1 F.No /2009-Appeal NATIONAL COUNCIL FOR TEACHER EDUCATION Hans Bhawan, Wing II, 1, Bahadurshah Zafar Marg, New Delhi O R D E R 12/02/2010 WHEREAS the appeal of Asa Ram Aggarwal Education & Research Society (Emax Institute), Chandigarh dated 20/12/2009 is against the Order No. F.NRC/NCTE/F73/HR-1212/2009/1053 dated 23/04/2009 of the Northern Regional Committee, refusing recognition for conducting B.Ed course on the grounds 1) CLU is not issued by the Competent Authority on the prescribed format. 2) In response to our letter, the State Govt. recommendation is negative. AND WHEREAS the Correspondent, Asa Ram Aggarwal Education & Research Society (E-max Institute) (hereinafter referred to as the appellant), preferred an appeal dated 22/12/2009 to the National Council for Teacher Education, New Delhi (hereinafter referred to as the Council) under Section 18 of the NCTE Act, 1993 against the said Order. AND WHEREAS Shri Om Parkash Aggarwal, Chairman and Shri Naneet Kappur, Accounts Officer, Asa Ram Aggarwal Education & Research Society (E-max Institute), Chandigarh presented the case of the appellant institution on In the appeal and during personal presentation it was submitted that the appellant s institution is in the Village Gola, Tehsil Mulana and it land does not fall under any controlled area and this has been certified by District Town Planning office vide it s memo dt , so, the appellant obtained CLU from Gram Panchayat office and these two documents were already submitted to the NRC vide institution letter dt With regard to the State Govt. negative recommendation it was submitted that the NRC filed an affidavit in the Hon ble High Court of Punjab and Haryana at Chandigarh stating that on consideration of the State Govt. recommendation, the NCTE has decided not to grant further recognition for teacher training institution for the session In the light of this affidavit NRC was not justified to refuse the recognition to the institution the session on this very ground. AND WHEREAS the Council noted that the appellant was in possession of 41 acre 1 kanal and 5 marla of land falling in the revenue estate of village Gola and the District Town Planner vide his memo dt mentioned that the said land does not fall under the controlled area. In view of this, the CLU issued by Gram Panchayat office was acceptable. The Council therefore came to the conclusion that there was adequate justification to accept the appeal and remand the case to the NRC for issuance of letter of intent prior to grant of recognition under clause 7(9) of NCTE regulation AND WHEREAS after perusal of documents, memorandum of appeal, VT Report, affidavit and after considering oral arguments advanced during hearing, the Council reached the conclusion that there was enough ground to accept the appeal and that it should be accepted, set aside the order of the NRC dt and remand the case to the NRC for issuance of letter of intent prior to grant of

2 recognition under clause 7(9) of the NCTE Regulations, within 15 days of issue of this order. NOW THEREFORE, the Council hereby remands back the case of Asa Ram Aggarwal Education & Research Society (E-max Institute), Chandigarh to the NRC, NCTE, for necessary action as indicated above. 3 F.No /2009-Appeal NATIONAL COUNCIL FOR TEACHER EDUCATION Hans Bhawan, Wing II, 1, Bahadurshah Zafar Marg, New Delhi O R D E R 12/02/2010 WHEREAS the appeal of Asian College, Saharanpur, Uttar Pradesh dated 25/10/2009 is against the Order No. F.NRC/NCTE/F-7/UP-3306/2009/10225 dated 10/09/2009 of the Northern Regional Committee, refusing recognition for conducting B.Ed course on the grounds Except for Language lab and computers nothing has been purchased to meet the deficiencies related to other labs and library. AND WHEREAS the Correspondent, Asian College (hereinafter referred to as the appellant), preferred an appeal dated 06/11/2009 to the National Council for Teacher Education, New Delhi (hereinafter referred to as the Council) under Section 18 of the NCTE Act, 1993 against the said Order. AND WHEREAS Shri Rajesh Kumar, Secretary and Shri Ravindra Kumar, Member, Asian College, Saharanpur, Uttar Pradesh presented the case of the appellant institution on In the appeal and during personal presentation it was submitted that the WRC issued a show cause on to the institution to clarify its position on 10 points and accordingly a reply was filed on The NRC accepted that the appellant s institution had satisfied on two points, and for the remaining points it was submitted that the society constructed its own building on the land owned by it; E.T., Science and Psychology Laboratories were well equipped and the list of the equipment purchased for the labs might be cross checked from the purchase