2 A. CALL TO ORDER The meeting was called to order on February 25, 2015 by Mayor Jim Daley at 7:30 p.m. in the Village Board Room, S. Founders Crossing, Homer Glen. B. PLEDGE OF ALLEGIANCE TO THE FLAG C. ROLL CALL Present at 7:30 p.m. were Mayor Jim Daley, Trustees Mike Costa, Marcia DeVivo, Tedd Kagianas, Margaret Sabo, Sharon Sweas and George Yukich. All remained present throughout the meeting. Also present on behalf of the Village were Village Clerk Gale Skrobuton, Village Manager Cameron Davis, Development Services Director Mike Salamowicz, Economic Development Director Janie Patch, Finance Director John Sawyers and Village Attorney Mark Sterk. A quorum was established. D. AMENDMENTS TO THE AGENDA There were no Amendments to the Agenda. E. APPROVAL OF MINUTES 1. August 26, Village Board Meeting Trustee DeVivo made a motion to approve the Board Minutes of August 26, 2014; second by Trustee Kagianas. Trustee Yukich commented that when reading the August 26, 2014 Board Meeting Minutes he could not remember what was said at the meeting. Trustee Yukich asked if, in the future, the Clerk could give the Minutes to the Village Board in a shorter time frame following a Board meeting. Voice Vote: All in favor: (5) Trustees Costa, DeVivo, Kagianas, Sabo, and Sweas Nays: (1) Trustee Yukich Motion carried. G. SCHEDULE OF ACCOUNTS PAYABLE Trustee Sabo made a motion to approve the Schedule of Accounts Payable for the period January 30, 2015 to February 26, 2015 in the amount of $983,590.02; second by Trustee Costa. Trustee Sabo asked if the payment to the Homer Township Chamber of Commerce was for their Annual Dinner and not the luncheon, as stated on the Schedule of Accounts Payable. Trustee Sabo noted that the annual membership fee for the Homer Township Chamber of Commerce is included on the Schedule of Accounts Payable, but has not come before the Village Board for approval prior to payment of the annual membership dues. Trustee Sabo asked if all memberships come before the Village Board for approval, or only certain ones. Manager Davis stated that the Village s Standard Operating Procedure (SOP) states that all memberships are to be approved by the Village Board, but he is not certain if the Chamber of Commerce membership dues have historically come before the Village Board for approval prior to payment since the annual fee is only $ Manager Davis stated that he will check the previous payments of the Chamber s annual membership dues and report his findings back to the Village Board. 3 Trustee Sabo asked when the Village received the bill from Krupske Sprinkler Systems that is dated February 1, Finance Director Sawyers stated that Krupske Sprinkler Systems bill the Village on a monthly basis and uses the date of the subsequent month. This invoice is for plumbing inspections were completed in January 2015 for the Village s Building Department. Abstain: (0) None Motion carried. H. REPORTS AND COMMUNICATIONS FROM MAYOR AND OTHER OFFICERS 1. Mayor Daley reported on the items listed below.. On Saturday, February 21 st the Lockport Township High School (LTHS) Lady Porters Bowling team successfully secured the school s amazing 4 th State Bowling title. The Lady Porters won the team title with 12,689 pins, 148 more than 2 nd place Collinsville. Oswego (East) placed 5 th and Joliet (West) placed 8 th. The Mayor also congratulated Kierstin Vandenburg, LTHS student, who placed 2 nd in the individual championship and Coach Art Cudzinski and the family, friends and fellow Porter fans who cheered the team to victory. Mayor Daley stated that the Village of Homer Glen will honor the Lady Porters at an upcoming Village Board meeting.. Homer Tree Service will begin the process of removing dead trees on the future 151 st Street Village Hall park property starting this Friday or Saturday. The tree removal company communicated to Village staff that it would take them approximately one (1) week to remove all of the dead trees. Mayor Daley reported that he sent a letter out to the residents in the area, informing them that the Village will only be removing dead trees. Additionally, he has directed Village staff to post a large sign on the fence on 151 st Street so that people who drive by the property will know that the Village is only removing dead trees.. One of Homer Glen s most popular restaurants, Blueberry Hill Breakfast Café and Pancake House, has plans to expand their operation into an adjoining vacant 1,300 sq. ft. space. The proposed expansion and remodel will create a much larger waiting area for restaurant customers. In addition, current plans call for the 1,300 sq. ft. expansion space to house sixty-one (61) new seats, as well as added bathroom facilities. The expansion will completely fill the north building of this shopping center to capacity as the Village s economic development successes continue to multiply. 2. Trustees: a. Trustee Costa No Report b. Trustee Yukich reported on the item listed below.. Plans for the Homer Community Festival are almost complete. The Festival will be held Thursday, June 25 th thru Sunday, June 28 th. c. Trustee Sabo reported on the items listed below.. Publicity for Earth Day~Arbor Day on May 16 th has been sent to newspapers seeking demonstrators, exhibitors, volunteers and sponsors. The Earth Day~Arbor Day Committee is Village of Homer Glen Page 2 of 11

