluluskan akan disabit kesalahan dan akan dikenakan, jika disabit kesalahan, suatu denda yang tidak melebihi RM20,000 atau dipenjarakan untuk tempoh tidak melebihi 2 tahun atau kedua-duanya. Skim insurans diluluskan Zurich General Insurance Malaysia Berhad telah dilantik oleh Kementerian Sumber Manusia untuk menawarkan skim insurans yang menyediakan perlindungan untuk kemalangan pekerjaan kepada pekerja-pekerja asing seperti yang diperuntukkan di bawah Seksyen 26(2) Akta Pampasan Pekerja Semua majikan adalah dengan itu dikehendaki oleh Akta agar menginsuranskan semua pekerja asing mereka di bawah Skim Insurans yang dikenali sebagai Skim Pampasan Pekerja Asing (SPPA). SPPA juga menyediakan perlindungan untuk Biaya Penghantaran Balik dan Kemalangan Diri di luar waktu bekerja. Skim Pampasan Pekerja Asing SPPA menyediakan perlindungan kemalangan kepada pekerja-pekerja asing dengan faedahfaedah berikut: Faedah-faedah yang diperuntukkan di bawah Akta Pampasan Pekerja 1952: a) Kematian Kemalangan akibat kecederaan pekerjaan (Faedah dipertingkatkan kepada maksimum RM25,000 di bawah SPPA). (Pampasan Pekerja sehingga RM18,000. Kemalangan Diri untuk Kemalangan & Hilang Upaya Kekal sehingga RM7,000) b) Hilang Upaya Kekal Keseluruhan c) Hilang Upaya Kekal Separa seperti dalam Jadual Hilang Upaya Kekal di bawah Jadual Pertama Akta d) Hilang Upaya Sementara Keseluruhan e) Hilang Upaya Sementara Separa f) Kemasukan Hospital dan Biaya Perubatan g) Penyakit pekerjaan seperti dalam Jadual Kedua Akta Biaya Penghantaran Balik bagi menghantar pulang pekerja-pekerja asing ke negara asal mereka sehingga jumlah RM4,800 apabila berlaku Kematian atau Hilang Upaya Kekal Keseluruhan. Kemalangan Diri di luar waktu berkerja untuk Kematian dan Hilang Upaya Kekal sehingga RM23,000. SPPA juga menyediakan kad pengenalan diri untuk setiap pekerja asing bagi perlindungan insurans yang ditawarkan. 5
6 Kadar premium Premium tahunan yang dikenakan bagi setiap SPPA adalah RM72 (sebelum Cukai (yang mana berkenaan) dan Duti Setem) bagi setiap pekerja asing seperti yang diluluskan oleh Kementerian Sumber Manusia. Pendaftaran SPPA Bagi mendaftar untuk SPPA, sila lengkapkan Borang Permohonan SPPA dan kembalikan kepada Zurich bersama-sama dengan: a) Salinan pasport setiap pekerja asing b) Salinan permit bekerja setiap pekerja asing c) Cek premium Prosedur tuntutan Apabila berlaku kemalangan yang dilindungi di bawah SPPA: 1. Laporkan kemalangan dengan segera kepada Jabatan Buruh (untuk kemalangan pekerjaan sahaja). (Kegagalan melaporkan kemalangan pekerja akan menyebabkan majikan disabit kesalahan di bawah Seksyen 13(5) Akta dan dikenakan denda tidak melebihi RM5,000 untuk kesalahan pertama, dan denda tidak melebihi RM10,000 untuk kesalahan berikutnya) 2. Laporkan kemalangan berkenaan dengan segera kepada Zurich dan kemukakan dokumen berikut untuk pemprosesan tuntutan: a) Borang Tuntutan yang dilengkapkan b) Taksiran Buruh c) Laporan Perubatan d) Resit Perubatan e) Sijil Kematian (untuk tuntutan kematian) f) Laporan Bedah Siasat (untuk tuntutan kematian) g) Laporan Polis (untuk tuntutan kematian) h) Dokumen-dokumen Tuntutan lain yang diperlukan 6
