( Promotion ) 2.2. The Promoter s customers may participate in the Promotion ( Entrants ) in line with the terms set out below Entrants will freely enter into the Promotion and the winner ( Winner ) will be selected in line with clause 6 below The Winner will win the ( Prize ) set out at clause 7 below. 3. TERMS OF ENTRY 3.1. By entering the Promotion, each Entrant agrees that they have read, accepted and agreed to be bound by these terms and conditions. The Promoter will not accept entries from: (a) employees of the Promoter or its holding or subsidiary companies; (b) employees of agents or suppliers of the Promoter or its holding or subsidiary companies, who are professionally connected with the Promotion or its administration; or (c) members of the immediate families or households of (a) and (b) above. (for these purposes immediate family members shall mean parents, step-parents, grandparents, children, step-children, siblings, civil partners or spouses) To be win the promotion, Entrants must respond to communication regarding confirmation of winner s mailing details within 7 days of notification The Promoter will not accept entries that are: (a) automatically generated by a computer; (b) completed by third parties or in bulk; (c) illegible, altered, reconstructed, forged or tampered with; or (d) incomplete. 1

2 3.4. Each individual is limited to one (1) entry for the Promotion. Entries submitted on behalf of another person will not be accepted and joint submissions are not permitted The Promoter reserves all rights to disqualify the Entrant if he/she does not satisfy the requirements set forth in this clause 4, or his/her conduct is contrary to the spirit or intention of the Promotion. 4. HOW TO ENTER 4.1. To enter the Promotion, Entrants must go to [Entrants shall be required to enter the competition online via the official landing page and submit the form provided on the landing page ( Online Entry Form ) by the Closing Date (as defined below). 5.1 Entrants will be required to enter some or all of the following details: (a) Address, clothing size information 5.2 The promotion will run from 0:00 (SGT) on 13 th September 2018 to 23:59 (SGT) on 20 th September 2018 (the Closing Date ). 5.3 All entries must be received by no later than 23:59 (SGT) on the Closing Date. Any and all entries received after the Closing Date are invalid and will not be considered for selecting the Winner of the Prize. 5.4 The Promoter will not accept: (a) responsibility for Promotion entries that are lost, mislaid, damaged or delayed in transit, regardless of cause, including, for example, as a result of any postal failure, equipment failure, technical malfunction, systems, satellite, network, server, hardware or software failure of any kind; or (b) proof of posting or transmission as proof of receipt of entries for the Promotion. 5.5 Upon entry, Entrants will receive an , confirming that entry for the Promotion has been received by the Promoter. 3 7 THE PRIZE 7.1 There will be 50 x winners prizes. 7.2 The Prize comprises the following: (a) 50 x Casio Scuderia Toro Rosso caps (b) 50 x Casio Scuderia Toro Rosso polo shirts 7.3 The Prize is subject to availability and the Promoter reserves the right to vary the Prize at any time in its sole discretion. There is no cash alternative for the Prize. 7.4 The Prize is non-negotiable, non-refundable, non-transferable and non-exchangeable for cash, credit and/or any benefits in kind. 7.5 The promoter will endeavour to provide winners with the correct size polo shirt. However once sent to winners, sizes cannot be swapped or changed by the promoter. 8 ANNOUNCEMENT OF WINNER 8.1 Winners will be notified on 21 st September 2018 ( Announcement Notice ) via the address provided by the Winner on his/her Online Entry Form. Subject to clause 9.5 below, only the Winner will be notified that he/she has been selected as the Winner of the Promotion. 8.2 Subject to clause 9.5 below, the Promoter s decision on the Winner is final and conclusive. The Promoter is not obliged to engage in any correspondence or discussion whatsoever with any Entrants in relation to its choice of the Winner. 8.3 It is the responsibility of each Entrant to check his/her for any Announcement Notice. The Promoter shall not be responsible for the Winner s failure to check his/her , or if the Announcement Notice is ends up in the Winner s Junk or Spam folder. 9 CLAIMING THE PRIZE 9.1 The Winner will be notified in line with clause 8 above. 9.2 All instructions for claiming the Prize will be contained in the Announcement Notice. To claim the Prize, the Winner must follow the instructions in the Announcement Notice within seven (7) calendar days of receiving the Announcement Notice. 9.3 The Winner will be mailed the Prize via UK Royal Mail Recorded Delivery. The promoter will confirmation notification of the Prize. 9.4 The Prize cannot be claimed by a third party on the Winner s behalf. 3

4 9.5 The Promoter does not accept any responsibility arising out of the Winner being unable to claim the Prize for any reason. 10 LIMITATION OF LIABILITY & INDEMNITY 10.1 Insofar as is permitted by law, the Promoter, its agents or distributors will not in any circumstances be responsible or liable to compensate Entrants (including the Winner) or accept any liability for any loss, damage, personal injury or death occurring as a result of participation in the Promotion, the Event and/or redemption or use of the Prize The Promoter, its agents or distributors accept no responsibility for any costs, expenses, charges or losses which may be incurred by any Entrant (including the Winner) in relation to the Prize or participation in the Promotion. Additionally, the Winner is solely responsible for all applicable taxes, including taxes imposed on his/her income The Promoter, its agents or distributors further hold no liability for any injury or damage to any Entrant s or any other person s computer relating to or resulting from participation in or downloading any materials in connection with the Promotion The Promoter, its agents or distributors shall not be liable for any failure to comply with its obligations relating to the Promotion where the failure is caused by something outside their reasonable control. Such circumstances shall include, but not be limited to, weather conditions, fire, flood, hurricane, strike, industrial dispute, war, hostilities, political unrest, riots, civil commotion, inevitable accidents, supervening legislation or any other circumstances amounting to force majeure Each Entrant (including any Winner) shall indemnify the Promoter for any losses or damage that he/she may suffer in connection with any action, conduct or omission committed by the Entrant. 11 Cancellation 11.1 If cheating, a virus, bug, catastrophic event, or any other unforeseen or unexpected event that cannot be reasonably anticipated or controlled affects the fairness and / or integrity of the Promotion, The Promoter reserve the right to cancel, change or suspend the Promotion. This right is reserved whether the event is due to human or technical error The Promoter reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, the Promotion with or without prior notice 4

5 for reasons outside its reasonable control (including, without limitation, in the case of anticipated, suspected or actual fraud, cheating, any computer virus, bug, or any catastrophic event). 12 DATA PROTECTION & GDPR 12.1 The Entrant agrees for the Promoter to process their personal information as set out in the Promoters Privacy Policy. This can be found at [ 13 GENERAL 13.1 In registering and participating in the Promotion each Entrant confirms that he/she: (a) fully and unconditionally agrees to and undertakes to comply with the terms and conditions herein and all other agreements, rules and policies referred to here in and any instruction of the Promoter in relation to the Promotion and; (b) accepts that decisions of the Promoter regarding all matters relating to the Promotion are final and binding If there is any reason to believe that there has been a breach of these terms and conditions, the Promoter may, at its sole discretion, exclude the Entrant from participating in the Promotion All decisions regarding the interpretation of these rules, eligibility, scheduling and staging of the Promotion lie solely with the Promoter (and anyone acting on its behalf), whose decisions are final. The Promoters decisions cannot be appealed and shall not give rise to any claim for monetary damages or any other legal or equitable remedy.
