Tenderer should down load the tender documents from the web site n-procure.com (In case of e-tender) Tender documents will not be issued in physical form from this office and submit the same (in soft & hard) as per instruction therein by RPAD. General Terms & Condition 01. TENDER FEE, EMD AND SECURITY DEPOSIT A. Tender Fee Paid Details (Tender Fee is COMPULSARY & there is no Exemption for Tender Fee). SSI / NSIC Firm also have to pay Tender Fee. Tender Fee & Earnest Money Deposit - will be accepted by D.D. in favour of Gujarat State Electricity Corp. Ltd., payable at State Bank of India, Sikka TPS Branch only (Branch Code No ). Cheques are not accepted & Tenders submitted without tender fee / EMD will not be accepted. No exemption from payment of tender fees and no price preference to the small, cottage & tiny industrial units registered under small scale industries of Gujarat

Tenderer should also certify as unconditional tender on tender cover it self. B. EMD at 1 % of the estimated cost is to be paid by D.D. in favour of Gujarat State Electricity Corporation Ltd. payable at State Bank of India, Sikka. Tenders without EMD are liable for rejection. The SSI / NSIC will be accepted for exemption of EMD for supply of subjected material only, otherwise tender / offer will be ignored. The Xerox copy submitted for SSI / NSIC shall be notarized only. SSI / NSIC submitted other than indented material will not be accepted for waiver of EMD / SD and without payment of EMD, tender will be rejected out rightly without intimation to the party. No exemption as well as relaxation shall be given to outside Gujarat based parties. No correspondence will be entertained further in the matter. The exemption in payment of EMD shall be given to the small, cottage & Tiny Industrial Units registered under small scale industries of Gujarat State and holding subsequent registration with CSPO/NSIC/DGS&D registration certificates for the item under tender. C. Security Deposit: Lowest party shall have to pay Security Deposit as, 5 % in case of Works & 10 % in case of Supply of order value before placement of order. (a) Small, Cottage and tiny industrial units of Gujarat State having the registrations numbers for production of goods and having the registration numbers from Govt. of Gujarat to submit Security Deposit and performance guarantee as under. (01) Wherever in the purchase policy, the Security Deposit and Performance Bank Guarantee rate of 5 % is stipulated, the same be considered at 3 % for Small, Cottage & tiny industrial units of Gujarat State. (02) Wherever the rate of Security Deposit & performance Bank Guarantee of 10 % is stipulated in the purchase policy, the same be considered as 6 % for Small, Cottage & tiny industrial units of Gujarat State. (03) Security Deposit and Performance Bank Guarantee shall not be insisted concurrently and therefore Security Deposit may be converted into Performance Bank Guarantee or once PBG is submitted, SD will be refunded L1 contractor has to pay Security deposit as per prescribed time limit mentioned in LOI. if successful bidder not paying SD in time, necessary action will be taken against firm as per GSECL norms. Tender Cover Packing (EMD + Tender Fee+ Other documents) 1. Technical Bid: The technical bid shall comprise of all the technical details of the stores / materials offered in accordance with the Corporation guaranteed technical particulars and conditions, etc. The Technical Bid shall be opened on Due Date as mentioned in tender Notice (If Possible), in the presence of those tenderers who wish to be present. If the Authorized Representative is likely to be present then he must submit the authorization letter of the representing company at the time of opening of Bids and this is compulsory. Only One authorized Representative shall be allowed. 2. Price Bid For E-Tender

5 GSECL TPS Sikka Page 5 of 19 Bidders are requested to submit Price Bid (Schedule-B) on-line only and not to submit the price bid in physical form. This is mandatory. If price bid is submitted in physical form, same will not be opened and only on-line submitted price bid will be considered for evaluation. Further if the quantity quoted differs in the any of the technical bid forms and in price bid forms, it is discretion of Committee GSECL to consider the quoted quantity. For Web-Tender The Price Bid must be submitted strictly as per Schedule-B and shall be submitted in the separate envelope (dully sealed) super scribed Price Bid with subject and shall be submitted simultaneously with the Technical Bid The time and date for opening of the Price Bid shall be determined by the Corporation and shall be communicated to the tendering firms after technical bids are analyzed and the intimation will be sent only to the technically qualified tenderers. Any technical questions information and clarifications that may be required pertaining to this Tender should be referred to The Chief Engineer, GSECL, TPS, Sikka, who also reserves the right to reject any OR all tenders without assigning any reasons thereof. The Technical & Price Bids shall contain adequate cross reference wherever necessary to ensure clear and proper co-relation of the two bids without ambiguities whatsoever. 