1 F.No / Appeal WHEREAS the appeal of Arafa Institute for Teacher Education (Arafa Charitable Trust), Thrissur, Kerala dated 23/07/2009 is against the Order No. F.SRO/NCTE/ /12629 dated 12/05/2009 of the Southern Regional Committee, refusing recognition for conducting TTC course on the grounds 1) The earmarked built-up space of 9970 sq.ft. for existing B.Ed and 7,227 sq.ft. for proposed TTC are not adequate to run both the course as per norms and standards of NCTE for B.Ed and TTC. 2) The books in the library numbering 3900 are not adequate for existing B.Ed course and proposed TTC course. 3) The facilities for language learning are not sufficient for proposed course. 4) The committee decided to issue show cause notice to existing B.Ed course under section 17 of NCTE Act and call the information of infrastructural facilities by sending questionnaire. AND WHEREAS the Correspondent, Arafa Institute for Teacher Education (Arafa Charitable Trust) (hereinafter referred to as the appellant), preferred an appeal dated 31/07/2009 to the National Council for Teacher Education, New Delhi (hereinafter referred to as the Council) under Section 18 of the NCTE Act, 1993 against the said Order. AND WHEREAS Shri. K.S. Hamza, General Secretary, Arafa Institute for Teacher Education (Arafa Charitable Trust), Thrissur, Kerala presented the case of the appellant institution on In the appeal and during personal presentation it was submitted that earmarked built up space of sq.ft ( sq.mtrs) is available for both B.Ed and TTC courses; the number of books purchased for TTC Course is more than 2500 and the total collection for B.Ed and TTC is more than 7000 Books; the books could not be entered in register due to shortage of notice for inspection; of late the language lab has been updated with all facilities. AND WHEREAS the Council noted that SRC vide its order dated 15/12/2007 closed the file of the institution on the ground that the institution did not fulfill the deficiencies within the stipulated time. Appellate Authority vide its order dated 10/07/2008 set aside SRC s order and remanded the case to SRC for causing inspection of the institution. In compliance to this appellate order, SRC caused inspection of the institution and sequel to this issued a Show Cause Notice. On consideration of the reply of the institution to this notice SRC conducted reinspection of the institution on 17/04/2007. The Visiting Team in its report dated 17/04/2007 indicated that the total built-up area available with the institution was 33,958 Sq.ft; Further on page-6, in column 7 mentioned the course wise built up area as sq. ft. for the existing B.Ed course, = sq. ft. for the proposed TTC course and sq. ft. as other common area. In column 8 it emphasized the earmarked building portion for the proposed course as 16, sq. ft. Regarding other observations about number of book, existing number of books 3900 with 8 journals had been further strengthened by the institution so as to make a

2 total number of books as Similarly, the Language lab of the institution had been further strengthened by purchase of more software, as the VTR suggested its updation by way of purchase of new software. In view of the above, the Council came to the conclusion that there was adequate justification in accepting the appeal, to remand the case to SRC for issuance of letter of intent prior to grant of recognition under clause 7(9) of NCTE Regulation, AND WHEREAS after perusal of documents, memorandum of appeal, affidavit, VT report and after considering oral arguments advanced during the hearing, the Council reached the conclusion that there was adequate ground to accept the appeal and set aside SRC s order dated with the direction to SRC for issuance of letter of intent prior to grant of recognition under clause 7(9) of NCTE Regulation, 2007 within 15 days of issue of this order. NOW THEREFORE, the Council hereby remands back the case of Arafa Institute for Teacher Education (Arafa Charitable Trust), Thrissur, Kerala to the SRC, NCTE, for necessary action as indicated above. 3 F.No /2009-Appeal WHEREAS the appeal of Burdwan Institute of Education (Oriental Association for Education & Research), Burdwan, West Bengal dated 19/08/2009 is against the Order No. ERC/7-99.7(15).2(2009).1007 dated 04/08/2009 of the Eastern Regional Committee, refusing recognition for conducting B.Ed. course on the grounds 1) No compliance made in response to the notice dt and subsequent letter dt and also reminder dt within the stipulated time. 2) Certified copy of land ownership documents has not been submitted as per Regulation 8(7) & 8(8) {Registered copy of sale deed along with the certified copy not submitted} 3) Total area is not mentioned in the building completion certificate. 