The tender is non-transferable document to be submitted in two parts namely Technical bid (Part-I) with all enclosures of the tender documents and Price Bid (Part-II) simultaneouslyin separate sealed covers dully super scribed the respective covers as Technical-Bid and Price Bid, Tender No, Due date of opening etc. The Tenders shall be accepted by R.P.A.D./speed post only up to 15:00 hrs. on the date of opening of tender. It shall be mandatory to submit 5% security deposit within 10 days from the date of issue of Letter of Intent before order placement. In case when successful bidder not at all responding within notice period or withdraws his offer then his EMD shall be forfeited and he will not be allowed to participate in the tenders invited from the same office for the period of One year for that place from where tender is invited. 1. TECHNICAL BID: 1.1) The technical bid comprises scope and nature of works and quantity of works/jobs, drawings (Refer Schedule-B), required technical qualification for execution of the works/job etc. for which price are to be quoted. Also, all the technical details of the stores/materials offered in accordance with the Corporation speciation guaranteed technical particulars and conditions, etc; except THE PRICE BID which should be quoted separately and should be submitted separately in the PRICE BID COVER. 1.2) The Technical Bid shall be opened at 3=30 PM (15.30 Hrs) on Duedate (If possible), in the presence of those tenderers who wish to be present. If the Authorized Representative is likely to be present then he must submit the authorization letter of the representing company at the time of opening of Bids and this is compulsory. Only One Authorized Representative shall be allowed.please note that the required documents should be invariably submitted with tender copy. And tender without documents is liable to be ignored.

6 1.3) Contractor has to submit all required documentary evidences there of to qualify for acceptance of their technical bid. The acquisition of the tender documents by any party will not automatically qualify the party as to its capability to execute such or similar orders. The Corporation shall assess the capability of the party at the time of evaluation of the technical bids. 1.4) The submission of the offer by any contractor does not mean that the bidder is qualified for execution of the works. After opening of the technical bids, the competent authority will evaluate on the basis of technical qualification criteria. If contractor s bid does not meet the technical qualification criteria, then his technical bid will be ignored. Decision taken by the CE(G),GTPS will be binding to all in this regard. 2. PRICE BID: 2.1) The price bid comprises Schedule-B, in which the tenderer has to offer their rates in accordance with the technical specification specified in technical bid with all commercial terms and condition. The Price Bid must be submitted strictly as per Schedule-B and shall be submitted in the separate envelope (dully sealed) super scribed PRICE BID with subject and shall be submitted simultaneously with the Technical Bid. 2.2) Price bids of technically acceptable tenders shall open in the presence of technically qualified parties only. The time and date of opening of the price bids shall be decided by the Corporation after analyzed & scrutiny of the technical bids and the intimation will be given only to the technically accepted/qualified tenderers / parties. 2.3) The TECHNICAL and PRICE Bids shall contain adequate cross-reference wherever necessary to ensure clear and proper co-relation of the two bids without ambiguities whatsoever. Any technical questions information and clarifications that may be required pertaining to this Tender should be referred to the Chief Engineer (Gen), Gandhinagar, TPS reserves the right to reject any OR all tenders without assigning any reasons thereof. 2.4) Bidders have to quote their rates GSECL s given format of price bid. CONDITIONS FOR PRICE BID a.) For Works Portion Only: As per Schedule B, for service tax etc. b.) For Supply Portion Only:- Party shall have to quote their rates in Schedule B of price bid only along with commercial terms and conditions. The details of applicable taxes/duties, service charges, packing & forwarding charges, freight, insurance, F.O.R. etc. with or without taxes or duties shall be indicated clearly in Tech Bid as well as also in Price Bid if applicable. It is compulsory to indicate above in Price Bid otherwise offer of taxes shown only in Tech. Bid will be ignored. In case of supply portion, party shall quote their VAT/CST registration number alongwith with its attested copy. If the same is not provided or the party is not registered then purchase tax as per Gujarat VAT Act, 2003 will be deducted from party s bill and purchase tax so collected will be deposited directly to the State Government. 3. Tenders duly filled must be accompanied by the following documents. Sealed percentage rate tenders are invited from the reputed contractors with sound engineering back ground, experience and financial capability, fulfilling qualifying requirement stated hereunder at GANDHINAGAR TPS, Gujarat.

