The tender forms can be downloaded from our Website: 2. The tenderer should pay an amount of Rs.100/- (Rupees One hundred only) towards tender fee for submission of tender for Pest Control Services in form of Demand Draft drawn favoring LIC of India on any Nationalized Bank payable at Agra OR vide MR at ZTC counter along with duly furnished tender forms. 3. The sealed quotation should be accompanied with a refundable Earnest Money Deposit (EMD) of Rs.1,000/-(Rupees One thousand only) in the form of Demand Draft drawn favoring LIC of India on any Nationalized Bank payable at Agra OR vide MR at ZTC counter, without which the Bid will not be considered. The EMD will not carry any interest and it will be refunded/ adjusted towards security deposit soon after the finalization of the tender. 4. The Terms and Conditions governing the tender are given herewith. 5. All pages of the tender forms will have to be signed and sealed by the tenderer as proof of its acceptance. 6. Tenders should be submitted in the form of two bid system viz. one sealed cover superscribed as Technical Bid for Pest Control Services and another sealed cover superscribed as Financial Bid for Pest Control Services. 7. The applicants should submit self attested copies of following documents in the sealed envelope superscribed as Technical Bid for Pest Control Services : a. Tender Document: (Page No. 2 to 14) all pages duly signed and sealed by the tenderer. b. PAN Card. c. License to stock and use restricted Insecticides for Commercial Pest Control Operations. d. Demand Draft for Rs. 100/- in favour of LIC of India payable at Agra OR copy of MR towards Tender Fees e. Demand Draft for Rs. 1,000/- in favour of LIC of India payable at Agra OR copy of MR towards EMD 8. The Financial Bid should be submitted in the format given in the Page No. 14 of the Tender Document. Financial Bid should be submitted in a separate sealed cover and marked as Financial Bid for Pest Control Services. 9. These two individual sealed covers are to be kept in a single big sealed cover superscribed as Tender for Pest Control Servicesat ZTC, Agra. 10. The sealed envelopes should be addressed and submitted to The Chairperson, Stores Committee, LIC of India, North Central Zonal Training Centre, JeevanVidya, Sikandara, Agra The tenders should reach the above address or to be dropped into Page 2 of 14

4 Tender for Pest Control Services at ZTC, Agra Eligibility Criteria & Requirements 1. The applicant must be a Registered/Licensed Organization/Govt. undertaking/ Partnership firm / Sole proprietorship / Individual. 2. The applicant must have valid License to stock and use restricted Insecticides for Commercial Pest Control Operations. 3. Non disclosure of relevant information or furnishing of incorrect information / documents will suffer disqualification of the application at any stage. 4. The applicant must not have been at any time declared as insolvent or convicted for any offence by any Authority. The applicant must not have been prosecuted or suffered any penalty for violation of any labor laws by any Authority. 5. The applicant should not have rescinded/abandoned any Pest Control contract awarded by any of his clients before the expiry of prescribed period of contract. 6. The applicant should neither be a sub-contractor to any other entity/ person nor has at any time sub-let the contract awarded to the applicant to any other person. 7. LIC of India is not responsible in any manner for the postal delay/loss/ non receipt of the tender. 8. The tenderers are advised to inspect the premises etc. where the services are required to be offered and assess for requirements themselves before submission of the tender. 9. The tenderer should pay an amount of Rs.100/- (Rupees One hundred only) towards tender fee for submission of tender for Pest Control Services in form of Demand Draft drawn favoring LIC of India on any Nationalized Bank payable at Agra OR vide MR at ZTC cash counter along with duly furnished tender forms. 10. The tenderer should pay an amount of Rs.1,000/-(Rupees One thousand only) towards refundable Earnest Money Deposit (EMD) in the form of Demand Draft drawn favoring LIC of India on any Nationalized Bank payable at Agra OR vide MR at ZTC cash counter, without which the Bid will not be considered. The EMD will not carry any interest and it will be refunded/ adjusted towards security deposit soon after the finalization of the tender. 11. The successful tenderer will be required to deposit an amount of Rs. 10,000/- (Rupees Ten Thousand only) by way of a crossed A/c payee demand draft favouring LIC of India, drawn upon any Nationalized Bank at Agra towards security deposit. This deposit will be refunded only on successful completion of the agreement period. No interest will be payable on this security deposit. 