4) Built up area not mentioned in the building plan is not as per NCTE norms and do not tally with the building completion certificate and application. AND WHEREAS the Correspondent, Burdwan Institue of Education (Oriental Association for Education & Research) (hereinafter referred to as the appellant), preferred an appeal dated 20/08/2009 to the National Council for Teacher Education, New Delhi (hereinafter referred to as the Council) under Section 18 of the NCTE Act, 1993 against the said Order. AND WHEREAS Shri. Bipin Singh, P.R.O, Burdwan Institute of Education (Oriental Association for Education & Research), Burdwan, West Bengal presented the case of the appellant institution on In the appeal and during personal presentation it was submitted that the institution has furnished compliance report in response to the deficiency letter issued by the ERC and the letter has not been considered, though the institution fulfills all the conditions as per NCTE guidelines. In particular it is mentioned in the appeal that the land and building which belong to Oriental Association for Education and Research will be transferred to Burdwan Institute of Education; the land is free from all encumbrances and the building plan has been modified and the total floor area is 18,495 sq.ft. which has been mentioned in the completion certificate. AND WHEREAS the Council after taking all aspects of the matters into consideration has come to the conclusion that the appeal deserves to be accepted and the matter remanded to ERC for conducting an inspection and taking further necessary action. AND WHEREAS after perusal of documents, memorandum of appeal, affidavit and after considering oral arguments advanced during the hearing, the Council reached the conclusion that there was adequate ground to accept the appeal, set aside ERC s order dated and remand the case to ERC for causing inspection of the institution to ascertain the infrastructure and instructional facilities as per NCTE norms within 30 days from the date of issue of this order and thereafter pass appropriate order.

4 NOW THEREFORE, the Council hereby remands back the case of Burdwan Institue of Education (Oriental Association for Education & Research), Burdwan, West Bengal to the ERC, NCTE, for necessary action as indicated above. 5 F.No /2009-Appeal WHEREAS the appeal of Chetna Primary Teacher's Training Institute, Purulia Dist., West Bengal dated 22/09/2009 is against the Order No. ERC/7-99.6(1).2/2009/981 dated 04/08/2009 of the Eastern Regional Committee, refusing recognition for conducting PTT (D.Ed) course on the grounds Teaching Staff are not qualified as per the NCTE norms. AND WHEREAS the Correspondent, Chetna Primary Teacher's Training Institute (hereinafter referred to as the appellant), preferred an appeal dated 24/09/2009 to the National Council for Teacher Education, New Delhi (hereinafter referred to as the Council) under Section 18 of the NCTE Act, 1993 against the said Order. AND WHEREAS Shri. Manik Chandra Mandal, Principal, Chetna Primary Teacher's Training Institute, Purulia Dist., West Bengal presented the case of the appellant institution on In the appeal and during personal presentation it was submitted that the teaching staff are qualified as per norms. The institution has also furnished the list of teaching and non-teaching staff. AND WHEREAS from a perusal of the staff list, the Council noted that the appointed teachers are qualified as per the old norms. The committee therefore felt that the institution may be allowed 3 months time to appoint staff as per the qualifications laid down in the NCTE Regulations, 2007 and report the matter to the ERC. In these circumstances, the appeal deserves to be accepted and the case remanded to ERC to review the matter on receipt of the report from the institution within a time frame of a fortnight. AND WHEREAS after perusal of documents, memorandum of appeal, affidavit, VT Report and after considering oral arguments advanced during the hearing, the Council reached the conclusion that there was adequate ground to accept the appeal, set aside ERC s order dated and remand back the case to ERC with the direction to allow 3 months time to the institution to appoint faculty and furnish report thereof to ERC. Thereafter ERC would review the matter on receipt of the report from the institution within a time frame of a fortnight.