4 seeking individuals, groups and businesses who utilize natural and recycled materials that provide solutions and examples of products and the green industry. Exhibitors that connect children with nature and the outdoors are especially encouraged to participate. Other demonstrators or exhibits are being sought that show efficient use of energy and cost savings. There will be a Green Market with arts and crafts for sale and nature friendly exhibits. A new program will be added to the event entitled Trash to Treasurers which is similar to Antique Road Show seen on TV. People will be able to bring an item to be appraised. More details about this event are forthcoming. At this time the sponsors that have pledged to support Earth Day~Arbor Day are: Meijer, Richards Building Supply, NuWay, Door to Door Organics and Konow Farm. Their thoughtfulness will help bring new and existing programs and activities this year. Look at the Village website for more information on Earth Day~Arbor Day.. The Environment Committee is seeking big trees in the Homer Glen community by holding a Big Tree Champion Contest to celebrate Arbor Day this year. All types of trees can be entered which may be growing on forest preserves, private property, parks and open spaces. Please seek permission for access to private property. The search includes the biggest tree from any tree category, which means that more than one big tree will be announced. The nomination forms will be available soon. To make the nomination process easy, the only measurement required will be the circumference of the tree. The deadline for nominations will be May 31 st.. The process for the Tree Replacement Program in the road right-of-way has begun. Recently, about (150) letters were sent to those who have lost trees in the right-of-way in front of their homes. So far, the number of responses from residents has been thirty (30). The trees planted in the spring will be increased to 2½ inches in diameter, which reflect the tree replacement size in other communities. d. Trustee Kagianas reported on the item listed below.. The Community and Economic Development Committee is asking the Homer Community Festival Committee to work with Homer Glen s local businesses and restaurants, who have invested in Homer Glen, when seeking food vendors for this year s Festival. e. Trustee Sweas No Report f. Trustee DeVivo reported on the items listed below.. The Parks and Recreation Committee met on Monday, February 23 rd and discussed the Goodings Grove Park and the recommended name. After the Committee reviewed the historical information provided, the consensus from the Committee was to keep the name of the Village s new park as Goodings Grove, after William Gooding, who first planted a fruit tree grove in this area. This recommendation will come before the Village Board in March for a vote. A final rendering of the park will also be available at that time.. The Will County Forest Preserve plans on preparing a County-wide bikeway plan in an effort to expand non-motorized transportation opportunities that will connect communities and open space areas. It is intended to be coordinated in the Will County Division of Transportation 2040 longrange transportation plan. Village Manager Davis completed the forest preserve s request to provide them with a map of current and future trails. We believe this is a great opportunity to communicate our current and future ideas on connectivity with the forest preserve trail system, along with other systems. 3. Finance Director Sawyers read the Treasurer s report into the record with ending balances as of December 31, General Fund $ 4,689, Special Event Fund $ 61, Village of Homer Glen Page 3 of 11