3. The tender must be submitted in 04 (Four) Cover system. Cover 01: Cover 02: Cover 03: Cover 04: The technical bid and supporting documents. In case of e-tender, It is mandatory to submit tender in online e-tender as well as in physical form on or before due date and time. If tender submitted in only one way, it will not be considered for evaluation. Corporation does not take any responsibility for postal delay on both ways and tenders received after due date and time will not be accepted by this office. Subletting of tender is not permitted. 5. Part order has to be accepted by party. 6. Tenderer has to complete the above work within stipulated time as mentioned in Technical Bid. Otherwise Penalty will be imposed as 0.5 % per week subject to maximum 10 % of order value.

Some of the major liabilities under various labour and industrial laws which the contractor shall comply which are as under. 1) Payment of contributing of way of Employer s contribution towards provident fund, family pension scheme, deposit linked insurance scheme, administrative charges etc., at the rates made applicable from time to time by Government of Gujarat / Government of India or other Statutory Authorities. 2) Payment of deposit in respect of each contract labour at rate of Rs. 30/- with the office of Commissioner of labour as per contract labour (Regulation and Abolition) Act. 3) License as prescribed under the contract labour (Regulation and Abolition) Act, and rules farmed there under depending upon the number of workman employed by the contractor License is compulsory if nine or more labours engaged during day. 4) Identity cards as prescribed under the factories Act, with photo affixed there to the same for identification. 5) Payment of retrenchment compensation, Notice pay and other liabilities as per Industrial Disputes Act. Payment to the contractor s employees arising out of any claim or disputes under the industrial Disputes Act or any other labour laws. 6) Payment of compensation in case of accidental injury. 7) Provision of crèche if female labour employed is more than 30 numbers. 8) Maternity leave as per the provision of the Maternity Benefit Act. The bidders are requested to submit the technical bid with the following credentials for technically qualifying criteria in soft as well as hard. Sr. No. Technical Qualifying Criteria 01 Details of such or similar works during last five (05) years satisfactorily at Sikka TPS or other Thermal Power stations of GSECL, NTPC or other Electricity Board in the later case. Documentary proof of having executed such or similar orders will have to be produced along with Technical bid. However, submission of such documentary proof by party will not automatically qualify the party as to its capability to execute such or similar orders and the Corporation shall assess the capability of the party at the time of evaluation of the Technical bid. 02 List of Tools & Tackles and all necessary instruments is to be submitted. 03 Details of P.F. Code no. from appropriate authority, if work to be carried out inside premises of STPS. 04 Latest Bank Solvency Certificate of minimum 20 % of estimated cost from any Nationalized Bank. 05 Details of registered partnership deed in case of partnership firm and activities of association and memorandum of association in case of company. 06 Conditional tender is liable to be rejected. Withdrawal or insertion of conditions unilaterally after opening of tenders will not be permitted unless it so desired by the GSECL 07 Party should have to submit the details of the registration number regarding Service Tax along with Technical Bid (i.e. Copy of Service Tax Registration). 08 Details of PAN No. from appropriate authority Bidders remark regarding submission of document in soft as well as hard with Page No. Non submission of above criteria the technical bid is liable to be rejected. 