bills; The library had 4300 books in total with more than 1000 titles, but at the time of inspection it was haring only 2100 books and rest of them were purchased in compliance to the show cause notice. These books were stacked in the cub-boards in an orderly manner; The building plan and the building completion certificate were issued by the panchayat office, as the building is located in a village; further there was no need to demarcate the built-up area course wise, as the entire building was meant for running only B. Ed course; The institution was having two play grounds (one for badminton and the other for volley ball) in apart from many in door games facilities. AND WHEREAS the Council noted that the visiting team report dated was positive and it inter-alia indicated that the appellant s institution was having 2520 Sq.mt. of land and Sq.mt. of built-up area, labs and library were adequately equipped. It also verified the purchase bills and accession register/ stock entry register and found that the labs and library were adequately equipped. It further noted that the building completion certificate was issued by the competent authority. The Council therefore came to the conclusion that there was adequate justification to accept the appeal and remand the case to the NRC for issuance of letter of intent prior to grant of recognition under clause 7(9) of NCTE regulation.

4 AND WHEREAS after perusal of documents, memorandum of appeal, VT Report, affidavit and after considering oral arguments advanced during hearing, the Council reached the conclusion that there was enough ground to accept the appeal and that it should be accepted, set aside the order of the NRC dt and remand the case to the NRC for issuance of letter of intent prior to grant of recognition under clause 7(9) of the NCTE Regulations within 15 days of issue of this order. NOW THEREFORE, the Council hereby remands back the case of Asian College, Saharanpur, Uttar Pradesh to the NRC, NCTE, for necessary action as indicated above. (Hasib Ahmad) Member Secretary 1. 5 F.No /2009 NATIONAL COUNCIL FOR TEACHER EDUCATION Hans Bhawan, Wing II, 1, Bahadurshah Zafar Marg, New Delhi O R D E R 12/02/2010 WHEREAS the appeal of Bareilly College, Bareilly, Uttar Pradesh dated 23/11/2009 is against the Order No. F.NRC/NCTE/F-7/UP-2153/141 Meeting/2009/12277 dated 12/11/2009 of the Northern Regional Committee, refusing recognition for conducting M.Ed course on the grounds The list of appointed faculty as per NCTE norms has not been submitted till date. AND WHEREAS the Correspondent, Bareilly College (hereinafter referred to as the appellant), preferred an appeal dated 23/11/2009 to the National Council for Teacher Education, New Delhi (hereinafter referred to as the Council) under Section 18 of the NCTE Act, 1993 against the said Order. AND WHEREAS Dr. Uma Vyas, Co-ordinator, Bareilly College, Bareilly, Uttar Pradesh presented the case of the appellant institution on In the appeal and during personal presentation it was submitted that the appellant s institution was under grant-in-aid system of UP Government; NRC issued conditional recognition order on and incompliance to this order the appellant appointed the teaching faculty after following the State Govt. and affiliating university procedural formalities i.e. giving advertisement notice in newspapers (13th July 2007 and 9th December, 2007); obtaining panel of expert on from the university, constituting selection committee on , university approved the faculty list on and the selected faculty jointed the institution on ; As per the guidelines the list of the appointed faculty was displayed in the college website and also a copy of it was sent to NRC on It was further contested that the NRC at no point of time, informed the appellant about this lacuna. NRC had straight away issued refusal order without giving any opportunity for making a submission/clarification with regard to appointment of the faculty by institution. AND WHEREAS the Council noted that institution adopted laid down procedure for appointing the teaching faculty for M.Ed. course. It further examined the faculty profile and found that the faculty was qualified as per norms. In view of the above the Council came to the conclusion that there was adequate justification to accept the appeal with a direction to the NRC for issuance of formal recognition order. AND WHEREAS after perusal of documents, memorandum of appeal, VT Report, affidavit and after considering oral arguments advanced during hearing, the Council reached the conclusion that there was enough ground to accept the appeal and reverse the order of the NRC dt , with a direction to the NRC for issuance of formal recognition order, within 15 days of issue of this order.

