2 A. CALL TO ORDER The meeting was called to order on May 27, 2014 by Mayor Jim Daley at 7:37 p.m. in the Village Board Room, South Founders Crossing, Homer Glen. B. PLEDGE OF ALLEGIANCE TO THE FLAG C. ROLL CALL Present at 7:37 p.m. were Mayor Jim Daley, Trustees Mike Costa, Marcia DeVivo, Tedd Kagianas, Sharon Sweas and George Yukich. Trustee Sabo arrived at 7:45 p.m. All remained present throughout the meeting. Also present on behalf of the Village were Village Clerk Gale Skrobuton, Village Manager Cameron Davis, Assistant to the Village Manager-Planning and Zoning Erin Venard, Finance Director John Sawyers and Village Attorney Mark Sterk. A quorum was established. D. APPROVAL OF AMENDMENTS TO THE AGENDA Trustee Sweas asked that Consent Agenda Item J1, Motion to Direct the Mayor to Submit a Letter to the Will County Division of Transportation, Providing Feedback from the Village of Homer Glen Regarding Sidewalk Limits Along Bell Road, from 151 st Street to 159 th Street, in Response to the County Engineer s Probable Cost Estimate, be moved to Agenda Item K7 under Legislation and Action Items to allow for discussion by the Village Board. The Village Board did not have an issue with moving this agenda item on the agenda. E. APPROVAL OF MINUTES 1. March 11, Village Board Meeting Trustee Costa made a motion to table approval of the Board Minutes from March 11, 2014; second by Trustee Yukich. Trustee Kagianas asked if there was a specific reason for tabling the approval of these Minutes. Trustee Costa stated that Trustee Sabo was not currently in attendance and the Minutes from the March 11, 2014 Board Meeting contained a lot of information on outdoor lighting. Trustee Costa commented that he believed that Trustee Sabo would like to further review the Board Meeting Minutes before they are approved by the Village Board. Voice Vote: Ayes: (5) Trustees Costa, DeVivo, Kagianas, Sweas and Yukich Absent: (1) Trustee Sabo F. RECOGNITION 1. Key to the Village Presented to Brian Stevens. Mayor Daley presented Brian Stevens with a Key to the Village of Homer Glen in recognition and appreciation for his volunteer service to the residents of our community during the past years. 3 stated that Mr. Stevens served as the Chairman of the Village s Plan Commission from and from As the Chairman, he was responsible for making sure that meetings proceeded in an orderly fashion and that they were conducive to rational decision making. His effective leadership set the tone of the hearings and helped to keep the discussions on track. 2. Village Receives GFOA Certificate of Achievement for Excellence in Financial Reporting. Mayor Daley recognized Finance Director, John Sawyers and Account Clerk, Kathy Carik for assisting the Village in attaining its twelfth consecutive Government Finance Officers Association (GFOA) Certificate of Achievement for Excellence in Financial Reporting. The Certificate of Achievement is the highest form of recognition in the area of governmental accounting and financial reporting and its attainment represents a significant accomplishment by a government and its management. The Mayor presented John Sawyers with the Certificate of Achievement plaque from the GFOA. G. SCHEDULE OF ACCOUNTS PAYABLE Trustee DeVivo made a motion to approve the Accounts Payable for the period April 24, 2014 to May 28, 2014 in the amount of $541,099.93; second by Trustee Costa. Ayes: (5) Trustees Costa, DeVivo, Kagianas, Sweas and Yukich Absent: (1) Trustee Sabo The Mayor did not vote H. REPORTS AND COMMUNICATIONS FROM MAYOR AND OTHER OFFICERS 1. Mayor Daley reported on the items listed below.. The Mayor reported that several months ago he and Manager Davis met with representatives from the Southwest Community Concert Band who were facing the challenge of looking for a new home. Previously, the band had operated out of the Village of Lemont. The Mayor stated that he suggested that the band consider contacting the minister at Eagle Rock Community Church in Homer Glen. Eagle Rock Church was happy to help and now the band is practicing at the church. The Southwest Community Concert Band performs four (4) seasonal concerts, Summer Park Concerts and hosts Winter Band Day and Summer Band Camp for students throughout the season. Summer Band Camp will be held at the end of June. Interested students with at least one (1) year of instructional playing experience are encouraged to attend. Additional information about our new community band and their 8 th Annual Summer Band Camp can be found at The next meeting of the Northern Will County Water Agency will be held on Monday, June 9 th at 11 a.m. in Homer Glen s Village Board Room. The agenda will be posted prior to the meeting.. Existing and new businesses in Homer Glen are planning or have recently completed big building and/or remodeling projects. Homer Glen businesses investing in remodeling of their stores include: Dunkin Donuts; McDonald s; Wendy s; Home Depot; Jewel-Osco; Jimmy Johns; and Simply Salsa. New stores include: Sleepy s; U.S. Bank; Dotty s; US Vision; and Dr. Vittori. The Mayor reported that with Meijer investing $9 million in their new Homer Glen store, the new combined commercial investment for all businesses in town jumps to almost $11 million in Homer Glen. Trustee Sabo arrived at 7:45 p.m. Village of Homer Glen 2 of 13

