The pre-bid queries received after specified deadline as above, shall not be entertained in any case. ITB 7.4 A Pre-Bid meeting will not take place. A site visit will not be conducted by the Employer.

Preparation of Bids ITB 9.1 Bidder must submit the Bid Fee of Rs. 15, (INR Fifteen Thousand only) or USD 230 in the form of Demand Draft in favour of Gujarat Energy Transmission Corporation Limited, Vadodara. The Bid Fee will be submitted along with the Bid Security in the Technical Bid only. The bid without bid fee in the technical bid shall be rejected without further correspondence with the bidder. ITB 11.2 (k) The Bidder shall submit bid security along with Technical Bid only. (The cover of bid security shall be in the cover of Technical Bid only.). The bid without bid security or bid security having lesser amount and validity as specified in the bidding document shall be rejected. ITB 16.1 (b) The period following completion of plant and services in accordance with provisions of contract shall be 20 Years ITB 18.1 Bidder must quote for all the items in the price schedule. The discount offered by bidder shall be distributed proportionately to all the BoQ items uniformly. ITB 18.2 ITB 18.4 (a) and (b) No deviations are allowed. The bidder shall include all taxes & duties in Unit CIF price and/or Unit EXW price in Schedule-1 and Schedule-2 respectively for bought out items i.e. goods purchased by contractor from a third party manufacturer. For such bought out items, bidder shall give break-up of taxes & duties considered in the Unit ExW price or Unit CIF price to know the taxes & duties component to avail deemed export benefit, if applicable during contract period due to change in GoI import export policy. ITB 18.4 (a) (i) The Incoterm for quoting plant to be supplied from abroad is as per Incoterm 2010 edition of International Chamber of Commerce (CIF). Port of Entry is : Kandla / Bombay ITB 18.4 (b) (i) ITB 18.4 (b) (ii) ITB 18.4 (f) The Incoterm for quoting plant to be supplied from within the Employer s country is: (EXW) The foreign bidders may consult Indian tax experts in respect of taxes (Union or State tax) which are payable by the bidder and or by the Employer prior to bid submission" At the time of inviting the bid, this project does not get deemed export benefit. If the deemed export benefits are availed later on during the contract period due to change in Govt. of India import export policy then the same shall be passed on to Employer by the Contractor with effective date. The Employer will issue requisite certificate / documents only to get such deemed export benefit. The bidders who have quoted conditionally that their offer is subject to availability of Deemed export benefits will be treated as non-responsive, and hence will be rejected. ITB 18.6 ITB 19.1 ITB 20.1 The prices quoted by the Bidder shall be Item Rate basis on FIRM Price only The prices for Plant & Equipment (including Mandatory Spare Parts) Supplied from Abroad shall be quoted either in the currency of the Employer s country, or in United States Dollars. The price for Plant & Equipment (including Mandatory Spare Parts) Supplied from Employer s Country, Installation and Other Services shall be quoted in local currency (Indian Rupees). The bid validity period shall be 180 days from the date of opening of the technical bid but the bid security is valid 28 days beyond the bid validity period.

4 Page 4 of 7 ITB 20.2 In case the bid validity and bid security are extended as required by the Employer, the bid validity and bid security shall not be extended conditionally. ITB 21.1 Bidders have to submit the Bid Security of INR 27,00, If the Bidder s Bid Security is for an amount less than the amount specified above, its Bid shall be rejected. The type of acceptable Bid Security is that of a bank guarantee issued by a reputable bank located in the Purchaser s country or any other eligible country listed in Section-5 of the Bidding Document in the format included in Section 4: Bidding Forms and acceptable to purchaser valid up to 208 (180+28) days from the date of opening of the technical bid. If the Bid Security is issued by a bank located outside the Purchaser s country, it shall have a correspondent bank located in the Purchaser s country to make it easily enforceable. Bank Guarantees to be submitted against bid security, Performance Security, Advance Payment Security, Guarantee shall be furnished of following Banks: (A) Guarantees issued by following banks will be accepted on permanent basis: ii. iii. All Nationalized Banks including the Public Sector Banks IDBI Ltd. and Private Sector Banks authorized by RBI to undertake State Government Business. The written confirmation of authorization to sign on behalf of the Bidder shall consist of:

(b) The bids submitted by an existing or intended Joint Venture shall include and undertaking signed by all parties (i) stating that all parties shall be jointly and severally liable and (ii) nominating a representative, who shall have the authority to conduct all business for all and on behalf of any and all parties of the Joint Venture during the biding process and, in the event of Joint Venture is awarded the contract, during the contract execution. Evaluation, and Comparison of Bids ITB 37.1 The currency that shall be used for bid evaluation and comparison purposes to convert all bid prices expressed in various currencies into a single currency is: Indian Rupees The source of exchange rate shall be: Telegraphic Transfer Selling Rate of State Bank of India in India The date for the exchange rate shall be: Opening date of Technical Bid i.e. 15 th Jun 2016 ITB 38.1 ITB 39.2 ITB 42 ITB 42.2 ITB 43.2 ITB 43.2 A margin of preference shall not apply. The evaluation of the bid shall be done on end cost basis.(i.e. total price inclusive of all taxes, duties and other applicable charges) The percentage by which quantities may be increased is: twenty-five percentage (25 %) at contract price. Not applicable Prior to the expiration of the period of bid validity and after KfW No Objection to the bid evaluation report and award proposal, the Employer shall notify the successful Bidder, in writing, that its bid has been accepted. The notification letter shall be a formal information to the L1 Bidder (best-ranked Bidder) about the acceptance of his bid. The Notification of Award shall not constitute a binding contract. It shall specify the sum that the Employer will pay the Contractor in consideration of the execution and completion of the plant and services (hereinafter and in the Conditions of Contract and Contract Forms called the Contract Price ). Promptly after issuance of the notification letter the finalized draft contract, taking into account any deviations, if accepted by the Employer, as per ITB 18.2.and 42.2., will be submitted to KfW for No Objection. After receipt of this No Objection the Employer shall notify to the successful bidder, in writing, the formal acceptance of the contract (hereinafter and in the Conditions of Contract and Contract Forms called the Letter of Acceptance ). At the same time of issuance of the Letter of Acceptance, the Employer will publish in an English language newspaper or well-known freely accessible website the results identifying the bid and lot numbers and the following information: (i) name of each Bidder who submitted a Bid; (ii) bid prices as read out at bid opening; (iii) name and evaluated prices of each Bid that was evaluated; (iv) name of bidders whose bids were rejected and the reasons for their rejection; and (v) name of the winning Bidder, and the price it offered, as well as the duration and summary scope of the contract awarded. After publication of the award, unsuccessful bidders may request in writing to the Employer for a debriefing seeking explanations on the grounds on which their bids were not selected. The Employer shall promptly respond in writing to any unsuccessful Bidder who, after Publication of contract award, requests a debriefing.

Promptly after notification issuance of the Letter of Acceptance, the Employer shall send the successful Bidder the Contract Agreement. The contract shall be signed at Purchaser s office at Vadodara.