7 F.No /2009-Appeal NATIONAL COUNCIL FOR TEACHER EDUCATION Hans Bhawan, Wing II, 1, Bahadurshah Zafar Marg, New Delhi O R D E R 12/02/2010 WHEREAS the appeal of Government Institute of Advanced Studies, Thrissur, Kerala dated 13/11/2009 is against the Order No. F.SRO/NCTE/ /15822 dated 24/09/2009 of the Southern Regional Committee, refusing recognition for conducting M.Ed course on the grounds 1) Professor is not appointed as per norms and standards of NCTE. 2) The affidavits of Rs.100/- and minutes of Selection Commission are not submitted. 3) Experience and Educational qualification certificates are not produced. AND WHEREAS the Correspondent, Government Institute of Advanced Studies (hereinafter referred to as the appellant), preferred an appeal dated 18/11/2009 to the National Council for Teacher Education, New Delhi (hereinafter referred to as the Council) under Section 18 of the NCTE Act, 1993 against the said Order. AND WHEREAS Dr. P. Usha Rana, Principal, Government Institute of Advanced Studies, Thrissur, Kerala presented the case of the appellant institution on In the appeal and during personal presentation it was submitted that Dr. R. Krishnakumari, the senior most Reader for M.Ed. in IASE, Trissur was provisionally given chanse of the M.Ed. course and P.G.dept., by the Directorate of Collegiate Education; It submitted to the SRC on , an affidavit on Rs. 100/- stamp paper; The entire faculty profile as per the format of the NCTE was also sent by on AND WHEREAS the Council noted that it was a Govt. institution and the faculty had been appointed by the Govt. It further examined the faculty profile and the affidavits of the faculty and noted that the institution appointed requisite qualified faculty. In view of the above the Council came to the conclusion that there was adequate justification in accepting the appeal for issuance of formal recognition order. AND WHEREAS after perusal of documents, memorandum of appeal, VT Report, affidavit and after considering oral arguments advanced during hearing, the Council reached the conclusion that there was enough ground to accept the appeal and that it should be accepted. Accordingly, the appeal was accepted and SRC s order dated was reversed with a direction to the SRC to issue formal recognition order under clause 7(11) of NCTE Regulations, within 15 days of issue of this order.

AND WHEREAS the Correspondent, Lloyd Institute of Management & Technology (hereinafter referred to as the appellant), preferred an appeal dated 23/11/2009 to the National Council for Teacher Education, New Delhi (hereinafter referred to as the Council) under Section 18 of the NCTE Act, 1993 against the said Order. AND WHEREAS Dr. Rakesh Singh, Director and Shri Vijay Parmar, Lecturer, Lloyd Institute of Management & Technology, Greater Noida, Uttar Pradesh presented the case of the appellant institution on In the appeal and during personal presentation it was submitted that the apellant had already submitted - (a) affidavit by the institute, (b) affidavit by the faculty, (c) consolidated Bio Data of faculty appointed by the institution on , (d) copy of approved faculty from the Registrar, Ch. Charan Singh University, Meerut on & It was also submitted that they should have been given a chance through reminder/notice before issue of refusal order. AND WHEREAS the Council noted that as per norms Professor/Head, Reader and three lecturers are required for the M.Ed. course. It perused the faculty profile and noted that the Professor and the Reader were not having requisite experience as per norms. In view of the above the Council came to the conclusion that there was no justification in accepting the appeal and hence it should be rejected. AND WHEREAS after perusal of documents, memorandum of appeal, affidavit, VT Report and after considering oral arguments advanced during hearing, the Council reached the conclusion that there was no ground to accept the appeal and that it should be rejected. Accordingly, the appeal was rejected and NRC s order dated was confirmed. NOW THEREFORE, the Council hereby confirms the Order appealed against. 1. 