Village Manager No Report Trustee Costa asked Manager Davis for the status of the flag pole in the Village s Stonebridge Park. Manager Davis stated that the flag poles are installed and the flags have been delivered. The landscaping and electric still have to be completed. I. PUBLIC COMMENT 1. Joseph Hill, 9100 West Plainfield Road, Brookfield, IL, representing T-Mobile, stated that he is available to answer any questions the Village Board may have regarding T-Mobile s request for the operation and co-location of a wireless communication facility for the property located at West 159 th Street in Homer Glen. 2. Larry Kowfirst, S. McCarron, voiced his concern about the Village s Ordinance Regulating the Outdoor Parking of Recreational and Construction Vehicles. Mr. Kowfirst stated that he moved to Homer Glen because there is so much open space and, he believes, any resident owning more than one (1) acre of property should be given a little more leeway as to what you put on your property or on the driveway, unless someone else objects to it. Mr. Kowfirst stated that he could understand the Village putting restrictions on what could be parked on someone s property if it was a 60 ft. lot with a short driveway, but with an acre lot, he thinks the Village should be more considerate to the property owner. 3. Dan Kenny, Maramel Drive, stated that he supports the Village s Outdoor Lighting Ordinance and this ordinance is one of the reasons he and his wife decided to move to Homer Glen. Mr. Kenny stated that, he believes, the ordinance makes Homer Glen unique, sets us apart and affords the Village the rare distinction as one of the only Dark Sky Communities in the entire world. Mr. Kenny noted that some residents believe that the Village s Outdoor Lighting Ordinance is too restrictive, unsafe or bad for business, but, he believes, having strict ordinances that are unilaterally enforced creates a level playing field which is good for business. Mr. Kenny stated that, in his opinion, the only thing that is bad for business is when the Village Board grants variances to a select few businesses while a majority of the existing business owners are already following the rules. Mr. Kenny asked the Village Board to not grant any more variances to businesses who are not willing to be in compliance with the Village s ordinances. Mayor Daley stated that, in certain circumstances, the Village has pre-existing annexation agreements that were made prior to the approval of the Village s Outdoor Lighting Ordinance, that are accepted because they annexed into the Village under a certain understanding and contract. 6 4. Bob Schmidt, W. Independence Way, stated that he moved into this area forty-seven (47) years ago when it was all farmland and, he believes that, over the years, the Mayor has done an excellent job in protecting Homer Glen. Mr. Schmidt stated that, he believes, if the Village takes away outdoor lighting, they will take away any business for 159 th Street because business owners will not come to Homer Glen. J. LEGISLATION AND ACTION ITEMS 1. Ordinance No An Ordinance Granting Approval of a Special Use to Amend a Planned Unit Development and Approval of a Special Use to Permit the Operation and Co-Location of a Wireless Communication Facility for the Subject Property Located at W. 159 th Street, Homer Glen, Illinois (T-Mobile Central, LLC). Trustee Costa made a motion to approve Ordinance No ; second by Trustee Sweas. Trustee Sweas noted that in 2011 the Village Board had approved a special use for T-Mobile to co-locate and operate a wireless communication facility at this same location; however, the special use expired in Trustee Sweas asked if there were any changes in T-Mobile s request for this special use from the special use that was approved by the Village Board in Mr. Hill stated that while he was not involved in T-Mobile s request that was made in 2011, the equipment area in the fenced-in compound has changed slightly, but their tower extension is the same. Manager Davis stated that the pad is 25 ft. less than it was in Trustee Sabo asked if there are any residents in the area surrounding T-Mobile s wireless communication facility. Manager Davis stated that there is significant buffering between the Circle Tractor property and the one (1) residence in the area. The only adjacent uses are the business or the school. The wireless communication facility is set back quite a distance from the school. Trustee Sabo asked Village staff if, in the future, a map of any residents in the area could be provided to the Village Board so the Board will know what is surrounding the facility property. Abstained: (0) None Motion Carried. 2. Ordinance No An Ordinance Authorizing the Execution of a Recreational Lease By and Between Commonwealth Edison and the Village of Homer Glen, Will County, Illinois, for the Construction and Maintenance of the Village s Southern Extension of the Village s Heroes Trail. Trustee DeVivo made a motion to approve Ordinance No ; second by Trustee Yukich. Trustee Costa asked if this trail will go to the property west of the current Village Hall, going north and south. Manager Davis stated that this trail will go from Martingale down to 159 th Street. Village of Homer Glen Page 5 of 11