7 (A). Prequalification Criteria:- TECHNICAL QUALIFICATION CRITERIA FOR THE WORK: 1. Details of skilled/semi-skilled persons presently employed by the contractor having sufficient knowledge of similar kind of job. Qualified technician and supervisor with experience of same or similar work are most important. At least 2 welders with high class performance and experience, 2riggers 2fitters and 7-8labors are essential. 2. Detail of tools tackles & equipment possessed relevant to the job/subject tender Party has to submit the least of tools and tackles for the work. At least 2 Nos welding set, cutting set with all auxiliaries and equipments are necessary. All necessary jugars, ceilings, chain pulley blocks, winch etc material required for job must be available with contractor. 3. Details of order for similar nature/kind of job/work carried out during last three years along with documentary evidence and performance certificate there of indicating the names of the organizations, order number and date. It is essential that party shall have carried out the similar mill right, heavy duty fabrication work, involving accurate cutting, welding, alignment & finishing etc. This work needs such accuracy being required to maintain original level and weight balance of the said wagon tippler. 4. Money Receipt for payment of prescribed Earnest Money Deposit (EMD) if paid in cash or crossed demand draft on any nationalized scheduled bank and payable at Gandhinagar in favor of Gujarat Electricity Board. The details of payment of EMD shall be clearly indicated on the cover of technical bid. 5. Bank solvency certificate of about 20% value of the contract. 6. Copy of the updated labor contract license from the appropriate authorities and updated workman group insurance policy covering labor engaged. 7. Detail of P.F. Code No. from the appropriate provident fund authorities and detail of P.F. paid to the employees for last six months. 8. Detail of the partnership deed if party is not sole proprietor. 9. Bidder shall have to submit the PAN card No for Income Tax with documentary proof. 10. The tenderer shall have to produce the document of last three years annual account, i.e. profit & loss account and balance sheet, if the estimated cost of tender is more than 50 lakhs along with technical bid. Other Terms & Conditions 1. Contractor shall indemnify GSECL against for any injury and/or damage that may be caused in his man or material. Moreover, the contractor shall be fully responsible for any damage caused to the Corporation s properties done by his man/materials while executing the work. The Corporation will be entitled to recover the damage from the party s bill. 2. At any time if GSECL feels that progress of work is unsatisfactory and work force of contractor is inadequate, other agencies/ departmental personnel will be put in parallel for expediting the work. Amount so incurred will be recovered from the contractor s bill. In this case decision of the Engineer-in-charge shall be final and binding to the contractor. 3. At any stage of the contract period, if the contractor fails to complete the job or his work is not found satisfactory the same will be got done at his cost and risk and additional expenditure incurred by the Corporation will be recovered from him by giving one week's notice. 4. Subletting the contract to other agency is not permitted unless and otherwise approved by the competent authority.

8 5. Conditional tender will not be accepted. Withdrawal of condition unilaterally before or after opening of tender will not be permitted. 6. The contractor has to carry out the required work strictly according to guidance given by the Corporation's responsible officer. 7. The Corporation reserves the right whether the materials to be accepted, or not. Only specified and scheduled materials are to be examined by Corporation's officer and then if suitable will be accepted by the Corporation. 8. The contractor shall submit his bill in triplicate to the CE(G), GSECL, TPS, Gandhinagar which will be paid after the certificate regarding correct receipt of the materials in good condition. 9. The rates should be quoted without any condition. The rates be written in words and figures legibly. 10. The contractor shall have to execute an agreement with the Corporation on a non judicial stamp paper, the cost of which will have to be borne by the contractor and will have to sign the contract and tender booklet of the Corporation. 11. Any terms and conditions mutually agreed to writing shall be for a part of the contract. 13. The authorized officer/person of the Corporation will have the liberty to check the material and work etc. 14. Regarding the quality and acceptance of the jobs the authorized officer's decision will be binding and final and no dispute on this account will be entertained. 15. General terms and conditions of the Corporation for works contract will be made applicable for this work also. The booklet is attached herewith. 16. No material for the said work will be supplied by the Corpn. except specified in schedule thereof. 17. Penalty :- If the work is not done as per specification given by the Corporation in stipulated time in all respects, the penalty will be levied as per Corporation's rules. Any delay that may take place in supply and / or erection, testing and commissioning activities beyond contractual cutoff date / stipulated period in the order shall be subjected to penalty (not liquidated damages) at the rate ½ % of the contract price / order price per week or part thereof subjected to a maximum of 10% of the total contract value/ order value (i.e. End cost including taxes & duties) 18. Tenders will be accepted only on or before due date and time of opening. 