11 F.No /2009-Appeal NATIONAL COUNCIL FOR TEACHER EDUCATION Hans Bhawan, Wing II, 1, Bahadurshah Zafar Marg, New Delhi O R D E R 12/02/2010 WHEREAS the appeal of Major Shiv Dayal Singh Mahavidhyalaya, Farrukhabad, Uttar Pradesh dated 10/11/2009 is against the Order No. F.NRC/NCTE/F-7/UP- 3126/2009/10693 dated 25/09/2009 of the Northern Regional Committee, refusing recognition for conducting M.Ed course on the grounds 1) Thirty Two computers are not enough for students of all courses, i.e. BA, B.Sc., B.P.Ed, B.Ed. 2) The deficiency with respect to Language learning facility still exists as old bills dated 18/06/2009, 20/06/2007 etc have been submitted. 3) For purchase of books old bills dated 17/08/2009, 16/06/2009 etc. have been submitted. AND WHEREAS the Correspondent, Major Shiv Dayal Singh Mahavidhyalaya (hereinafter referred to as the appellant), preferred an appeal dated 16/11/2009 to the National Council for Teacher Education, New Delhi (hereinafter referred to as the Council) under Section 18 of the NCTE Act, 1993 against the said Order. AND WHEREAS Dr. Shailendra, Member, Major Shiv Dayal Singh Mahavidhyalaya, Farrukhabad, Uttar Pradesh presented the case of the appellant institution on In the appeal and during personal presentation it was submitted that the appellant had made exclusive provision of the ET lab, only for the B.Ed. & M.Ed. courses and the available 32 computers were adequate for both courses. The language lab was having lingua phone and other required instruments and apparatus, purchased before one week of the inspection. The appellant in compliance to the show cause notice, purchased more books on and hence the total number of books available with the institution were 3326 for the M.Ed. course. AND WHEREAS the Council noted that the language lab, library and educational technology laboratories were adequately equipped. It also perused the bills & accession register etc. and noted that the procurement of materials/books for language learning lab and library was done well before the date of inspection and only some additional books were added to remove the inadequacy as pointed by the NRC vide its show cause notice dated In view of the above the Council came to the conclusion that there was adequate justification to accept the appeal and remand the case to the NRC for issuance of letter of intent prior to grant of recognition under clause 7(9) of NCTE of Regulations. AND WHEREAS after perusal of documents, memorandum of appeal, VT Report, affidavit and after considering oral arguments advanced during hearing, the Council reached the conclusion that there was enough ground to accept the appeal and that it should be accepted, set aside the order of the NRC dt and remand the case to the NRC for issuance of letter of intent prior to grant of recognition under clause 7(9) of the NCTE Regulations.

13 F.No /2009-Appeal NATIONAL COUNCIL FOR TEACHER EDUCATION Hans Bhawan, Wing II, 1, Bahadurshah Zafar Marg, New Delhi O R D E R 12/02/2010 WHEREAS the appeal of Millat Teachers Training College, Madhubani, Bihar dated 12/11/2009 is against the Order No. F.No. BR-S/N-40/08/14520 dated 26/10/2009 of the Eastern Regional Committee, against recognition for conducting B.P.Ed course on the grounds The appellant institution has been granted recognition for B.P.Ed course of one year duration with an intake of 50 for the academic session AND WHEREAS the Correspondent, Millat Teachers Training College (hereinafter referred to as the appellant), preferred an appeal dated 13/11/2009 to the National Council for Teacher Education, New Delhi (hereinafter referred to as the Council) under Section 18 of the NCTE Act, 1993 against the said Order. AND WHEREAS Dr. Faiyaz Ahmad, Secretary and Dr. S.K. Mishra, Millat Teachers Training College, Madhubani, Bihar presented the case of the appellant institution on In the appeal and during personal presentation it was submitted that the appellant applied to the ERC for an intake of 100 in the B.P.Ed. programme. It provided the facilities and requirements for an intake of 100 and the same was brought to the notice of ERC through its reminder letter, but the ERC granted recognition for B.P.Ed. programme for an intake of 50, instead of 100 intake. AND WHEREAS the Council noted that as per Regulations, an institution shall be considered for grant of recognition for only one course for the basic unit as prescribed in the norms and standards for the particular teacher education programme and under the norms and standards of B.P.Ed. degree, it has been stated the intake shall be a basic unit of 50 students. In view of the above the Council came to the conclusion that there was no justification in accepting the appeal and that should