12. The Competent Authority reserves the right to change the relevant dates; to accept or reject all or any of the applications; to accept any higher bid; or cancel all tenders without assigning any reasons whatsoever. Selected Bidder will have to execute a contract (agreement) with ZTC, Agra on a non judicial stamp paper of appropriate value. 15. Failure to sign and submit the contract/submission of Security Deposit within 7 days of intimation of selection may result in the forfeiture of EMD and cancellation of selection as L1 bidder. 8 Tender for Pest Control Services at ZTC, Agra TERMS AND CONDITIONS 1. Definitions: i. ZTC means North Central Zonal Training Centre of Life Insurance Corporation of India, situated at Sikandara, Agra (UP) and is represented by Principal or in his absence any other official authorized by the Principal. ii. iii. iv. Corporation means Life Insurance Corporation of India. Competent Authority means Principal or in his absence Vice Principal or any other official authorized by the Principal of ZTC. Workmen means employees of the service provider/contractor deployed at ZTC for providing Pest Control Services. v. Contractor/Tenderer/Vendor/Service Provider/Agency have been used interchangeably and means the Bidder who has submitted this tender. 2. Aim of the Contract: Effective disinfection and satisfactory pest control services designed through a weekly programme for eliminating, reducing, controlling and preventing nuisance of damage and health hazard from all varieties of pests viz., mosquitoes, flies, cockroaches, ants, bugs, moths, spiders, silverfish and lizards etc. and all varieties of rodents viz., rats, mice etc. 3. Scope of Work: The job of Pest control shall include the following: a. General Pest Control: General pest control means eradication of Cockroaches, Mosquitoes, Flies, Spiders, Lizards, bedbugs etc through standard products (such as BAYER etc) as permitted insecticides by Government of India and WHO norms. The Pest control should cover all the places with application of gel, spray, fumigation under the beds, tables, chairs, on and around the pile of files, on wooden furniture, on false ceiling, on all staircases, on all toilets drain ducts, in all places mentioned in para 4 and should leave no space unattended. These Pest Control services will have to be provided twice in a week on the days specified by ZTC. b. Fogging: Fogging in the entire open area of ZTC as mentioned in para 4 shall be used for controlling insects once in a week on the day specified by ZTC. c. Rodent Control: Rodent controlling should be done with rat traps/pads as per orders and instructions on the subject. d. The pesticides etc. used for pest/rodent control should not have adverse impacts on human health. Page 8 of 14

9 e. The entire responsibility of any kind of damage, injury or loss to anyone during this service providing will be of the vendor completely. 4. Area of Operation: LIC Zonal Training Centre, Sikandra, Agra is a residential training centre for officers, employees and agents of the Corporation with a land area of 9447 sq.yards and the ZTC premises for which the contract is notified has the following infrastructure: i. Main Building comprising of Faculty wing, administrative wing with cash counter, store, Principals room, Vice-Principal s room, library, lobby, two class rooms, Kitchen, Dining Halls, workers area with toilet, 5 toilets, 42 hostel rooms, 4 Guest Faculty rooms, 5 rooms for store and office use, one table tennis room, one gymnasium, large terrace with seven water tanks. ii. iii. iv. Annexe Building comprising of two class rooms, faculty room, two store rooms, common toilets and terrace with one water tank. Large compound with lawn and pathways on the front and rear, two guard rooms, toilet for guards, parking space, power room, two store rooms. Principal s bungalow with garden, terrace, one water tank and attached garage. v. Residential block with four flats, gardens, staircase, terrace, two water tanks and attached garages. vi. Any further structural addition and/or modification. The above premises shall hereinafter be referred to as ZTC premises or ZTC campus or Area of Operation. The Pest Control Services contract shall be for the entire ZTC premises as mentioned above 5. General Conditions : i. The contract for Pest Control Services shall be valid for a period of ONE year, which if found satisfactory, can be renewed successively for two more years each time annually, on the same terms and conditions subject to escalation clause given below by the competent authority. If the performance is not satisfactory the contract may be terminated by the Competent Authority at any time before completion of one year, by giving one month notice to the contractor. ii. Escalation clause: Monthly payment for the first year of the contract will be fixed/constant during the first year of the contract. At the time of renewal of the contract after expiry of the initial period of contract (i.e. one year from the date of commencement), for every subsequent year, the monthly payment for the renewed contract will be arrived at, based on the following formula.- Page 9 of 14