19. The contractor will be responsible and liable for any damage to man and materials during his work. 20. While execution of this job our plant and auxiliaries will be in running conditions. Hence contractor has to take all precautions for safety etc. Safety belts etc. also to be used wherever necessary while working. 21. Corporation reserve the right to terminate the contract if quantity shown in Schedule-B is executed earlier. 22. All the terms and conditions specified in Industrial & safety laws are binding on the contract. 23. Registration certificate under labor contract act will have to be obtained before execution of contract. 24. The laborers shall be supplied for 8 hours a day, so contractors shall arrange accordingly. 25. Completion Time :-The time for completion of the work is _11 Months_. 26. TIME LIMIT EXTENSION If contract is as and when required:

9 This contract can be extended further for a period of12 weeks or till finalization of new contract whichever is earlier and during such extended period the rates will be payable at the existing contract rate. If the contract is ARC/BRC then following clause for time limit extension shall be incorporated: If this contract is extended beyond time limit, the contractor shall have to work in extended period till finalization of new contract and during such extended period the rates will be payable at the existing contract rate or new rate whichever is less. 27. Payment Terms: Party has to accept payment terms as per GSECL rules only i.e. as per actual work done. NO ADVANCE payment will be allowed. Net Payment will be released within 30 days after completion of work and submitting their relevant invoices. 28. Guarantee:(if applicable) After completion of work Party should give Bank Guarantee for 10% value of contract valid for 6 months against defective workmanship or faulty material. The supplier/contractor/party (i.e. tenderee) has to give Bank Guarantee with validity period of additional 01 (one) month i.e. more than actual Guarantee/Warranty period of 6/12/18/24/36/48/60 months (depending upon product) to safeguard Company s interest in case of any eventuality happening on the last day of the Guarantee/Warrantee period after office hours of the Bank or Bank holidays. The CE(G),GSECL, Gandhinagar, reserves right to reject/accept any or all tenders without assigning any reasons thereof and to split up the work between the parties as the case may be. SCHEDULE - A Name of Work: WORK OF WAGON TIPPLER RAIL TABLE AND PLATFORM STRENGTHENING OF WAGON TIPPLER NO 4 AT CHP, GTPS SCOPE OF WORK: 1. Works includes collection of materials/spares from the main store / department store, shifting, transportation of the same to working site. Structural steel required for execution of work will be supplied by the GSECL free of cost from GSECL s main store or departmental store of coal yard. 2. Before starting the work, the contractor shall have to receive specific written line clear with complete isolation, on which work is to be carried out from concern competent authority of coal yard operation, CHP-I or CHP-II Control Room. 3. The contractor has to visit the coal handling plant, take detailed dimension of rail table level, rail size and incidental structural work etc. as per the instruction of site in-charge engineer & prepare / pre-fabricate the stool plates from 20 mm / 12mm MS plates, complete with lifting/transporting and erection work. 4. The size of the structural material to be used for the above work will be decided as per requirement and availability of material in main store / sub store of CYM. 5. Contractor has to remove complete oil from wagon tippler power pack and hydraulic system internal by draining the system and keep the oil safe in oil barrels. Necessary precautions to avoid fire on and below the wagon tippler area should be arranged by contractor. Necessary fire water hose shall be provided by GSECL. Party has to wash/sprinkle the water in surrounding area and confirm no flame/spot due to welding cutting work. 6. The contractor has to remove the existing rails from original rail table, cut the damage rail stool plate as per instruction of EIC, remove the plates of wagon tippler along with its ribs, cut the I Beam of rail table top portion at 100mm below the platform, provide the double side 20mm MS plate strengthening of each I Beam structure. The fabrication of plates must be very precise so that original rail table should not disturb. Contractor has to remove beetle rail, provide perfect packing and replace with new rail. 7. The structure of both side rails of wagon tippler should be carried out one by one. The fabricated plate support must be completely welded fully with original plate of I beam of tippler table in 3 full runs. After complete leveling with bubble level guage and water level at all position of new connected plates in through wagon tippler length, the rail table must be provided on these plates. 8. The rail table plate must be fabricated from 20mm MS plate connecting with strengthening plates with through welding run. The rail table leveling and thoroughness must be precisely incorporated and top of table should be exactly as per original height. This should be ensured with EIC before processing further fabrications. 9. The above rail table preparation should be carry out at both the side of rails, and thus the strengthening plates shall be provided 4 Nos 300mm width in through wagon tippler length. For perfectness of the level party has to provide support angle ribs and level wedges etc. Beetle rail, along with main rail leveling has to be carried out. 10. All such arrangements and extra material, if required, is under the scope of contractor.

