3 Section I: Invitation for Sealed Quotation Name of the Office: (Nepal Telecom), Wireline and Customer Service Directorate Address of the Office: Chauni, Kathmandu Invitation for Sealed Quotation Sealed Quotation No: NDCL/WCSD-SQ-XX/ Date of first Publication: May 3, 2018 (Baisakh 20, 2075) 1. The Nepal Telecom, Wireline and Customer Service Directorate invites sealed quotations from registered Suppliers for Supply and delivery Twenty Four (24) Core Self Supporting Aerial Optical Fiber Cable 2. Interested eligible Suppliers may obtain further information and inspect the Sealed quotation forms at the office of Nepal Telecom, Wireline and Customer Service Directorate, Chhauni, Kathmandu Phone: Fax No Sealed Quotation Forms may be purchased by eligible Suppliers on the submission of a written application and upon payment of a non-refundable fee of Rs Sealed Quotations must be submitted to the above office on or before 11:45 am on 18 th May, 2018 (Jeshth 4, 2075). Quotation received after this deadline shall not be accepted. 5. Quotations must be valid for a period of 45 days after opening of Sealed quotations i.e., (1 st July, 2018) 6. Bids must be accompanied by a Bid Security amounting NPR 2,43, which shall be valid for 90 days after opening of the Sealed Quotations (i.e 15 August, 2018). The bid security must be furnished by any one of the "A" class commercial bank licensed from Nepal Rastra Bank located in Nepal. 7. If bidder wishes to submit the Cash Security, the cash should be deposited in Nepal Telecom s Account No at Nabil Bank limited, Supporting Aerial Optical Fiber Cable Page 3 of 12

4 Pulchowk, Lalitpur, Nepal and submit the receipt of the deposited amount of cash along with the Sealed Quotation. 8. Sealed Quotation shall be opened in the presence of Suppliers' representatives who choose to attend at 12:00pm on 18 th May, 2018 (Jesth 4, 2075) at the office of Nepal Telecom, Wireline and Customer Service Directorate, Chhauni, Kathmandu. 9. If the last date of purchasing, submission and opening falls on a government holiday then the next working day shall be considered the last day. 10. 6 Section II: Instructions to Bidder 1. Scope of Works The Purchaser stated in the Invitation for Quotation invites bids for the Supply and delivery of Twenty Four (24) Core Self Supporting Aerial Optical Fiber Cable as detailed in attached specifications and the bill of quantities provided herein. 2. Eligibility criteria a) This Invitation for Bids is open to all registered Suppliers in Nepal with qualifications as described below (without which bid shall be rejected): b) Up to date Firm/Company Registration Certificate of Bidder c) VAT and PAN Registration Certificates of Bidder d) Tax Clearance Certificate of fiscal year ( B.S) of Bidder e) The Power of Attorney and signature specimen of the Authorized Person of bidder. f) Manufacturer's Authorization Letter/s for offered Goods from the manufacturer. g) Quality Assurance Certificate ISO 9000 Series Certificate of the Manufacturer of the Optical Fiber Cable(OFC) valid at least up to the date of sealed quotation invitation h) The manufacturer/s of offered goods must have a manufacturing experience of at least five (5) years on the date of bid opening. In order to prove this requirement, the Bidder shall submit authentic documents from concerned authority or user/client certificate. i) The Manufacturer of Optical Fiber shall have supplied more than One (1) Thousand Kilometer of Optical Fiber Cable till the date of bid opening. The Manufacturer of offered Optical Fiber Cable shall have supplied Optical Fiber Cable to at-least Three (3) different Service Providers/ administrations. In order to prove the fulfilment of this requirement, the Bidder shall submit user/client certificates from the users. j) Detailed Supply Records of the offered goods as per Annex I Supporting Aerial Optical Fiber Cable Page 6 of 12