4 . The Mayor congratulated Chief Stevens and his team on Mokena Fire District s ISO Classification upgrade. The Mokena Fire District serves the fire protection needs of the southern portion of Homer Glen s corporate boundaries. The Mayor invited Chief Stevens to give his report to the Village Board. Chief Howard Stevens reported that the Mokena Fire District, which protects portions of Homer Glen, Mokena, Frankfort and Orland Park, is one of the (192) internationally accredited Fire Districts in the world and one of only (13) in the entire State of Illinois. Chief Stevens stated that the Mokena Fire District is building the new fire station on 183 rd Street, closer to Homer Glen, which helped them achieve a Class A rating in their latest ISO (Insurance Service Organization) review. The ISO evaluation includes a review of the Fire District s Emergency Communication System; Fire Department Procedures; Water Supply; and Community Risk Reduction. Chief Stevens reported that the Mokena Fire District recently went through the ISO Classification review and they were approved to the highest ISO Class 1 Classification. The ISO was founded in 1909 and through their reviews of fire departments throughout the nation they recommend a classification to insurance companies. Chief Stevens stated that having a Class 1 Classification generally means that insurance rates for commercial establishments and homeowners are going to be lower. Chief Stevens noted that the Mokena Fire District will be sending a mailer to all of their residents within the Mokena Fire Protection District so they can contact their insurance company about the ISO classification. 2. Trustees a. Trustee Costa reported on the item listed below.. The Homer Community Festival will be held on Thursday, June 26 th through Sunday, June 29th at 151 st and Crème Road. On Thursday, June 26 th we will be having a Special Needs Family Day from 2:30 p.m.-4:30 p.m. Residents of Homer Glen who have a child or a family member with special needs can preregister to enjoy the carnival rides and games at no cost. Applications are available online or by calling the Homer Township Administration office, and must be received by June 19 th. Parking will open at 2:00 p.m. b. Trustee Yukich reported on the items listed below.. Plans for the Homer Community Festival have been finalized and Mega Passes for the carnival rides can be purchased before Thursday, June 26 th for $45.00 and $55.00 at the event at the Homer Township Highway Department or at T-Time Family Fun Center, W. 159 th Street. Fireworks will be Thursday night, with a rain date of Friday. Bands include: Thursday, Maggie Speaks; Friday, 80 s Enough and Hi Infidelity; Saturday, Reverend Bob, Krazy Uncles, Sinister Finch, and Infinity; and Sunday, Cooper s Grove, 4 Cast, and One of These Nights. A Bag Tournament will be held on Saturday. This is a double elimination tournament and preregistration is required.. The Public Services and Safety Committee will be discussing the recent incident of a dog attack in Homer Glen at the Committee s June 4 th meeting, at 7:00 p.m. in the Village Board Room. The public is invited to attend. c. Trustee Sabo reported on the items listed below.. The next Stargazing event will be held on Friday, June 20 th from 9-11 p.m. at Homer Township s historic Trantina Farm located east of Gougar Road on 151 st Street. This is becoming a very popular event with over 300 people attending last fall s Stargazing event. Information is available on the Village website, After a rainy week, EarthDay~Arbor Day was held on May 17 th with sunny weather and no rain. The turnout was very good in spite of cooler weather. A total of ninety (90) exhibitors participated in the event. Sponsors included: Konow s Corn Maze; Willowbrook Ford; The Davey Tree Expert Company; Home Depot Kids Workshop; Nicor Gas; NuWay Disposal; Savers; Kapital Electric and Village of Homer Glen 3 of 13

