1 F.No /2010-Appeal WHEREAS the appeal of RBS College, Mathura, Uttar Pradesh dated 07/07/2010 is against the Order No. NRC/NCE/F-3/NRCAPP295/159 Meeting/2010/22140 dated 14/05/2010 of the Northern Regional Committee, refusing recognition for conducting D.El.Ed course on the grounds 1) Registered land document is not certified. 2) Submitted CLU is not notarized. 3) Khasra no./ghata no. is not mentioned on the Building Plan. AND WHEREAS the Correspondent, RBS College (hereinafter referred to as the appellant), preferred an appeal dated 08/07/2010 to the National Council for Teacher Education, New Delhi (hereinafter referred to as the Council) under Section 18 of the NCTE Act, 1993 against the said Order. AND WHEREAS Sh. Rajvir, Secretary, RBS College, Mathura, Uttar Pradesh presented the case of the appellant institution on In the appeal and during personal presentation, it was submitted that the certified copy of land documents as received from the Sub Registrar. Mathura was enclosed with the reply dt to the deficiency letter. CLU was not asked by the NRC and they now submitted a notarized CLU; and by mistake Khasra / Ghata number was not mentioned in the building plan which has been mentioned now. AND WHEREAS the Council noted that the appellant obtained a certified copy of the land document only on and the C.L.U was issued only on According to the provisions of the NCTE Regulations, 2009, these documents have to be submitted along with the application. Since the appellant has not fulfilled these requirements, the Council came to the conclusion that the NRC was justified in closing the file, and therefore the appeal deserved to be rejected and the order of NRC confirmed. and after hearing oral arguments advanced during hearing, the Council reached the conclusion that there was no ground to accept the appeal and that it should be rejected. Accordingly, the appeal was rejected and NRC s order dated 14/05/2010 was confirmed. NOW THEREFORE, the Council hereby confirms the Order appealed against. 1. 3 F.No /2010-Appeal WHEREAS the appeal of S.A College of Education, Nalanda, Bihar dated 06/07/2010 is against the Order No. ERC/ /2010/4079 dated 17/05/2010 of the Eastern Regional Committee, refusing recognition for conducting B.Ed course on the grounds 1) No FDR in the name of the institution. 2) The institution submitted term deposit advice of Rs lakh and Rs lakh but not submitted in Original FDR of Rs lakh and Rs lakh of a Nationalized Bank towards Endowment and Reserve funds. 3) Undertaking submitted by the institution not in prescribed from. 4) The land documents are in the name of individual. The land documents are in the name of S.A College of Education Sakin Sikandra Distt Nalanda secretary Salman Akhtar whereas it should be in the name of S.A College of Education Sakin Sikandra Distt Nalanda through its secretary Salman Akhtar. 5) As per the land documents the land documents are for agricultural land. 6) As per the building plan, there is no provision for multipurpose hall. 7) The Non-encumbrance certificate has been issued by the Circle Officer on 12th April 2010 whereas it should have been from the Revenue Authorities on the prescribed format. 8) The certified copy of land documents have been issued on 7th Dec i.e. after the date of application of the institution. 9) The Original affidavit complete in all respects has been sworn on 19th April 2010 i.e. after the date of submission of application. 10) The society applying for teacher training college has been formed on 11th April 2009, whereas the permission of the competent authority to use the land for educational activity has been obtained on 23rd March ) Notarized copy of conversion / change of CLU from the competent authority not submitted. AND WHEREAS the Correspondent, S.A College of Education (hereinafter referred to as the appellant), preferred an appeal dated 07/07/2010 to the National Council for Teacher Education, New Delhi (hereinafter referred to as the Council) under Section 18 of the NCTE Act, 1993 against the said Order. AND WHEREAS Sh. Salman Akhtar, Secretary, S.A College of Education, Nalanda, Bihar, presented the case of the appellant institution on In the appeal and during personal presentation, it was submitted that the FDRs are in the name of the President of the Trust, who is the authorized representative of the institute; FDRs have been submitted and they have been returned with the order dt ; undertaking, as prescribed and available on the NCTE website has been submitted; the land has been transferred to the institution and it is in the name of the S.A. College of Education through its secretary; it is mentioned in the gift deed that the land will be used according to the need of S.A College and Panchayat Officer has given a no objection certificate on ; there is a provision of an examination hall in the building plan, which has been converted into multipurpose hall; the Circle Officer who has issued a non encumbrance certificate is a Revenue Authority in Bihar; a certified copy of land document was got issued on

