1 STATUTORY FORM 6 APPLICATION FOR SPECIAL LICENCE Section 138 Sale and Supply of Alcohol Act 2012 Adobe Acrobat V11 is required to fill this form online Download for free A SPECIAL LICENCE IS REQUIRED if you want to sell and/or supply alcohol at an event or series of events such as sporting events, birthday parties, social club events, bus trips etc. A SPECIAL LICENCE IS NOT REQUIRED if you are supplying alcohol to your guests in your own home, or your guests are bringing their own alcohol to your home. If you are supplying alcohol free to your guests at a genuine private social gathering which is not open to the public (and you are not there just for the purpose of meeting together to consume alcohol), then you also do not require a special licence. In this situation the alcohol must be genuinely free of any charge including a ticket cover charge. (Note some halls do not allow BYO functions and conveyances are not permitted to have BYO alcohol on board. In both cases you will need to hold a special licence to sell alcohol.) 1. On-site special licences allows the holder of the licence to sell and supply alcohol at a premises (or conveyance) for consumption at that premises or conveyance eg halls, tents, buses, etc 2. Off-site special licences allows the holder of the licence to sell alcohol at an event for consumption elsewhere. For example a stall at a fair only selling alcohol to be taken away Applications need to be submitted at least 20 working days before the first event date. If your application has been submitted late the District Licensing Committee (DLC) may only consider your application if it is satisfied that the need for the special licence could not have been foreseen earlier. The District Licensing Committee will decide if the application can be processed. Where this is declined, a refund will not be issued. YOUR APPLICATION MUST INCLUDE THE FOLLOWING DOCUMENTS (IN TRIPLICATE) 1. If the premises is not owned by the applicant, a written statement is required from the owner of the premises to the effect that the owner has no objection to the granting of the licence 2. Copies of tickets, invitations, guest lists and/or any promotional material for the event 3. A copy of your alcohol management plan (for events with more than 400 people) 4. A copy of the site layout or area and marquees etc (if the event is outside) 5. 2 NOTES: You can apply for up to 12 events or dates within a twelve month period on the same application (under certain conditions 24 dates will be accepted) A special licence must be for a legitimate event (or series of events) and not just alcohol consumption. For licensed premises it cannot merely be for an extension of hours or to cover days that your main licence excludes such as Easter Sunday, Christmas etc Licensed clubs hiring out their premises for functions not related to club activities must apply for a special licence Substantial food, non-alcoholic drinks and free water must be available during the event The DLC may require a certified manager to be appointed and may require a public advertisement to be placed in The Hutt News please discuss with a Licensing Inspector FUNCTIONS IN COUNCIL HALLS Contact Leisure Active in the first instance to check hall availability and book if necessary. BYO functions are not permitted in council halls, however an exemption may be considered for small gatherings, birthdays and weddings where adequate security arrangements are in place. SYSTEMS, STAFF AND TRAINING The object of the Sale and Supply of Alcohol Act 2012 is to ensure that the sale, supply and consumption of alcohol is undertaken safely and responsibly and to minimise harm caused by excessive or inappropriate consumption of alcohol.