5 Once Upon a Child. Donors were Bret-Mar Landscape Management Group and Teerling Nursery. Service providers for Earth Day~Arbor Day included: Instant Shade Inc.; Home Depot; Homer Glen Emergency Management Agency; Homer Glen Junior Woman s Club; Homer Township Chamber of Commerce; Homer Township Fire Protection District; Konow Farm; Lockport Township High School; Northwest Homer Fire Protection District; NuWay Disposal and Will County Policy Auxiliary. Trustee Sabo thanked all the volunteers including: Homer Glen Junior Woman s Club; Homer Township Chamber of Commerce; Homer Glen Staff; Mr. Homer Glen Talking Tree (Aaron Opon); and Dr. Branch (Kyle Stevens). Trustee Sabo also thanked Walter Konow, the Konow Family and his employees for the event preparation and the extra work that was involved because of difficult circumstances due to weather and ground conditions. Trustee Sabo also gave special thanks to the Environment Committee for organizing one of the best Earth Day~Arbor Day celebrations including: Cynthia Rataj; Randy Juras; Sharon Sweas; Gary White, Bob Moses; Kathy Kudla; Cathy Rehr and Co-chairman Sue Steilen. Trustee Sabo commented that Mrs. Steilen was able to anticipate solving any rain related problems and make adjustments for indoor locations for exhibitors who planned to be located outside in the complete layout of the property. The Environment Committee worked very diligently to provide the public with a very comprehensive, fun and educational event with every Committee member adding something special to the event. Trustee Sabo reported that many complements were received from the public relating to activities that taught adults and children about nature and tree related activities such as a big tree planting demonstration, tree identification and a large slice of a Sequoia Tree on display that was 2,600 years old. Trustee Sabo thanked Village Manager Davis for taking pictures at the event and also thanked the many newspapers and other social media who broadcasted the Earth Day~Arbor Day event near and far. d. Trustee Kagianas reported on the items listed below.. Trustee Kagianas congratulated Brian Stevens on the outstanding professional job he did for the residents of Homer Glen as the Chairman of the Plan Commission. Trustee Kagianas congratulated Finance Director John Sawyers for once again receiving the GFOA Certificate of Achievement for Excellence in Financial Reporting for the Village of Homer Glen.. On June 6 th the Homer Township Chamber of Commerce will be holding their Annual Golf Outing Fundraiser at Old Oak Country Club. Information is available on the Chamber of Commerce website, Trustee Kagianas reported that several businesses have voiced their concern about how decisions the Village Board makes can make it difficult to grow their businesses and noted that these comments were made before the Village Board voted not to allow additional types of outdoor temporary business signage. Trustee Kagianas stated that he will share the concerns of the business owners with Village Manager Davis and Economic Development Director Patch. e. Trustee Sweas reported on the item listed below.. The Homer Harvest Days Committee has been receiving a very good response from demonstrators and vendors and the Committee continues to expand on the food vendors for the event that will be held on September 6 th and 7 th at the Trantina Farm on 151 st Street, east of Gougar Road. Returning to this year s Homer Harvest Days event will be the Illinois Live Steamers, Wax Hands Replicas and the Buckskin Rawhide Demonstrations. Some of the other displays will show spinning, knitting, shoe making and glass blowing. Life and activities of the 18 th Century children will be demonstrated. President Lincoln will be making a guest appearance along with a display of Lincoln pottery. The Committee is working on the entertainment schedule and will have that available in the near future. The next meeting of the Homer Harvest Days Committee will be held on Wednesday, May 28 th at 7:00 p.m. at the Homer Township Administration office. Village of Homer Glen 4 of 13

6 f. Trustee DeVivo reported on the items listed below.. The Recreation and Park Committee did not meet in May because of the Memorial Day Holiday. The next meeting of the Committee will be held on Monday, June 23 rd at 6:30 p.m. in the Village Board Room.. Trustee DeVivo stated that she served on the Plan Commission with Brian Stevens and noted that Brian was also instrumental in the Incorporation of the Village of Homer Glen. She thanked Mr. Stevens for his service. 3. Finance Director Sawyers Treasurer s read the report into the record with ending balances as of April 30, Director Sawyers stated that this is the last month of the Village s fiscal year and this report will be submitted for certification. These balances also reflect the Village Board approved equity transfers of $1.5 million for the General Fund to the Park and Recreation Fund and also $500,000 from the General Fund to the new EAB Tree Replacement Fund. General Fund $ 4,273, Motor Fuel Tax Fund $ 2,112, Park Fund $ 2,389, Capital Project Fund $22,354, Village Clerk No Report 5. Village Attorney No Report 6. Task Force Chairperson(s) No Report 7. Public Safety Officials No Report 8. Village Manager No Report. I. PUBLIC COMMENT 1. Richard Schroeder, W. 163 rd Street, voiced his concern about the Caton Farm and Bruce Road SRA, which has been in the planning stage by Will County for more than