4 after receipt of deficiency letter; since a fresh affidavit was asked for in the deficiency letter, it was obtained later only; the land was available prior to and hence permission was obtained early; and the CLU was issued by Panchayat Office, who is the competent authority and notarized CLU was enclosed to the application. AND WHEREAS the Council noted that while the submissions made by the appellant in respect of FDRs, affidavit, multipurpose hall, undertaking, etc. are acceptable, the notarized copy of land use certificate issued by the Pancahayat Officer is not acceptable as change of land use is permitted by appropriate Revenue Authorities only and certified copy of the registered land document was obtained only as The appellant has therefore not submitted a certified copy of the registered land document and a notarized copy of the CLU issued by the competent authority along with the application as required under the provisions of the NCTE Regulations, In the circumstances the Council came to the conclusion that the appeal deserved to be rejected and the order of the ERC confirmed. and after hearing oral arguments advanced during hearing, the Council reached the conclusion that there was no ground to accept the appeal and that it should be rejected. Accordingly, the appeal was rejected and the ERC s order dated 17/05/2010 was confirmed. NOW THEREFORE, the Council hereby confirms the Order appealed against. 1. 5 F.No /2010-Appeal WHEREAS the appeal of S.A.M Mahila Mahavidyalaya, Firozabad, Uttar Pradesh dated 07/07/2010 is against the Order No. F.NRC/NCTE/F-3/UP-2779/162 nd Meeting/2010/ dated 21/07/2010 of the Northern Regional Committee, refusing recognition for conducting B.Ed course on the grounds The deficiencies communicated to the institute through letter NRC/NCTE/UP-2779/160 Meeting/2010/22945 dt. 01/06/2010 still exists. AND WHEREAS the Correspondent, S.A.M Mahila Mahavidyalaya (hereinafter referred to as the appellant), preferred an appeal dated 07/07/2010 to the National Council for Teacher Education, New Delhi (hereinafter referred to as the Council) under Section 18 of the NCTE Act, 1993 against the said Order. AND WHEREAS Sh. Parth Yadav, Secretary and Sh. Nitin Yadav, Member, S.A.M Mahila Mahavidyalaya, Firozabad, Uttar Pradesh presented the case of the appellant institution on In the appeal and during personal presentation, it was submitted that on receipt of the show cause notice dt from NRC, wherein it was pointed out that the faculty selected in 2009 being quite old, the institute may appoint required faculty as per NCTE norms and get the list approved by the affiliating University; the appellant constituted selection Committees including the experts nominated by the B.R. Ambedkar University, Agra and made selection of Principal and other faculty, which happened to be the same that was earlier approved. The appellant forwarded copies of the University s letters nominating experts minutes of the selection Committees affidavits and University s approval letter dt for the selected faculty to the NRC with his letter dt AND WHEREAS the Council taking into account the steps taken by the appellant in pursuance of NRC s show cause notice has come to the conclusion that the appeal deserved to be accepted, the order of NRC reversed with a direction to issue formal recognition order within 15 days of issue of appellate order. VT Report and after considering oral arguments advanced during the hearing, the Council reached the conclusion that there was adequate ground to accept the appeal, reverse NRC s order dated 21/07/2010 with a direction to issue formal recognition order within 15 days of issue of appellate order. NOW THEREFORE, the Council hereby reverses the Order appealed against.

