1 - MINUTES - CHASKA CITY COUNCIL 1. Call to Order The meeting was called to order by Mayor Windschitl at 7:00 pm. 2.Pledge of Allegiance 3. Roll Call Roll call was taken. Present: Councilmembers Boe, Geisler, Rohe, Schulz, and Mayor Windschitl. Councilmember absent: none. Also Present: Matt Podhradsky, City Administrator; Matt Clark, City Engineer; Kevin Ringwald, Community Development Director; Liz Hanson, City Planner; Nate Kabat, Assistant City Administrator; and, Luke Melchert, City Attorney. 4. Adopt the Agenda Motion by Councilmember Geisler, second by Councilmember Boe, to adopt the agenda as presented. 5. Visitor Presentation Victoria Boy Scout Troop 337 Nick Fasching Scoutmaster and Merit Badge Counselor for Citizenship of the Community Nick Fasching introduced the Victoria Boy Scout Troop 337 Senior Patrol Leader. Andrew Fasching, Senior Patrol Leader, commented Citizenship of the Community teaches them how to be a good citizen and how to give back to the community. They are at the meeting to observe what goes on in the City and what takes place at a City Council meeting. Mayor Windschitl requested each member of Boy Scout Troop 337 introduce themselves. Councilmember Rohe inquired what the age range was in the Troop and if it starts with Indian Guides, and goes on to Cub Scouts and then Boy Scouts. Mr. Fasching responded the ages range from the end of fifth grade through the age of 18. City Administrator Podhradsky stated it Boy Scouts start with Lion and Tiger Cubs. Councilmember Geisler inquired if their group is merged with other Cities. Mr. Fasching explained a lot of their members are from Victoria because that is where the Troop originated. They are now getting new members from Chaska and they switched their meeting place to Chaska.

2 PAGE 2 6. Minutes Motion by Councilmember Boe, second by Councilmember Schulz to approve the minutes of the September 11, 2017 City Council meeting. 7. Consent Agenda City Administrator Podhradsky requested item 7(b) be approved contingent upon the City receiving back sufficient assessment agreements in order to move forward with the contract. Mayor Windschitl requested item 7(b) be pulled from the Consent Agenda, and put on the Regular Meeting Agenda as item 8(a). Motion by Councilmember Boe, second by Councilmember Geisler to approve the amended Consent Agenda: A. Adopt Resolution No , Financing Certain Proposed Projects and Establishing Compliance and Reimbursement Bond Regulations under the Internal Revenue Code Motion to adopt Resolution No , Relating to Financing of Certain Proposed Projects; and, Establishing Compliance with Reimbursement Bond Regulations under the Internal Revenue Code. B. Adopt Resolution No , Awarding Bid for the NE Collector Road Project to Ryan Contracting Company Motion to adopt Resolution No , Awarding the Bid for the NE Collector Road Project to Ryan Contracting Company in the Low Bid Amount of $1,701, a. Adopt Resolution No , Awarding the Bid for the NE Collector Road Project to Ryan Contracting Company in the Low Bid Amount of $1,701, Motion by Councilmember Roe, second by Councilmember Schulz to adopt Resolution No , Awarding the Bid for the NE Collector Road Project to Ryan Contracting Company in the Low Bid Amount of $1,701,955.60, contingent upon the City receiving a sufficient number of assessment agreements. 8. Adopt Resolution No , Approving the Preliminary Site Plan and Conditional Use Permit (CUP) for Bavaria Downs Event Center at 3919 Bavaria Road/A BULAE/PC #17-20 City Administrator Podhradsky introduced the item to the Council. City Planner Hanson presented the item to the Council. Mayor Windschitl inquired what the sight line issue is that was brought up by the neighbors. City Planner Hanson responded there is some openness between the edges of the property and the adjacent neighbors. The applicant has indicated they would like to help address those concerns.

3 PAGE 3 In response to Councilmember Geisler, City Planner Hanson stated they will do an onsite septic system since they cannot connect to City sewer. In response to Mayor Windschitl, City Planner Hanson pointed out the general area where the permanent auxiliary structure would be on the property. She stated it will be built up to code and they will be finalizing the actual design for the final site plan approval. It will not be a tent because they need to have it for longer than 180 days and it can hold up to 400 people. Mayor Windschitl inquired which direction people are told to go to get to the site. City Planner Hanson responded it depends which direction they are coming from, but a majority of people will probably use Highway 5. Councilmember Geisler inquired if the cropland along the side of the road will continue to be farmed. City Planner Hanson responded the areas of the cropland that are not impacted will continue to be farmed. Councilmember Geisler inquired if sprinklers would be added inside the house. City Planner Hanson confirmed they would be added. Mayor Windschitl commented the number of cars listed for a couple of hundred people seems low. He realizes there have been traffic studies done and there will only be traffic on weekends, but they need to be kind to the neighbors. He has heard from areas around the wineries that have issues with traffic. City Planner Hanson responded some people car pool, and some use other services such as Uber into the site. The numbers are determined from the applicant s existing venues. Community Development Director Ringwald stated this site is on a collector road which is design to handle 20,000 cars a day. City Engineer Clark stated they will be taking into account a sensitivity analysis that addresses traffic. It will look at what an offset of traffic coming from the south would do as well as if people were coming from the north. This will help them determine what is needed for mitigation, access, and spacing for the venue as well as increased traffic volumes due to future development. There is no public access from the site to 82 nd. Community Development Director Ringwald stated the primary access is off of Bavaria Road. The project is phasing in and by the time the third phase comes, they will have a good idea on how traffic is functioning.