a decade. Mr. Schroeder noted that the specifications of the plan are to carry traffic from Rt. 30, west of the river, over to the east of the river and then drop down to Bruce Road to 159 th Street. Mr. Schroeder stated that the route being considered, that shows traffic going to 159 th Street, is a non-existing road which, if built, would cut through farmlands and take out homes and businesses. Mr. Schroeder stated that, as a member of the Will County Farm Bureau, he agrees with the Farm Bureau s position that there is a better way to plan this particular route. Mr. Schroeder stated that of the three (3) previously proposed routes, he believes the better route would have been along I-355, with Cedar Road serving as a secondary road. Mr. Schroeder read a portion of a letter sent to the Will County Transportation Committee from State Senator Christine Radogno and State Representative Renee Kosel stating that they support the planned Bruce Road interchange with I-355. The completion of this interchange, in addition to planned improvements with local roads, would eliminate the need for the middle alignment and its negative physical and financial impacts on the area. 2. Mary Ellen White, W. 163 rd Street, voiced her opposition of the Will County middle alignment for the Caton Farm and Bruce Road SRA because it will cut through some major farm properties and take some businesses off the tax rolls. Ms. White stated that she believes there are existing roads that can be put to use. 3. Kathy Schuberte, S. Pebble Creek Drive, stated that on March 4 th, while trying to take her dog for a walk, her neighbor s dog attacked and killed her dog and she was also bit. Ms. Schuberte stated that she no longer feels safe in her own neighborhood and asked the Village Board to pass a law that would not allow any dangerous or vicious dogs in Homer Glen. 7 4. Jenna Staub, 5400 Walnut Avenue, Downers Grove, stated that she opposes Will County s proposed route for the Caton Farm and Bruce Road SRA as it would go through her family s property. 5. Roselyn Zanbuto, W. Woodmill Ct., stated that her dog was attacked twice while tied up in her front yard by another dog and she believes the Village Board needs to pass an ordinance regarding vicious dogs. Mayor Daley stated that since the Village of Homer Glen does not have an Animal Control Department at this time, the Village s Public Services and Safety Committee will be discussing what alternatives the Village may have regarding dangerous and vicious dogs. The Mayor noted that the Village has a contract with Will County Animal Control to handle any dog problems or issues in Homer Glen. The public is invited to attend the Public Services and Safety Committee meetings which are held on the first Wednesday of each month. 6. Robin Burek, S. Pebble Creek Drive, stated that on April 11 th her neighbor s dog came over her 6 ft. privacy fence and attached her dog. Ms. Burek stated that when she called Will County Animal Control she was told that nothing could be done because it was her neighbor s decision as to what they could do with their dog. Ms. Burek asked the Village Board to address the issue of vicious dogs and not leave it up to Will County Animal Control. 7. Bonnie Chudyk, W. Woodmill Ct., stated that with the recent attacks by vicious dogs, she also does not feel safe walking her dog. Ms. Chudyk stated that she believes if the Village Board cannot pass a law to protect the residents from vicious dogs, then Will County should address this problem. J. CONSENT AGENDA 1. Motion to Approve the Village s Participation in the Will County Urban County Program. This item was moved to Legislation and Action Items as K7. 2. Consider for Approval Motions Pertaining to the Establishment of an Administrative Assistant Position. a. Motion to Approve the Position Description for the Administrative Assistant. b. Motion to Approve the Revised Village of Homer Glen Organizational Chart. c. Motion Authorizing the Hiring of an Administrative Assistant. 3. Motion to Approve the Village s Participation in the Will County Urban County Program. It is understood that Village s participation in the program will be for a three (3) year period. Trustee Costa made a motion to approve the Consent Agenda; second by Trustee Yukich. K. LEGISLATION AND ACTION ITEMS 1. Motion to Approve the Mayor s Appointments to the Community and Economic Development Committee, Environment Committee, Homer Harvest Days, Parade and Festival Committee, Parks and Recreation Committee, Public Services and Safety Committee and the Emergency Management Agency. Trustee Kagianas made a motion to approve the Mayor s Appointments; second by Trustee Costa. Village of Homer Glen 6 of 13

