3 INSTRUCTIONS TO BIDDERS (ITB) 1. All bidders are required to read these conditions carefully and submit one set duly signed by them as token of having read, understood and accepted the conditions, along with information called for by MRPL. 2. The Bidding document shall be read in conjunction with any amendment(s) issued. 3. Bidders should get clarified all the technical doubts and other points related to the tender before submitting the priced and un-priced offer. 4. No assumption, stipulation, deviations from terms and conditions or presumptions, etc. shall be made by the Bidder while submitting the offer in the Price Part of the Tender. The liability of obtaining all necessary clarity with respect to the tender, its technical aspects and pricing shall be on the Bidder. MRPL shall be under no obligation whatsoever to entertain any tender bid which is based on any assumption, stipulation, deviations from terms and conditions or presumptions, etc. and would have the option to reject such bid. 5. Bidder shall submit the offer in two parts, i.e. Technical Bid and Price Bid in separate sealed covers through post (in case of manual tender)/ uploaded in the system (in case of E Tender). 6. In case of manual tender, both the sealed covers containing Part-1 (Un priced Technical Bid) and Part- 2 (Priced Bid) shall be put in one single cover and submitted by duly super-scribing Tender Number & Bid Closing date. In case offer received without super-scribing Tender Number it will be treated as unsolicited offer. Part I - TECHNICAL BID Bidders are required to serially number all the pages being appended by them as part of submission to the Technical bid. Such numbering shall include, Covering letter, Technical specifications, items list being offered, Drawings, Specification, Certificates, Catalogues, Compliance or Deviation statements, etc. as applicable to this Tender and create an Index Page with headings and corresponding page numbers. In addition to this, all pages of the Tender Documents issued by MRPL shall be signed on all pages and to be submitted by post (in case of manual tender)/ uploaded in the system (in case of E Tender). Part II - PRICE BID Contain only Price Bid of the offer. 7. In case, PRICE BID is included in TECHNICAL BID portion, or PRICES are mentioned in the technical bid itself the entire bid will be rejected. 8. Bidders may attend Pre Bid Meeting (If applicable), Technical Bid/ Price Bid Opening at own expense and interest. Queries if any, to be sent 2 days prior to pre bid meeting. 9. Date and Time of Price bid opening shall be advised separately to the technically qualified bidders. 10. In case of Tender fee/emd, the parties are requested to send Tender fee through DD/EMD of prescribed value by way of DD/BG issued by a Scheduled/ Nationalised Bank in the name of MRPL, payable at Mangaluru along with a request letter. MRPL will not be responsible for any loss or postal delay / non receipt of tender/ Tender Fee/ EMD etc. Date format should be DD.MM.YYYY (Date/Month/Year) format. In case the tender fee/emd is/are paid electronically, then proof of the same shall be provided. 11. Tender Fee (through DD)/EMD, as mentioned above in the form of DD/BG drawn in favour of MRPL, Mangaluru to be couriered to Materials Department, MRPL, Kuthethoor PO, Via Katipalla, Mangaluru and bidder shall ensure to submit the same at MRPL before bid closing date and time. In case payment is done electronically, bidder shall ensure to submit the proof within the bid closing date/time. Rev 0, dated Page 3 of 18

4 12. The Bank Guarantee by Indian Bidders will be given on non- judicial stamp paper as per stamp duty applicable at the place where the tender has emanated. The non-judicial stamp paper should be in name of the issuing Bank. The Bank Guarantee by Indian bidders will be given from Nationalized /Scheduled Banks only. The Foreign bidders will give Bank Guarantees from an Indian Bank situated in their city or the from the bank list provided along with tender. 13. Bids without Tender Fee (If applicable), EMD (If applicable) & Integrity Pact (where applicable) duly NOT signed in all pages will be summarily rejected, without any further reference to the Bidder. 14. In case of manual tenders, all the Rates given in the Tender must be expressed both in words and in figures and in case of difference between the two, the rates given in words would be final and considered correct. In case of any differences between unit rates and totalised rates quoted by the bidder, then the unit rates shall prevail. 15. Any corrigendum / amendment to the tender will be uploaded on MRPL website e- Procurement site and will not be published through press advertisement. Prospective bidders should visit the above MRPL website/ e-procurement site from time to time to make note of corrigendum / amendment if any. MRPL will not be responsible for nonreceipt of communications in this regard. 