Call to Order The meeting was called to order by Mayor Windschitl at 7:00 pm. 2.Pledge of Allegiance Mayor Windschitl requested a moment of silence in memory of the victims affected by the shooting in Las Vegas. 3. Roll Call Roll call was taken. Present: Councilmembers Boe, Geisler, Rohe, Schulz, and Mayor Windschitl. Councilmember absent: None. Also Present: Matt Podhradsky, City Administrator; Matt Clark, City Engineer; Nate Kabat, Assistant City Administrator; and, Luke Melchert, City Attorney. 4. Adopt the Agenda Motion by Councilmember Rohe, second by Councilmember Schulz, to adopt the agenda as presented. 5. Visitor Presentation Tobacco 21 Cecilia Laube from Strategic Transformation Consulting Cecilia Laube, referred to a summary provided on page 5 of the meeting packet, and highlighted information related to raising the tobacco sales age to 21. She requested this topic be addressed at a future work session for further discussion. Dr. Richard Scott, Chief Public Health Officer for Carver County, provided statistics on smokers and reported on the effects of nicotine on youth. He stated raising the tobacco sales age to 21 is one of the best ways to protect kids from a lifetime of addiction. Mayor Windschitl inquired if this has been presented to Carver County. Dr. Scott responded they hope to in the future. The best way to get this initiative going is to start local, and Chanhassen is also considering this as well. The goal is to have this approved across the State. Mayor Windschitl commented on the statistic that 65 percent of young adult ages support raising the tobacco sales age to 21. Dr. Scott stated making it harder for youth to purchase tobacco will help them to make healthy choices that are not based on peer pressure. Most young kids often get their tobacco from 18- year-olds who are still in high school. Raising the tobacco sales age to 21 will aid in prevention as well.

2 PAGE 2 Councilmember Rohe commented it is important to get the tobacco out of the high school. Smoking, even in moderation, increases a person s odds for cancer and other health conditions. Ms. Laube pointed out tobacco is often just the beginning of a long and destructive journey of addiction and her biggest concern is exposure. Councilmember Rohe commented it is important to get the other communities on board as well because there are a lot of questions that need answers. Dr. Scott commented they are trying to get the conversation going. This initiative has been passed in Edina and St. Louis Park and they will be meeting with Chanhassen. They hope to have the County adopt this as well. Councilmember Rohe stated this topic has merit and looks forward to further discussion on it. Sue Sindt, 1445 Skillman Avenue East, Maplewood, Tobacco Harm Reduction for Life, suggested they talk with other Cities that have already adopted this ordinance. The County does not provide issue is that this addresses the age of purchase, not age of use. Youth will find someone to purchase for them, or they will purchase in a neighboring City that allows it. This will take income from local stores and many Cities are waiting for the State to take action. The House of Representatives conducted a survey at the State Fair and it showed a lot of people support raising both the purchase and smoking age. Smoking age is a State issue, and purchase is a City issue, not a County issue. She stated she sells flavored nicotine and many people use vaping as an exit strategy from harmful tobacco products. Nicotine loses its addictive properties in absence of the other chemicals found in cigarettes. If they restrict access to tobacco products, they would also be restricting access to the less harmful products. She suggested they come up with strategies other than just passing a law. Councilmember Rohe stated St. Louis Park provided a copy of its ordinance, and it shows they do have the ability to levy a misdemeanor on anyone furnishing tobacco or related devices to persons under the age of 21. He inquired if it is the same consequence as someone purchasing alcohol for someone underage. City Administrator Podhradsky explained it is the same concept as the social host ordinance that Chaska has. They will gather information and present it for discussion at a future work session. Councilmember Boe commented he would like to know which Cities have and have not adopted this ordinance. Mayor Windschitl stated Hutchinson, Elk River, and Detroit Lakes have voted not to adopt this ordinance and North Mankato is hesitant to due to discrimination issues. Jack Pallas, 845 Livingston Court, in education for 30 years, commented his siblings have all been smoking since they were fifteen and this is a worthwhile topic to talk about.