8 2. Motion to Direct the Village Manager to Sign an Engagement Letter with Mulcahy, Pauritsch, Salvador and Co. for Audit Services for the Fiscal Years Ending April 30, 2014 and Trustee Sabo made a motion to direct the Village Manager to sign an Engagement Letter; second by Trustee Costa. Trustee Sweas commented that while the Village has been satisfied with Mulcahy, Pauritsch, Salvador and Co., she asked if it is the norm to have the same auditing company for such a long period of time. Finance Director Sawyers stated that it is not uncommon to retain one auditing firm over a period of time and noted that Mulcahy, Pauritsch, Salvador and Co. list of references, as defined in their proposal, includes their duration of service with other clients and some of them are quite lengthy. Director Sawyers stated that Homer Glen is an evolving Village and, in his opinion, having the audit firm grow with the Village has made them efficient. Trustee Sweas asked if Mulcahy, Pauritsch, Salvador and Co. had all the required certifications. Director Sawyers stated that as part of the auditing firm s requirement for filing for the Village s Certification and Reporting Excellence they have to go through an audit by other CPA firms, which they have done. Director Sawyers stated that Mulcahy, Pauritsch, Salvador and Co. was also the lowest bidder. Director Sawyers stated that because Homer Glen is small and subcontracts a lot of services, the Village does not take cash for from over 90% of the transactions for permits, licenses and fees at the front counter, which minimizes the possibility of thefts or errors. On the outflow of funds the Village has a dual signature requirement on all transactions no matter what the amount. Director Sawyers stated that because the Village has a smaller staff we have issues with segregation of duties and we have successfully built a lot of controls to try to mimic bigger firms. Mayor Daley stated that he is very satisfied with the Village s auditing firm. The Mayor noted that the Village s bond rating has gone up and everything signifies that the firm is doing an excellent job and the Village continually receives the Award for Excellence in Financial Reporting. 3. Motion to Grant an Extension of the Existing Variance for the S. Erin Drive, Homer Glen, Illinois (Setta). It is understood that the first extension is for an additional 180 day period beginning on May 27, 2014 and continuing through and including November 24, Trustee DeVivo made a motion to grant the extension; second by Trustee Yukich. Motion to Assign a Class J Liquor License (Special Event License) to Homer Township Road District for the Homer Community Festival Occurring on June 26 th thru June 29 th and to waive the fee. Trustee Costa made a motion assign the Class J Liquor License: second by Trustee Kagianas. Trustee Kagianas asked if the Festival Committee had a list of non-profit groups to work the beer tent and collect tips that they will use for their fundraising. Trustee Costa stated that the Festival Committee has asked organizations within the community to fill out an application. Each organization must meet certain criteria to make sure they have a certain number of participants to work in the beer tent and provide documentation showing that they are a not-for-profit organization. Trustee Costa stated that this year the Committee has enough applicants to cover all of the time frames for working in the beer tent at this year s Homer Community Festival. Trustee Kagianas asked if the Committee has secured the food vendors and has agreements with these restaurants for this year s Festival. Village Clerk Skrobuton stated that the Committee has received applications from eight (8) local restaurants, along with a fee for their tent rental, proof of insurance and their Temporary Food Event application and fee which will be submitted to the Will County Health Department. 5. Motion to Approve the Amount of $115, to be paid to the Northern Will County Water Agency for the Village of Homer Glen s Portion of the Northern Will County Water Agency s Annual Budget for FY It is understood that the Villages of Bolingbrook, Lemont, Romeoville and Woodridge will pay for the remaining $447, Trustee Yukich made a motion to approve the payment; second by Trustee Costa. Motion to Approve the Village Board s Special Meeting, for the Purpose of Discussing the Future Use of the Woodbine Property, on Monday, June 9 th at 7:00 p.m. at the Homer Junior High School, S. Bell Road, Homer Glen. Trustee Sabo made a motion to approve the Special Meeting; second by Trustee Yukich. Trustee Sabo noted that this Special Meeting is scheduled for the day before the next Board Meeting and she does not believe that this is enough time to get the word out to our residents. Trustee Sabo stated that, in her opinion, the Village needs more time to get notice of this very important meeting to our residents and she suggested that this meeting be scheduled for another date, to be determined by the Village Board, one (1) or two (2) weeks later. Trustee Sabo stated that she feels the Village should