1 THE DISTRICT DOCKLANDS Santa Claws Competition Terms and Conditions Promotional Period The competition opens at 11am Monday, 4 December 2017 and closes 5pm Sunday, 24 December How to enter To enter the District Santa Claws competition, customers must do the following during the Promotional Period: 1. Spend $20.00 in any store at THE DISTRICT DOCKLANDS 2. Present their receipt(s) to the campaign staff at the Square near H&M. 3. Fill in their details and place into the barrel located in the Square between 11am and 5pm Monday to Thursday, 12pm-8pm Friday, and 11am-5pm Saturday and Sunday for a chance to be drawn to participate in The Claw to win a prize. * There will be 11 draws each day except Fridays when there will be 15 draws. Two winners will be selected for each draw, and after each draw the barrel will be emptied. Rules of Entry for The Claw Entrants must have a minimum height of 140cm and a maximum weight of 120kg The winner/proxy must comply with the following rules whilst in The Claw, or they will be disqualified from the competition: a. No pulling on the claw. b. No Kicking balls. c. Only use hands to grab a ball. d. Only one ball can only be grabbed whilst in the air. 1. The winner/proxy will be strapped in and will be raised. 2. Once the winner/proxy indicates they are in their desired position (after a 10 second countdown) the first whistle will blow and the 30 or 45 seconds commences) 3. The winner/proxy is then lowered, taking approximately seconds. 4. The end time will be indicated by a second whistle being blown once by the compere after the 30 seconds and the winner/proxy will be raised. 5. When the whistle is blown the winner/proxy must immediately stop grabbing for any balls. Failure to do so will result in loss of the ball collected and the contestant will be disqualified from the competition. 6. Any balls dropped before existing The Claw will not be awarded to the winner. 7. Each ball is equal to one prize. 8. The prize of the ball will be awarded to the contestant. 9. The winner must sign a Prize Receipt form to confirm receipt of their prize voucher. Conditions of entry 1. Information on How to Enter forms part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions. 2. Customers will receive one entry form for every $20.00 receipt presented to the staff member. 3. Receipts can be added together to total the required spend if the purchases were made within the Promotional Period. 4. Customers may enter more than once, but each entry requires the specified spend of $20 or more. 5. Entry is only open to Australian residents aged 18 years or over.

Employees of and their immediate family, tenants in the centre and their immediate family, the staff of tenants in the centre and their immediate family, the proprietors and staff of companies involved in the production, publishing and administration of this promotion and their immediate family are not eligible to enter. Immediate family means parents, siblings, spouse, children and grandparents. Tenants means lessees, licensees and in the case of a corporation, their directors 7. No responsibility is accepted for late or lost entry forms or misdirected entries. 8. Prize claims or entries will not be accepted via mail. 9. Entries that are illegible, forged, mutilated, copied or tampered with in any way will not be considered for prize redemption. 10. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. 11. Receipts from partial lay-bys, gift voucher/card purchases, interest free purchase payments, eftpos and ATM receipts, bill payments such as the payment of credit card bills, bank transactions, bank fees and charges and service bills (such as gas, electricity, rates and phone bills), undated receipts, receipts dated outside the Promotional Period and receipts which have already been used cannot be used to redeem an entry form. 12. The Promoter reserves the right to mark a receipt as used when redeeming an entry form. 13. If a prize winner is under the age of 18 years, the prize will be awarded to the winner s nominated parent or guardian. 14. The prize values are correct at the authorisation date of the competition. The Promoter is not responsible for any subsequent variation in values. 15. The prizes are not redeemable for cash or transferable and must be taken as offered. 16. The Promoter s decision is final and no further correspondence will be entered into. 17. If any prize (or part of any prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority. 18. Any further costs associated with prize redemption are not included and will need to be met by the prize winner.

No further correspondence will be entered into. 3) The winner need not be present at the draw to enter the SANTA CLAWS. However, they will need present themselves to staff within 3 minutes of the draw being made and the winner announced over the loud speaker. 4) If not present a proxy can stand in on behalf of the winner. If the winner does not want to enter the SANTA CLAWS, they can nominate someone to enter the SANTA CLAWS, on their behalf. The name on the winning entry will be awarded the prize. 5) The prize winners must provide suitable identification to the Promoters satisfaction to be entitled to enter the booth and redeem their prize. 6) The winner/proxy will be asked to sign a waiver before they enter the SANTA CLAWS. See attached. 7) The entry barrel will be emptied after each draw. The entry forms will be kept in a safe and secure place for three months after the draw. Liability 1. The Promoter and any companies associated with this competition, accept no responsibility for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or for any personal injury suffered or sustained as a consequence of the use and enjoyment of any item gained via the prize except for any liability which cannot be excluded by law. 2. The Promoter accepts no responsibility for any tax implications that may arise from the prize winnings or the use thereof. It is the responsibility of each entrant to seek independent advice on the possible implications this may have on their own financial situation. 3. Unless due to fraud or ineligibility under these Terms and Conditions, all valid prize claims in excess of the advertised prize pool value will be honoured. 4. If for any reason this competition is not capable of running as planned including infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Promoter, which corrupts or affects the administration security, fairness, integrity or proper conduct of this promotion, then it will be suspended subject to the approval gaming authorities in VIC where required. 5. The Promoter reserves the right to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify or suspend the promotion subject to the approval of the gaming authorities in VIC where required. 6. Printing errors or other quality assurance matters outside the control of the individual player cannot and will not be used as the sole basis for refusing to award a prize. 7. If all or any part of any Term or Condition contained in these Conditions of Entry shall be declared or become unenforceable, invalid or illegal for any reason, such term or provision (or part thereof) shall be deemed severed from these Conditions of Entry and the other Terms and Conditions hereof shall remain in full force and effect as if the offending term or provision appearing had not been inserted herein.

7 Customers Information 1. By entering the promotion, you give the Promoter consent to use your personal information for further purposes and promotions unless you say otherwise. 2. If the customer chooses to accept the prize, the Promoter reserves the right to use the customers name and photograph for marketing and publicity purposes.