7 Trustee Costa asked if this document could also include that the Village would like to be able to bring a branch of the trail over to the ComEd property line near the Healing Garden. Manager Davis stated that we can talk to ComEd about bringing the trail to the property line of the Healing Garden.. Nays: (0) Abstained: (0) None Motion Carried. 3. Motion to Approve the Proposed Date of Saturday, April 18, 2015 and Time of 9 a.m. to 1 p.m. for the Village s Spring 2015 Paper Shredding and Recycling Event. Trustee Costa made a motion to approve the proposed date and time for the Village s spring 2015 Paper Shredding and Recycling Event.; second by Trustee Kagianas. Abstained: (0) None Motion Carried. 4. Motion to Approve the Agreement with Shred-it for Document Shredding Services to be Provided at the Village s Spring 2015 Paper Shredding and Recycling Event and to Direct the Mayor to Sign Said Agreement. Trustee DeVivo made a motion to approve the agreement with Shred-it for document shredding services; second by Trustee Sweas. Abstained: (0) None Motion Carried. 5. Motion to Approve an Agreement with School District 33C for the Use of Hadley Middle School s Parking Lot for the Village s April 18, 2015 Paper Shredding and Recycling Event and to Direct the Village Manager to Sign Said Agreement. Trustee Costa made a motion to approve the agreement with School District 33C; second by Trustee DeVivo. Village of Homer Glen Page 6 of 11

8 Abstained: (0) None Motion Carried. 6. Motion to Authorize HR Green to Prepare Required MFT Qualified Documents for Submittal to IDOT for the Following Village of Homer Glen MFT Fund Projects: (1) The Completion of the Removal and Replacement of the Remaining Old Post Top Lighting Fixtures Within the Village; and (2) The Village s Street Light Maintenance Project. It is understood that HR Green will prepare the proper IDOT documents, for both projects, at an amount not to exceed $4, It is further understood that HR Green s fee would be paid from the Village s MFT Fund. Trustee Costa made a motion to authorize HR Green to prepare the MFT documents for submittal to IDOT; second by Trustee Sabo. Trustee Sweas asked if it is known how much the maintenance project would cost annually. Manager Davis stated that $30,000 was budgeted for the maintenance project. Abstained: (0) None Motion Carried. 7. Ordinance No An Ordinance Regulating the Outdoor Parking of Recreational Equipment/Vehicles and Construction/Commercial Related Vehicles in the Village of Homer Glen, Will County, Illinois. Trustee Yukich made a motion to approve Ordinance No ; second by Trustee Costa. Trustee Kagianas stated that, he believes, this ordinance is an overreaching attempt on government to control our residents land and personal property and the Village Board is now going to tell our residents what they can have in front on their house and stored on their property. Trustee Kagianas stated that, he believes, under this ordinance, any lettering on a work truck may be restrictive; however, if the ordinance were to refer to vehicles with different classifications of license plates being allowed to be parked in residential neighborhoods, that would be a different situation. Trustee Costa stated the Village has had an ordinance prohibiting recreational vehicles being parked in front of a resident s house for quite a while. The Public Services and Safety Committee discussed this ordinance for several months and many residents attended the meetings and voiced their opinions. Trustee Costa stated that, he believes, the Committee has come up with some ideas that have loosened the restrictions on what residents can park in front of or on the side of their house. Trustee Costa stated that residents can now park a snowmobile trailer or small boat trailer on their driveway, but not on the grass. The ordinance also allows a resident to have another recreational vehicle parked on the side of their house, which is behind the right-of-way, as long as it is on proper bedded ground. 9 has made provisions for residents who have had vehicles on their driveways to now have them there legally. Trustee Costa noted that a gross vehicle weight of 14,000 lbs., which would encompass work vehicles taken home every night that are on 24/7 call, are allowed to be parked on the driveway. If a recreational vehicle is on the driveway it cannot protrude into the sidewalk. Trustee Costa stated that the requirement of having complete screening in front of your vehicle when it was parked on the side of your house has been taken out of the ordinance. Trustee Costa noted that the ordinance states that a recreational vehicle cannot restrict a line of site, cannot go over the sidewalk, must be in road worthy condition and must be registered to the homeowner. Trustee DeVivo asked if any of the