6 NOW THEREFORE, the Council hereby remands back the case of Chetna Primary Teacher's Training Institute, Purulia Dist., West Bengal to the ERC, NCTE, for necessary action as indicated above. Memorial Teacher's Training Institute, Burdwan Dist., West Bengal dated 19/09/2009 is against the Order No. ERC/ /2009/831 dated 25/06/2009 of the Eastern Regional Committee, refusing recognition for conducting B.Ed course on the grounds 1) The institution has not been submitted the requisite documents for the teachers training course as per letter dt and earlier notice dt ) The land document submitted by the institution is for English Medium School, Building Completion Certificate and Building Plan is submitted for the same. AND WHEREAS the Correspondent, G.M. Memorial Teacher's Training Institute (hereinafter referred to as the appellant), preferred an appeal dated 22/09/2009 to the National Council for Teacher Education, New Delhi (hereinafter referred to as the Council) under Section 18 of the NCTE Act, 1993 against the said Order. AND WHEREAS Shri. Susil Kumar Misra, Secretary, G.M. Memorial Teacher's Training Institute, Burdwan Dist., West Bengal presented the case of the appellant institution on In the appeal and during personal presentation it was submitted that the allegation that the requisite documents as per the letters of the ERC dated & have not been submitted is wrong; Kalna Mishra Social Welfare Organization is statutorily recognized educational society which has established both the school and teacher training institute for B.Ed Course. It has been further submitted that according to MOA that society owns land and building of both the English medium school and G.M Memorial Teachers Training Institute. AND WHEREAS the Council noted that the ERC has taken into account the replies furnished by the institution to their communications dated & The appellant, while maintaining that the English Medium school and G.M Memorial Teachers Training Institute are part and parcel of the Kalna Mishra Social Welfare Organization has not been able to satisfactorily explain as to which is the building plan and built up space clearly and specifically earmarked for the teacher training institution which is under consideration. In these circumstances the Council is of the opinion that the ERC was justified in refusing grant of recognition to the appellant institution. The appeal therefore deserves to be rejected and the order of the ERC confirmed. AND WHEREAS after perusal of documents, memorandum of appeal, affidavit, VT Report and after considering oral arguments advanced during hearing, the Council reached the conclusion that there was no ground to accept the appeal and that it should be rejected. Accordingly, the appeal was rejected and ERC s order dated was confirmed.

College of Health and Physical Education, Patna, Bihar dated 23/09/2009 is against the Order No. ERC/7-99.6(1).27/2009/1116 dated 05/08/2009 of the Eastern Regional Committee, refusing recognition for conducting B.P.Ed course on the grounds 1) A list of requisite no. of teaching staff appointed has not been submitted by the institution. 2) Leagally valid land documents (English version of registered lease deed/patta, up-to-date land revenue receipts, non-encumbrance certificate for last 12/15 years in favor of the institution from the Tehsildar/ competent authority of the jurisdiction). 3) Building plan submitted by the institution not legible and not signed by competent authority, total area, built up area, plot no. kahta no., khasra no. not given. Approved building plan with Plot no,total area, built up area, plot no. kahta no., khasra no. from competent authority not submitted. 4) total area, built up area, plot no. kahta no., khasra no. not given in completion certificate submitted by the institution. Building completion certificate with total area, built up area, plot no. kahta no., khasra no. from the state govt. authority not submitted. 5) Lack of facilities for language learning. 6) The institution has not submitted the downloaded copies from the website. AND WHEREAS the Correspondent, Govt. College of Health and Physical Education (hereinafter referred to as the appellant), preferred an appeal dated 29/09/2009 to the National Council for Teacher Education, New Delhi (hereinafter referred to as the Council) under Section 18 of the NCTE Act, 1993 against the said Order. AND WHEREAS Shri. Ram Japan Rai, Principal and Shri. Vijay Kumar, Clerk, Govt. College of Health and Physical Education, Patna, Bihar presented the case of the appellant institution on In the appeal and during personal presentation it was submitted that the Institution is not a new Institution. The entire building and premises are owned by the Government. Since the building was constructed in 1956 the documents pertaining to such a building cannot be legible; and the building completion certificate was not mandatory 55 years back. The appellant has not given any reply to other important deficiencies relating to appointment of teaching staff and facilities for language learning. AND WHEREAS the Council noted that the appellant Institution was issued a letter of intent for grant of recognition on subject to fulfillment of the conditions laid down therein. The Institution despite having been given further opportunities by the ERC through their communications dated and has not been able to fulfill the essential requirements for the grant of formal recognition. In these circumstances the ERC was justified in refusing recognition. the Council therefore came to conclusion that the appeal deserves to be rejected and the order of the ERC confirmed.