7 F.No /2010-Appeal WHEREAS the appeal of Savita Devi Girls College, Meerut, Uttar Pradesh dated 06/07/2010 is against the Order No. F.NRC/NCTE/F-3/UP-3112/162 nd Meeting/ dated 16/08/2010 of the Northern Regional Committee, refusing recognition for conducting B.Ed course on the grounds 1) The institution has canceled information regarding details of other institutions in the application submitted to NRC. 2) The same Management is running another institution with file number UP-1282, Sarita Devi Mahavidyalaya at Khasra no ) Quite a few documents are same in file UP-3112 and UP ) The building is still under construction. 5) Psychology lab and science lab are in the same room. 6) Science lab is ill equipped. 7) ET and language lab are in the same room and ill equipped. 8) Library is not organized. The title of books, journals and encyclopedia are not as per NCTE norms for B.Ed. 9) Playground does not exist. 10) The approach road is not in good condition. 11) The website of the college does not exist. AND WHEREAS the Correspondent, Savita Devi Girls College (hereinafter referred to as the appellant), preferred an appeal dated 08/07/2010 to the National Council for Teacher Education, New Delhi (hereinafter referred to as the Council) under Section 18 of the NCTE Act, 1993 against the said Order. AND WHEREAS the appeal of the institution against the order of the NRC dt refusing recognition for conducting the B.Ed Programme on the ground that on the land bearing Khasra No. 645 another institution is proposed to be run by the some management was considered along with taking note of some other deficiencies. The Council in their Order dt remanded the case to the NRC to issue a speaking order. The NRC thereafter issued a speaking order dt again refusing recognition, against which the present appeal has been preferred. AND WHEREAS the Council noted that the appellant institution was issued letter of intent prior to grant of recognition under clause 7(9) of the NCTE Regulations, 2007 on On receipt of a reply dt from the institution regarding appointment of faculty and launching of website, the NRC issued a show cause notice on pointing out that the college website has not been developed. On receipt of a reply dt itself, the NRC issued a refusal order on on the ground that on the land bearing Khasra No. 645 another institution is proposed to be run by the same management. The Council noted that on the direction of the Council, the NRC has now issued a speaking order of refusal citing eleven grounds. AND WHEREAS Smt. Anuradha Malik, Asstt. Secretary, and Sh. Santosh Kumar, Office in-charge, Savita Devi Girls College, Meerut, U.P, presented the case of the appellant institution on In the appeal and during personal presentation, it

8 was submitted that in the application form there is no clause to mention the details of other institutions run by the applicant society; the same management is running another institution on Khasra No. 645; except for Society Registration and Bye-laws no other document is same in file No. UP and UP-1282; at the time of inspection construction of building of 1500 sq mts was complete and only plaster on outer walls and extra construction work for future expansion was going on ; psychology and science lab are in separate rooms; required equipments are there in science lab; as computers are mandatory for both ET and Language labs both are in the same room; library has 3074 books including 1014 titles, 200 reference books, 5 journals and 2 sets of encyclopedia and accession register and bills are enclosed; 1200 sq. mts of land is for play ground; approach road is made of cemented bricks; and the college website was shown to V.T. AND WHEREAS the Council noted that most of the grounds indicated in the NRC s order dt are based on the report of the visiting team that inspected the institution on and the NRC thereafter issued orders under clause 7(9) on The NRC received replies of the institution in respect of faculty and website on and The Council also noted that the submissions made in the appeal deserved acceptance. In the circumstances, the Council came to the conclusion that the appeal deserved to be accepted, the order of NRC reversed with a direction to NRC to consider the replies of the institution dt and and take further decision thereafter. VT report and after considering oral arguments advanced during hearing, the Council reached the conclusion that there was enough ground to accept the appeal and reverse the order of the NRC dt with the direction to consider the replies of the institution dt and and for further decision thereafter. 