3 Miami Daily Business Review Sept. 28, 2018 Miscellaneous Notices CUTLER CAY COMMUNITY DEVELOPMENT DISTRICT FISCAL YEAR 2018/2019 REGULAR MEETING SCHEDULE NOTICE IS HEREBY GIVEN that the Board of Supervisors of the Cutler Cay Community Development District will hold Regular Meetings in the Cutler Cay Community Clubhouse, 7755 SW 192nd Street, Cutler Bay, Florida 33157, at the times specified for the following dates: October 8, 2018 at 4:00 p.m. February 11, 2019 at 4:00 p.m. April 8, 2019 at 4:00 p.m. June 10, 2019 at 10:00 a.m. August 12, 2019 at 10:00 a.m. The purpose of these meetings is to conduct any business coming before the Board. Meetings are open to the public and will be conducted in accordance with the provisions of Florida law. Copies of the Agenda for any of the meetings may be obtained from the District's website or by contacting the District Manager at Ext and/or toll free at From time to time one or two Supervisors may participate by telephone; therefore a speaker telephone will be present at the meeting location so that the Supervisors may be fully informed of the discussions taking place. Said meeting(s) may be continuedas found necessary to a time and place specified on the record. If any person decides to appeal any decision made with respect to any matter considered at these meetings, such person will need a record of the proceedings and such person may need to insure that a verbatim record of the proceedings is made at his or her own expense and which record includes the testimony and evidence on which the appeal is based. CALL TO ORDER Mrs. Perez called to order the August 27, 2018, Special Board Meeting of the Cutler Cay Community Development District at 4:00 p.m. in the Cutler Cay Community Clubhouse located at 7755 SW 192 nd Street, Cutler Bay, Florida B. PROOF OF PUBLICATION Proof of publication was presented that notice of the Special Board Meeting had been published in the Miami Daily Business Review on August 13, 2018, as legally required. C. ESTABLISH A QUORUM It was determined that the attendance of the following Supervisors constituted a quorum and it was in order to proceed with the meeting: Chairman Christopher Musser, Vice Chairperson Lois Rubin, Supervisors Donna Fishbein and Robert Gonzalez. Staff in attendance were: District Manager Gloria Perez of Special District Services, Inc. and District Counsel Ginger Wald of Billing, Cochran, Lyles, Mauro & Ramsey, P.A. D. ADDITIONS OR DELETIONS TO THE AGENDA There were no additions or deletions to the agenda. E. COMMENTS FROM THE PUBLIC FOR ITEMS NOT ON THE AGENDA There were no comments from the public for items not on the agenda. F. APPROVAL OF MINUTES 1. July 9, 2018, Public Hearing & Special Board Meeting The minutes of the July 9, 2018, Public Hearing & Special Board Meeting were presented and the Board was asked if there were any additions and/or corrections. There being no additions and/or corrections, a MOTION was made by Supervisor Gonzalez, seconded by Vice Chairperson Rubin and unanimously passed to approve the minutes of the July 9, 2018, Public Hearing & Special Board Meeting, as presented. G. OLD BUSINESS There were no Old Business items to come before the Board. H. NEW BUSINESS 1. Update on Road Striping Project 1 of 2 Page 2

5 Mrs. Perez advised the Board that the striping project was scheduled to begin on September 5, 2018, weather permitting. Supervisor Milian arrived at approximately 4:05 p.m. 2. Consider Approval of Proposed Settlement Agreement in the Case of DeFeo v. Cutler Cay Community Development District Ms. Wald provided an overview of the case. It was noted that the website modifications were being looked into by District management. Staff recommended approval of the settlement. A brief discussion ensued followed by the following motion: A MOTION was made by Supervisor Fishbein, seconded by Chairman Musser and passed unanimously approving the Settlement Agreement in the case of DeFeo v. Cutler Cay Community Development District, as presented. I. ADMINISTRATIVE MATTERS 1. Financial Update Mrs. Perez presented the financial statement through July Financials are stable for the year and will cover budgeted expenditures. Available funds as of July 31, 2018, were $297, J. BOARD MEMBER/STAFF COMMENTS/REQUESTS There were no comments from the Board Members or Staff. K. 6 RESOLUTION NO A RESOLUTION OF THE BOARD OF SUPERVISORS OF THE CUTLER CAY COMMUNITY DEVELOPMENT DISTRICT AUTHORIZING AND ADOPTING AN AMENDED FINAL FISCAL YEAR 2017/2018 BUDGET ( AMENDED BUDGET ), PURSUANT TO CHAPTER 189, FLORIDA STATUTES; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the Board of Supervisors of the Cutler Cay Community Development District ( District ) is empowered to provide a funding source and to impose special assessments upon the properties within the District; and, WHEREAS, the District has prepared for consideration and approval an Amended Budget. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF SUPERVISORS OF THE CUTLER CAY COMMUNITY DEVELOPMENT DISTRICT, THAT: Section 1. The Amended Budget for Fiscal Year 2017/2018 attached hereto as Exhibit A is hereby approved and adopted. Section 2. The Secretary/Assistant Secretary of the District is authorized to execute any and all necessary transmittals, certifications or other acknowledgements or writings, as necessary, to comply with the intent of this Resolution. The Oaks Center 2501A Burns Road Palm Beach Gardens, FL Re: Year 2018 Cutler Cay CDD Report Dear Ms. Perez: The intent of this report is fourfold: 1) To inform as to the status of ownership of the infrastructure that was financed or constructed by the District; 2) To describe the state, working order and condition of the infrastructure still owned by the District; 3) To give recommendations as to the funds estimated necessary for the proper maintenance, repair and operation of the District s infrastructure and; 4) To report on the insurance being carried by the District. The District is located in Sections 2 and 3, Township 56 South, Range 40 East, in Miami-Dade County, Florida. It is bounded by Old Cutler Road on the west, SW 185 Terrace and undeveloped land on the north, Biscayne Bay on the east, and SW 196 Street on the south. The development is located within Zip Code See Exhibit Infrastructure Ownership and Maintenance Responsibilities. a. General i. The CDD owns the land and improvements within the tracts shown in Exhibit 1. These tracts and improvements were granted in 2008 to the District by Shoma Development Corporation (the Developer ) and by The Cutler Cay Homeowners Association, Inc. (the HOA ) via Quit-Claim deeds recorded at ORB 26735, PG 1457 and ORB 26735, PG 1455, respectively. The portions of Old Cutler Road and SW 196 Street that lie within the development were dedicated to Miami-Dade County by the recording of the plat titled Cutler Cay in Plat Book 162, Page 23. The water and sanitary sewer systems were completed and conveyed to Miami-Dade County for ownership and maintenance. b. Maintenance Responsibilities of CDD-Owned Facilities i. The District signed a Maintenance Agreement dated March 9, 2009 with the Page 9

Roads, Perimeter Walls, Fences, Landscaping and i. The roads and other CDD-Owned facilities named above are in good working order and condition. It is recommended that in FY 2018/2019, funds be allocated for pavement marking replacement since they are beginning to fade. ii. Funds will be needed to mill and resurface the 73,300 Square Yards of asphalt pavement in CDD roads in about 15 years. The District Board of Supervisors may decide how to provide for these funds, whether by an annual assessment or at some time in the future. The present costs for milling 1 of asphalt is $3.00/SY and for placing 1 of asphalt is $6.50/SY. Therefore, the present costs for milling and resurfacing the District roads is estimated to be as follows: 1. Milling 1 of asphalt: 73,300 $3.00/SY = $ 219, Resurfacing 1 of asphalt: 73,300 $6.50/SY = $ 476, Total Present Value: $ 696,350 In addition to the above, the CDD should budget about $1,000 per year for miscellaneous traffic signs and pavement marking repairs b. Stormwater Management System, Lakes, Ponds, Drainage and Open Areas i. The drainage and stormwater management system is in good working order and condition except for the area at SW 188 Terrace and SW 74 Court which floods periodically during major storms. 4 Alvarez Engineers, Inc. 15 Cutler Cay CDD 2018 Report ii. The following is a suggested program for cleaning the inlets, manholes, pipes, French drains and repairs of baffles in the District roads. The cleaning should be done as needed when a drainage problem is reported. To calculate the yearly maintenance cost, it can be assumed that one phase of 25% of the drainage structures will require service on a year, so that theoretically the entire system (all four phases) will be cleaned every four years. Therefore, using an estimated cost of $155 for cleaning one drainage structure, then: 1. Phase I: 82 $155/Structure = $12, Phase II: 112 $155/Structure = $17, Phase III: 83 $155/Structure = $12, Phase IV: 86 $155/Structure = $13,330 In addition to the above, the District should budget about $1,000 per year for miscellaneous drainage repairs. iii. The following is a suggested program for maintaining the lakes. There are four lakes within the District, they are identified in the plat of Cutler Cay in Plat Book 162, Page 23 as Tract O, Tract N, Tract B and Tract C. The total perimeter of the lakes is approximately 10,350 LF. Using an estimated cost of $0.07 per linear foot of lake perimeter, the estimated monthly budget amount is $725/month. The monthly services should include: 1. Algae and aquatic plant control. 