10 AND WHEREAS after perusal of documents, memorandum of appeal, affidavit, VT Report and after considering oral arguments advanced during hearing, the Council reached the conclusion that there was no ground to accept the appeal and that it should be rejected. NRC/NCTE/F73/UP-2458/141st Meeting/2009/9077 dated 28/08/2009 of the Northern Regional Committee, refusing recognition for conducting B.Ed course on the grounds The list of appointed faculty as per NCTE norms has not been submitted till date. AND WHEREAS the Correspondent, Indira Gandhi Girls Degree College (hereinafter referred to as the appellant), preferred an appeal dated 31/08/2009 to the National Council for Teacher Education, New Delhi (hereinafter referred to as the Council) under Section 18 of the NCTE Act, 1993 against the said Order. AND WHEREAS Shri Ramesh Singh, Teacher, Indira Gandhi Girls Degree College, Gorakhpur, Uttar Pradesh presented the case of the appellant institution on In the appeal and during personal presentation it was submitted that the institution was issued letter of intent prior to recognition 20/02/2008 and in compliance to this the institution selected the faculty following the procedure laid down in the NCTE norms; institution wrote a letter to the Gorakhpur University on , asking for nomination of University experts for the Selection Committee; Selection Committee on 13/06/2008 selected the faculty and the list of teaching staff was duly approved by D.D. University, Gorakhpur on 09/08/2008; The faculty details alongwith the requisite affidavits were furnished to NRC on through FLYKING courier which were received by NRC on AND WHEREAS the Council noted that the institution selected the faculty by a duly constituted selection committee and the list was approved by the affiliating body; It further examined faculty profile and found that the staff was qualified as per NCTE norms. In view of the above, the Council came to the conclusion that there was adequate justification in accepting the appeal. AND WHEREAS after perusal of documents, memorandum of appeal, affidavit, VT report and after considering oral arguments advanced during the hearing, the Council reached the conclusion that there was adequate ground to accept the appeal and reverse NRC s order dated with direction to the NRC to grant recognition to the institution within 15 days of issue of this order.

13 F.No /2009-Appeal WHEREAS the appeal of Late R.I.Jamkhandi Kannada D.Ed College, Bagalkot, Karnataka dated 17/08/2009 is against the Order No. F.SRO/NCTE/D.Ed/ /14893 dated 30/07/2009 of the Southern Regional Committee, refusing recognition for conducting D.Ed course on the grounds 1) The management is running, School, D.Ed(Karnataka) in the same land and proposed D.Ed(Urdu)(Second Course) which are against the regulations of NCTE. No exclusive land available for proposed D.Ed Course. 2) The building is under construction for proposed D.Ed course as per notice reply. 3) The available books are not adequate for existing D.Ed and proposed D.Ed course(urdu). 4) The Management stated that the order has been placed for books. 5) The management has not provided exclusive land, infrastructural and instructional facilities for the proposed D.Ed(urdu) course. AND WHEREAS the Correspondent, Late R.I.Jamkhandi Kannada D.Ed College (hereinafter referred to as the appellant), preferred an appeal dated 08/09/2009 to the National Council for Teacher Education, New Delhi (hereinafter referred to as the Council) under Section 18 of the NCTE Act, 1993 against the said Order. AND WHEREAS Shri. Khaleela Ahmed N.T. Head Master and Shri. Maktumhusan, Secretary, Late R.I.Jamkhandi Kannada D.Ed College, Bagalkot, Karnataka presented the case of the appellant institution on In the appeal and during personal presentation it was submitted that they have applied D.Ed. (Kannada medium) as they are already running D.Ed. (Urdu medium); an exclusive area of 10,000 sq. ft. on the first floor of the existing D.Ed. Urdu medium college has been constructed for the proposed D.Ed. Kannada section; the society is running school in a separate building; the painting work of the newly constructed first floor was under progress; there are 4,050 books for both the courses and 1224 more books for the new course have been purchased and on receipt of recognition of NCTE the management will obtain permission from the Dist. Collector for earmarking the space for D.Ed course. AND WHEREAS the Council noted that while the inspection team as on found that the first floor was under construction, the appellant enclosed a building completion certificate which indicate that the year of construction of ground and first floor was 2007 and the date of inspection by the engineer was This clearly establishes that the institution has no separate building/ space for the proposed course. Moreover, the total buit up area for the existing and proposed course was not found to be adequate as per NCTE norms. Also, at the time of inspection, the building was not complete. Therefore the SRC was justified in refusing recognition. The Council has come to the conclusion that the appeal deserves to be rejected and the order of the SRC confirmed.