be rejected as the ERC was right in granting recognition for a basic unit of 50 in B.P.Ed. programme. AND WHEREAS after perusal of documents, memorandum of appeal, affidavit, VT Report and after considering oral arguments advanced during hearing, the Council reached the conclusion that there was no ground to accept the appeal and that it should be rejected. College, Sabarkantha, Gujarat dated 12/11/2009 is against the Order No. WRC/APW02521/322280/127th/2009/R-5356 dated 29/10/2009 of the Western Regional Committee, withdrawing recognition for conducting PTC course on the grounds Land documents are not valid as per the NCTE norms. AND WHEREAS the Correspondent, Saraswati P.T.C. College (hereinafter referred to as the appellant), preferred an appeal dated 19/11/2009 to the National Council for Teacher Education, New Delhi (hereinafter referred to as the Council) under Section 18 of the NCTE Act, 1993 against the said Order. AND WHEREAS Shri Daxaben A. Purohit, Managing Trustee and Shri Chandubhai K, Patel, Trustee, Saraswati P.T.C. College, Sabarkantha, Gujarat presented the case of the appellant institution on In the appeal and during personal presentation it was submitted that the appellant s institution was granted recognition for conducting P.T.C. Programme in the year 2006; From the NCTE s website the appellant came to know that WRC in its 114th meeting held on 4-5th Feb 09 had received some complaint against the appellant s institution and WRC had decided to forward the complaint to the college for its reply; The institution wrote a letter on to the WRC stating that the complaint was totally false and had been filed by some competitor and also sent relevant documents in proof of having infrastructure facilities as per norms; Later WRC in its 124th meeting decided to issue a show cause notice; After perusing this decision on website the appellant sent a letter to the WRC on informing the WRC to grant one month time for registration of the land document as the trustee of the trust had gone to a foreign country. Inspite of the fact that the applicant had asked for time for the purpose of registration of the lease deed, WRC has passed the impugned order on stating that land document not valid as per the NCTE norms. However the appellant got the lease deed registered on for 4790 sq. mts of land and 1575 sq. mts of built-up area. AND WHEREAS the Council noted that the WRC issued show cause notice on informing the institution that lease deed submitted for land and building was not registered as per the NCTE norms at the time of application. Further, after considering the institution s reply dt WRC withdrew the recognition of the institution on on the show cause ground itself. The trust registered long term lease agreement for a piece of land of 4790 sq. mts and 1575 sq. mts of built-up area, situated at a property bearing Sy. No. 613/ A, building No. 985,Ghadi Gram Panchayat,. The Council however noted that advocate M.R. Solanki issued a land title certificate for 7200 sq. ft. of building & 4800 sq. ft. of land located at sy. No. 160, building No and this area was adequate as per norms. Further the appellant

16 instead of shifting to own premises, rather made a lease agreement on with a private party and this was not acceptable after 2007 regulations. Even the agreement was not for the same other property, for which an application for grant of recognition was submitted. The complaint of Shri Ketul Gor also mentioned that the trust had transferred PTC college into another private building from 17th March 09 without WRC s permission. Further with the reply of the institution dt , the appellant enclosed only building plan and no other document. In view of the above the Council came to the conclusion that there was no justification in accepting the appeal and hence it should be rejected. Girls Degree College, Meerut, Uttar Pradesh dated 21/11/2009 is against the Order No. F.NRC/F73/UP- 1991/141st Meeting/2009/10846 dated 26/09/2009 of the Northern Regional Committee, refusing recognition for conducting B.Ed course on the grounds The list of appointed faculty as per NCTE norms has not been submitted till date. AND WHEREAS the Correspondent, Shaheed Mangal Pandey Govt. Girls Degree College (hereinafter referred to as the appellant), preferred an appeal dated 23/11/2009 to the National Council for Teacher Education, New Delhi (hereinafter referred to as the Council) under