try to get as many residents to attend this meeting as possible and two (2) week s notice is not enough. Mayor Daley agreed that the Village does want to get as many people as possible to attend the meeting to voice their opinion and he believes that two (2) weeks is adequate time. The Mayor asked Manager Davis if Homer Jr. High School had any other Monday s available, besides June 9 th for the Village to hold this Special Meeting. Manager Davis stated that the school is very busy with the school year ending and June 9 th was a date that worked for both the Village and the school had the room available. Manager Davis stated that he would have to check with the school for other available dates if the Village Board did not want to have the Special Meeting on June 9 th. Trustee Sweas noted that if the meeting date is June 9 th the Village could only place one (1) ad in the newspaper notifying the public of this Special Meeting Manager Davis stated that, historically, the Village has run a ½ page for Special Meetings and he noted that the newspaper has been contacted about running an ad. Manager Davis stated that in scheduling the meeting for July 9 th he was trying to comply with the Village Board s request to have this meeting as soon as possible; however, he can change the date if directed by the Board. Trustee Yukich suggested that s about the Special Meeting date be sent to the sports groups and local organizations. The Mayor stated that one of the reasons he would like to move this forward is because the Village has decided which architectural firm we will use to work with us to design the building for the renovation into a new Village Hall and decisions will need to be made. Trustee Sweas asked if a mailing announcing the Special Meeting date would be sent out to the residents of the Woodbine and Saddle Brook subdivisions that surround the Woodbine property. Mayor Daley stated that the Board can decide if they want to send out a mailing; however, the Village Board might want to consider how much it would cost to do everything that they want to achieve. The Mayor questioned if the Village Board only wanted to send a mailing to these two (2) subdivisions, why wouldn t a mailing be sent to every home when the purchase of the Woodbine property was made for the benefit of every taxpayer in Homer Glen. Manager Davis stated that the Village has an list of all the residents who have contacted the Village on previous occasions and an can be sent to them about the Special Meeting date. Trustee Sabo stated that she believes a mailing should be sent out to the residents who live near the Woodbine property since they will be most affected by the change in use for the property. Trustee DeVivo commented that she supports having the Special Meeting on June 9 th. Trustee DeVivo noted that developing the plans for the park property will be a long process and the Village will be reaching Village of Homer Glen 9 of 13

11 out to the residents during this entire process and more meetings will be scheduled. Trustee DeVivo stated that she believes the main thing the Village should be thinking about at this time is renovating the Woodbine building into a Village Hall and developing the land into a future park is the next step in this process. Trustee Sabo questioned the exact purpose of this Special Meeting and asked what the Village wants to know from our residents. Trustee Sabo asked if the input from the residents who attend this Special Meeting will determine the future use or direction the Village will follow in developing the park property. The Mayor stated that the purpose of the meeting is to discuss the future use of the Woodbine property and get input from the public. The Mayor noted that the motion before the Village Board tonight is only to approve a date for the Special Meeting. 7. Motion to Direct the Mayor to Submit a Letter to the Will County Division of Transportation, Providing Feedback from the Village of Homer Glen Regarding Sidewalk Limits Along Bell Road, from 151 st Street to 159 th Street, in Response to the County Engineer s Probable Cost Estimate. Trustee Sweas made a motion to direct the Mayor to submit a letter to the Will County Division of Transportation; second by Trustee Yukich. Trustee Sweas stated that the Village is extending the sidewalk to the southwest corner of 151 st and Bell Road and the Village will be responsible for approximately $27,000 to $30,000. Trustee Sweas asked if the Village could stipulate that, if and when a developer does decide to build on that property, the Village would receive some type of compensation for putting in the sidewalk. Attorney Sterk stated that the Village could draft a recapture agreement with the developer of the property, otherwise the Village would have to put a special service area on the property. Attorney Sterk stated that this does not have to be included in the motion for Board approval. L. WORKSHOP 1. Discussion of the Village s P-1 Zoning District. Mayor Daley stated that at the last Board meeting Trustee Sabo asked that the Village s P-1 Zoning District Classification be placed on the next Board Meeting agenda for discussion. The Mayor noted that Village Village of Homer Glen 10 of 13

