3 Page 3 of 6 shall be 20 Years ITB 18.1 Bidders shall quote for the entire plant and services on a single responsibility basis such that the total bid price covers all the Contractor s obligations mentioned in or to be reasonably inferred from the bidding document in respect of the design, manufacture, including procurement and subcontracting (if any), delivery, construction, installation and completion of the plant. This includes all requirements under the Contractor s responsibilities for testing, precommissioning and commissioning of the plant and, where so required by the bidding document, the acquisition of all permits, approvals and licenses, etc.; the operation, maintenance and training services and such other items and services as may be specified in the Bidding Document, all in accordance with the requirements of the General Conditions. Items against which no price is entered by the Bidder will not be paid for by the Employer when executed and shall be deemed to be covered by the prices for other items. The following components or services will be provided under the responsibility of the Employer: 1. Terminal Gantry shall be provided by an Employer 2. Notification in Govt. Gazette shall be published by an Employer 3. Foundation drawing, tower drawing & BOM available with employer (list attached in Part-II) shall be provided for execution of work. The foundation drawing and tower details not available with the employer shall be designed and got approved by the bidder from employer with no extra cost to employer. 4. Parameters, Data etc. required for super structure / extension design and its foundation design. Where bids include the undertaking of the work or the provision of services or facilities by the Employer in excess of the above-mentioned work, services and facilities, the employer shall assess the costs of such additional work, services and/or facilities during the duration of the contract. Such costs shall be added to the bid price for evaluation. ITB 18.2 No deviations are allowed. ITB 18.4(a)(i) The Incoterm for quoting plant to be supplied from abroad is as per Incoterm 2010 edition of International Chamber of Commerce (CIF). Port of Entry is : Kandla / Bombay ITB 18.4(b)(i) ITB 18.4 (d) ITB 18.6 The Incoterm for quoting plant to be supplied from the Employer s country is: (EXW) The bidders are required to ascertain on their own availability of Deemed Export benefit. They are solely responsible for obtaining such benefits, which they have considered in their bids and in case of failure to receive such benefits for reasons whatsoever, including change in government of India export and import policy, the Employer will not compensate the bidder. Only requisite certificate / documents will be issued by the Employer. The bidders who have quoted conditionally that their offer is subject to availability of Deemed export benefits will be treated as non-responsive, and hence will be rejected. The prices quoted by the Bidder shall be Item Rate basis on FIRM Price only

4 Page 4 of 6 ITB 19.1 ITB 20.1 The prices shall be quoted either in the currency of the Empolyer s country, or in United States Dollars. For purposes of payment: (a) (b) (c) (d) A Bidder shall identify the portion of the bid price that corresponds to expenditures incurred in the currency of the Employer s country, which shall be paid in this currency; and A Bidder expecting to incur expenditures in other currencies for inputs supplied from outside the Employer s country (referred to as the foreign currency requirements ) and wishing to be paid accordingly, shall indicate up to three foreign currencies of their choice expressed as a percentage of the bid price, together with the exchange rates used in the calculations in the appropriate form(s) included in Section 4 (Bidding Forms). If some of the contract expenditures related to Installation and Other Services are to be incurred in the Employer's country, such expenditures shall be quoted in either foreign and/or local currency, depending upon the currency in which the costs are to be incurred. During the performance of the contract, the bid currency shall not be allowed to be changed. The bid validity period shall be 180 days from the date of opening of the technical bid but the bid security is valid 28 days after the bid validity period. ITB 20.2 ITB 21.1 ITB 21.5 ITB 21.7 ITB 22.1 ITB 22.2 The bid validity and bid security shall be extended by bidder in case required by the Employer and shall not be extended conditionally. Bidders have to submit the Bid Security of Rupees 4 million or equivalent amount in US$ or in any freely convertible currency. If the Bidder s Bid Security is for an amount less than the amount specified above, its Bid shall be rejected. Note: The applicable exchange rate on date of publication of the bid invitation i.e. 17 th Jul The source of exchange rate shall be Telegraphic Transfer Selling Rate of State Bank of India, India. The type of acceptable Bid Security is that of a bank guarantee issued by a reputable bank located in the Purchaser s country or any other eligible country listed in Section-5 of the Bidding Document in the format included in Section 4: Bidding Forms and acceptable to purchaser valid up to 208 (180+28) days from the date of opening of the technical bid. If the Bid Security is issued by a bank located outside the Purchaser s country, it shall have a correspondent bank located in the Purchaser s country to make it easily enforceable. The original price bid duly sealed and bid security of non-responsive bidder to the technical bid shall be returned before opening of the price bid. If the Joint venture has not been formed legally constituted at the time of bidding, the Bid Security shall be in the names of all future partners as named in the letter of intent mentioned in clause 4.1 of the Instruction to Bidders. D. Submission and Opening of Bids ITB 23.1 Bidders shall not have the option of submitting their bids electronically. ITB 27.1 ITB 29 If electronic bid submission is permitted in accordance with ITB 23.1, the specific bid opening procedures shall be: NA Bidder can ask any pre-bid clarification for the technical and/or financial part of the bidding documents in accordance to the ITB 7.1 (i.e. 21 days prior to the deadline for submission of bid as specified in BDS). The pre-bid queries received after specified deadline as above, shall not be entertained in any case. ITB 30.1 (a) No deviations are allowed. (b) No reservations are allowed. (c) In case of omission, the evaluation shall be done considering maximum price quoted by

However, payments for item omitted in tender shall not be made considering free supply and/or work item including increase of quantity up to twenty five (25%) of the ordered quantity. Bidder may note that such omitted item considered free supply shall have to be executed free of cost to the full extent required for completion of the work as per the actual engineering. Bidders are therefore advised to quote for the all items as per the BOQ. In case, quantity of such omitted item increases beyond twenty five (25%) of the ordered quantity during the execution of the work, payment shall be made as per the negotiated rate, mutually agreed between the Employer and Contractor. E. Evaluation, and Comparison of Bids ITB 36.1 In addition to the arithmetical corrections listed in ITB 36.1, (I) In case of discrepancy in total of individual item and multiplication of unit rate and quantity for the same item, corrected total calculated by multiplication of unit rate and quantity shall be considered for evaluation. (II) In case of variation in BoQ quantity and offered quantity, BoQ quantity shall be considered for evaluation purpose. ITB 37.1 The currency that shall be used for bid evaluation and comparison purposes to convert all bid prices expressed in various currencies into a single currency is: Indian Rupees The source of exchange rate shall be: Telegraphic Transfer Selling Rate of State Bank of India in India The date for the exchange rate shall be: Opening date of Technical Bid i.e. 30 th Aug 2012 ITB 38.1 ITB 42 A margin of preference Shall not apply.