Section 18 of the NCTE Act, 1993 against the said Order. AND WHEREAS Dr. Rajiv Pandey, Reader, Shaheed Mangal Pandey Govt. Girls Degree College, Meerut, Uttar Pradesh presented the case of the appellant institution on In the appeal and during personal presentation it was submitted that Director Higher Education, UP vide his letter dt sanctioned 07 posts of B.Ed lecturers and 06 other posts; and on the Govt. appointed 07 lecturers in the year 2007 itself; as all candidates of the appointed faculty did not join, the Govt.again in Nov 09 filled up the vacant posts on transfer basis. So, all the lecturers were appointed through U.P.S.C. and they were qualified as per norms. Being a Govt. institution there was some delay in the appointment of the faculty. AND WHEREAS the Council noted that the institution was issued conditional recognition order on and in compliance to this the Govt. posted 07 lecturers initially in the year 2007 itself. And in the year 2009, subsequent vacant posts were filled up. It also noted that NRC vide its letter dt. 09 July 07 informed the institution to submit the faculty details, with in 21 days, failing which an action would be initiated as per the provisions of the Act. The institution on informed NRC that 07 lecturer posts had been sanctioned by the U.P. Govt. and to fill up these posts on transfer basis/ appointment basis was under process. NRC, after a lapse of more than 2 years, issued refusal order on , without ascertaining whether the appointment of the faculty was done or not. The fact was that the institution as already appointed the requisite faculty. In view of the above, the Council came to the conclusion that there was adequate justification to accept the appeal with a direction to the NRC for issuance of formal recognition order, in continuation of the conditional recognition order, so that the recognition of the institute gets effective from the year of affiliation by the university after issue of conditional recognition order.

AND WHEREAS the Correspondent, Shree Swaminarayan Education College (hereinafter referred to as the appellant), preferred an appeal dated 30/11/2009 to the National Council for Teacher Education, New Delhi (hereinafter referred to as the Council) under Section 18 of the NCTE Act, 1993 against the said Order. AND WHEREAS Shri Patel Bharat Kumar, Secretary, Shree Swaminarayan Education College, Mehsana, Gujarat presented the case of the appellant institution on In the appeal and during personal presentation it was submitted that the appellant submitted an application for B.Ed programme on and WRC granted recognition vide its order dt ; Later WRC issued a show cause notice under section 17 of the NCTE Act on , in respect of the validity of the land document i.e. the institution does not own the land. And in response to this it submitted a reply on and also on alongwith documents relating to land purchased by the appellant i.e. Extract of form No. 7/12 certificate of Gram Panchayat, Vijapur, title certificate, registered agreement to sell, registered sale deed and the map etc. AND WHEREAS the Council noted that the institution was granted formal recognition on ; WRC received the complaint from Hemchandra North Gujarat university mentioning that principal is not appointed, a Science lab, Psychological Lab and Language lab is inadequate and institute is running in school building on rented/ lease basis from other trust and on the basis of this complaint, WRC issued a show cause notice on , to appoint a qualified principal within 45 days and in this notice it did not mention about the remaining points of the complaint; and again on it issued another notice for the land document. The institution submitted its reply on stating that it had appointed the principal and the institution was granted recognition in a rented building taken on 35 years rent agreement and further the appellant was in the process of purchasing the land for constructing own building within a year. Subsequent to this letter, the trust purchased 4800 sq. mts of land at sy. No. 184/2 on and got a building plan approved for a built-up area of 1810 sq. mt. From the document of lease agreement and sale deed the Council inferred that at the time of submission of application the institution was having only notarized rent agreement for 35 years and this was not a legally valid document and further land on ownership was procured at a later time.

