To provide Bed Tea/Break fast/lunch/dinner to the Guests on the rates as mentioned in Annexure A. 2. House keeping of Guests House premises. Sealed Tenders are invited for providing catering as well as housekeeping service on outsource basis for the Guest House of DMRC situated at New Pali Road, Jodhpur on the following terms and condition:- 1. The contractor will deposit an amount of Rs.5000/- (Rupees five thousand only) in the form of Demand Draft/Cheque/Cash in favour of Director, Desert Medicine Research Centre, Jodhpur as earnest money at the time of submission of tender. The earnest money of unsuccessful tenderer will be returned & the earnest money of the successful tenderer will be adjusted against the security deposit of Rs.20,000/ which will be submitted by the contractor at the time of awarding the contract in the form of bank guarantee/draft/cash. 2.The contractor must have two years similar work experience and related experience documents must be enclosed. 3. Initially the contract will be for a period of one year and if the services rendered by the contractor are found to be satisfactory, the contract may be extended further up to two year on same terms & condition 4. The firm shall be liable to implement the Labour laws, minimum wages Act and other social legislations Act i.e. EPF, ESI etc. for the manpower engaged by the agency. 5 The agency shall be registered with the Service Tax Department and regularly filing service tax return. 6. The Contractor will have to provide catering as well as house keeping jobs under this contract. However, he has to depute at least 03 persons (One cook, 2 helper) for this work. Wages payable for these persons will be as per rates as prescribed by Rajasthan/Central Govt. whichever is higher as applicable. 7. The Contractor will provide the Break-fast/Lunch/Dinner etc. as per menu & rates mentioned in Annexure- A. 8. The Contractor will take charge of the capital items of the Guest House including kitchen and dinning hall electrical gadgets by acknowledging the inventory handed over

2 to him. Except natural wear and tear the contractor will be responsible for their theft/damages/loss etc. The loss due to theft/damage shall be recovered from his bill. 9. The contractor will have to bring his own kitchen utensils Bone China crockery etc. for preparation & serving of food in Guest House & for Seminar, Workshop & Conference & meetings etc; 10. The Contractor will ensure that his staff members are disciplined dressed neatly and speak politely to the guests and officials in DMRC Guest House. 11. DMRC will not be responsible for any injury, loss of life or any mishap to contractor s staff while on duty during stay in DMRC Guest House premises or otherwise. 12. The Contractor will provide uniform to his staff. 13. No stale food (left over) should be served to the guests 14 The payment for refilling of the gas cylinders would be made by the contractor. 15 The Contractor will ensure the use of only standard brands of cooking oils and masalas of ISI Mark/Agmark. 16. All groceries (provisions) to be used should be of standard quality. 17. Only fresh vegetables would be used and served. 18 The agency before submitting the tender may inspect the office premises during office hours on any working days. 19 The number of man power mentioned above may be varying any time as per the demand of this Office. 20.This Office reserves the right to accept or reject any tender/quotation without assigning any reason. 21. The Contractor shall ensure that the rooms of the Guest House, kitchen, Dinning Hall & its surroundings and service tables are kept neat and clean. 22 Cooking should be in the most hygienic manner to the satisfaction of In charge Guest House. 23 The contractor will be responsible for discharging liabilities in respect of the workers working under him as per State/Central Govt. rules & regulations. 24. The statutory liabilities viz. EPF, ESI, Bonus, Employees Insurance & Service Tax etc. will be reimbursable only against production of authenticated documents. 25. The contractor has to provide the Breakfast, Lunch, Dinner on the approved rates for Seminar, Workshop, Conference meetings. No extra payment will be made for crockery, utensil required. The extra manpower required will be paid proportionately. The contractor shall have to provide extra man power as & when required by the Institute. 26. The payment of wages/salary to the outsourced staff to be made mandatorily through electronic bank transfers. 27. The contractor has to sign an agreement on a non-judicial stamp paper worth Rs.100/- within seven days of award of work. 28. Pre bid meeting shall be held on at 11 A.M at Desert Medicine Research Centre New Pali Road, Jodhpur. Pre bid meeting shall be held as per NIT schedule so as to provide an opportunity to the participating bidder to clarify various tender