9 F.No /2010-Appeal WHEREAS the appeal of Seth Heera Lal Sunwallka Charitable Trust, Bhilwara, Rajasthan dated 14/06/2010 is against the Order No. NRC/NCTE/F-7/NRCAPP- 114/157 Meeting/2010/19770 dated 12/04/2010 of the Northern Regional Committee, refusing recognition for conducting D.P.Ed course on the grounds 1) FDRs of Rs.3 lac and Rs.5 lac have not been submitted. 2) Building plan is not approved by competent authority. 3) Building Completion Certificate is not from competent govt. authority. AND WHEREAS the Correspondent, Seth Heera Lal Sunwallka Charitable Trust (hereinafter referred to as the appellant), preferred an appeal dated 14/06/2010 to the National Council for Teacher Education, New Delhi (hereinafter referred to as the Council) under Section 18 of the NCTE Act, 1993 against the said Order. AND WHEREAS Sh.Mitthu Lal Ghwalka, Chief Trusty and Smt. Shakuntla Yadav, Kosha Adhyaksh, Seth Heera Lal Sunwallka Charitable Trust, Bhilwara, Rajasthan presented the case of the appellant institution on In the appeal and during personal presentation, it was submitted that the FDRs are ready and will be produced; the building completion certificate is being enclosed with the appeal and it was not stated who is the competent authority; and the building plan is approved by competent authority. AND WHEREAS the Council noted that the building plan was got approved only on and it does not contain Khasra / Plot number; the building completion certificate which was issued by the Gram Sarpanch on also does not indicate the details of land; and more importantly, the appellant has not furnished the FDRs for Rs. 5 and Rs. 3 lakhs, which according the provisions of the NCTE Regulations 2009 should have been sent along with the application itself. In these circumstances the Council came to the conclusion that the NRC was justified in closing the file, and therefore, the appeal deserved to be rejected and the order of NRC confirmed. and after considering oral arguments advanced during hearing, the Council reached the conclusion that there was no ground to accept the appeal and that it should be rejected. Accordingly, the appeal was rejected and NRC s order dated 12/04/2010 was confirmed.

11 F.No /2010-Appeal WHEREAS the appeal of Sharbati College of Education, Mohindergarh, Haryana dated 08/07/2010 is against the Order No. F.NRC/NCTE/HR-413/2010/162 nd Meeting/ dated 09/08/2010 of the Northern Regional Committee, refusing recognition for conducting B.Ed course on the grounds 1). The faculty till date has not been selected through dully constituted selection committee as per NCTE norms for B.Ed. 2). The College had admitted students for B.Ed. programme from ; ; without approval of NRC, NCTE. AND WHEREAS the Correspondent, Sharbati College of Education (hereinafter referred to as the appellant), preferred an appeal dated 08/07/2010 to the National Council for Teacher Education, New Delhi (hereinafter referred to as the Council) under Section 18 of the NCTE Act, 1993 against the said Order. AND WHEREAS The appeal of Sharbati College of Education, Mohindergarh, Haryana against the order of the NRC dt withdrawing conditional recognition for conducting B.Ed course, was accepted by the Council and in its order dt NRC was directed to issue a revised order specifying that it would be effective from the academic session The NRC in their order dt withdrew recognition from the academic session Aggrieved by these orders, the appellant filed a writ petition No of 2009 before the Hon ble High Court of Delhi at New Delhi and the Hon ble Court in their order dt inter alia directed the NRC to issue a show cause notice to the petitioner in terms of Section 17(1) of the NCTE Act and thereafter take into consideration the necessary material to satisfy itself whether the terms and conditions of the recognition granted on have been complied with or not. The NRC on receipt of the Hon ble Court s order asked the petitioner on to submit point-wise reply to their letter dt On receipt of a reply from the institution on and consideration of the same NRC in their order dt refused recognition on the grounds that faculty till date has not been selected through duly constituted Selection Committee as per NCTE norms and the college admitted students for the B.Ed programme from and without formal approval of NRC NCTE; against which the present appeal has been filed. AND WHEREAS Dr. (Major) Surat Singh Yadav, Chairman, Sharbati College of Education, Mohindergarh, Haryana presented the case of the appellant institution on In the appeal and during personal presentation, it was submitted that they had submitted the required information and documents relating to teaching faculty which has been proved in the judgment of the Hon ble High Court and during the course of inspection carried out by the M.D University inspecting team revealed that the faculty was selected by a duly constituted selection Committee.