16. Deviation on Pre-Qualification Criteria (as applicable) and Bidders Evaluation Criteria is not acceptable and such Bids having any deviation are liable for rejection. 17. Date format should be DD.MM.YYYY (Date/Month/Year) format in respect of dates mentioned by bidders in their offer. 18. The tender terms/ conditions as per SCC (Special conditions of the contract) Supersedes all similar terms prescribed under GCC. 19. Where applicable, offers of those vendors who do not attach the Integrity Pact duly signed shall be summarily rejected without any further reference to the vendor. 20. Tenders are invited on-line on the website from the firms having Class IIB or above Digital Signature Certificate (DSC) (with Signing & Encryption Certificate) issued by any agency authorized by Controller of Certifying Authority (CCA), Govt. of India. 2. Offers received online on the e-procurement e portal only will be considered for evaluation. 3. The server date and time as appearing on website shall only be considered as cut-off time for receipt of tenders. Offers received by any other mode will not be considered. 4. Bidders are responsible for obtaining the digital certificates for participation / submission of bids at their cost/ updating necessary software(s)/ browsers from time to time which are compliant with the e- tendering portal. 5. 6 Pre-Qualification Criteria:- 1. The bidder should be an Original Equipment Manufacturer (OEM) of Dynamic Shear Rheometer (DSR) or an authorized dealer of the Original Equipment Manufacturer (OEM). If the bidder is a dealer of the OEM, then the bidder should submit the valid authorization letter from OEM along with technical bid of the offer 2. The bidder, who intended to participate for the item indicated in the tender, should have supplied, installed and successfully commissioned at least one number of Dynamic Shear Rheometer to any Refinery Quality control Laboratory OR R&D Centers, Reputed National Institutions OR any Hydrocarbon Industries having similar applications during past 5 years ending last day of the previous month in one which the tender is invited. The bidder should submit relevant documentary evidence such as copy of the confirmed purchase order, installation report and a recent performance report along with the technical bid of the offer. Rejection Criteria:- The offer(s) of bidder(s) is/are liable for rejection in case of following conditions: 1. The bidder does not comply with PQC and BEC. 2. Either the Indian agent on behalf of the Principal / OEM or Principal / OEM themselves can bid but both cannot bid simultaneously for the same item / product in the same tender. If both OEM and his agent submit bids, only bid submitted by OEM will be considered and bid submitted by agent will be rejected. 3. If an agent submits bid on behalf of the Principal / OEM, the same agent shall not submit a bid on behalf of another Principal / OEM in the same tender for the same item / product. In such eventuality, both offers will be rejected. 4. EMD in original, is not found in Technical bid of the offer. However, PSU/ firms registered with NSIC/ MSE (Micro Small Enterprises) vendors registered with DIC (District Industries Centres) or any other body specified by Ministry of Micro, Small & Medium Enterprises (MoMSME), provided they are registered for the Items they intend to quote and they submit evidence irrespective of the monetary value limit mentioned in their registration certificate, are exempted from submission of EMD. 5. The benefit of PP Policy is not applicable to Traders/ dealers / resellers/ distributors/ authorised agents registered with NSIC/MSE (Micro & Small), firms registered with District Industries Centre (DIC) and therefore such vendors are NOT EXEMPTED from submission of EMD. Offer of such bidders without required amount of EMD shall be rejected. 6. The bidders failure to enter into Integrity Pact (if applicable) and non-submission of duly signed Integrity Pact copy along with technical bid of the offer. 7. The Technical bid contains Prices or offer is submitted in single bid i.e. Price Bid and Technical Bid submitted together as a single bid. 8. If vendor has sought any techno- commercial deviation. 7 Bid Evaluation Criteria:- 1. The bidder quote should be in toto with respect to all the Technical requirements. Incomplete offer / not confirming to our technical specification/requirements will not be considered for technical evaluation. 2. The bidder should have well established service center and well trained service personal in India for the item indicated. The bidder should offer service/maintenance of the instrument indicated in the tender at MRPL site only OR at the bidder s service center located in India. Instrument cannot be sent out side India for repair, calibration and service. The bidder should submit an undertaking along with the technical bid of the offer. 3. The bidder should agree to enter into AMC/CMC after the warranty period. The payment terms for AMC/CMC will be done after each service visit or as per the terms and conditions of MRPL. The bidder should submit an undertaking along with the technical bid of the offer. 4. Technically accepted bids will be evaluated on overall L1 basis. 5. In case, if it is found that the L1 price quoted by the vendors is identical, preference for Order shall be given to the vendor who quotes least delivery period. Rev 0, dated Page 7 of 18