9 GSECL TPS Sikka Page 9 of 19 SCOPE OF WORK Name of the work: Work of replacement of expansion bellows in Boiler Unit 1 & 2 at STPS REMOVAL OF DAMAGED / ERODED EXPANSION JOINTS: The scope of work includes the preparation of necessary temporary scaffolding at elevated location of various flue gas duct, PA duct & SA duct with their own scaffolding material, locking the respective duct by means of welding of channel /beam before cutting the eroded expansion joint to maintain the original width of joints, cutting the eroded expansion joints (Single, double & triple fold) by means of gas cutting, removing the same form respective duct and crediting the same scrap in main store as per instruction of EIC. The scope of work also includes removal of insulation cladding and insulation materials required to uncover and cutting of respective damaged / eroded expansion joints. Quantity of work shall be considered on actual cutting length of expansion joint. ERECTION, ALIGNMENT & WELDING OF SINGLE/DOUBLE/TRIPLE/FOUR FOLD EXPANSION JOINTS: The scope of work includes as follows. -- Cleaning the edges of respective duct at which new expansion joints to be erected and welded. Edge preparation of respective duct by means of grinding. -- Transportation of required size of new expansion joints from main store to site including means of transportation at their own cost. -- Shifting of new expansion joints or pieces of expansion joints (in case of big expansion joints) from site to respective location where it is to be erected. -- Required lifting tackles (i.e. chain pulley block, wire & pulleys etc.) shall have to be arranged by the contractor at their own cost. -- Placement and alignment of new expansion joints with corner either in single piece or in more than one piece in respective position and seal welding the same with suitable size of welding electrode of ISI brand confirming to AWS-6013 [which is recommended by EIC] series only. Any rectification required matching the gap of cut portion of respective duct & width of new expansion joints shall have to be carried out. -- Removing the lock of new expansion joints to release the load on it. -- Removing and cutting of temporary locking of respective duct. -- Removing of scaffolding. -- Welding should be free from any kind of welding defect. Welding shall have to be rectified if any defect noticed. -- Cleaning of surrounding area by disposing off the debris, scrap materials etc.

11 GSECL TPS Sikka Page 11 of 19 GENERAL TENDER TERMS & CONDITIONS Name of the work: Work of replacement of expansion bellows in Boiler Unit 1 & 2 at STPS The contract means the document forming tender and the subsequent agreement that may be entered into. 00. The General rules and regulations of the Corporation for tender and contract for works will apply to the extent the same are not modified herein. Any other rules and regulations, conditions etc. that are in force in present and that may be framed by the Corporation from time to time in condition with contracts will be binding and acceptable to the contractor. 01. Sub- letting or transfer of contract without prior written approval of Corporation will be treated as a breach of contract and it will be punishable by forfeiting the security deposit as well as termination of contract. 02. The contractor have to pay total 5% of the order value as security before placement of order. 03. The contractor shall hold the Corporation indemnified against and in respect of any claim arising out of injury to any persons, loss of life, workman s compensation or any other claims whatsoever. The contractor shall be responsible for any damages to any property of the Corporation due to negligence of the contractor or his employees. The Corporation will be entitled to recover the damages from the contractor and it shall be final and binding to the contractor. 04. The successful tenderer/ contractor will have to enter into an agreement with GSECL and the cost of the stamped paper will be borne by the contractor. The contractor will also have to execute an indemnity bond on required value of stamped paper as per GSECL rules. The cost of the stamped paper will be borne by the contractor. 05. ARBITRATION : All questions, disputes or differences whatsoever which may at any time arise between the parties to this contract in connection with the contract or any matter arising out of or in relation thereto, shall be referred to the Gujarat Public Works Contract Dispute Arbitration Tribunal as per the provisions of the Gujarat Public Works Contract Dispute Arbitration Tribunal Act, The party shall strictly observe all the labour laws and Factory Acts in existence and amendments made from time to time 07. (A) Party shall have to strictly observe all safety rules as per the Factory Act 1948 and whatever amendments made from time to time to avoid any chances of accidents. Contractor shall have to strictly follow the instructions of safety officer. (B) The safety precautions issued vide this office circular no. CCUT/ SAFETY/ 490 / CIR / 345A dated are applicable to this contract also and to be followed strictly. (C) Before starting the contract, it is advisable that party shall have the documents for insurance of workers. 08. The work shall be completed within stipulated time as well as on receipt of shut down. If required, party shall have to work round the clock to maintain the work schedule. 09. Payment shall be made as per actual work done only on RA Bill basis. 10. The contractor shall have to take all necessary precautions to avoid fire during cutting, welding, etc. In case of any smoldering fire, same should be extinguished by contractor immediately using their own labour, tools, water & buckets etc. 11. The party shall arrange his own adequate tools and tackles, welding accessories,

