Sykes DATE March 29, 2011 RE: Administrative Fee for Appointed Counsel In 1997, the Tennessee General Assembly enacted Public Chapter 547 providing for the assessment of an administrative fee on indigent criminal and juvenile delinquent defendants who are provided court appointed counsel. Court appointed counsel includes public defenders and private attorneys. The public chapter authorized a fee of between $50 and $200 per defendant. Public Chapter 547 is codified in Tennessee Code Annotated sections and The legislation required court clerks to submit monthly reports to the Administrative Office of the Courts. The reports were to contain the following information: how many defendants were appointed counsel, how many defendants were assessed or had a fee waived, and the amount collected by the clerk s office and submitted to the Department of Revenue. The attached report was compiled from information received from the court clerks and the Department of Revenue. To achieve uniformity in the reporting process, judges designated to hear cases out of their assigned courts and other individuals appointed to hear cases have been listed as Special/Designated Judge. Also, when reports for municipal courts were received in our office without a judge s name, a search was made of the Municipal Technical Advisory Service website to obtain a judge s name. Therefore, the municipal judge s names may not be current. Only those judges with data reported will be listed. The 2010 reports submitted by the clerks show that 211,857 defendants were appointed counsel. Of those, 89,535 had the fee waived and 122,322 were ordered to pay the fee. The Department of Revenue reported receiving $1,476, from the clerks for deposit into the state s general fund. Montgomery County reported the largest amount collected by a county with $84, Since enactment of this legislation a total of $13,764, has been deposited into the fund.
