1 PetFirst Online 10 th Anniversary Sweepstakes Terms of Use and Rules Sweepstakes entry dates are from Wednesday, June 18, 2014 at 12:01 a.m. EST Wednesday, July 2, 2014 at 11:59 p.m. EST. Sweepstakes is sponsored by the City of Jeffersonville, Indiana. Winner selection begins Tuesday, July 8, 2014 and ends Thursday, July 17, One $50 gift card winner will be chosen each day at random and announced on Facebook. The grand prize winner will be announced on Friday, July 18, 2014 on our Facebook page. Please read the Terms of Use and Rules carefully before participating in the sweepstakes. The sweepstakes is sponsored by PetFirst. Complete the online submission form at PetFirst s Facebook page at Click the Sweepstakes tab located at the top of the PetFirst Facebook page. Click on submit photo Complete the following information: 1. Your full name 2. Your address (sweepstakes winners will be notified by ) 3. Your pet s name words that best describe your pet 5. Upload your pet s photo (JPG format at least 1.5 MG per photo but not more than 2 MB) o Note: Photos under 1.5 MB are accepted but may not be included in marketing material since photos under 1.5 MB are not easily reproduced. o Note: One entry per person. Prizes The winners will be notified by . Winners will be as follows: 10 winners receive $50 PetFirst gift card 1 grand prize winner receives certificate for free Lifetime 5000 policy Eligibility No purchase necessary to enter or win. Participation in the Sweepstakes is strictly online and entries may be received only as outlined in the Rules. Entries will be accepted via submission of the PetFirst Facebook page on the Sweepstakes tab, via entry, or via mail. Sweepstakes participants must be at least 18 years of age and legal residents of the United States at the time of entry. Photos entered must be of your actual pet and all form fields must be completed per instructions. Winners must reside within the United States. Incomplete submission are ineligible. By participating in the Sweepstakes, you agree that: You have read and understand the Rules. You meet the Sweepstakes eligibility requirements as explained in the Rules.

2 You are bound by the Rules and PetFirst s Conditions of use, Legal Notices and Privacy Policy as published on Petfirst.com You unconditionally accept and agree to comply with and abide by the Rules and decisions of PetFirst o All decisions with regard to accepting photos for submission and final winners are at the sole discretion of PetFirst and are final. Submissions by the same individual are not eligible for multiple prizes (one winning entry per individual). The Rules shall be legally binding on you and your legal representatives, heirs, successors, and assigns. Persons in the following categories are NOT eligible to participate in or win prizes in the Sweepstakes: Residents of the state of Washington, PetFirst associates, affiliate companies, subsidiaries, business partners, family members of associates. Void where prohibited. Prize Details Subject to these Rules, the following prizes will be awarded ( Prize or Prizes ) and all values are in U.S. dollars: 10 winners receive $50 gift card redeemable as credit toward a new or existing PetFirst pet insurance policy Grand Prize Winner receives certificate redeemable for a free Lifetime 5000 pet insurance policy (See Voting and How the Winners are Determined below.) How to Enter Entries are limited to photos of the following types of live pets : cats and dogs. Farm animals, birds, reptiles, hamsters, ferrets and other small animals other than DOGS AND CATS will not be accepted into the Contest. To enter the Sweepstakes, visit our PetFirst Facebook page at click on the Sweepstakes tab, then complete all entry form fields and submit the entry form between Wednesday, June 18, 2014 from 12:01 a.m. and July 2, 2014 at 11:59 p.m. EST. You may only enter the sweepstakes once. In your submission, you must complete all required information fields. Only complete entries will be accepted. For alternate means of entry, you can or mail the following information to PetFirst: 1. Your full name (first and last) 2. Your address 3. A photo of your pet 4. Your pet s name 5. A list of 10 words that best describe your pet To entries, send the information listed above to 10years@petfirst.com. To enter the sweepstakes by mail, send the information to One Quartermaster Court, Jeffersonville, IN, Complete entries must be received by Wednesday, July 2, 2014 at 11:59 p.m. EST. One winner will be selected at random each day from July 8, 2014 through July 17, 2014, with the grand prize winner being

3 chosen on July 18, If your entry is selected as one of the (10) Winners (see Voting and How the Winners are Determined below), PetFirst will notify you by ; we will not notify those whose entries were not selected as the (10) Winners. PetFirst will post winners on its Facebook page each day from July 8, 2014 through July 18, PetFirst is not responsible for lost, late, incomplete, stolen, misdirected, or illegible entries (for more information, see Liability and Force Majeure below), and entries will only be accepted through PetFirst s Facebook page as stated in these Rules. Once submitted, you cannot edit or delete your entry from the Sweepstakes. NOTE: Entrants may be required to provide PetFirst with proof that he/she is the authorized account holder of the address associated with the entry. If a dispute cannot be resolved to PetFirst s satisfaction, the entry will be deemed ineligible. Entries made by any other individual or any entity, and /or originating at any other website or address, including commercials sweepstakes subscription notification and/or entering services sites, will be declared invalid and disqualified from this Sweepstakes. The use of any devise to automate the entry process is prohibited. Voting and How the Winners are Determined Winners will be selected at random. Use of Submitted Photos and Information By entering into this Sweepstakes, you warrant that you are the sole owner and copyright holder of the photo(s) and information you submitted; that these items do not infringe any intellectual property rights of any individual or entity, including the photographer who took the photo(s) you have submitted; and that these items do not contain any material that otherwise violates any criminal prohibition. You grant PetFirst, its associates, agents, personnel, assigns, licensees, successors in interest and legal representatives, an irrevocable and perpetual and royalty free right to use your photo(s), information and name (first name and/or last name or any fictional name you provided with your entry) or likeness, in all forms and in all media and in all manners, without any restriction or notice as to changes or alterations for any advertising, promotion, publicity, or any other lawful purposes. Your photo(s) and information may be altered for the purposes of proper publication at the Petfirst.com website, or other online social media sites in connection with this Sweepstake. You waive any claims you may have based on any usage of your photo(s) and information and release PetFirst from any and all liability related to distribution, publication, and dissemination of these items, including publication on the Internet. You waive all moral or integrity rights with respect to the photo(s) you have entered into this Sweepstake. PetFirst is not liable or responsible for any content provided by users of this Sweepstake to PetFirst s website. PetFirst will not sell the rights in your photo(s) or information to any third party. Other Restrictions Prizes will be awarded only to winners who have fully complied with these Rules. Prizes are nonassignable, non-transferable and void if sold or auctioned. No cash alternative or substitution of a prize winning will be allowed. Prizes may not be used with any other offer, coupon, or discount. Prize recipients shall be solely responsible for all sales tax and income tax, as may be applicable to the prize, and all other costs incurred in using the prize.