12 AND WHEREAS the Council noted that the NRC has not followed the directions of the Hon ble High Court to specifically issue a show cause notice in terms of section 17(1) of the NCTE Act and changed their own order dt withdrawing recognition from the academic session into an order of refusal. The appellate order dt specifically took note of the interests of the students who were admitted and the affiliation granted by M.D. University even though the institution was not granted formal recognition. In the circumstances the order of the NRC refusing recognition is contrary to the intentions and directions of the Council. In the circumstances the Council came to the conclusion that the appeal deserved to be accepted, the order of NRC reversed with a direction to issue a formal show cause notice in terms of sec. 17(1) of the NCTE Act and take further necessary action. VT Report and after considering oral arguments advanced during the hearing, the Council reached the conclusion that there was adequate ground to accept the appeal and reverse the order dated of NRC with a direction issue a formal show cause notice in terms of sec. 17(1) of the NCTE Act and take further necessary action. 13 F.No /2010-Appeal WHEREAS the appeal of Shri Jwala Prasad Sharma Shikshan, Agra, Uttar Pradesh dated 07/07/2010 is against the Order No. NRC/NCTE/F-3/NRCAPP251/159 Meeting/2010/21825 dated 12/05/2010 of the Northern Regional Committee, refusing recognition for conducting D.El.Ed course on the grounds Submitted CLU is not notarized. AND WHEREAS the Correspondent, Shri Jwala Prasad Sharma Shikshan (hereinafter referred to as the appellant), preferred an appeal dated 07/07/2010 to the National Council for Teacher Education, New Delhi (hereinafter referred to as the Council) under Section 18 of the NCTE Act, 1993 against the said Order. AND WHEREAS Sh. Mukesh Sharma, Member, Shri Jwala Prasad Sharma Shikshan, Agra, Uttar Pradesh presented the case of the appellant institution on In the appeal and during personal presentation, it was submitted that he has inter alia enclosed a copy of the CLU to the application and in response to the deficiency letter, he has forwarded a stamped C.L.U issued by the competent authority on Along with the appeal he has sent a notarized copy of the same C.L.U. AND WHEREAS the Council noting that a C.L.U issued by the competent authority has all along been available in the records of the NRC and now a notarized copy also has become available has came to the conclusion that the appeal deserved to be accepted, and the order of NRC reversed with a direction to process the application on merits. and after hearing oral arguments advanced during the hearing, the Council reached the conclusion that there was adequate ground to accept the appeal, the order dated of NRC reversed with a direction to process the application on merit. 15 F.No /2010-Appeal WHEREAS the appeal of Shukdeo Prasad Tripathi Mahavidyalaya, Kushinagar, Uttar Pradesh dated 15/07/2010 is against the Order No. F.NRC/NCTE/F-3/UP- 2392/162 nd Meeting/2010/ dated 16/07/2010 of the Northern Regional Committee, refusing recognition for conducting B.Ed(Addl) course on the grounds The certified photocopy of certificates in respect of the appointed faculty has not been submitted. AND WHEREAS the Correspondent, Shukdeo Prasad Tripathi Mahavidyalaya (hereinafter referred to as the appellant), preferred an appeal dated 15/07/2010 to the National Council for Teacher Education, New Delhi (hereinafter referred to as the Council) under Section 18 of the NCTE Act, 1993 against the said Order. AND WHEREAS Sh. Divakar Mishra, Asst. Coordinator and Sh. Shubash P. Tripathi, Coordinator, Shukdeo Prasad Tripathi Mahavidyalaya, Kushinagar, Uttar Pradesh presented the case of the appellant institution on In the appeal and during personal presentation, it was submitted that they have removed the deficiency shown in the letter (show cause notice) of NRC dt and sent a reply on which has not been taken into account and refused recognition. AND WHEREAS the Council noted that in the show cause notice it has been mentioned that there is no faculty to teach methods of teaching Biology and English. The appellant with his reply dt , which is available in the file of the NRC, has furnished attested copies of the certificates in respect of two selected lecturers. These certificates being in order, the NRC should not have ignored them and refused grant of recognition. In the circumstances the Council came to the conclusion that the appeal deserved to be accepted, the order of NRC reversed with a direction to issue formal orders of recognition within 15 days of issue of the appellate order. VT Report and after considering oral arguments advanced during the hearing, the Council reached the conclusion that there was adequate ground to accept the appeal, the order dated of NRC reversed with a direction to issue formal orders of recognition within 15 days of issue of the appellate order. 