1 SECOND MENDMENT TO GREEMENT BETWEEN CTY OF JCKSONVLLE ND ULD & WHTE CONSTRUCTORS, NC. FOR DESGN BULD SERVCES FOR MNOR- MEDUM SZE CVL ENGNEERNG & PRK MPROVEMENT PROJECTS (SOUTH RE) ~H~ SECOND MENDMENT to greement is made and entered into this _jj)_ day of.. {, 2015, by and between the CTY OF JCKSONVLLE, a Florida municipal corpsj1lion in Duval County, Florida (the "Owner") and ULD & WHTE CONSTRUCTORS, NC., a Florida profit corporation with an office at 4168 Southpoint Parkway, Suite 101, Jacksonville, Florida (the "Design-Builder"), for various specific minor to medium size civil engineering and park improvement projects in the South rea (the "Projects"). WHERES, on September, 2009, the parties made and entered into City of Jacksonville Contract No (the "greement"); and WHERES, said greement has been amended once previously; and WHERES, said greement should be amended further by extending the period of service from March 2, 2015, through September 30, 2015, with no increase to the maximum indebtedness, such maximum indebtedness remaining an amount not-to-exceed 12,000, for the period September, 2009, through September 30, 2015, and with all other provisions, terms, and conditions of said greement remaining unchanged; now therefore N CONSDERTON ofthe mutual covenants and obligations contained herein, Owner and,design-builder agree as follows:. The above-stated recitals are accurate, true, and correct and are incorporated herein and made a pmt hereof by this reference. 2. Section 1.2 of said greement is amended by extending the period of service from March 2, 2015, through September 30,2015, and as amended shall read as follows: "1.2 Period of Service: This greement shall commence on the Effective Date and shall continue and remain in full force and effect thereafter until September 30, 2015, or until earlier termination as provided in rticle 8 hereof or rticle 11.2 of the General Conditions of Contract." 3. The total maximum indebtedness shall remain a not-to-exceed amount of 12,000, SVE ND EXCEPT as expressly amended by this instrument, the provisions, terms, and conditions of said greement, as previously amended, shall remain unchanged and shall continue in full force and effect.
