1 I 0 1 SPECIAL CITY COMMISSION MEETING MINUTES Tuesday November P M The meeting was called to order at 6 35 PM on the above date by Mayor Peggy Noland in the Commission Chambers City Hall Deerfield Beach Florida ROLLCALL Present Also Present Commissioner Joe Miller Commissioner Ben Preston Vice Mayor Bill Ganz Mayor Peggy Noland Burgess Hanson City Manager Andrew Maurodis City Attorney Ada 3raham Johnson MMC City Clerk Absent Commissioner Marty Popelsky Excused Mayor Noland announced that Commissioner Popelsky s absence is excused APPROVAL OF THE AGENDA DIGITAL TIME STAMP November MOTION was made by Commissioner Miller and seconded by Commissioner Preston to approve the November agenda as submitted Voice Vote YEAS Commissioner Miller Commissioner Preston Vice Mayor Ganz and Mayor Noland NAYS None ITEM 1 DIGITAL TIME STAMP Resolution A Resolution of the City Commission of the City of Deerfield Beach Florida etermining the award of RFP for restaurant operations at the International Fishing Pier 1

2 Andrew Maurodis City Attorney outlinecfthe resolution and the options that the City Commission has to take action on They were as follows 1 Approve the ranking and recommendation of the evaluation com ittee and award to Two Toge her LLC db a BurgerFi 2 Reject all proposals and start again 3 Refer the matter back to the evaluation committee to conduct further evaluations 4 A 4 5 vote decides to re rank the shortlisted firms If this option is chosen the Commission must review all written submittals and oral presentations ofthe short listed firms prior to the re ranking process He advised that the first three 3 opti nsisby majority vote the fourth is by 4 5 vote Commissioner Preston suggested that the Commission take the proper amount of time to make sure that their decision is best for the citizens and not the vendors Mr Maurodis said that the Commission has been provided all backup material which he outlined Commissioner Miller thanked David Santucci Purchasing Manager and the Evaluation Committee for all the hours they hav P4t into this proje t The three 3 final contenders were all worthy restaura ts He said he appreciates the funds used make a LEED building and the recommended c mpany has done the same to be a green certified restaurant They serve all natu ral organic food He further stated that he visited one of their restaurants and el1j yed it as well as the decor In closing he again commended the evaluation committee arid recommended approving their recommendation MOTION was made by Commissioner Miller and seconded by Vice Mayor Ganz to approve BurgerFi as the vendor for the pier restaurant Mayor Noland thanked the Selection Committee She Sc lid that in reviewing t e initial criteria there are some issues which she expounded on She expressed concern with giving someone the facility for 10 ye ar notwiths anding we have spent 4 million on this facility She said that she and this commliriityknows what kind ofrestaurant we had for 42 years She spoke about objectives ofthe pier restaurant which related to a family atmosphere and the menu pricetllat the Commission was seeking She oujlined her concerns with what the City Commission de sired as o tiined in the proposal however she said that the recommended proposer does notfit that description She said that only two 2 of the three 3 restaurants follow d that criteria She briefly touched on the decor She briefly commented that two 2 of the restaurants changed their names to fit the atmosphe r qecor th y vyere Brewzzi s and Glass Act She also commented on it being a fad ofeating nutritious meals Continuing Mayor No an9 expressed cqi1 r1 Nith r gard to some of the regular patrons thathave breakfast at the restauraltsand how th y W9 lcrt k tg th menu of the recommended vendor She specifically mentionedfather Dalton envisioning him eating a granola bar and a banana for breakfast She expressed that the traditional breakfast menu is a better fit for our residents Thereafter she expressed concerns with regards to the decor which the recommended company has warehouse lighting that looks like the old ice block very industrial and cold She said that she is looking 2

3 1 c for something that is going to accommodate the residents and tourjsts She said that she does not believe the choice selected is relative to the residents Mayor Nolal d suggested thauhe Commission seriously consider the menu and what is going up as it will be there for 10 years Commissioner Preston said that for many years he has gone to the Pier Restaurant and had breakfast there as he has been fishing at the pier for over 20 years Consequently breakfast sets the settingbeforethe fishermen begin fishing He said that the company that was ranked 1 does not reflect the traditional breakfast menu He further stated that not only do the fishermen eat there but many of the nearpy residents also go to the restaurant to have breakfast and the selected proposers menu does not reflect that He reiterated that we should be considering the residents foremost Commissioner Miller said that if this is a fad for gopd nutritious meals then it is a good fad He further stated that although this is a franchise they have extensive experience with serving breakfast He commented on their franchise businesses in the Delray and Fort Lauderdale area He shared having had pancakes at their restaurant and his wife having had a veggie burger and how he had better pancake elsewhere but his wife enjoyed the burger so much she would like to go back He further commented on the decor of the restaurant he said that they are in tune with the public Mayor Noland listed items on the menu and commented on their prices She said that there is nothing on the menu that she will eat She said that we must cater to everybody not the minority but the majority Mr Maurodis recommended that the Commission make their decision based upon the material Vice Mayor Ganz said that all three 3 presentations are good He said that the Commissioners and Mayor Noland all bring Lip great points However if we believe in an evaluation committee process we should standby it as we hope that they would make a smart decision Nonetheless all three 3 presentations have both pros and cons However he reiterated that he believes in the evaluation committee So unless there is gross negligence he supports the evaluation committee s ystem and would like to honor what they have recommended Commissioner Preston said that the final decision is that of the Commission and must reflect what the people mostly enjoy He said that he looked at the menu and a lot of the guys that fish out there would not be happy with the menu He said he looked at all three 3 menus and the numbers do not attract the people that it was meant to attract He said that it is a drastic change 3