10 Where:- A1 = Consumer Price Index (All groups-combined) for the 3 rd month preceding the renewal month. A2= Consumer Price Index (All groups- Combined) for the 3 rd month preceding the commencement month of the contract. Price decreases will be handled in the same manner as price increase adjustments. iii. iv. During the period of this agreement, the Contractor may, by giving a notice of three months to ZTC terminate the contract. The Competent Authority shall be the sole judge to decide whether the performance of the contractor is satisfactory or not. v. Decision of the Competent Authority regarding termination of contract shall be final, conclusive and binding on the contractor and the contractor shall not be entitled to any compensation in this regard. vi. vii. viii. ix. There shall not be any supervision and control by the ZTC or any of its officers/ employees in respect of workers employed by the contractor to fulfill the obligations of the contract. The Contractor shall provide the name, address, contract number, ID and address proof of the workers engaged by him. The discipline of the workers of the Contractor in the discharge of their duties shall be regulated by the Contractor. If in the course of execution of this contract by the contractor any minor or major damage is caused by the contractor to the persons or property of ZTC, after joint investigation by the ZTC and the contractor any claims arising there from shall be the sole liability of the contractor from whom the cost etc. would be recoverable. The contractor shall render all assistance and co-operation to ZTC if any enquiry is held thereon. The contractor shall not have any license or tenancy rights in the premises of ZTC by virtue of entering into an agreement with ZTC. The contractor shall not transfer or assign or share benefit of this agreement with anyone else. x. The contractor shall be solely responsible to ensure that the terms and conditions including the obligations mentioned in the contract are duly performed and observed without fail. xi. The contractor through its proprietor, partner, director or any responsible person competent to take decision, should attend the meeting whenever called for by the Competent Authority of ZTC and abide by the instructions given by the Competent Authority from time to time. Any omission on part of ZTC at any time to exercise any of its right under the terms of the service contract shall in no way impair or affect the validity of the terms and rights of the ZTC to enforce its right at any time subsequently. Any dispute arising out of the terms of this contract or in the interpretation of any clause herein shall be settled by mutual discussion between the nominated authorities of ZTC and the contractor. The Competent Authority shall be the final authority in resolving such disputes. Any dispute arising out of or relating to this contract shall be deemed to have arisen in Agra and be subject to adjudication of a competent court in Agra alone. The ZTC shall be entitled to deduct or recover any such amount liable to be paid or due, from the Agency out of any money lying to the credit of the Agency and in case the same is found insufficient the contractor shall be called upon to pay the balance amount within a prescribed period. If no money is lying to the credit of the contractor, the contractor shall deposit the amount so liable to be paid without any protest or demur. No residential facilities will be made available to any representative of the contractor in the campus. The contractor shall ensure that, it obtains/ renews appropriate licenses from all concerned authorities such as Central/State government, Municipalities, Local bodies etc at its own cost The contractor shall be solely responsible for implementing all the provisions of all relevant laws, rules and regulations as may be in force from time to time and as may be required in respect of the work being done by him for ZTC. ZTC shall not be responsible in any way for any breach of these rules and regulations by the contractor. The contractor shall maintain necessary records as prescribed by law and the competent authority. In terms of provisions of Section 33(3) of the Insurance Act, 1938, as amended by the Insurance Laws (Amendments) Act, 2015, Insurance Regulatory and Development Authority of India (IRDAI) is authorized to verify all such books of account, register, other documents and the data base in the custody of contractor in respect of service outsourced by the L I C of India. It shall be the duty of the contractor to provide such documents/ statements/ information as may be required by IRDAI within such time as may be specified by the IRDAI. In terms of provisions of Section 33(4) of the Insurance Act, 1938, as amended by the Insurance Laws (Amendments) Act 2015, any Investigating Officer of IRDAI may examine on oath the service provider or contractor where the services are outsourced by the L I C of India in relation to his business. The service providers engaged by L I C of India are subject to the various provisions of Insurance Act, 1938, IRDA Act, 1999, Rules, Regulations or any other orders issued Page 11 of 14