After complete fabrication and welding of rail tables of both rails, the upper plate on which rails are to be attached must be supported with extra ribs. 20mm MS plate ribs in vertical formation should be attached from bottom I beam plate to top of the stool plate with full 3 welding runs and precise load bearing manner & as per directive of concern engineer-in-charge. Taking a wrong or faulty dimension & damaging/wastage of steel will be penalized & suitable recovery will be done as per GSECL's rules & regulations. 12. After complete rail table and supporting structure ribs, the platform preparation is to be started with 20mm plates in center part of rails and 12mm plates at outer parts of platform. The structure below platform should be again strengthen by providing 3 ribs of 20mm and 12 mm plates in through length between structure plates, as original platform plates were installed with these ribs. 13. The platform must be so fabricated that the ribs of stool table and strengthening ribs of structure must be exactly matched within the slots and perfect level with double run upper and lower side of plates must be incorporated. 14. The contractor shall have to cut the plates in the minimum pieces. Welding electrodes must be of high property above 1,20,000 psi strength and used for dissimilar metal/high performance welding strength of reputed make & that should be approved by concern sectional head i.e. Ex. Engr. (Coal Yard). 15. The contractor shall have to carry out replacement of rails as supplied by GSECL with fasteners, rail fitting clams and wedges etc. The required size and quantity of fasteners will have to be arranged by contractor. New rails for main & beetle rail, will be supplied by GSECL. 16. The contractor shall have to make suitable arrangement in advance for all type of consumables like welding electrodes, cutting gas cylinders, welding & cutting accessories, welding machines, etc. at his own cost. Also consumables entry gate pass are to be duly endorsed at main gate from competent authority. The transportation of welding/cutting accessories and man/material is in contractor s scope. 17. The contractor shall have to carry out all associated work if required, (like removal & re-erection of supporting plates etc) without any extra cost. This is to be considered in the scope of work. The welding work should be as per standard welding procedure, all the plate welding above 16mm should be carried out with V notch welding. The first welding run should be carried out by 2.5 mm welding rods and finishing by 4mm size rods only. The welding rods to be used for above work should be of standard make only for dissimilar metal high strength welding work. Party has to submit the original invoice of purchase of welding rods before starting the work, and same rods should be used for work. 18. The work is of very precise nature and requires extreme strength for unloading of wagons with 70 MT loaded coal + tare weight of wagon. Any lacuna in work may tend to accident of wagon tippler and big fatigue. Hence contractor has to give guarantee of the work for at least 6 months from completion of work. 19. The contractor shall have to carry out the work continuously for 12 hours daily. During supervision, inspection or joint measurement if any defect observed the same must be rectified immediately without any extra claim. According to joint measurement sheets the actual work as per schedule 'B' will be considered for payment. 20. Time limit: Time limit of the work is 60 days from issue of line clear, and starting of the work. However if due to any emergency, the work get discontinue by GSECL, in that case the time limit of work shall be considered as total time of work carried out in piecemeal portion. 21. The total tenure of this work is 60 days from the date of commencement of the work. As the work is very urgent and wagon tippler will remain out of service, no extra time for manmaterial mobilization etc shall be provided. 22. PERFORMANCE BANK GUARANTEE: The performance bank guarantee amount of 10% of order value shall be kept for 6 months as per GSECL rules. If any damage/hazard occurs due to poor workmanship, wrong measurements, mismatch work and leveling, it should be rectified by party immediately otherwise the PBG shall not be realized.

