2 TERMS & CONDITIONS of TENDER 1. The tender documents with tender form along with complete details can be purchased from Jalgaon / Akola / Aurangabad sub-units on payment of Rs.1180/- (including 18% GST) (Non-Refundable). The tender duly sealed alongwith EMD should be submitted up to 1.30 PM on at National Seeds Corporation., Plot No.X-24, MIDC Behind Maitreys Hotel, Jalgaon , The tenders so received shall be opened by the Area Office, NSC, Jalgaon Committee on the same day i.e at 2.30 PM in the presence of tenderers / their representative at NSC, Jalgaon.. Tender document must accompany with EMD of Rs,50,000/- through DD in favour of National Seeds Corporation Ltd., payable at Jalgaon or online transfer to NSC, SBI Account No IFSC Code SBINOOO6117, Branch, Market Yard, Pune. Tenders without EMD shall be rejected. No interest shall be paid on EMD. 2. The Tender should be submitted only after agreeing with all the terms and conditions. For acceptance of terms and conditions, he is required to sign & seal on all pages. 3. The stock is available for sale on AS IS WHERE IS BASIS. The stock is available for inspection by the parties between AM to 5.00 PM on any working day at Jalgaon and Area Manager, Jalgaon (Mobile No ) may be contacted in this regard. Details of stock is as under :- (a) Failed Gram Seed Qtls. (b) Undersize Gram Seed Qtls. (b) Condemned Gram Seed Qtls. Total Gram Qtls. 4. All seeds are packed in different packing sizes on AS IS WHERE IS BASIS. The arrangements for lifting the seeds will be made by the Tenderer at his own cost. The cost of removing tags, labels, seals & defacing of bags will be borne by the Tenderer and Area Manger concerned should be advised to remove all tags, labels, seals & deface the bags before delivery. The stocks shall be supplied only after removing tags,

3 labels, seals etc in open condition. If tenderer wants to lift the material with bag, he should deposit Rs.3/- per bag and after returning the bag in good condition Rs.3/- will be refunded otherwise this amount will be forfeited. 5. Successful Bidder will have to deposit 10% of the Order value within 7 days of the receipt of the order by RTGS in NSC s Account. Period of lifting will be 30 days from the date of order days will be allowed to lift the entire ordered quantity and if he entire quantity is not lifted than after one month storage Rs.25/- per quintal per month will be charge provided the tenderer deposit the full cost of ordered or balance quantity. 7. Lifting of seed shall be made from above stocking points after making 100% payment. Labor charges, if any on this account shall be borne by the purchaser. 8. In the case of Tenderer will not deposit 10% amount within 7 days from the date of offer his EMD will be forfeited. In case the party deposited 10% amount within 07 days from the issue of order deposit the full cost within 30 days from issue of order date his 10% deposited amount including all other deposited amount, if any, shall also be forfeited. 9. GST if any shall be borne by the Tenderer. 10. Any difference or dispute arising out of or in connection with the tender shall be decided by the Arbitrator. The Chairman-cum-Managing Director, NSC shall be sole Arbitrator and the Arbitrator s decision shall be final and binding to the parties. Place of arbitration will be at New Delhi. 11. The Corporation is not bound to accept the highest quotation. Any or all the quotations may be rejected without assigning any reason thereof. The Corporation also reserves the right to accept in whole or part of the offers made. The decision of the Corporation in this matter shall be final and binding to all. 12. NSC is selling the Gram as failed seed / condemned seed / undersize seed therefore, tenderers have no right to submit the offer for specific variety. 13. Indian manufacturers / suppliers who are Micro Small Medium Enterprises (MSME) Small Scale Units and registered with National Small Industries Corporation under single point registration schemer are exempted from payment of Earnest Money and tender cost deposit provided they furnished photo copy of valid registration with NSIC under the single point registration scheme, for the quoted stores in support of claim along with their request letter.

4 This facility will, however, will not be provided to those small scale units who are registgered under the old registration scheme which were extended upto 30 th June, 1981, only. In this regard a written request is to be made by the bidder. 14. The tenderers have to submit the rate for all the three categories i.e. undersize seed / fail seed / condemned seed. The tenders who have quoted the rate for all the categories will be considered only. 15. Quantity of Gram may decrease / increase at the time of supply& actual quantity available at the time of supply only will be lifted by the tenderer. 16. Regional Manager reserves the right to accept or reject any or all the tender without assigning any reason whatsoever.