15 F.No /2009-Appeal WHEREAS the appeal of Meera Mahavidyalaya, Ujjain, Madhya Pradesh dated 25/09/2009 is against the Order No. WRC/APW05168/222271(Co- Ed)/121st/2009/58432 dated 29/07/2009 of the Western Regional Committee, refusing recognition for conducting D.Ed (Co.Ed) course on the grounds Appointed Principal does not have adequate teaching experience as per NCTE norms. AND WHEREAS the Correspondent, Meera Mahavidyalaya (hereinafter referred to as the appellant), preferred an appeal dated 01/10/2009 to the National Council for Teacher Education, New Delhi (hereinafter referred to as the Council) under Section 18 of the NCTE Act, 1993 against the said Order. AND WHEREAS Shri. Amit Upadhyay, Chairman and Shri. Neeraj Upadhyay, Secretary, Meera Mahavidyalaya, Ujjain, Madhya Pradesh presented the case of the appellant institution on In the appeal and during personal presentation it was submitted that that they have already changed the Principal as per the NCTE norms and rectified the position. However, from the documents furnished by the appellant it is observed that the institution constituted its own selection committee and the experience of the candidate selected for appointment as Principal includes experience as a visiting faculty. In the circumstances the WRC was justified in refusing recognition on the ground that the appointed principal does not have adequate teaching experience as per the NCTE norms. AND WHEREAS the Council, therefore, came to the conclusion that the appeal deserves to be rejected and the order of WRC confirmed. AND WHEREAS after perusal of documents, memorandum of appeal, affidavit, VT Report and after considering oral arguments advanced during hearing, the Council reached the conclusion that there was no ground to accept the appeal and hence it should be rejected. Accordingly, the appeal was rejected and WRC s order dated was confirmed. NOW THEREFORE, the Council hereby confirms the Order appealed against. (Hasib Ahmad) 1. 17 F.No /2009-Appeal WHEREAS the appeal of Pestle Weed College of Information Technology, Dehradun, Uttaranchal dated 14/09/2009 is against the Order No. F. NRC/NCTE/F- 3/UR-27/2009/8294 dated 17/08/2009 of the Northern Regional Committee, withdrawing recognition for conducting B.Ed course on the grounds 1) The submitted building plan is in the name of the college but total area, total built up area and course wise demarcated area are not mentioned in the building plan. 2) The minutes of duly constituted selection committee as per NCTE norms are not submitted. 3) The list of the faculty approved by the affiliating University has not been submitted. 4) The university letter regarding nomination expert on the selection committee has not been submitted. 5) no Supporting document regarding clarification of CPF scheme is submitted. 6) There is no faculty to teach methods of teaching Hindi, Sanskrit, etc. 7) As per reply of the institution dt.27/07/2009 CBSE affiliated institution is being run from the same premises. Further, Physics, Chemistry, and Biology labs of the CBSE INSTITUTION are being shared by B.Ed students which is not permissible as per NCTE norms for B.Ed. 8) 20 Computers are not sufficient for 200 Students. 9) No Bank statement regarding salary being paid through bank is submitted. 10) No supporting document regarding language learning facilities are submitted. 11) No proof regarding college website as required per NCTE Regulations, 2007 is submitted. 12) The number of titles in the library is not as per NCTE norms. 13) The institution has admitted general candidates against the SC/OBC vacant seats but no supporting State Govt. Further, as per category- wise bifurcation, 58 candidates have been admitted but the list of 50 candidates has been submitted. AND WHEREAS the Correspondent, Pestle Weed College of Information Technology (hereinafter referred to as the appellant), preferred an appeal dated 14/09/2009 to the National Council for Teacher Education, New Delhi (hereinafter referred to as the Council) under Section 18 of the NCTE Act, 1993 against the said Order. AND WHEREAS Shri. Prem Kashyap, Chairman and Dr. G.S. Aswal, Principal, Pestle Weed College of Information Technology, Dehradun, Uttaranchal presented the case of the appellant institution on In the appeal and during personal presentation it was submitted that the land area and built up area being used by the appellant is 7500 sq. mtrs. and sq. mtrs. respectively and the area for B.Ed and M.Ed courses is sq. mtrs. The selection committee was not formed as the University did not nominate an expert by then; the University s nomination of experts was conveyed only on ; a new date of interview will be fixed and proceedings of the selection committee will be submitted, thereafter the institution is