15 PART- II GENERAL TERMS AND CONDITIONS & SCOPE OF WORK 1. The contract means the document forming tender and the subsequent agreement that may be entered into. 2. The available facility in GSECL, TPS-G'nagar- workshop will be provided free of cost, other works are to be carried out / arranged by the contractor at his own cost. 3. The general rules & regulations of the GSECL for tender and contract for the work will apply to the party. 4. Any other rules and regulations, conditions, etc. that are in force at present and that may be framed by the GSECL from time to time in connection with contract will be binding and acceptable to the contractor. 5. Sub- letting or transfer of contract without prior written approval of GSECL will be treated as a breach of contract and it will be treated as punishable by forfeiting the security deposit as well as termination of contract. 6. The work shall be completed within stipulated time after issuing line clear & as per instruction & directive of Engineer in-charge. If required party will have to work round the clock to maintain the work schedule and no work is to be left half done. 7. The party shall arrange his own adequate tools & tackles, safety equipments, welding electrodes, welding & cutting accessories, drilling machine, grinders, scaffolding, etc at his own cost. 8. Structural steel required to execute the work will be supplied by the GSECL free of cost from GSECL main store or departmental store of coal yard. 9. An authorized & technically qualified representative of the contractor must be invariably available at site while the work under execution. The address of the representative should be submitted to this office, so that party can be contacted whenever required in connection with execution of the work. 10. After completion of work, working site & surrounding area should be made clean/clear by removing/crediting/dumping of M.S. debris & all type of scraps & material as per instruction of Engineer-in charge. Scrap should be credited to main store and should be dumped at place shown by E. E. (Store). 11. The electrical connection will be given free of cost. 12. The party must have to submit daily progress report to site in charge for the work carried out. 13. The contractor if desires can see the plant and site of work with permission of undersigned on any working day during working hours. 14. The time limit is 60 days for completion of work with all respect. 15. The contractor shall hold the GSECL indemnified against and in respect of any claim arising out of injury to any persons, loss of life, workman's compensation or any other claims whatsoever. 16. The contractor shall be responsible for any damages to any property of the GSECL due to negligence of the contractor or his employees. The GSECL will be entitled to recover the damages from the contractor and it shall be final and binding to the contractor. 17. The successful tenderer / contractor will have to enter into an agreement with GSECL and the cost of the stamped paper will be borne by the contractor. The contractor will also have to execute an indemnity bond on required value of stamped paper as per GSECLs rules. The cost of the stamped paper will be borne by the contractor. 18. The party shall strictly observe all the labour laws and Factory Acts in existence and amendments made from time to time. (A) Party shall have to strictly observe all safety rules as per the Factory Act 1948 and whatever amendments made from time to time to avoid any chances of accidents. Contractor shall have to strictly follow the instructions of safety officer. (B) Before starting the contract, it is advisable that party shall have the documents for insurance of workers. 19. Payment shall be made as per actual work done only.

16 20. The contractor shall have to take all necessary precautions to avoid fire during cutting, welding, etc. In case of any smoking fire they should be extinguished by contractor immediately using their own labour, tools, water & buckets etc. 21. Income Tax will be deducted at source at prevailing rates as per I. T. Act. 22. Scaffolding materials like wooden sleepers, M.S. Angles, channels and plates if available with GSECL, will be issued free of cost, otherwise contractor will have to arrange for the same at his own cost. After completion of work scaffolding as is to be removed immediately and should be credited to main / departmental store of G'nagar- TPS. 23. Shifting, transportation of materials from main store / departmental store to working site shall have to be done by contractor at his own cost. 24. Rates should be offered on certain percentage higher or lower than the estimated amount under schedule -B. the net offered amount should be written in figure and in words on schedule. 25. If this contract is extended beyond time limit, the contractor shall have to work in extended period till completion of job and during such extended period the rates will be payable at the existing contract rate. 26. Any delay that may take place in supply & /or erection, testing and commissioning activities beyond contractual cutoff date/stipulated period in the order shall be subjected to penalty (not liquidated damages) at the rate of 1/2 % of the contract price/order price per week or part there of subject to a maximum of 10% of the total contract value/order value (i.e. End cost including taxes & duties) TECHNICAL QUALIFICATION CRITERIA FOR THE WORK: 1.1 Details of skilled/semi-skilled persons presently employed by the contractor having sufficient knowledge of similar kind of job. Qualified technician and supervisor with experience of same or similar work are most important. At least 2 welders with high class performance and experience, 2riggers 2fitters and 7-8labors are essential. 1.2 Detail of tools tackles & equipment possessed relevant to the job/subject tender Party has to submit the least of tools and tackles for the work. At least 2 Nos welding set, cutting set with all auxiliaries and equipments are necessary. All necessary jugars, ceilings, chain pulley blocks etc material required for job must be available with contractor. 1.3 Details of order for similar nature/kind of job/work carried out during last three years along with documentary evidence and performance certificate there of indicating the names of the organizations, order number and date. It is essential that party shall have carried out the similar mill right, heavy duty fabrication work, involving accurate cutting, welding, alignment & finishing etc. This work needs such accuracy being required to maintain original level and weight balance of the said wagon tippler. 1.4 Money Receipt for payment of prescribed Earnest2 Money Deposit (EMD) if paid in cash or crossed demand draft on any nationalized scheduled bank and payable at Gandhinagar in favor of Gujarat Electricity Board. The details of payment of EMD shall be clearly indicated on the cover of technical bid. 1.5 Bank solvency certificate of about 20% value of the contract. 1.6 Copy of the updated labor contract license from the appropriate authorities and updated workman group insurance policy covering labor engaged. 1.7 Detail of P.F.