14 TECHNICAL SPECIFICATIONS Technical requirements Bidder Compliance 1.0 Item description Dynamic Shear Rheometer (DSR) for the measurement of rheological properties of Asphalts and Modified asphalts. The instrument should meet all the requirements of standard ASTM D 7175, D 4402, D 7405 and D Scope of supply 2.1. General The bidder should quote for all the items indicated in scope and comply with the requirements. The bidder should submit all the documents as per the tender requirements Main unit The bidder should quote one number of DSR machine under the heading Dynamic Shear Rheometer (DSR) for the measurement of rheological properties of Asphalts and Modified asphalts. The offered DSR machine should comply all the technical specifications and other requirements. The bidder should offer only the latest model DSR available at the time of bidding and guarantee for minimum seven years service support in terms of software up-gradation, spares and consumables from the date of installation of the system at MRPL. The offered DSR should be fully tested and calibrated at factory (OEM) and should come with the factory test reports and the same should be demonstrated at MRPL during installation. Note: During installation, if the offered DSR machine does not meet the performance requirements, it will be rejected and the bidder should replace the system without any financial implications to MRPL Data system: Under the heading "Data System" the bidder should offer data system (computer & printer) required for the DSR. The offer shall include Laser jet printer and MNC brand computer with below indicated specifications or better: Rev 0, dated Page 14 of 18

15 CPU Intel core i5 processor or better, RAM Minimum 6GB DDR3 or better, HDD - Minimum 1TB or better, Graphics Intel HD graphics or AMD Radeon, USB port 6 or 8 GB ethernet, display 21 TFT monitor or better, keyboard and mouse. The bidder should offer genuine licensed latest windows operating system and licensed version anti-virus software. The vendor should also offer licensed version Microsoft office for exporting the distillation data to Excel. The bidder should submit all the above licenses to MRPL during installation. The bidder should agree to make necessary arrangements for the service support for the offered data system. The bidder will be the point of contact for any complaints or service for the offered instrument Calibration and verification standards Bidder should quote the required Calibration Standards necessary for the calibration and verification 2.5. Essential spares and accessories. The bidder should offer item wise quote for all the required essential spares required for two years of trouble free operation under the heading -'Essential Spares & Accessories' Installation and training charges The scope includes on-site training by qualified installation/application engineer for routine analysis, application/method development, calibration, routine maintenance etc to MRPL officers for a minimum period of 5 working days. The bidder shall quote for installation and training charges, if any, under the heading 'Installation and training charges'. The bidder should inspect and verify all the items against the Purchase order, immediately after the receipt of the consignment at MRPL and shall install at MRPL site Local and free supply items. If the offer includes any local supply, which should be clearly indicate in the offer as local supply Items. 16 3. Technical specifications 3.1. General The offered DSR machine should cover the determination of the dynamic shear modulus and phase angle of asphalt binders when tested in dynamic (oscillatory) shear using parallel plate geometry and should be applicable to asphalt binders having dynamic shear modulus values in the range from 100 Pa to 10 MPa. The instrument should meet all the ASTM test requirements (Especially, ASTM D 7175, D 4402, D 7405 and D 7552) with following technical specifications. Bidder should comply & confirm against following technical specification; 1. Advanced rotational rheometer for the visco-elastic characterization of asphalt, polymer modified asphalt, polymer melt and other petroleum products. 2. Oscillatory mode tests should include torque, frequency sweep, strain, creep, stress tests and combination of the stress/strain tests. 3. Flow mode tests should include stress and torque sweep at controlled speed and sweeps. 4. Instrument should transient mode with single and multi level creep/stress studies should be possible with the machine. 5.