4 Liability and Force Majeure Each person who enters the Sweepstakes does so at his/her own risk. By participating in the Sweepstake, each entrant (1) hereby releases and agrees to hold PetFirst harmless from and against any and all costs, injuries, losses or damages of any kind, including, without limitations, death and bodily injury, due in whole or in part, directly or indirectly, to participation in the Sweepstakes or any Sweepstakes-related activity, or the receipt, use or misuse of any Prize; and (2) acknowledges that PetFirst has not made any warranty, representation, condition, or guarantee, express or implied, in fact or in law, with respect to any Prize, and HEREBY SPECIFICALLY DISCLAIMS ALL SUCH WARRANTIES, INCLUDING WITHOUT LIMITATION, THE IMPLIED WARRANTIES OF MERCHANT ABILITY AND FITNESS FOR PARTICULAR PUPOSE. PetFirst assumes, and shall have, no responsibility for any damage to an entrant s computer system that is directly or indirectly caused by accessing or downloading content from any website or otherwise submitting electronic mail to PetFirst and participating in the Sweepstakes, or for any computer system, phone line, hardware, software or program malfunctions, or other errors, failures, dropped or delayed computer transmissions or network connections that are human or technical in nature. Without limiting the generality of the foregoing, PetFirst is not responsible for incomplete, illegible, misdirected, late, lost, damaged, stolen, or postage-due entries or redemption documents; or for lost, interrupted, inaccessible or unavailable networks, servers, satellites, Internet Service Providers, websites or other connections; or for miscommunications, failed, mumbled, scrambled, delayed or misdirected computer, telephone or cable transmissions; or for any technical malfunctions, failures, or difficulties, printing errors, clerical, typographical or other error in the offering or announcement of any prize or in any prize notification document, or other errors of any in-kind or nature; or for the incorrect or inaccurate capture of information, or the failure to capture any information. PetFirst reserves the right, without prior notice and at any time, to terminate the Sweepstakes, in whole or in part, or modify or suspend the Contest in any way, if it determines, in its dole discretion, that the Sweepstakes is technically impaired or corrupted or that fraud or technical problems, failures or malfunctions have corrupted, destroyed or severely undermined the administration, security, fairness, integrity and/or feasibility of the Sweepstakes. In the event PetFirst is prevented from awarding prizes or continuing with the Sweepstakes as contemplate herein by any event beyond their control, including but not limited to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, fire, flood, natural or manmade epidemic of health of other means, earthquake, explosion, labor dispute or strike, act of God or public enemy, satellite or equipment failure, riot or civil disturbance, terrorist threat or activity, war (declared or undeclared) or any federal state or local government law, order, or regulation, public health crisis (e.g. SARS), order of any court or jurisdiction, or other cause not reasonably within PetFirst s control (each a Force Majeure event or occurrence), PetFirst shall have the right to cancel, terminate, modify, suspend or extend the Sweepstakes. If the Sweepstakes is terminated, in whole or in part, before the designated end date, PetFirst may select winners (or the remaining winners, as the case may be) in a random drawing from all eligible, non-suspect entries received as of the date of the event giving rise to the termination.

5 Only the type and quality of prizes described in these Rules will be awarded. Any prizes that are not duly claimed in accordance with these Rules will not be awarded. Any attempt by an entrant or any other individual to deliberately damage the Sweepstakes or undermine the legitimate operation of the Sweepstakes, or to annoy, abuse, threaten or harass any other person, is in violation of criminal and civil laws and should such an attempt be made, PetFirst reserves the right to disqualify the applicable individual and seek damages and other remedies from any such person to the fullest extent permitted by law. The invalidity or unenforceability of any provision of these rules shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these Rules shall otherwise remain in effect and shall be construed in accordance with their terms as if the invalid or illegal provision were not contained herein. Headings and captions are used in these Rules solely for ease of reference, and shall not be deemed to affect in any manner the meaning or intent of these Rules or any provision hereof. These Rules cannot be modified or amended in any way except in writing by a duly authorized representative of PetFirst. Governing Law and Venue/Jurisdiction All issues and questions concerning the construction, validity, interpretation and enforceability of these Rules or the rights and obligations of participants or PetFirst in connection with the Sweepstakes shall be governed by and construed in accordance with the laws of the State of Indiana in the United States without regard to conflict or choice of law provisions or international treaties or conventions. Participants specifically agree to the venue and jurisdiction being exclusively in the federal and state courts situated in Clark County in the state of Indiana, United States.