Consent Agenda Motion by Councilmember Rohe, second by Councilmember Boe to approve Consent Agenda items a and b: A. Public Assessment Hearing: Adopt Resolution No , Adopting the Assessment Roll for the NE Collector Road Project, and Resolution No , Approving Site Assessment Agreements Related to the Project City Administrator Podhradsky presented the item to the Council. City Engineer Clark reported the construction contract will be awarded pending approval of this resolution. City Administrator Podhradsky stated they received a really good bid, the landowners have been great to work with, and City Engineer Clark has done an excellent job. Mayor Windschitl opened the public hearing at 7:34 pm. Mayor Windschitl closed the public hearing at 7:35 pm. Motion by Councilmember Boe, second by Councilmember Geisler, to adopt Resolution No , Adopting the Assessment Roll for the Chaska Creek Boulevard Street and Utility Improvements. Motion by Councilmember Schulz, second by Councilmember Boe, to adopt Resolution No , Approving the Site Assessment Agreements for the NE Collector Improvement Project.

Public Assessment Hearing: Adopt Resolution No , Approving the Imposition of Service Charges for the 2018 Chaska Downtown Special Services District City Administrator Podhradsky introduced the item to the Council. Assistant City Administrator Kabat presented the item to the Council. Krista Flemming, owner of Chaska Mill Building, reported the funds they have acquired allowed them to hold events, improve partnerships and communication, rebrand the Chaska Downtown Business Alliance (CDBA), and support their Administrator. They have continued their partnership with the City on construction issues and help the businesses get more notoriety to the area. Jen Angell, CBDA Administrator, stated the revitalization of Second Street coincided with the new website and logo. The new website will launch a business portal this week and they have started to record their meetings so that businesses have access to what is being discussed. The hope to increase the community presence and retail in the downtown area. Mayor Windschitl commented they can see momentum of things happening, word is getting out, and people are showing up. There are a lot of positive things happening in downtown Chaska. He announced Ms. Flemming just had a ribbon cutting for her business in the Mill Building. Ms. Flemming stated she holds retreats in the space at the top of the mill, which is full through The space that just opened will be used as an event space. Mayor Windschitl opened the public hearing at 7:49 pm. Mayor Windschitl closed the public hearing at 7:50 pm. Motion by Councilmember Rohe, second by Councilmember Geisler, to adopt Resolution No , Approving the Special Services and Service Charges for 2018 with the Chaska Downtown Business Alliance to Serve as District Management Entity for the Chaska Downtown Special Service District. 10. Bills Motion was made by Councilmember Boe, second by Councilmember Schulz to approve the bills. Roll call was taken. Voting aye: Councilmembers Geisler, Boe, Rohe, Schulz, and Mayor Windschitl. 5 PAGE 5 Councilmember Boe Commented his thoughts and prayers go out to everyone affected in the Las Vegas shooting. Commented Angelfest at Guardian Angels was well attended. Commented the Oktoberfest Bonspiel took place at the Chaska Curling Center and was well attended. They won first place in the second bracket. Congratulated City Administrator Podhradsky on running the Twin Cities Marathon and Assistant Administrator Kabat on running a 10k. Councilmember Rohe Requested a work session to look at the ward system. He is not advocating for any change, but it may be time to look at it. They are not getting people to run and with an at-large system there may be more interest from people to run. As they grow as a community, the ward system may be outdated. There are benefits to having a ward system, but it may not be serving the best interest of the entire community. Councilmember Schulz commented they have looked at all the topics as a group and not as specifically representing a certain area. Councilmember Boe commented he sees both sides. The at-large system would allow people to run and not feel like they are running against someone they know. Mayor Windschitl commented with an at-large system, they are running against each other and it may create an issue. All the Councilmembers could come out of southwest Chaska and there is no voice for other areas. He sees as many negatives for moving away from the ward systems as he does positives. They may need to conduct a City-wide survey and it needs a lot of input and discussion. Some Cities expand their City Council to include at-large seats. City Administrator Podhradsky commented they have looked at this prior to this Council, but it did not go anywhere. The ward lines will change based on the census. Councilmember Geisler stated she would like to see which Cities similar to Chaska in population are ward or at-large. Councilmember Rohe commented the objective would be to determine how they draw good talent to run and they want to make sure they are cultivating the next generation of leadership. He suggested they do leadership training at the City level to get people involved. A lot of the issues that come up with other Cities are because of one-issue candidates. They need to show that the great things they get to do as Councilmembers far outweigh the bad. Councilmember Geisler commented she has been invited to speak to students at the middle school about women in government and suggested they see if the high school would also be willing to add this to their curriculum. City Administrator Podhradsky suggested they look at the pros and cons of at-large versus the ward system, and other options as well. Mayor Windschitl commented it is hard to find people to volunteer in general and it is a bigger problem than just in Chaska. The Council agreed to look at this further at a future work session. Councilmember Geisler Requested an update on the Ernst House. City Administrator Podhradsky responded that now, with the Ess House having been torn down after the fire, they are currently looking at the entire site as one. They have met with a couple of brokers on how to maximize the value of the Ernst House. With the Highway 41 project, they are looking at how to maximize parking behind the Ernst House that could serve the commercial