2. Border grass and brush control to water s edge. 3. Monthly water testing. 4. Fish and wildlife monitoring. 5. Debris removal. 6. Management reporting. 7. Fish stocking should be optional and not included in the monthly cost. c. Water Distribution System i. The water distribution was completed and conveyed in good working order and condition to Miami-Dade County for ownership and maintenance. ii. Issues may be reported to the County at either of the following numbers: (Emergencies) or (Customer Service). d. Sanitary Sewer System i. The sanitary sewer system was completed and conveyed in good working order and condition to Miami-Dade County for ownership and maintenance. ii. District Roads i. The District has budgeted funds for maintaining the roads and perimeter walls and fountain as shown above. c. Stormwater Management System i. The District has budgeted funds for maintaining the drainage system, lakes and ponds as shown above. d. Water Distribution System i. No maintenance costs are estimated since the water distribution system is owned and maintained by Miami-Dade County. e. Sanitary Sewer System i. No maintenance costs are estimated since the sanitary sewer system is owned and maintained by Miami-Dade County. 4. Insurance Alvarez Engineers has reviewed the District s general liability, property, hired nonowned auto, employment practices liability and public officials liability coverage insurance policy provided by Florida Insurance Alliance under Agreement No , for the period between October 1, 2017 and October 1, The District has budgeted sufficient funds to cover the $6,323 insurance premium. 6 Alvarez Engineers, Inc. Description of Public Facilities the District is Building, Improving or Expanding During the Fiscal Year , the District completed or is considering the following actions: - Repair of the asphalt in front of SW 74th Avenue and near SW 74th Avenue. - Repair of the perimeter wall located on Old Cutler Road. - Repair of damaged curbing within the Districts. - Installation of signs Prepare to Stop Ahead, thermoplastic double yellow lines, stop bars and rpms signs on required areas within the District. - Improvement of road striping. - Repair and upgrade of the southern entrance water feature structures. 19 FINANCIAL RISK MANAGEMENT POLICY Special District Services, Inc. ( SDS, Inc. ), acting in the capacity of District Manager, as part of good management practices and to satisfy annual audit requirements does implement certain measures and procedures to identify and mitigate financial mismanagement/fraud risks, as follows: a. Each month the District s operating/checking bank account is reconciled by an authorized person who has not deposited funds to, processed expenditures or written checks from, that particular operating/checking account; and b. Each expenditure from the District s operating/checking account requires a minimum of two (2) approvals from authorized staff and/or District officials and the respective approvals are provided by persons other than the preparer of the expenditure(s); and c. All financial transactions are logged and maintained by the District Manager for record keeping purposes; and d. A designated member of the Board (by an electronic approval procedure) has an opportunity to review the District s expenditure(s) prior to the payment(s) being released; and e. The District engages an independent firm, pursuant to Chapter , Florida Statutes, to audit the prior year s financial activities (October 1 st through September 30 th ) from which an independent fiscal year annual audit is prepared; and f. Within sixty (60) days of the end of each fiscal year (September 30 th ) the District s Board of Supervisors reviews, pursuant to Chapter (5), Florida Statutes, the prior year s budget relative to actual revenues and expenditures and adopts by resolution an amended/revised final budget.