18 willing to abide by EPF scheme; there is qualified faculty for Hindi and Sanskrit teaching methods; science lab is now separated; 10 more computers have been purchased; salary to staff is being paid through bank; there is a website for the college; list of books is enclosed; no general candidate has been admitted against vacant SC / OBC seats; and no unsigned list of candidates was submitted and there was only a typing error in the general category. AND WHEREAS the Council noted from the presentation that the total built-up area of 6566 Sq.mt. was available with the appellant for conducting B.Ed (2 units), M.Ed (1 unit) and a school. Moreover, when the selection committee for appointment of faculty is stated to have already met on , with university nominee and has made selections as per NCTE norms, it needs to be taken into cognizance. Morever, the Regional Committee has withdrawn/refused recognition of the B.Ed. course, initially granted, without any reference to the subsequent recognition of additional intake for B.Ed. course and the sanction of M.Ed. course. In these circumstances the Council came to the conclusion that the NRC was not justified in withdrawing recognition without taking into account the functioning of the institution in a holistic manner, taking into account all the courses and total available infrastructural and instructional facilities in the institution. The report of the inspection conducted under Section 17 of NCTE Act on , has also confined its inspection to the B.Ed course but has observed that the number of teachers appointed by the institution for the two units of B.Ed were not sufficient, while endorsing that it has all other facilities; It did not specify the availability of the infrastructural facilities for the additional unit of B.Ed and M.Ed programme. In view of the above, the Council came to the conclusion that the case may be remanded to NRC for causing a composite inspection of the institution to ascertain availability of adequate facilities as per norms for all the teacher training programmes i.e. B.Ed (2 units) & M.Ed (1 unit) and thereafter pass an appropriate order. AND WHEREAS After perusal of documents, memorandum of appeal, affidavit, VT report and after considering oral arguments advanced during the hearing, the Council reached the conclusion that there was adequate ground to accept the appeal, set aside NRC s order dated and the case may be remanded to NRC for causing a composite inspection of the institution to ascertain availability of adequate facilities as per norms for all the teacher training programmes i.e. B.Ed (2 units) & M.Ed (1 unit) and thereafter pass appropriate orders. Till then the institution is to continue as a recognized institution. NOW THEREFORE, the Council hereby remands back the case of Pestle Weed College of Information Technology, Dehradun, Uttaranchal to the NRC, NCTE, for necessary action as indicated above. College (Lokhit Magaswargiya Shaikshanik Va Sanskrutik Krida Mandal), Washim-Dist., Maharashtra dated 03/08/2009 is against the Order No. No.WRC/APW06656/ /110th/VTR/2008/55689 dated 23/05/2009 of the Western Regional Committee, refusing recognition for conducting D.Ed (M) (Co-Ed) course on the grounds WRC considered the case of the institutions in light of letters F.No. 46-3/2008/NCTE(N&S)/84003 dt. 17 Sep, 2008, F.No /2007/NCTE(N&S) dt. 1 October, 2008 and F.No /2007/NCTE(N&S) dt. 31 October, 2008 received from, NCTE, New Delhi and negative recommendation received from Maharashtra State Govt. in respect of D.Ed. Course. Keeping in view of the negative recommendation received from the Maharashtra State Government in respect of D.Ed. course and directions received from NCTE Hqs, the WRC decided that no further processing will be done in this case. AND WHEREAS the Correspondent, Prashik Marathi D.Ed. College (Lokhit Magaswargiya Shaikshanik Va Sanskrutik Krida Mandal) (hereinafter referred to as the appellant), preferred an appeal dated 03/08/2009 to the National Council for Teacher Education, New Delhi (hereinafter referred to as the Council) under Section 18 of the NCTE Act, 1993 against the said Order. AND WHEREAS Shri. Kailas Kamble, Secretary and Shri. Ashish Bhagat, Member, Prashik Marathi D.Ed. College (Lokhit Magaswargiya Shaikshanik Va Sanskrutik Krida Mandal), Washim-Dist., Maharashtra presented the case of the appellant institution on In the appeal and during personal presentation it was submitted that the institution has made ready the entire infrastructure required for the D.Ed course; an inspection of the institution has been conducted; recommendation of the State Govt. is not valid to refuse recognition; the petitioner is willing to remove any lacunae or shortcomings, if pointed out; and the order is not a reasoned order. The petitioner also stated that his institution is a minority institution (Buddha Dharmiya) and enclosed a copy of the certificate issued by the Govt. of Maharashtra. 