1 SUMMARY RECORD OF THE 103 rd MEETING OF THE COMMITTEE FOR SPIRIT DRINKS ON 15/06/ President: Delegations: J. ZORRILLA TORRAS All delegations were present, except Cyprus and Malta 1) ADOPTION OF THE AGENDA The agenda was adopted by all Member States and the Chairman opened the discussions. 2) NEW GEOGRAPHICAL INDICATIONS (GIS): STATE OF PLAY The Commission informed the Member states that: "Újfehértói Meggypálinka" (Hungary) The technical file was published in the Official Journal of the EU of for the launching of the objection procedure. "Pisco" (Peru) - The technical file was published in the Official Journal of the EU of for the launching of the objection procedure. "Russian vodka" (Russia) and "Ron de Guatemala" (Guatemala) - some clarifications have been asked by the Commission to the applicants. 3) EXCHANGE OF VIEWS ON A DRAFT COMMISSION REGULATION AMENDING ANNEXES II AND III OF REGULATION (EC) No 110/2008 FOR THE INCLUSION OF THE GI "SOMERSET CIDER BRANDY" The Commission presented a draft Commission Regulation for the registration of the new GI "Somerset cider brandy" (UK). Some MS did not agree with the inclusion of a derogation for the use of the indication "cider brandy" for products which belong to the category of cider spirits. In addition, they could only accept the registration of the GI "Somerset cider brandy" with the obligation of indicating the sales denomination "cider spirit". The Commission proposed to continue to examine other possibilities that could be satisfactory for all MS before proposing a new draft. 1

2 4) EXCHANGE OF VIEWS ON A WORKING DOCUMENT OF THE COMMISSION CONCERNING A COMMISSION REGULATION ESTABLISHING DETAILED RULES FOR THE IMPLEMENTATION OF REGULATION (EC) No 110/2008 The Commission presented a working document on Commission implementing rules for the use of compound terms for spirit drinks and procedural rules on geographical indications of spirit drinks. As regards "compound terms", most of Member States expressed their satisfaction for the initiative of the Commission, reiterating their preference, already expressed in previous meetings, for a regulation rather than guidelines. They pointed out that many points needed clarifications and that their detailed comments will be addressed shortly to the Commission services. Only few MS expressed their opposition to the establishment of implementing rules, but indicated that they would send their comments on the draft. In relation to the provisions on procedures relating to geographical indications for spirit drinks, the Commission services stressed that, in order to harmonise the procedures, the text on GIs was drafted following the same structure and criteria than that related to wine and other agricultural products, underlying that the appropriate adaptation to the particularities of spirit drinks had been made. Most of the MS stated that they will also send to the Commission comments on this part of the text. 5) AOB Commission: Alignment of Regulation (EC) No 110/2008 to the Lisbon Treaty The Commission services informed the MS that the modification of Regulation (EC) No 110/2008, in order to align the provisions on comitology with the Lisbon Treaty, was going to be carried out before the end of Germany: Modification of the Regulation on additives Germany informed the Commission that some modifications were necessary to the regulation on additives, in order to extend some rules to fruit spirits. The Commission services replied that a detailed and substantiated request should be addressed directly by Germany to DG SANCO, responsible for that Regulation. Germany: Croatian GIs Further to Germany's request to explain the type of spirit drinks to be protected through the Accession Treaty of Croatia, the Commission services presented the list of names proposed by Croatia and the outcome of the public consultation held in the framework of the objection procedure, whose deadline was reached on 14 th June The Commission also explained the meaning of the terms contained by the geographical indications requested and the categories of spirit drinks they correspond to. Austria: Use of the term Jagertee in Italy Austria asked to the Commission an update on the ongoing procedure concerning the use, by some Italian producers, of the term Jagertee, which is an Austrian registered GI. 2

3 The Commission answered that the other associated services are being consulted and that any development will be communicated to Austrian authorities. France: Inclusion of the category "Absinth" in Regulation (EC) No 110/2008 France requested the inclusion of the category "Absinth" in Annex II to Regulation (EC) No 110/2008, adding that a formal request was sent by mail to the Commission. The Commission answered that the request will be examined and encouraged FR to consult other interested MS on this issue in order to propose a definition on which all concerned parties agree.