12 Staff put together information about the P-1 Zoning Classification, as unanimously approved by the Village Board in May 2012, for further discussion by the Village Board. Manager Davis stated that the Village Board approved the P-1 Zoning Classification in 2012 when rezoning the library because a public zoning district classification did not exist in Homer Glen. Manager Davis stated that the P-1 Zoning Classification would have made the process of building an addition to the library simpler for our government partners to go through the development review with the Village. Manager Davis stated that any development proposal of a government entity in the P-1 Zoning Classification will have to comply with the Village s ordinances and if, during the review process, any part of their plans do not comply with an ordinance, the government entity would have to come back to the Village Board. Trustee DeVivo stated that when the Village of Homer Glen was first incorporated we were using Will County s ordinances and we kept finding things in our ordinances that needed to be amended. Trustee DeVivo stated that she believes creating the P-1 Zoning Classification was a good solution to finally put something in place that dealt with government properties. Trustee DeVivo stated that, in her opinion, the P-1 Zoning Classification serves the purpose and she believe that it does not skirt any issues since they have to abide by the Village ordinances. Trustee Sabo asked the Village Manager to state the permitted uses for the P-1 Zoning Classification. Manager Davis stated that permitted uses of the P-1 Zoning Classification are public institutional government buildings and schools. Trustee Sabo stated that the Lighting Ordinance was not included in the P-1 Zoning Ordinance. Erin Venard, Assistant to the Village Manager-Planning and Zoning, stated that the Lighting Ordinance is a separate ordinance and the P-1 Zoning District Classification is a part of the Zoning Ordinance and is included in the table of uses. Manager Davis stated that the number one benefit from the P-1 Zoning Classification, in the case of public buildings, is lot coverage and the number one concern with a public building and a school is the ancillary uses of ball fields, lights and things of that nature. Manager Davis stated that if someone wanted to put up a football stadium in a P-1 Zoning District that did not meet the Village s lighting requirements they would have to come before the Village Board for a separate action on lighting. Trustee Sabo asked if the Village Board will be made aware of any changes in use for the property in a P-1 Zoning District, besides the construction of a building, before the process begins. Manager Davis noted that when it comes to the schools, the School District s Regional Superintendent of schools has a lot of control over permitting on school public property. Trustee Sabo voiced her concern that since this is a permitted use and a lot of decisions that will be made before it reaches the Village Board, she believes Village Board should have more input. The Mayor stated that the Village Board will have the opportunity to review any plans that do not meet Village codes. Trustee Sabo commented that by the time the Village Board sees a plan the governmental applicant will have spent a lot of time and money on the project. Trustee Sabo stated that she believes it is unfair to the applicant and the Village Board not to be able to discuss what will be built on a piece of property. Trustee Sabo stated that she feels that a Permitted Use means that the Village Board will not be given the opportunity to make any decisions in a planned project until it gets to the Board level. Trustee DeVivo stated that these government properties are purchased with taxpayers money and questioned why the Village Board would have to review every little detail. Trustee DeVivo stated that she Village of Homer Glen 11 of 13