7 k) Bid Submission Form duly signed with date by the authorized person and stamped with official seal as per Section IV "Bidding Form". l) Prices Schedule duly filled and signed with date by the Authorized Person and stamped with official seal in accordance with Section VI: Quotation and Price Schedule offered goods m) The Bidder and Manufacturers shall furnish self declaration letter regarding offered goods shall be Genuine, newly manufactured & Unused. n) The Bidder and Manufacturers shall provide self declaration letter of not involved in fraudulent activity such as carteling in order to manipulate the bid price, submission of fake certificates and fake information. o) The Manufacturers shall provide Product Catalogue, Brochures with Technical Specification of offered goods and Company Profile. p) The Bidder and Manufacturers shall provide self declaration letter of not have a conflict of interest. q) The offered Twenty Four (24) Core Self Supporting Aerial Optical Fiber Cable shall have been used satisfactorily for a minimum period of Two (2) years on the date of bid opening. In order to prove the fulfilment of this requirement, the Bidder shall submit user certificate from the Telecom operators /User Administration. Note: The Copy document submitted shall be notarized. 3.One Bid per Bidder 4. Content of Quotation Form Each Bidder shall submit only one quotation, A Bidder who submits more than one quotation shall cause all the quotations with the Bidder s participation to be disqualified. Clarification A prospective bidder requiring any clarification of the bidding documents may notify the Nepal Telecom in writing at the mailing address indicated in the invitation for bids. The Nepal Telecom will respond in writing to any request for clarification of the bidding documents received not later than Seven (7) days prior to the deadline date for the submission of bids. Written copies of the Nepal Telecom's response (including an explanation of the query but without identifying the source of the inquiry) will be sent to all prospective bidders who have purchased the bidding document. 6. Language of Quotation All documents relating to the Quotation shall be in English or in Nepali. The Quotation by the Bidder shall comprise the following: 7. Documents Comprising Quotation a. Technical Specifications The Bidder shall indicate on the appropriate Price Schedule the unit prices (where applicable) and total price of the goods to be supplied under the contract. 8. Quotation Prices All duties, taxes and other levies payable by the Bidder under the contract shall be included in the rates, prices and total Bid Price submitted by the Bidder. Price quoted by the Bidder shall remain fixed and valid until completion of the Contract Performance and will not be subject to variation in any account. 9. Quotation Validity The Quotation shall remain valid for the period of 45 days (i.e., 1 st July, 2018) after opening of the quotation. Supporting Aerial Optical Fiber Cable Page 8 of 12

Deadline for Submission of Quotations The Bidder shall furnish a Bid Security in Nepali Rupees ( NPR) 2,43, and shall be valid for the period of 90 days from the Sealed Quotations opening date (i.e. 15 August, 2018). The bid security must be furnished by any class A commercial bank which is approved by Nepal Rastra Bank. Insufficient Bid Security Amount or Validity shall result in rejection of bid. If bidder wishes to furnish Cash deposition, the cash shall be deposited to Nepal Telecom Account no maintained at Nabil Bank limited, Pulchowk, Lalitpur. Nepal and shall submit the original receipt (No Photocopy) of the deposited amount along with the Sealed Quotation. The Quotation shall be typed or written in indelible ink and shall be signed by an authorized person. Any entries or amendments including alternations, additions or corrections made shall be initialled by the same authorized person. The Bidder shall submit the Quotation in sealed envelopes. The envelope shall be addressed to the Purchaser specified in the Invitation for Quotation and shall bear the name and identification number of the quotation. Quotations shall be delivered to the Purchaser at the address no later than the time and date specified in the Invitation for Quotation. 14. Late Quotation Any Quotation received by the Purchaser after the deadline shall not be accepted and shall be returned unopened to the Bidder upon request. 15. Modification And Withdrawal Quotations once submitted shall not be withdrawn or modified. 16. Bid Opening The Purchaser shall open the Quotations in the presence of the Bidders' representatives who choose to attend at the time and in the place as specified in the Invitation for Quotation. In case the bidder's representative is not present during the bid opening, bid shall be opened in the date & time specified. Supporting Aerial Optical Fiber Cable Page 9 of 12

