3 Decision No: IN THE MATTER HDC/SP/244/2015 of the Sale and Supply of Alcohol Act 2012 AND IN THE MATTER of an application by Patrick Tama O Brien for an on-site special licence pursuant to Section 22 of the Act in respect of premises situated at 503 Railway Road, Hastings known as the Hastings Sports Centre. BEFORE THE HASTINGS DISTRICT LICENSING COMMITTEE AT A MEETING HELD IN THE LANDMARKS ROOM, GROUND FLOOR, CIVIC ADMINISTRATION BUILDING, LYNDON ROAD EAST, HASTINGS ON FRIDAY, 3 July 2015 AT 9.00AM. Chair: Councillor Kerr DECISION This is an application by Patrick Tama O Brien for an on-site special licence in respect of a martial arts and kickboxing event to be held at premises situated at 503 Railway Road, Hastings known as the Hastings Sports Centre. Reports were received from the Police and Medical Officer of Health indicating no objection to the application. A report was received from Licensing Inspector indicating no objection to the application subject to conditions. No objection or notice of desire to be heard has been received. Accordingly we deal with the matters on the papers. The Committee has considered the matters to which it is to have regard under section 142 of the Act and is satisfied that these are met. Accordingly the applicant is hereby granted a special licence authorising the sale and supply of alcohol for consumption on the premises, to any person attending the following occasion or event: Mixed Martial Arts and Kick Boxing

4 CONDITIONS The Special Licence is issued with the following conditions: (a) Alcohol may be sold under the licence only on the following days and during the following hours: Saturday 4 July pm to pm (b) The licensee must take the following steps to ensure that the provisions of this Act relating to the sale or supply of alcohol to prohibited persons are observed: There shall be no sale or supply to minors or intoxicated people. That the applicant fully complies with the undertakings set out in the application submitted. (c) The licensee must take the following steps to ensure that the provisions of this Act relating to the management of premises are observed: The premises are to be managed in respect of the sale of alcohol by Keri Dawn Gardiner (30/CERT/0562/2015). (d) Drinking water must be freely available at the following places while the premises are open for business: Easily accessible drinking fountains at the venue. (e) Food must be available for consumption on the premises as follows: Hot takeaway food including hot chips, pies, toasted sandwiches and hot dogs. (f) Low-alcohol beverages must be available for sale and supply on the premises as follows: Low Alcohol beer. (g) Non-alcohol beverages must be available for sale and supply on the premises as follows: Juices and soft drinks. (h) The licensee must take the following steps to provide assistance with or information about alternative forms of transport from the premises: Staff will promote taxi services at ticketing booths and bars.

5 (i) The licensee must file with the District Licensing Committee returns relating to the sale of alcohol as follows: Nil. (j) The licence is also subject to the following conditions, which in the committee s opinion are not inconsistent with the Act: The Alcohol Management Plan supplied as part of the application is to be fully complied with. (k) (l) The operation of this licence is subject to random inspection by the Hastings Police and/or Inspector of the Hastings District Council. Members of the public shall be excluded from the premises in the following circumstances: On the request of any member of the New Zealand Police or Inspector of the Hastings District Council.