4 PAGE 4 Councilmember Geisler stated with a property this big, they should be able to make room for more parking if needed. She inquired where the sister company is located. City Planner Hanson responded they have a venue located in St. Paul and in Minneapolis. If this is approved tonight, the applicant will have to come back for final site plan approval. Mayor Windschitl inquired when the venue will become operational. City Planner Hanson responded they hope to hold weddings as soon as next summer in Venue 1. Community Development Director Ringwald stated a public hearing was held at the Planning Commission meeting on this application, but there is not a public hearing at this meeting. Motion by Councilmember Rohe, second by Councilmember Geisler, to adopt Resolution No , Approving the Preliminary Site Plan and Conditional Use Permit for Bavaria Downs/A BULAE/PC# Adopt Resolution No , Approving Maximum Property Levy Payable for 2018 City Administrator Podhradsky presented the item to the Council. Mayor Windschitl commented it is good and it is lower than they expected. They have met what was needed for the CIP that will take care of things that have not been done for years. It is exciting to look at things that will happen in five years. City Administrator Podhradsky stated at the work session they projected a $48.00 increase per residences, but after all the numbers were in, it went down to $ Motion by Councilmember Boe, second by Councilmember Geisler, to adopt Resolution No , Adopting the Proposed 2018 Budget and the Proposed Assessed-2017 Payable-2018 Maximum Property Tax Levy. 10. Bills Motion was made by Councilmember Rohe, second by Councilmember Schulz to approve the bills. Roll call was taken. Voting aye: Councilmembers Geisler, Boe, Rohe, Schulz, and Mayor Windschitl. 5 PAGE 5 Announced Back to the Block will take place on Saturday, September 23 from 10:00 am to 5:00 pm. This celebration is for the opening of Second Street and the ribbon cutting will be at 12:00 pm on the east side. Councilmember Rohe Inquired if the City takes care of weeds that are creeping over into the street. He has noticed it on Hundertmark Road. Councilmember Boe commented he has also noticed it in the seam between the curb and the street. City Administrator Podhradsky responded he will look into it and respond via . Mayor Windschitl commented someone asked him what the City sprays on the sidewalks so they may be been out spraying weeds. Councilmember Boe Commented there are a few concrete flower boxes that have a lot of weeds on them. City Administrator Podhradsky responded he thinks they were planning on taking care of them this week. Mayor Windschitl stated on Second and Pine, they just put burlap down and it does not make sense. Commented they have sent a few Chaska electric workers to help in Florida and he would love to have them come to a meeting and share their experiences when they are back. City Administrator Podhradsky stated they do plan to have them share their experiences, along with Chief Wiebe. Mayor Windschitl stated they are going to be heading home this week after a 14-day deployment. Commented it is great they are planning to repair two to three miles of trails each year. He inquired if they are planning to add signage. Community Development Director Ringwald responded the wayfinding project is being finalized. Announced Carver County is having a ribbon cutting at 6:00 pm for a one mile stretch on the River Bluffs Regional Trail east of Chaska. People can meet at the courthouse at 5:45 pm and they will be transported by bus to the ribbon cutting location. Assistant City Administrator Kabat Commented there has been a great partnership between the City, Southwest Chamber of Commerce and Downtown Business Alliance for the Block Party that will take place on Saturday. Council member Geisler asked if the city has added a link to their website on the city s website. He will check to see if there is a link to the Downtown Business Alliance s website on the City s website. Commented they are expecting to see an application submitted by the brewery for a CUP in the next month or two. Councilmember Schulz stated it would be great to see that before the end of City Administrator Podhradsky Commented work is being done at the Red Bench Bakery. Councilmember Boe stated it should be opened at the end of October or early November. Mayor Windschitl

6 PAGE 6 Commented Chief Wiebe was in the Florida Keys and was in charge of a pod where they distribute supplies and water. He will be home this week after a 14-day deployment. He read an from Kissimmee, Florida that expressed thanks to the electrical workers for their help in restoring power to the area after Hurricane Irma. The electric workers, Leo Rohlik and Jordan Storms, will also be home this week. City Administrator Podhradsky stated they are also considering sending workers to the Caribbean islands. This has given the workers experience they would have never had before, it is the right thing to do, and it develops relationships with workers in Florida. If anything were ever to happen in Chaska, the electrical workers in Florida would be here to help out. Commented they bid out two construction projects recently and they were very competitive. It will save a lot of money for them as a City. Inquired if bids have come in for Veterans Park. City Administrator Podhradsky responded they were set to come in soon. Commented the Chaska Cubs had their golf tournament today. The weather was miserable, but there was a great turnout. Announced Guardian Angels has their annual festival on September 30 and everyone is welcome to stop by. Inquired about the road condition on Stoughton Avenue and when it will be fixed. City Administrator Podhradsky responded he will look into it. 12. Adjourn Motion by Councilmember Boe, second by Councilmember Schulz to adjourn the meeting at 8:37 pm.