10 The Purchaser shall prepare and provide minutes of the opening including the information disclosed to those present. 17. Process to be Confidential Information relating to the examination, evaluation and comparison of Quotations and recommendations for the award of a contract shall not be disclosed to Bidders or any other persons not officially concerned with such process until the award to the successful Bidder has been announced. Any efforts by the Bidder to influence the Purchaser in the Quotation evaluation, comparison or contract award decisions may result in rejection of Bidder s quotation. 18.Examination of Quotations Prior to the detailed evaluation of Quotations, the Purchaser shall determine whether each Quotation meets the eligibility criteria defined in Clause 2 of this section as well as following examination Preliminary Examination of the Bids shall be done in accordance with Clause No. 2. Nepal Telecom will examine the bids to verify whether the bid is valid & complete, whether the bid is accompanied by valid bid securities, whether required sureties have been furnished, whether the documents have been properly signed, and whether the bids are generally in order Detailed Technical evaluation shall be carried out for those bids, which are found to be responsive after preliminary examination. Technical Examination of the Bids shall be done in accordance with Section V: Technical Specification Detailed Commercial Evaluation shall be carried out for those bids, which are found to be responsive after Detail Technical Evaluation as per section V. The detail commercial evaluation shall be carried out in accordance with the Section III: Conditions of Contract Once the bids are considered substantially responsive after detailed Technical and Commercial evaluation, all those responsive bids shall be judged from Financial Evaluation perspective only and no weight-age shall be given to other technical details or parameters or additional features and facilities of the offered products. 11 19. Evaluation and Comparison of Quotations 19.1 In evaluating the Quotations, the Purchaser shall determine for each Quotation the evaluated Bid Price by adjusting any corrections for errors. Quotations shall be checked by the Purchaser for any arithmetic errors. Errors shall be corrected by the Purchaser as follows: a. where there is a discrepancy between the amounts in figures and in words, the amount in words shall govern; and b. where there is a discrepancy between the unit rate and the line item total resulting from multiplying the unit rate by the quantity, the unit rate as quoted shall govern 19.2 If the Bidder does not accept the corrected amount, the Quotation shall be rejected and the Security pursuant to Clause 10 may be forfeited. 20. Award of Contract The Purchaser shall decide the award of the contract, within 15 days of the opening of the quotation, to the Bidder whose Quotation is within the approved estimate and who has offered the lowest evaluated Bid Price, provided that such Bidder has been determined to be eligible in accordance with the provisions of Clauses Purchaser's Right to Accept or Reject The Purchaser reserves the right to accept or reject any Quotation or to cancel the bidding process and reject all Quotations, at any time prior to the award of the contract, without assigning any reasons whatsoever and without thereby incurring any liability to the affected Bidder or Bidders. 12 22. Notification of Award and Signing of Agreement 22.1 The Bidder whose Quotation is accepted and all other participating bidders shall be notified of the award by the Purchaser. Within 7 days of receipt of the notification, the successful Bidder shall deliver the Performance Security pursuant to Clause 23 and sign the Agreement Inability of the Bidder to make an Agreement within the above stated period shall result in cancellation of the Contract Award and forfeiture of the Bidder s Security, upon which the Contract shall then be awarded to the next successive successful Bidder. The successful Bidder shall deliver to the Purchaser a Performance Security in cash or Bank Guarantee of the any "A" class commercial bank licensed from Nepal Rastra Bank located in Nepal is acceptable to the Purchaser equivalent to 5 % of the Quotation amount. 23. Performance Security i) If bid price of the bidder selected for acceptance is up to 15 (fifteen) percent less than the approved cost estimate, the performance security amount shall be 5 (Five) percent of the bid price. ii) If the bid price is more than 15 (Fifteen) percent low of the cost estimate, the performance security amount shall be determined as follows: Performance Security Amount =[ [0.85 x Cost Estimate Bid Price) x 0.5] + 5 % of Bid Price.