12 GSECL TPS Sikka Page 12 of 19 drilling m/c, grinders, scaffolding, welding m/c, gas cutting sets, lifting materials like hydraulic jacks, slogging spanners, dial gauges & piano wire etc. 12. Party shall have to arrange all consumables, including required electrodes, Kerosene, rustolene, paints, grinding wheels etc. at his own cost. 13. An authorized and technically qualified representative of the contractor must be available at site while the work is going on. The address of the representative should be submitted to this office so that party can be contacted whenever required in connection with execution of the work. If not available then Rs. 500/- will be imposed as penalty. 14. Scaffolding materials like wooden sleepers, M.S. Angles, channels and plates if available with GSECL, will be issued free of cost, otherwise contractor will have to arrange for the same at his own cost. After completion of work scaffolding as is to be removed immediately and should be credited to main store of SIKKA TPS. 15. After completion of work working area and surrounding area should be made clean by removing M. S. debris and all types of scrap etc. Scrap should be credited to main store and should be dumped at place shown by E. E. (Store). 16. Electrical connection and power consumption will be given free of cost at one mutually agreed point. 17. Oxygen/ acetylene gas, if available, will be issued on chargeable basis from GSECL main store, otherwise the party has to arrange on its own. The empty cylinders should be returned to main store within stipulated time. 18. Shifting, transportation of materials from main store/tool room to working site shall have to be done by contractor at his cost. 19. Party shall submit daily progress report for the work carried out by them. If party fail to submit the same then Rs. 150/- per day will be imposed as a penalty. 20. The contractor, if desires, can see the plant and site of work with permission of undersigned on any working day during working hours. 21. Party has to carry out the work at site only. 22. The required spares like steel plates, nut bolts, stud, lubricants, bushes, shims, flight pan, sprocket, chain link, bearings, shafts etc will be given by the Corporation free of cost for carry out the work as per Schedule-B. If any damages occurred while replacement of new parts, the actual cost of the parts will be recovered from the contractor. 23. Income Tax will be deducted at source at prevailing rates as per I. T. Act. 24. Do not mention any commercial terms/conditions in Technical bid. Any terms/conditions related to commercial matter mention by you in Technical bid will not considered. 25. For each hour delay or past thereof the contractor shall be charged Rs. 500/- per hour as delay charges. 26. After completion of work contractor should have submit material account statement along with re-conciliation statement along with bill otherwise bill will not be processed. 27. Time limit of the work is 11 months from the date of commencement of work. It can be extended further 06 months, if required with same rate, terms and conditions for balance qty. 28. The work may be executed in Unit No. 1 or Unit No. 2 as per the site condition and requirement of GSECL, party has to carry out the work in either/ both unit as per instruction of EIC. 13 GSECL TPS Sikka Page 13 of 19 Special Terms & Conditions:- 1. The quantity given in schedule-b is purely tentative based on assumption. The quantity may vary on either side depending upon the condition of boiler / equipment s and availability of items and spares but in any case as per GSECL's discretion. 2. Party shall have to stack the material properly near the work place / specified allotted area / spare area as per instruction of EIC. Party shall be fully responsible for any loss of material / damage of material supplied by them till completion of work in all respect. 3. Party shall have to co-ordinate with the other agencies working near to their work place to avoid any accident as well as for the safety to personal job. Party shall be fully responsible for any kind of damage of surrounding equipment and components. 4. Party representative / site in-charge should be available at site throughout the execution of work to receive the instruction from this office. 