22 F.No /2009-Appeal WHEREAS the appeal of Rashidiya Rani Sagari Teacher's Education College, Gaya, Bihar dated 28/10/2009 is against the Order No. ERC/ (II)(1S).5/2009/1347 dated 31/08/2009 of the Eastern Regional Committee, refusing recognition for conducting D.Ed course on the grounds 1) The institution has not appointed requisite number of teaching staff qualified as per NCTE norms. 2) Affidavit R.100/- & Rs.10/- stamp paper regarding teaching staff not submitted. 3) The website of the institution is available but it does not have internet connection. And also on seeing of the website it is found that the site is suspended not functioning which is not as per Regulation. 4) The land and building of the institution are not in the name of the institute but on lease from a private person, not from Government as per VT Remarks. The same is not as per the NCTE Norms. 5) As per VT Remarks the fixed deposits made on the proposal name of the Secretary but not in the name of the institute. 6) The appointed teachers and the Principal are not qualified as per the NCTE Norms. 7) The Librarian does not have any qualification in Library Science as per VT remarks. 8) It has appointed non-teaching staff more than the needs as per VT remarks. 9) As per the VT remarks a part of the building is under construction. In this regard the institution has not submitted any supporting document. AND WHEREAS the Correspondent, Rashidiya Rani Sagari Teacher's Education College (hereinafter referred to as the appellant), preferred an appeal dated 28/10/2009 to the National Council for Teacher Education, New Delhi (hereinafter referred to as the Council) under Section 18 of the NCTE Act, 1993 against the said Order. AND WHEREAS Shri. Kishore Yadav, Assistant, Rashidiya Rani Sagari Teacher's Education College, Gaya, Bihar presented the case of the appellant institution on In the appeal and during personal presentation it was inter- alia submitted that the institute appointed a principal and five teaching staff and the list was sent on ; affidavits were sent on ; at the time of inspection internet connection was not available though website is there; when applied for recognition there was no provision to take land on lease from Govt; on land and building was made in the name of the institutions, FDR for Rs.3 lakhs has been converted in the name of the institution and Rs.5 lakhs is still with ERC and the librarian is qualified. AND WHEREAS the Council noted that the institution has not yet been given any recognition under Clause 7(9) of the NCTE Regulations and therefore ground of non-appointment of staff and website was not relevant at this stage. Moreover the application of the institution was dated and at that point of time land on lease basis was allowed by the NCTE. Further the institution created requisite FDRs

23 towards endowment fund and reserve fund. In view of the above the Council came to the conclusion that there was adequate justification in accepting the appeal to be remanded to ERC for issuance of letter of intent prior to recognition under Clause 7(9) of NCTE Regulations, so as to facilitate the institution to complete the formalities related to the appointment of staff etc. AND WHEREAS after perusal of documents, memorandum of appeal, affidavit, VT report and after hearing oral arguments advanced during the hearing, the Council reached the conclusion that there was adequate ground to accept the appeal, set aside ERC s order dated and remand the case to the ERC for issuance of letter of intent prior to recognition under Clause 7(9) of NCTE Regulations, so as to facilitate the institution to complete the formalities related to the appointment of staff etc. NOW THEREFORE, the Council hereby remands back the case of Rashidiya Rani Sagari Teacher's Education College, Gaya, Bihar to the ERC, NCTE, for necessary action as indicated above. Ed) course on the grounds The Professor and Reader do not have adequate teaching experience at M.Ed level as per NCTE Norms. AND WHEREAS the Correspondent, Rastrasant Tukdoji Maharaj College of Master in Education (Shri Durgamata Bahu-Uddeshiya Krida & Shaikshanik Sanstha) (hereinafter referred to as the appellant), preferred an appeal dated 10/09/2009 to the National Council for Teacher Education, New Delhi (hereinafter referred to as the Council) under Section 18 of the NCTE Act, 1993 against the said Order. AND WHEREAS Shri. Kapil G. Gaikwad, Vice-President and Shri. V.R. Thakur, Assistant, Rastrasant Tukdoji Maharaj College of Master in Education (Shri Durgamata Bahu-Uddeshiya Krida & Shaikshanik Sanstha), Parbhani, Maharashtra presented the case of the appellant institution on In the appeal and during personal presentation it was submitted that relevant documents regarding the experience of Professor and Reader have been submitted but the same were not considered. AND WHEREAS from the documents submitted by the appellant the Council noted that in so far as the experience of the Reader is concerned the total experience of candidate selected is 9 years in B.Ed. college instead of 10 years as prescribed in the NCTE Regulations; while Dr. D.K. Ambhore (candidate selected