17 F.No /2010-Appeal WHEREAS the appeal of Sonalal Brijlal Jain Bahuuddeshiya Sewabhavi Sanstha, Dhule, Maharashtra dated 06/07/2010 is against the Order No. WRCAP272/REJECTION/134th/2010/62923 dated 14/05/2010 of the Western Regional Committee, refusing recognition for conducting D.El.Ed course on the grounds 1) FDRs made on 26/03/2010, that is, after the date of application. 2) Certified copy of land document not submitted. 3) CLU issued on 26/02/2010 that is after the date of application. AND WHEREAS the Correspondent, Sonalal Brijlal Jain Bahuuddeshiya Sewabhavi Sanstha (hereinafter referred to as the appellant), preferred an appeal dated 08/07/2010 to the National Council for Teacher Education, New Delhi (hereinafter referred to as the Council) under Section 18 of the NCTE Act, 1993 against the said Order. AND WHEREAS Sh. According to the provisions of these Regulations, inter alia Fixed Deposit Receipts for Rs. 5 and Rs. 3 lakhs, a certified copy of the registered land document and a notarized copy of C.L.U have to be submitted along with the application. Since the appellant obtained the FDRs on , the CLU on and has not yet obtained a certified copy of the registered land document. The Council came to the conclusion that the WRC was justified in rejecting the application and therefore, the appeal deserved to be rejected and the order of WRC confirmed. and after considering oral arguments advanced during hearing, the Council reached the conclusion that there was no ground to accept the appeal and that it should be rejected. AND WHEREAS the Council noted that the visiting team which inspected the institution on has commented that labs and library are properly equipped and the institution made the purchases mentioned above before issue of the show cause notice on The Council therefore came to the conclusion that the appeal deserved to be accepted, the order of NRC reversed with a direction to issue letter of intent prior to grant of recognition under the provisions of clause 7(9) of the NCTE Regulations within 15 days of issue of appellate order. AND WHEREAS the Correspondent, Renaissance College of Education (hereinafter referred to as the appellant), preferred an appeal dated 13/07/2010 to the National Council for Teacher Education, New Delhi (hereinafter referred to as the Council) under Section 18 of the NCTE Act, 1993 against the said Order. AND WHEREAS Sh. Wasim Raja, Secretary, Renaissance College of Education, Bardhaman, West Bengal presented the case of the appellant institution on In the appeal and during personal presentation, it was submitted that land conversion certificate issued by Distt. Land & Land Reform Officer, Burdwan is dated and not and it was submitted on ; the application form in triplicate submitted was duly admitted by ERC; building plan containing plot number, total area and built up area approved by Gram Panchayat Pradhan has been submitted with the application; the building is not within the jurisdiction of BDO Nawda Block but under the jurisdiction of Galsi Block; non encumbrance certificate from revenue authority dt was submitted on ; the covered area of the building is 1581 sq. mts (17000 sq. ft); the land has been purchased by Renaissance College of Education and there is no condition in the deed of conveyance; and copies of FDRs duly attested by Bank manager have been submitted. AND WHEREAS the Council noted that conversion certificate was issued by Distt. Land & Land Reforms Officer, Burdwan on which was got notarized on ; the building plans(2) forwarded with the application were approved by Gram Pradhan and indicated plot number and built up area; no building completion certificate has been furnished; non encumbrance certificate has been issued on ; and originals of FDRs have not been sent but only photocopies were sent. The Council further noted that the appellant has not enclosed a certified copy of the registered conveyance deed for the land alongwith the application.

