1 APPLICATION Your Commercial Food Vendor contract signifies that, upon acceptance to Art Under the Elms, the applying vendor is 18 years of age or older, agrees to be present during all show hours, and will abide by all LCSC, City, State of Idaho and Festival Rules Regulations, Procedures and Guidelines. OPERATING HOURS Commercial Food Vendors must be open and operating during the following show hours: Friday April 27, 12-7pm Saturday, April 28, 10-6 pm Sunday, April 29, 10-4:30pm BOOTH SIZE Each primary space measures 16 x 16, including frontage. If your set-up exceeds 16 x 16 you must reserve additional space. Additional space is available in 4 increments (limit of 3) FEES 1-16X16 Booth Space $ x4 Additional Booth Space (Limit 3) $60.00 Electricity $ x8 Table $10.00 Applications Submitted after 2/1/18 $35.00 ELECTRICITY Electricity in the food court is at its maximum. To better assist all vendors please provide total amps required and outlet type. Electrical panel boards are placed prior to Food Vendor check in by LCSC Physical Plant Department. Though all efforts will be made to provide the necessary electricity, electricity cannot be guaranteed. Neither AUE nor the college are liable for any loss of income or damage due to the loss, or use, of electricity. CHECK-IN/SET-UP Wednesday, April 25, 4-6pm or Thursday, April, 26, 8-6pm Vendors must not block the Fire Access Vendors will receive one (1) campus loading pass per booth purchase that permits entry to the loading/unloading area to unload inventory and materials for a maximum of 1 hour, per booth space, during check-in. Vendor loading passes must remain in vehicle s windshield. Vendors are responsible for labor & equipment needed for set-up. Page 1 of 5
2 SAFETY Vendors, employees and associates must adhere to all LCSC speed limits. LCSC campus speed is limited to creeping only Violators will be ticketed and/or banned from campus. Vendors must have a spotter while backing up vehicle with trailer. This is a high traffic area for students. VENDOR BADGES Vendor badges will be issued at check-in Lost badges will not be replaced. PARKING Parking is available ONLY in designated areas. Notice City of Lewiston Residential No Parking Signs when parking on street. Library parking lot is reserved for Handicap Accessible parking beginning Friday, April 27, 11pm until Sunday, April 29, 4pm. Sacajawea Hall Parking available with parking pass. Parking is prohibited on interior campus streets and lawns. Vendor parking is located on the intersection of 11th Avenue & 4th Street For more information, contact: LCSC Campus Security, 500 8th Avenue, Lewiston, ID (208) PEPSI PRODUCTS PEPSI has all beverage pouring rights on the LCSC campus; so all vendors are required to purchase any commercial beverage products, including bottled water, from PEPSI. Vendors found to be selling other items will be asked to remove said items or leave immediately. COMMISSION A 10% commission on your gross sales will be collected Sunday, April 29 at 4pm TAKE-DOWN Sunday, April 29, 4:30pm No vehicles may enter the campus prior to 4:30pm Vendors are responsible for labor & equipment needed for take-down. Vendors may use the security monitored loading zone, for a maximum of 1 hour per booth space purchased, to load inventory and exhibit materials. Page 2 of 5
3 SECURITY LCSC is not responsible for damage to or loss of merchandise or money due to theft or any other cause. Security is provided by local and Campus law enforcement agencies from Thursday through Sunday. FIRE DEPARTMENT Vendors must comply with all regulations of the Lewiston Fire Department. Vendors are required to keep their area clean and free of unsightly garbage during the event. All vendor trash must be removed from booth space prior to departure. Refer to Food Court Map provided at check in for the following; Cardboard Crate & Dumpster ERD s Recycling Receptacles Grease Grey water ANIMALS Animals are not permitted on campus during Art Under the Elms with the exception of Service Animals. If your pets travel with you, you must adhere to all LCSC and City of Lewiston rules regarding animals: City of Lewiston ordinances may be found online at: City of Lewiston - Animal Ordinances LCSC Rules regarding animals may be found at: LCSC Animal Policy If you are found in non-compliance, you may be ticketed and /or asked to leave and risk not being invited back. 4 TAX COMMISSION An ST-124 Idaho State Tax Permit is required and will be provided for you on check-in. For more information, contact: Idaho State Tax Commission P.O. Box 1014, Lewiston, ID (208) Ext. 24 LIABILITY User agrees to indemnify and hold harmless the State of Idaho, Lewis-Clark State College, its agents, employees, or any other covered group or individual against loss or expense, including attorney s fees by the reason of bodily injury, property damage, or personal injury arising out of the negligence of User, its employees, users, or agents. This agreement applies to User s use of Lewis-Clark State College s facilities. User agrees to provide Lewis-Clark State College with a Certificate of Insurance evidencing general liability insurance with limits of at least $1,000,000 per occurrence for the perils of bodily injury, property damage, and personal injury and naming Lewis-Clark State College and the State of Idaho as additional insured. Any personal injury to vendor or third parties or any property damage incurred in the course of this agreement shall be the responsibility of the vendor. Vendor agrees to indemnify, defend, and hold harmless the State of Idaho and Lewis-Clark State College, its agents, employees, or any other covered group or individual against all costs, losses, damages, liabilities, expenses, demands, and judgments, including court costs and attorney s fees, which may arise out of vendors performance hereunder, except to the extent such are caused by the negligence of LCSC. This agreement applies to User s use of Lewis-Clark State College s facilities. Vendor shall not be covered by LCSC Insurance. Vendor shall be responsible for determining what insurance is necessary in order to perform the work contracted for, and for procuring such insurance, and shall procure all licensing and insurance required by law. AUE reserves the right to close any booth that does not conform to general standards of safety, cleanliness, attractiveness, or good taste. Operators and/or their employees exhibiting behavior not in accordance with accepted standards, including but not limited to illegal activities, will be asked to vacate the premises immediately. Art Under the Elms reserves the right to remove any artist from the present or future shows at their discretion or for breach of event participation rules, regulations, procedures, guidelines, and legal agreements including violation of applicable laws of the State of Idaho, or for disruptive or abusive behavior.