residents that received the original warning letters would not be in compliance with the new ordinance that the Village Board is considering for approval. Chief Building Official Joe Baber stated that there is a possibility that some of the residents may not be in compliance with the new ordinance, as there were some vehicles that were parked in the grass and not on approved hard surfaces. Mr. Baber stated that this proposed ordinance is a lot less restrictive than the previous ordinance and it only applies to the R-zoned properties. The property owners of larger parcels can park larger vehicles on their property, and the ordinance does allow them to park one commercial vehicle on their driveway, with the size of the vehicle being the determining factor. Trustee Kagianas voiced his concern that some of the commercial work vehicles might not be in compliance because they could be over the 14,000 lbs. limit of the ordinance. Trustee Kagianas stated that, in his opinion, this ordinance is now more restrictive because the Village is defining ways where Homer Glen residents will not be in compliance with the ordinance. Trustee Sabo stated that the Public Services and Safety Committee had the input from the residents who had the problem with storing the vehicles and from the residents who had an issue with looking at their neighbor s parked recreational vehicles. Trustee Sabo stated that, she believes, this Committee has come up with ideas that are less restrictive and they are trying to satisfy the people who own the vehicles, as well as the property owners that feel if these vehicles are not stored properly that their property value will go down. Trustee Sabo asked Trustee Yukich to read the new proposed ordinance regulations. Trustee Yukich read the following proposed ordinance regulations. 1. It applies only to those properties located within the R-zoning districts. 2. Allows one (1) recreational vehicle to be parked between the front building line and the public right-of-way. 3. Allows one (1) commercial type vehicle to be parked between the front building line and the public right-of-way. \ 4. All vehicles are required to be parked on an approved hard surface. 5. At no time are vehicles allowed to be parked or to be located on any portion of public sidewalk and public right-of-way or affect roadway site lines. 6. All vehicles must be operable and have current state licenses and registrations to the address at which it is being stored. 7. All vehicles shall be maintained and stored in a safe manner. 8. Any commercial or construction vehicle stored in a residential area shall be classified as a light duty vehicle or less, as determined by the vehicle s gross weight. 9. Parking of vehicles larger in size than the light duty classification shall be prohibited on public streets, unless it is being utilized for short term activity. 10. Vehicles that are stored on a hard surface location that was lawfully established prior to the adoption of the zoning ordinance shall be deemed legal, nonconforming or grandfathered use. Trustee Yukich stated that, he believes, the Public Services and Safety Committee did a wonderful job and kept the promise they made to the residents of Homer Glen to make this ordinance less restrictive. 10 Mayor Daley stated that, if approved by the Village Board, these changes will be placed on the Village s website. Trustee Sweas asked if a resident could have one (1) recreational vehicle and one (1) commercial vehicle. Mr. Baber stated that a resident could have one (1) of each type of vehicle as long as they are stored in compliance with the ordinance. Trustee Kagianas asked if a resident would be in compliance with the Village s ordinance if they drive a corporate vehicle and the license is not registered to the house. Trustee Costa stated that the intent of having the vehicle registered to the residence where it is being stored is for the recreational vehicles and not for commercial vehicles. Bob Schmidt, owner of Wheel-Go Camping noted that an RV weighs more than 14,000 lbs. and he does not believe the Village Board should be telling any resident that they cannot keep a large recreational vehicle on their property. Mr. Baber stated that the 14,000 lb. gross vehicle weight is only for the commercial and construction vehicles and does not apply to the RV s or other recreational vehicles. Ayes: (5) Trustees Costa, DeVivo, Sabo, Sweas and Yukich Nays: (1) Trustee Kagianas Abstain: (0) None Motion carried. Trustee DeVivo voiced her concern that there may be some verbiage issues with this ordinance and she does not want the Village ordinance to stand in the way of a resident not being able to park their work vehicle in their driveway. Trustee DeVivo stated that she does not believe this ordinance should become a revenue source for this community and asked the Village Board to be kept informed if residents have a complaint so they can be addressed. 