for the post of Professor) informed the institution that he would be joining as HOD on , the experience certificate dated issued by the Principal, Govt. College of Education, Parbhani indicated that he was still working in that college from Further in the notarized affidavit, Dr. Ambhore had not shown any experience beyond In view of these blatant discrepancies the claim of the appellant that relevant documents, have been sent, cannot be accepted. In these circumstances the Council came to the conclusion that there was no justification in accepting the appeal and that it should be rejected. AND WHEREAS after perusal of documents, memorandum of appeal, affidavit, VT Report and after hearing oral arguments advanced during hearing, the Council reached the conclusion that there was no ground to accept the appeal and that it

Institute of Education (For Girls) (hereinafter referred to as the appellant), preferred an appeal dated 30/10/2009 to the National Council for Teacher Education, New Delhi (hereinafter referred to as the Council) under Section 18 of the NCTE Act, 1993 against the said Order. AND WHEREAS Shri. Sushil Kumar, Gen. Secretary and Shri. Rakesh Kumar, Clerk, S.D. Institute of Education (For Girls), Ambala, Haryana presented the case of the appellant institution on In the appeal and during personal presentation it was submitted that the institution is situated in the Municipal limits of the Ambala and is not on agricultural land; the Distt. Town planner issued NOC on ; which was sent to the NRC; the Municipal Committee passed building plan on , which was also forwarded to the NRC; thereafter Municipal Committee also issued NOC on and therefore want of CLU cannot be a ground. A letter of inspection of the institution was issued by the NRC on and a general letter of the State Govt. should not be cited as a ground for rejection. AND WHEREAS the Council noting the submissions of the appellant and the general tenor of the letter from the State Govt. of Haryana, has come to the conclusion that the appeal deserved to be accepted and the order of the NRC be set a side with the direction to NRC to re-examine the matter for issue of orders under Clause 7(9) of the NCTE Regulations, AND WHEREAS after perusal of documents, memorandum of appeal, VT Report, affidavit and after considering oral arguments advanced during hearing, the Council reached the conclusion that there was enough ground to accept the appeal and that it should be accepted, set aside the order of the NRC dt and remand the case to the NRC for issuance of letter of intent prior to grant of recognition under clause 7(9) of the NCTE Regulations 2007.

AND WHEREAS the Correspondent, Shri Guru Tegh Bahadur Khalsa College (hereinafter referred to as the appellant), preferred an appeal dated 29/09/2009 to the National Council for Teacher Education, New Delhi (hereinafter referred to as the Council) under Section 18 of the NCTE Act, 1993 against the said Order. AND WHEREAS Shri. S.A.S. Goomer, Chairman, Shri. S.M.S. Chawla, Secreary and Dr. R.S. Chandok, Principal, Shri Guru Tegh Bahadur Khalsa College, Jabalpur, Madhya Pradesh presented the case of the appellant institution on In the appeal and during personal presentation it was submitted that on the basis of inspection report conducted under section 13 of the NCTE Act, NCTE Hqrs placed the name of the institution at Sl.No.202 under the list of institutions which are fit to undertake the examination for as per the order of the High Court. In the above context, it was no more open for the WRC to act on the order dt.31/07/2007 when the conditions stipulated therein stood satisfied at the later point of time. He, therefore claimed that the order dt was not warranted. AND WHEREAS the Council noted that consequent upon the directions of the Hon ble High Court of Jabalpur, an inspection of the institution was conducted on , u/s 13 of the NCTE Act. Based on the inspection report the institution was placed in the list of recognized institutions. The interim order issued by the Hon ble High Court of Madhya Pradesh, Jabalpur on listed this institution as a recognized institution. As such, the Council felt the WRC was not justified in considering the matter simultaneously or even thereafter and refuse the recognition, without taking into account the development, wherein the council in a separate action and after due consideration of the inspection report has treated this institution as a recognized institution. In view of this the Council came to the conclusion that there was adequate justification in accepting the appeal. AND WHEREAS after perusal of documents, memorandum of appeal, affidavit, VT report and after considering oral arguments advanced during the hearing, the Council reached the conclusion that there was adequate ground to accept the appeal and reverse WRC s order dated with direction to the WRC to restore the recognition of the institution, within 15 days of issue of this order.
