Service provider will be responsible for maintenance of landscape garden by regular wedding, watering of plants pruning, spraying of insecticides etc. Further, plotted plants at the places specified by LIC Pune DO-I (Entrance, SDC Pune & VIP guest house at Ganesh Khind) have also be provided & maintained on library basis. In addition, any other gardening related work at the place as required by LIC Pune DO-I have to be carried out On empanelment, we will be calling quotations from empanelled vendors for garden maintenance, providing plants on library basis. Service provider has to carry out servicing two times in a year & will have to attend break down call within 24 hours On empanelment, we will be calling quotations from empanelled vendors stating charges for hly servicing of machines & attending to break down calls & cost of spares which may be replaced. 8 General terms & conditions on which services are to be provided 1. During the period of agreement The service provider shall be fully responsible for Providing services at the required places to the satisfaction of LIC of India Pune DO-I. 2. All the required material, equipments will be that of service provider. 3. There should not be any damage to the property, underlying asset for which services are provided. In case of damage cost of asset will be recovered from service provider 4. If any persons/s other than the specified workers are found using Divl.Office facilities, it will be viewed seriously and penalized. Smoking, consumption of alcoholic drinks, indulgence in any obnoxious activities by the worker is strictly prohibited. 5..The service provider shall provide adequate number of competent and well trained staff for rendering flawless services. Appointment of Minors is strictly prohibited. All workers shall maintain perfect cleanliness and hygiene. They should be devoid of any ailment 6. The service provider shall not assign or transfer the rights and responsibilities assigned to him to any other person of entity and shall not sub contract his services partially or wholly in any matter whatsoever to others. No tenancy rights are created 7. Any omission on the part of the Corporation at any time to exercise any of its rights under the terms and conditions of the agreement shall in no way impair or affect the validity of the terms and conditions and rights of the Corporation to enforce its rights at any time subsequently.. 8. The Service Provider/Contractor must ensure that the wages to the Workers are paid within the stipulated time period as provided under relevant Rules &Regulations/Law/Statute in force. Payment of bills due from LIC will be made on monthly basis through NEFT only, subject to deduction of Tax at source under section 194 C of Income Tax Act 1961 & Penalty imposed if any as per terms and conditions of tender/contract. The service provider shall ensure the compliance of all provisions of Contract Labour Act (Regulation and abolition Act 1970), Minimum Wages Act 1948, Payment of Wages Act 1935, ESI Act, Employees Provident Fund and Misc. Provisions Act, The Child Labour (Prohibition and Regulation) Act 1986 and such other statutory enactments, amended from time to time. Any Rules and Regulations promulgated by the Government and Local Bodies, coming into force that may apply to the contract shall be The service provider s sole responsibility 8

9 including any liability on account of non-compliance or violation thereof. The service provider shall also comply with all the requirements of laws with regard to provision of labour and ensure that an appropriate license from State/Central Labour Commissioner is obtained. In the event of any liability of any nature whether relating to statutory compliances or payment of wages or otherwise, is saddled on the Corporation with regard to Personnel engaged and deployed by The service provider Providing catering services the Corporation shall be entitled to recover the same from the EMD/Security/running bill held with the corporation. The service provider would undertake to indemnify and to make good the loss to the full extent to the Corporation failing which the Corporation shall be within its right to take appropriate action in law for recovery of the said amount. 9. It is particularly agreed that the Corporation shall in no way be held responsible for any bodily injuries sustained or death of any employee(s) of The service provider. The Service provider shall alone be liable to pay all statutory compensations which may be awarded or payable to such employee or his/her dependent. If under any circumstance the Corporation is made liable to pay any such compensation, The service provider will indemnify / reimburse the Corporation in full extent. 10. The Service provider to whom contact is awarded shall sign a Declaration that he agrees to all terms & conditions mentioned above without any condition whatsoever. He should declare that he agrees that all deficiencies will attract penalty and the recovery will be affected without any notice to him. He should also declare that in case of his premature withdrawal from the services for any reason whatsoever, during the period of the agreement or in case of his failure in course of the agreement period to comply with these terms and conditions the Competent Authority is at liberty to recover penalty of Rs 5000/- (Rs. Five Thousand only).plus cost of damages if any from biil/s due. 11. Earnest money deposit/ security deposit( as applicable) will have to be deposited at the time of submission of quotations/ when contact is awarded to successful bidder. Agreement on stamp paper of Rs 500/-( cost to be born by service provider) will be entered into with the vendor to whom contract will be awarded specifying above terms & conditions along with terms of payment for services 9