3 provision/condition/clause before the bids are submitted. In case the points/doubts raise by the prospective bidders, needs to be modified that the same will be consider for modification. After pre bid meeting tender condition will be frozen. No change will be possible after opening the bid 29. The contract can be terminated by DMRC any time by giving one months notice. 30.The last date of submission of tender along with credentials & certificate is 30th June, 2016 on hrs to the undersigned in person/by registered post. The tender will be opened on same day at hrs in the presence of representative present at time. 31. We will have the right to verify by personal inspection/visit the contractor establishment. 32. 7 Relevant Minimum Wages circular of Central government or Rajasthan government as applicable must be attached in support of Minimum wages. GENERAL CONDITIONS OF TENDER 1.Period of Contract: Initially for period of one years that may be extended for a similar or lesser period on same terms conditions as mentioned in the Tender Documents if the services rendered by the contractor are found to be satisfactory. The contractor will neither appoint any sub- contractor nor will sub-let the work assigned to him without the written permission of DMRC The contract can be terminated by DMRC any time by giving one months notice. The contractor has to give minimum two months notice for terminating the contract. 2. Evaluation of Performance: After three months of operation, the contractor will be evaluated on the basis of the guidelines and rules detailed in this document. If the caterer fails to meet the expectation and promises made, license agreement can be cancelled at that time. 3.Fulfillment of Statutory Provisions: The contractor will ensure the compliance of all statutory provisions i.e. Minimum Wages Act, Payment of Wages Act, Industrial Disputes Act, Contract labour (Regulations and Abolition) Act, ESIC Act, 1948 and EPF Act, 1952 and all other labour and industrial enactment at his own risk and cost in respect of all staff employed by him. The institute shall be indemnified for any action brought against it for any violation/non-compliance of any of the provisions of any of the acts, etc. Hence, non-compliance or violation of any of these provisions of any of the Acts would lead to the immediate termination of the contract. The agency shall be registered with the Service Tax Department and regularly filing service tax return. Contractor will submit the proofs of payments towards PF, ESIC and Service Tax (if applicable) dues of previous month for claiming subsequent month's payment. 4.Details of Workers: The contractor shall submit a list of workers, with complete details including local/ permanent addresses, contact details, and their photographs etc, for approval, which may be allowed to work at the Guest House. We reserves right to reject any or all the names without assigning any reason thereof. Only those workers who have been cleared by the DMRC will be allowed to enter into the premises of the Guest House. 5.Payment date of Salary to the Workmen: The Contractor has to pay the salary to workmen by 5th of every month for immediate previous months work without waiting for clearance of his pending bills. Failing which a penalty equivalent to 5% of monthly bill value shall be imposed on contractor. The Payment shall be made strictly on satisfactory work and on daily attendance basks. Contractor will issue salary slip to all staff members engaged and shall remit the salary in the staffs account through net banking to ensure the timely payment. Contractor will be also responsible for the opening of bank account of all employees to nearby bank on their own cost in order to transfer the salaries of employees' directly to their accounts. 6.Maintenance of Attendance Record The contractor has to maintain attendance record of all the workmen and Guest house in-charge, DMRC,shall certify that. A copy of the same record shall be submitted every month along with the bill for payment. 7.Accident or Injury to Workmen (a) The Institute shall not be liable for any damage or compensation payable in respect of or in consequence of any accident or injury to any workmen or other person in the employment of the

8 contractor through claim from insurance company. The contractor shall indemnify and keep the Institute indemnified against all such damage and compensation whatsoever in respect or in relation thereto. 8.Medical Fitness of engaged Workmen (a) The contractor shall employ only healthy adult and trained staff with good health and sound mind for all services. (b) The contractor will ensure that all employees engaged by him are free from communicable/ infectious disease and are medically fit to work at Guest House. DMRC will conduct medical examination if required. The cost of the medical examination will be borne by the contractor. 9.Compliance of Institute's Security & Safety Regulations (a) The contractor will be responsible for his employees in observing all security and safety regulations and instructions as may be issued by the Institute from time to time. The contractor will be responsible to take appropriate disciplinary actions against his workers to fulfill his obligations under this agreement, provided that, action should be taken in accordance with Industrial Employment (Standing Order) Act, 1946 and the DMRC Authority should be informed at every point of time. (b) Contractor will ensure that their employees should protect the institute's information received during discharge of their duties from any unauthorized disclosure to third party(ies) without permission. (c ) The contractor will be responsible for making good to the satisfaction of the DMRC for any kind of loss or damage to any structures and properties within the Guest House premise. If such loss or damage is due to fault and/ or the negligence or willful acts or omission of the contractor, his employees, agents, or representatives, will make good the loss as assessed by the Officer-in-charge, RGIPT. 10.Conduct of staff (a) The Guest House staff will not entertain any of their guests/ outsiders in the Guest House premises and not normally leave the premise without Guest house in charge permission (b) The Contractor will provide uniform to his staff.all employees will be in uniform during schedule timing and none should be visible in vests/shorts or improper clothes at any time. ( c) The contractor will be responsible for the courteous behavior of all their staff, employed directly or indirectly, and shall exercise a proper degree of control over them. The contractor shall be bound to prohibit and prevent employees from trespassing/acting in anyway detrimental or prejudicial to the interest of the community or of the properties. The contractor shall be responsible thereof and indemnify the institute of all consequent claims or actions for damages or injury or on any the other grounds whatsoever. (d) Smoking, drinking within the entire area of the Guest House in particular, and the Institute campus is strictly prohibited. Violators will be prosecuted as per law. (e) In case, institute suffers loss of any nature because of the contractor or his employees for not following security or safety regulation, the contractor will be liable to make good the loss as determined by the DMRC at its sole discretion. Institute will have the right to recover such losses, etc., from the dues payable to the contractor and/or security deposit, etc. (f) The contractor staff will not be treated as the institute's staff for any purpose whatsoever. The contractor will be responsible for strict compliance of all statutory provisions of relevant labour laws applicable from time to time in carrying out the above job 11.Forfeiture of EMD: If the party fails to accept the work order issued at the rates originally quoted by him or at rates negotiated subsequently, as the case may be, the Earnest Money shall be forfeited.emd of unsuccessful bidder shall be refunded within 30 days of opening of Bids. Signature and seal of the bidder required on all the pages, which have to be submitted along with Technical Bid, and Financial Bid.