6 PAGE 6 district. They have people make sure there are no issues with the house and that it is secure. It is not currently on the market and they are trying to develop a concept plan over the winter they can share with a broker. The City owns from the back of Clearsoft all the way to the building on the corner. A person could not tear down the Ernst House because it is historically protected. Councilmember Boe commented the roof over the porch looks like it is sagging. City Engineer Clark Commented work needs to be done to upgrade the signal on the 61 project and the signal will be down from 9:00 am to 1:00 pm. Mayor Windschitl stated they need to be relamped because they are hard to see. City Engineer Clark responded the State has money programmed to upgrade the signals with the Highway 41 project. The County and State do operate the signals, but it could fall under a cooperative agreement with the City for upgrades. The 61 portion will be open to Pine Street by next week, weather permitting. City Attorney Melchert Commented he would like to be part of the discussion regarding the tobacco sales age and the ward system. City Administrator Podhradsky Provided an update on A BULAE. They will be meeting tomorrow to go over the cost of extending the City s water line to provide for the required fire sprinkler system in the house. In the City s CIP, they have had the goal to loop the water system so it goes up to the north to back feed the Arbor Lake booster station. They have always thought it would come with the development of McKnight Road, but there is a potential opportunity to do it with this project. They will look at if a public/private partnership is possible to address the issues for the project as well as for the City. Councilmember Rohe commented they should look into it and this project on that property is perfect. Provided an update on the credit card system to be paired with utility billing. He provided a handout to the Council, and stated they have contractors that will bid on it. He requested the Council him with questions and comments. With the Data Practices Act, the best thing to do is not store credit card information and have a private vendor come and provide the service. Budget billing is not part of this, but he will look further into it. Commented it was the one-year anniversary of the Ryder Cup this week. Assistant City Administrator Kabat Reported the Second Street event went very well. He heard good feedback from the downtown businesses, they saw good crowds, it was a good opportunity to show people there are a lot of businesses downtown, and it was great to partner with the Parks and Recreation Department. The Southwest Metro Chamber managed the Donut Run. Councilmember Boe commented it was very popular. Mayor Windschitl Announced long time Chaska resident Ed Brose passed away.

7 PAGE 7 Commented he will not be at the Council meeting on October 16. Councilmember Rohe stated he will not be at that meeting either. City Administrator Podhradsky stated if they do not have a quorum, they can vote on items at the meeting on October 30. Announced Homecoming will be on Friday and due to construction, the parade route will be different. Commented Chaska football is rated number 3 in Class 5A. Announced the upcoming Council meetings will be on October 16 and October 30. At the meeting on October 30, Chief Wiebe and the two lineman will be present to talk about their experiences in helping with the hurricane in Florida. 12.