8. Ordinance No An Ordinance Amending Ordinance No , an Ordinance Entitled Outdoor Lighting in the Village of Homer Glen. Trustee Sabo made a motion to approve Ordinance No ; second by Trustee Kagianas. Trustee Kagianas suggested that, in the future, the Village Board should discuss having an exemption on the lighting of the American Flag without having a heavy burden of trying to determine what light bulb has to be shining on the American Flag. Trustee Sabo stated that the reason the American Flag is addressed in the ordinance is so people will know that the light should shine on the flag and not on someone s property or in their house. Trustee Sabo stated that the flag can be lit from the ground up or from the top down or with solar lighting, but the ordinance does not say that you are restricted to a certain amount of light on the flag. Trustee Sabo stated that the ordinance does say that if the flag is a certain distance you must have a certain wattage, which is required because of the angle of the light, but the ordinance does not say you cannot have more than one (1) light fixture. 11 Trustee Sabo stated that, she believes, this entire ordinance is about safety and consistent lighting throughout the Village which is very important so that the eye can adjust and people are not be subject to dangerous glare or blinded by certain light that someone uses. Trustee Sabo stated that there are other safety factors that are built into the ordinance, because the illuminating engineer s guidelines are used by the lighting designers and those guidelines are all about safety. Trustee Sabo stated that the compliance date has been removed from this ordinance, which the Environment Committee had wanted to remove for a long time. There are four (4) categories of lighting, which makes it a lot easier for a business to comply, including building lighting, landscape lighting and parking lot lighting. Trustee Sabo stated the definitions have been updated, the ordinance includes examples of lighting fixtures that are fully shielded and full cut-off so the light is distributed to where it is needed, and there is a luminaire chart that is very easy for developers to use. Trustee Sabo stated that the ordinance also includes an example of how to calculate lumens and explains that a lumen is a measurement of light. Trustee Sabo stated that having the Environment Committee and Community and Economic Development Committee work together has been very valuable and the Environment Committee wants to continue to improve the ordinance to make it clearer and easier. Trustee Sabo stated that, she believes, the Village s Outdoor Lighting Ordinance is for Community and Nature in Harmony because people cannot find it in many other places and our residents can still have the quality of life that they need. Trustee Sabo stated that, she believes, the Village of Homer Glen is environmentally conscious, we are also growing with business and the outdoor lighting ordinance has not prevented any business from coming into Homer Glen. Trustee Sabo stated that the Environment Committee has recommended that a loan program for nonconforming industrial/commercial lighting situations be adopted that is similar to the loan program for the sign ordinance. The Environment Committee is working on a lighting brochure that sums up the proposed loan program. Abstain: (0) None Motion carried. 9. Resolution No A Resolution Authorizing the Presentation of a Draft for Payment of $3,847.25, from the Remaining Balance of $23,518.75, Pursuant to the Irrevocable Letter of Credit, (LOC No ) Issued by the State Bank of Countryside, on Behalf of Tri-K Development, Inc., for the Benefit of the Village of Homer Glen for Payment of Outstanding Professional Service Fees for the Kenwood Liquor Development. Trustee DeVivo made a motion to approve Resolution No ; second by Trustee Sweas. Trustee Yukich asked if Tri-K Development has been notified that the Village is pulling the Letter of Credit. Manager Davis stated that the Village does not notify people when we pull a Letter of Credit. Manager Davis noted that these are past due bills that Tri-K Development has owed to the Village for many years. The Village has made multiple attempts to collect the past due balances, but we have been unsuccessful. Manager Davis stated that the Village will contact Tri-K Development after the Village Board approves this resolution. Village of Homer Glen Page 10 of 11

ADJOURNMENT Trustee Costa made a motion to adjourn the meeting; second by Trustee Sabo. Voice Vote: All in favor: (6) Trustees Costa, DeVivo, Kagianas, Sabo, Sweas and Yukich Motion carried.