12 there under. The service provider shall comply with provisions of Regulations, Guidelines and any other law in force. xxii. For matters not specified herein, yet found necessary for proper functioning of ZTC related to Pest Control, separate instructions within the ambit of this agreement, may be issued by the competent authority to the contractor, which shall be binding on the contractor. 6. Penalty clause: 7. Control Register: a. In case of recurrence of complaints regarding mosquitoes, bugs, rats, etc. received from trainees, employees and resident of ZTC a penalty will be imposed as decided by the competent authority. b. In case of failure in providing pest control services given in para 3 of the terms and conditions of the contract on any specified day, no amount shall be payable to the service provider for the day and an additional 25% of amount for the day shall also be recovered as a penalty from the service provider. The control register for pest control shall be maintained by office and shall be available at reception counter. The service provider shall make entry in the control register after each service. 8. Payments: i. The amounts specified in Financial Bid are inclusive of all costs, wages, statutory payments, other expenses and all taxes. The contractor shall not be entitled to make any other demands monetary or otherwise from ZTC during the term of this contract, including renewal period, if any. ii. iii. iv. ZTC will make monthly payment within 15 working days of receipt of bills from the contractor. Income tax, as per prevailing rules, shall be deducted from the payment to service provider. Penalties as given in para 6, if any, shall be deducted from the monthly payment to the contractor. 9. Security Deposit: The security deposit of Rs. 10,000/- (Rs. Ten thousand only) shall remain with the ZTC in its account but the successful tenderer shall have no right to claim interest over the security deposit. The Competent Authority shall have the right to deduct out of the above security deposit any amount for which the contractor may become liable hereunder and shall refund the Page 12 of 14

13 balance amount if any to the contractor after the termination/completion of the term of the contract. If the contractor fails, in course of the agreement period, to comply with the terms and conditions of the Agreement, the security deposit may be forfeited in full or in part as decided by the Competent Authority. 10. Restricted Liability of the Corporation: There shall be no relationship of employer and employee, under any circumstances whatsoever between the Life Insurance Corporation of India on one side and the workmen deployed by the contractor for providing services agreed in the contract. The workmen deployed at ZTC, shall always be treated as employees of the contractor. The workmen so deployed, or to be deployed by the contractor shall at no time be entitled to claim to be the employees of the Corporation, or be entitled to file any legal case in any Court of Law, against the Corporation to claim any such relationship with the Corporation. The Corporation will in no case and under no circumstances be liable in any way whatsoever to pay, compensate, indemnify or to settle any claim of any sort whatsoever of any of the workmen so deployed by the contractor, under any Laws, Act or Rules and Regulations including the Labour Laws, whether Centre or State, including any liability resulting any injury, loss of life or limb that may be suffered by workmen in discharging their duties. The contractor providing the Pest Control Services will undertake to indemnify the Corporation for any loss/damage caused to the Corporation due to carelessness, negligence or absence, specific/non specific, willful/non willful acts by the contractor /workmen posted for duties and/or the litigation initiated by any of the staff/employees of the contractor against the Corporation. 11. Declaration: I/we hereby agree to all the Terms & Conditions mentioned above without any condition whatsoever. I/we also further agree that all the deficiencies will attract penalties and the recovery will be effected without any notice to me/us. In case of my premature withdrawal without due notice from the Pest Control Services for any reason, whatsoever, during the period of the agreement or in case of my/our failure in course of the agreement period to comply with these terms and conditions, the Competent Authority is at liberty to forfeit my/our security deposit of Rs. 10,000/- (Rupees ten thousand only).