4 Vice Mayor Ganz said that tonight is th first titne that he has heard from the public regarding the menu He commentedon elimiriati gjhe coriulii ee if the Commission is not going to take therecommeridatibn of the evaluatioff committee 8slheir professionalism and hours on the projects have b en well spent He again reitera ted that he believes in the committee system and would like to horior what they have recommended Commissioner Preston said that when we initially discussed the menu we indicated what we wanted He asked Vice Mayor Ganz if the menu recornmended is what was suggested by the Commission and outlined in the proposal Vice Mayor Ganz said that they are not that far off Commissioner Preston said that if we were given criteria we should not have to make the statement that they are not that far off Discussion pursued regarding the menu of the restaurant that was recornmended by the selection committee Vice Mayor Ganz said that his recommendation recommendation is to stand by the committee s Commissioner Miller said that if the restauraht has an item that does not sale he believes that they will stop making that item and provide what is being requested As they will adapt to what the customers want Mayor Noland said that at the beginning she thanked the Committee this was a committee of people that has not wor ed for the City 9 long period of time and does not know the City s history She said that we kn ow what the residents want which is why we sit up here as Commissioners She reit rated that the menljis far off she again listed the items that are on the menu which is not traditional NotWithstanding the decor is not a beach decor She said that this is something important to all of us and the residents that live in this community andsai that this was an exception for the Committee recommendation Moreover Mayor Nolahd said that he is looking at the clientele the residents She said that she understands healthy traditional breakfast with a beach atmosphere butwe had a criteria a Vice Mayor Ganz said that why they are allgoodj this one misses the mark from a financial standpoint which is the most be ne titia I Heasked Mr Santucci went through the evaluation committee rankings to review thei information Vice MayorGanz said that if the committee does riot havethe history weshould state that upfront He further explained his conc rns if we do not stick to the recommendation of the Committee We do not want to end up in a 2 2 vote He stated that we know what Mayor Noland and Commissioner Preston s concerns are He asked if 4

5 I f f I r r rl RegularCity Commission Meeting MihHte Novemb r they would like a re rank by Commission the Commission and evaluate it ourselves He suggested that we put it in the hands of Commissioner Miller said that since the number 1 and give Deerfield Beach what they want rank d person is here we can create Mr Maurodis said that he would not feel comfortable with allowing how they can change it them to talk about Mr Santucci said that the gross revenue they were about 8 5 each much higher than the 3rdranked The a nnuallease payment is annually He continued outlining the financial information and BurgerFicalculated 5 of the gross sales but explained that we cannot really guess as we do not know what their revenue would be Commission rmiller withdrew his motion Mr Maurodis said that the Commission will re rank and reevaluate the firm with the Commission doing the valuation In doing that process we would want the Commission to rewie all of the material from all three firms as thereviewing committee Thereafter he outlined the process that would be taken by the Commission to review and rank and that the ranking be put into a motion Motion was made by Commissioner Miller and seconded by Vice Mayor Ganz to re rank Mr Santucci entertained questions by the Commission Vice Mayor 3an st te9 thatjhere ar some questions that he would like to ask that andasked if that would be a problem were not considered previolisl Mr Maurodis recommended that the three 3 restaurants state if they problem answering the questions wo uld have a Anthony Verderame BurgerFi said he has no objection 0 answering questions Toula Amanna Class Act Restaurant Group stated she has no objection to answering questions Mr Santucci said that the third ranked firm is not here but he will contact them and get something in writing in this regard Mayor Noland asked that the Commission read the criteria and look at the decor as this is very important information She stated that this City is very dear to our hearts this is one of the bigger things that we will be making a decision on VoiceVote YEAS Commissioner Miller Commissioner Preston Vice Mayor Ganz and Mayor Noland NAYS None 5