26 According to the provisions of the NCTE Regulations, 2009, inter alia, a certified copy of the registered land document, a notarized copy of the C.L.U and original FDRs have to be sent along with the application. Since these requirements have not been fulfilled by the appellant, the Council came to the conclusion that the appeal deserved to be rejected and the order of ERC confirmed. and after hearing oral arguments advanced during hearing, the Council reached the conclusion that there was no ground to accept the appeal and that it should be rejected. Accordingly, the appeal was rejected and ERC s order dated 15/05/2010 was confirmed. NOW THEREFORE, the Council hereby confirms the Order appealed against. 1. College (hereinafter referred to as the appellant), preferred an appeal dated 09/07/2010 to the National Council for Teacher Education, New Delhi (hereinafter referred to as the Council) under Section 18 of the NCTE Act, 1993 against the said Order. AND WHEREAS Sh. K.C. Samaria, Secretary and Sh. N.K. Arya, Member, Saharia B.Ed. College, Jaipur, Rajasthan presented the case of the appellant institution on In the appeal and during personal presentation, it was submitted that he had sent a detailed reply to the show cause notice dt on to NRC and the same has not been considered. In the appeal also he has put forth the same submissions which are contained in the reply to the show cause. AND WHEREAS the Council noted that the observations contained in the show cause notice are mostly based on the contents of the report of the visiting team which is very negative regarding the state of affairs of the institution. the Council is however not clear as to how the NRC examined the detailed reply of the institution and came to the conclusion that all the deficiencies communicated through their letter dt still exist. The Council is of the view that the NRC should have indicated in their withdrawal order as to which of the specific deficiencies were continued to be still existing, despite the reply of the institution. In the circumstances the Council came to the conclusion that the appeal deserved to be accepted and the order of NRC reversed with a direction to issue a speaking order indicating their observations on the pointed out deficiencies vis a vis the replies of the institutions. VT Report and after considering oral arguments advanced during the hearing, the Council reached the conclusion that there was adequate ground to accept the appeal and reverse the order of NRC dated 21/06/2010 with a direction to issue a speaking order indicating their observations on the pointed out deficiencies vis a vis the replies of the institutions.

AND WHEREAS Dr. D. Sivalingam, Managing Trustee and Dr. Balaji, Trustee, Sarada Ramkrishna College of Master of Education, Thiruvannamlai, Tamilnadu presented the case of the appellant institution on In the appeal and during personal presentation, it was submitted that the appellant had already applied to the NAAC on and as the B.Ed college completes its three year term at the end of the year , the NAAC certificate will be produced after its issue; CLU as well as building plan duly approved carries the survey No. 402/1 and 402/2 and these were submitted on ; and the built up area of 2150 sq. mts is exclusively made for M.Ed course and it is more than what is prescribed in the norms. AND WHEREAS the Council noted that the survey numbers are not mentioned in the building plans earlier submitted and they have been indicated only in the plan submitted with the appeal, the built up area has been mentioned in a revised affidavit only and most importantly, the appellant has not submitted NAAC certificate, which according to the provisions of clause 8(4) of the NCTE Regulations, 2009 should be available before an institution makes an application for a new course of M.Ed / M.P.Ed. Since the appellant has not fulfilled this requirement, the Council came to the conclusion that the appeal deserved to be rejected and the order of SRC confirmed. and after considering oral arguments advanced during hearing, the Council reached the conclusion that there was no ground to accept the appeal and that it should be rejected. Accordingly, the appeal was rejected and SRC s order dated 13/04/2010 was confirmed.

Teachers Training College (hereinafter referred to as the appellant), preferred an appeal dated 12/07/2010 to the National Council for Teacher Education, New Delhi (hereinafter referred to as the Council) under Section 18 of the NCTE Act, 1993 against the said Order. AND WHEREAS Sh. Y.K.N. Tewari, Chairman, Seva Samiti's A.Y.T. Teachers Training College, Siwan, Bihar presented the case of the appellant institution on In the appeal and during personal presentation, it was submitted that non-encumbrance certificates issued by advocate are accepted by banks / financial institutions and the NCTE Regulations also do not say that it should be from Revenue Authority; the land documents were accepted as valid and legal issued by the Anchal Adhikari when he allowed mutation and use of the land for educational purposes and approved building construction and a copy of mutation certificate is enclosed; though the land was initially acquired for residential purposes later he obtained permission of the Anchal Adhikari on to use the plot for educational purposes; and the appellant has removed the deficiency in affidavit in his letter dt AND WHEREAS the Council noted that the survey numbers of the land given in land documents, non encumbrance certificate and land use certificate are one and the same and the applicant has submitted along with the appeal a corrected affidavit dt mentioning correctly Eastern Regional Committee rectifying the earlier name of WRC. The Council considering all aspects of the matter has come to the conclusion that the appeal deserved to be accepted, the order of ERC reversed with a direction to process the application further on merit.