20 In view of the above the Council came to the conclusion that there was no justification in accepting the appeal and hence it should be rejected. AND WHEREAS the Correspondent, Shri Shivdan Singh Smriti College (hereinafter referred to as the appellant), preferred an appeal dated 10/11/2009 to the National Council for Teacher Education, New Delhi (hereinafter referred to as the Council) under Section 18 of the NCTE Act, 1993 against the said Order. AND WHEREAS Shri A.K. Pachaury, Shri Shivdan Singh Smriti College, Aligarh, Uttar Pradesh presented the case of the appellant institution on In the appeal and during personal presentation it was submitted that the appellant had given to the inspection team on the day of visit, the documents related to the list of the faculty members and their experience. The institution was granted conditional recognition vide NRC s order dt Incompliance to this letter also, the appellant on submitted copies of the affidavit on Rs. 10/- stamp paper relating to the experience certificates of principal & faculty and an affidavit of management on Rs. 100/- stamp paper. Again on the institution submitted advertisement notice, selection committee minutes, faculty qualification and also appointed list of the faculty by the university. However the NRC denied recognition and issued refusal order. AND WHEREAS the Council noted that the institution appointed requisite faculty i.e. a principal and five lecturers following the due produce laid down in the norms. The faculty was selected on by the duly constituted expert committee by the university and further the list of the faculty was also approved by the university. In view of the above the Council came to the conclusion that there was adequate justification in accepting the appeal, with a direction to the NRC to issue formal recognition order under clause 7(11) of NCTE Regulation. AND WHEREAS after perusal of documents, memorandum of appeal, VT Report, affidavit and after considering oral arguments advanced during hearing, the Council reached the conclusion that there was enough ground to accept the appeal and that it should be accepted. AND WHEREAS Shri Madan Lalsharma, President and Shri M.L.Garg, SPL Member, B.P.S. College of Education, Distt. Mahindergarh, Haryana presented the case of the appellant institution on In the appeal and during personal presentation it was submitted that pursuant to the issue of show cause notice, the appellant submitted an affidavit clarifying that the institute had made advertisements in news paper on 25/ ; requested the affiliating university, (Maharishi Dayananad University) for nomination of subject expert; as per the direction of the university s letter dt and , the management constituted a selection Committee comprising Prof. Hemant Lata Sharma and two other professions as subject experts; Hence, the selection of the faculty was made by the competent selection Committee, constituted as per the NCTE norms /university guidelines. AND WHEREAS the Council noted that the superintendent of colleges, Maharshi Dayanand University, Rohtak vide his letter dt stated as per interim state policy/ guidelines three outside experts in the concerned course of the study, at the level of professor. In exceptional cases, where professor in the concerned course of study are not available, then associate professor with more than 5 years experience may be taken as experts for constitution the expert panel. Accordingly the institute constituted an expert panel comprising of 3 professors. It also perused the clause 7(9) of NCTE regulations and noted that The faculty shall be appointed on the recommendation of the selection Committee duly constituted as per the policy of the State Govt./ Central Govt./ University or the concerned affiliating body. In view or the above the Council came to the conclusion that there was adequate justification in accepting the appeal for issuance of formal recognition order, as the faculty was appointed by the institution through a properly constituted selection committee.

Siwan, Bihar presented the case of the appellant institution on In the appeal and during personal presentation it was submitted that the appellant institution has requisite number of teaching and other faculty as per NCTE norms and with the intake of 50 seats per year it will be unable to meet the expenses and in order to run the institution effectively and smoothly the appellant institution need at least 100 seats per year and this fact is completely ignored by the ERC. AND WHEREAS the Council noted that ERC vide its order dt refused recognition for BTC course; The institution preffered an appeal and the appellate Authority vide its order dt accepted the appeal for issuance for formal recognition order. In compliance to this the ERC issued formal recognition order for B.T.C. with an intake of 50 per year. It also perused the Regulations of NCTE and noted that in the first instance an institution shall be considered for grant of recognition for only one course for the basic unit as prescribed in the norms and standards for the particular teacher education programme and the prescribed intake for the B.T.C. (D.Ed.) course is 50 students. In view of the above the Council came to the conclusion that there was no justification in accepting the appeal and hence it should be rejected.