13 believes the Village has enough control and this is why the Board approved the P-1 Zoning Classification in Trustee Yukich stated that when the library was putting an addition onto their building they had to follow all of the Village ordinances. Manager Davis stated that because the P-1 Zoning Classification is a Permitted Use, the only time an issue will come before the Village Board is if something does not comply with Village ordinances or if there is a map amendment required, which was the case when Highway Commissioner DeVivo was not able to conform with the Village s ordinance regarding parking in his plans for an addition to the Highway Department building. Manager Davis noted that if the map amendment had not been needed and Commissioner DeVivo had been able to conform to the parking ordinance, he could have moved forward and the Village Board would not have needed to vote on his addition. Manager Davis commented that the goal of the P-1 Zoning Classification was to make it simpler for our sister governmental entities so they did not have to go through months and months of municipal review. Trustee Yukich stated that he believes that the issue with the P-1 Zoning Classification is that the Village Board may never see any plans for these permitted uses and will not have an opportunity to discuss the plans for these government building projects. The Mayor stated that currently a contractor submits the plans to our Building Department for review and if the plans are in compliance with Village ordinances, nothing is reviewed by the Village Board. Trustee Yukich stated that he is only concerned about the Village Board reviewing the plans for government projects in the P-1 Zoning Classification. Mayor Daley stated that the Village Board will be made aware of any plans submitted for a government agency project. Trustee Sabo voiced her concern that the Village Board will not see any plans prior to the project being started and stated that she is specifically referring to the Woodbine property. Manager Davis stated that since the Village owns the Woodbine property it will be developed with the Village Board s consent. He stated that the Woodbine property is not currently zoned P-1. Trustee Sabo stated that she believes the Village Board should be kept informed through all phases of any government development in the P-1 Zoning District. M. OLD BUSINESS Trustee Costa stated that this past April the Village Board had a discussion about needing more time to review the Board packets due to the amount of information provided on the numerous items included on the agenda. Trustee Costa noted that the Village Board meets the 2 nd and 4 th Tuesday of every month and asked if the Board would consider changing the meeting dates to the 2 nd and 4 th Wednesday in order to give the Board additional time to review the packets. Trustee Costa noted that the Homer Harvest Days Committee meets on the 2 nd Wednesday of the month and asked if Trustee Sweas could ask the Homer Harvest Days Committee to change their meeting date so the Village Board could meet on the 2 nd Wednesday. Trustee Sweas stated she will ask the Homer Harvest Days Committee members at tomorrow s if they would consider changing their Wednesday meeting date. The Mayor stated that the Village Board could change the meeting dates and asked Manager Davis if there were any conflicts with moving the Village Board meetings from Tuesday to Wednesday. Manager Davis stated that occasionally there may be a conflict on the staff level with conferences that begin on Wednesday, but he believes it can be worked around to accommodate whatever the Board s wishes are. 14 N. NEW BUSINESS 1. Consider Letter of Opposition to Will County s Current Proposed Route of the Caton Farm and Bruce Road SRA. Mayor Daley stated that Trustee Sabo has asked the Village Board to direct the letter, included in the Board s packet, to Mr. Bruce Gould of the Will County Department of Highways. The letter continues to communicate the Village s long-standing opposition to the Caton Farm, Oak Avenue, Bruce Road SRA s middle alignment which would bring the proposed SRA north, to 159 th Street, less than ¼ mile west of Cedar Road. The Mayor stated that he is in full support of sending this letter to Will County. Manager Davis asked if the Village Board could vote to send the letter so that it would be an official part of the Village s records. Trustee Sabo made a motion to direct the Mayor to sign and send a letter to Bruce Gould, PE Director of Transportation and County Engineer, Will County Department of Highways, opposing the County s current proposed route of the Caton Farm and Bruce Road SRA; second by Trustee Yukich. Trustee Sabo stated that besides being sent to Mr. Gould, the letter should be copied to Will County Executive Larry Walsh, County Board member Walter Ademic-Chair of Public Works and Transportation, County Board members Steve Balich and Mike Fricilone. Trustee Sabo asked if the letter could also be send to the TCC Committee (Transportation Corridor Committee) which consists of Lockport Township, Plainfield Township, Homer Township, Homer Glen, Crest Hill, Joliet and New Lenox. Trustee Sabo suggested that a copy be sent to the Farm Bureau, who will be having a Special Meeting on June 11 th at 10 a.m. at 100 Manhattan Road in Joliet, as they are strongly opposed to this proposed route. Mayor Daley asked Trustee Sabo to give the list to Manager Davis so copies of the letters can be sent. O. ADJOURNMENT Trustee Costa made a motion to adjourn the meeting; second by Trustee Sabo.