5. After completion of work in all respect, surrounding area is to be cleaned as per instruction of EIC. Party shall have to credit all eroded, removed and miscellaneous scrap etc. to Main store. All balance Steel material should be credited to Main Store Only. All removed insulation mattress should be dumped at site shown by EIC / Civil Dept. 6. TIME LIMIT The period for completion of complete work of unit shall be as under excluding the mobilization period : [a] 30 days for COH [b] 20 days for AOH, [c] 03 Months if the work is to be carried out on piece-meal basis on as & when required during RSD Or Forced / Planned Outage period. If the completion of work is delayed due to contractor's fault, the penalty will be charged as per the GSECL's rules. 7. PERFORMANCE GUARANTEE: - 5 % of order value will be retained by GSECL for 03 (Three) Months after completion of work. If any defect found within 03 (Three) Months contractor has to attend the same without any extra charges, failing to which, Performance Guarantee amount will be withheld for further period till the defect is attended. If the same is not attended within stipulated time period, GSECL will arrange to attend the same through other agency at your risk & cost. 8. If quality of work is not found satisfactory and work got delayed for re-commissioning of boiler due to insufficient performance than Corporation reserves the right to with draw uncompleted item (work) from contractor's scope and balance work can be awarded to some other agency or may be taken up departmentally at the risk and cost of the contractor. The amount of balance work will not be paid to contractor over and above the amount of balance work or the expenditure incurred to carry out the balance work whichever is higher will be recovered from the contractor's bill as per Corporation s rule. In addition, Corporation may penalize the contractor for above as decided by EIC.

14 GSECL TPS Sikka Page 14 of Party shall have to co-ordinate with the other agencies working near to their work place to avoid any accident as well as for the safety to personal job. 10. Work shop facility shall be provided by GSECL, if available only, on chargeable basis on demand by party. 11. All necessary supports / hangers / tie rod shall have to be erected by the party as per existing lay out and as per instruction of EIC with provision of pin rods etc. 12. Single phase or three phase power supply will be provided at single point in the plant from the nearby power supply module available. The successful bidder will have to lay required cabling / wiring in proper way from the allotted power supply only using proper lugging, connectors. While demanding for the supply, agency will have to mention the required power in KVA or Amperes loading with advance intimation and should provide adequate protection through MCB-ELCB / MCCB / SFU along with the time duration. Any damage to the power supply module provided by GSECL, due to over loading / short ckt. etc.. While using it, then party will have to repair / restore the same at their own expense.. The supply taken from anywhere else other than allotted power supply is strictly prohibited. The distribution of power supply shall be done through proper terminal / industrial power plug socket arrangement. If electricity is to be charged, then proper Energy meter with valid calibration certificate will have to be installed in presence of electrical department at the point of sppuly connection with proper arrangement. 13. Party has to provide the following documents along with the bill: a) Copy of paid PF Challan along with copy of ECR in Triplicate. b) Material Statement c) Invoice Copy d) Copy of MR & CR (if applicable) e) Labour License (if Applicable) f) Muster Roll (Attendance register) in Triplicate g) Duly paid wage register (If paid through bank then along with bank statement or bank name and A/c No of concern employee is required to mention in the register or disbursed in present of GSECL, officer and certification of GSECL officer in wage register is required to taken) in Triplicate h) Group insurance/work Compensation policy in Triplicate. i) Bonus and leave encashment register as per applicability in Triplicate. GSECL will supply:- 1. Electrical connection, air and water at single point shall be given free of cost by GSECL to carry out the job. 2. All spare parts, Expansion bellows, insulation, cladding sheet, etc required to complete the work. 3. Gland packing seal rings, gaskets, asbestos ropes, gland and packing ropes etc. 4. Steel material like M.S. Plate, flats, Angle etc if required. 5. Air and water supply and consumption at one location. Necessary distribution extension up to work location is to be arranged by contractor. 6. Special welding electrodes viz. Hard facing, S.S. welding, CI welding, Dissimilar metal welding if required.
