1 400 Ashley Court Glen Mills, PA Phone: Fax: ATTIC FAN - DECEMBER 1995 WHEREAS, the Declaration of Condominium for Darlington Woods Condominium restricts alterations of any common elements or any additions or improvements thereto, without prior written approval of the Board of Directors; and WHEREAS, the Board of Directors of Darlington Woods Condominium has been asked to approve an architectural change request for the installation of an approved attic fan through the roof of individual town home units; and, WHEREAS, the Board of Directors of Darlington Woods Condominium recognizes the benefit of this installation to some homeowners in Darlington Woods Condominium, WHEREAS, the Board of Directors is adopting the installation of the attic fan, make FASCO, model AGVI6, model 660R-24, BE IT THEREFORE RESOLVED that the Board of Directors of Darlington Woods hereby approves the installation of an attic fan to the existing town home roof with the following specifications: 1. TO maintain uniformity of the outside wall, a louver shall be installed in the center of the gable. Mode1660R The make FASCO, model AGV16 shall be the only fan permitted. 3. Any contractor performing the installation must provide a certificate of insurance. The installation must be approved by the Association's maintenance contractor. 4. All expense shall be borne by the homeowner. 5. All maintenance shall be borne by the homeowner. 6. Homeowner agrees to take responsibility for, or claim for, or duty to, repair or remedy in any manner whatsoever any and all damages or defects to any portion of their unit or any other units, including, but not limited to, the roof of said unit, caused by or through the installation, operation, and/or removal of said attic fan, whether negligent, intentional, or otherwise, no matter Page 1
2 by whom said damage or defect is caused. The Board has the right to obtain an independent opinion. 7. All responsibility shall be transferred as part of any resale to the new owner. 3 STORM DOOR - OCTOBER Color must be white 2. No decoration on the door is permitted, i.e., initials, scrolls, etc. No jalousie windows 3. No scalloped edges, only straight lines 4. Must conform to style shown below. FULL VIEW MIDDLE STRIP CANNOT EXCEED 3"/ BOTTOM PANEL LESS THAN 12". A written request for this addition to a unit is not needed if it conforms to the above requirements. Unit owners will be responsible for maintenance and repair of the storm/screen door. 4 AWNINGS - AUGUST, 2001 The Darlington Woods Board of Directors has established specifications for the rear patio and/or deck awnings in the community. They are as follows: 1. The applicant, prior to installation of the awning, must receive written approval from the Board of Directors. The required "Alteration to Common Element" form is available at the Management office. 2. Awnings must be retractable. 3. Awnings must be retracted back against the home when not in use. 4. Awnings must be attached to the fascia of the home; it may not be attached to any part of the roof. 5. The size of the awning must not exceed the sizes of the existin2 deck or patio. 6. No outdoor grills may be used while the awning is extended. 7. The owner is responsible for any damage to the building and/or common element during installation or while installed. 8. Manufacturer of the awning must be Sunbrella Fabric Collection, Color # , Black Forest Fancy with the "wave" edge. "The frame and hood must be white in color. Installation is to be into the studding with 3/8 X 3 1/2 " lag bolt brackets. 9. The owner is responsible for obtaining a Borough permit if necessary. 10. The owner must comply with all local regulations and requirements. The awning is the continuing maintenance responsibility of the unit owner (and all subsequent owners). The Association reserves the right to require the homeowner to repair, remove or replace an awning (fabric, trim, etc.). If such repair, replacement or removal is necessary, in the opinion of the Board of Directors in order to maintain the aesthetics of the community. 5 GAS FIREPLACE - DECEMBER 1997 WHEREAS, the Declaration of Condominium for Darlington Woods Condominium restricts alterations of any common elements or any additions or improvements thereto, without prior written approval of the Board of Directors; and WHEREAS, the Board of Directors of Darlington Woods Condominium has been asked to approve an architectural change request for the a gas fireplace installation affecting the common elements; and WHEREAS, the Board of Directors is adopting a retrofit of the existing fireplace with the following materials in conjunction with the National Fuel Gas Code, NFP A 54; and BE IT THEREFORE RESOLVED that the Board of Directors of Darlington Woods and PECO is approving the retrofits to the existing fireplaces with the following specifications: 1. The Board of Directors require galvanized pipe, copper (k or I only) compression of flared fittings, corrugated stainless steel tubing (gastite or wardflex) for all above ground installations. All piping must be run under the downspout as to not be visible from the exterior. No propane tanks, other than for a gas grill are permitted on or underground. 2. The Board of Directors requires black iron (no coating required) or galvanized pipe or copper (k or I) or corrugated stainless steel must be used for indoor installations. 3. The Board of Directors require galvanized pipe (all joints pitched and wrapped, copper (k or I only), plastic pipe (astmorated sdr 9 or 11). All underground piping must be approved by the Board and must be installed 17" below ground level with a minimum #12 tracer wire. Underground must be installed by an appropriate contractor. 4. The Board of Directors requires shut-off (non-displaceable ball valve) within 6 feet of the decorative appliance for the individual fuel line. All vented gas logs require a permanent damper opening per the manufacturer's specifications. 5. All expense shall be borne by the homeowner. All maintenance shall be borne by the homeowner. 6 INSURANCE - FEBRUARY 1997 The Darlington Woods Board desires, by this Resolution, to clearly define the procedures for submission and processing of insurance policy claims. BY IT THEREFORE RESOLVED, that the following procedures are in effect as of March 1997: 1. The Association will maintain an "all risk" casualty insurance policy insuring the entire property, including the common elements, units and fixtures. 2. The Association casualty insurance policy is subject to a $5,000 (subject to change) per occurrence (non-specific). 3. In the event of a claim, each unit owner making a claim pursuant to an individual occurrence will be assessed a pro-rata share of the deductible and any other amount of the loss not covered by the Association's insurance. It shall be obligatory upon the Board for the Association to repair or restore the damage. The Association shall obtain reliable estimates and shall have the right to repair the property based on proceeds which are proportionate to the claim. 4. Unit owners are advised to maintain what is referred to in the insurance industry as an HO-6 policy on each unit, insuring, among other things personal property of the unit owner, building losses the homeowner is responsible for, coverage for the Association's deductible, and liability protection. No unit shall be used in a manner which will increase the insurance premium payable by the Association. No unit shall be kept in a manner which would violate any fire code, ordinance, law or any manner which would endanger themselves or their neighbor(s). Unit owners shall provide for periodic cleaning of any chimney and flue of the unit's fireplace to prevent possibility of fire damage. Unit owners are required to maintain their individual heaters, water heaters, smoke alarms, air conditioners and air conditioner condensate lines, and appliances, including dryer vents to prevent the possibility of fire or any other type of property damage. 5. All claims must be processed through the Board of the Association. Upon receipt of a claim by the Board it will, if appropriate, contact the Association's insurance company and have a claims adjustor assigned to the claim. 6. A unit owner is required to notify his/her insurance company as to any claim he/she has concerning personal property or improvements to the damaged unit. 7. Claims and deductibles from leaks resulting from one unit to another should be reported to the Page 6
7 individual unit owners' insurance company as well as the Association's carrier if over the deductible. The cost of repair is not covered by insurance. If negligence is found, the affected unit owner's insurance company may subrogate against the party causing the damage. Owners will be guided by the insurance company's determination of negligence. The Association is not responsible to coordinate plumbing repair. 8. Roof leak damage on the interior of the unit, unless caused by wind damage or ice damning, is the responsibility of the homeowner if under the Association's deductible. All roof repairs will be made by the Association. Ground water is not covered by insurance DARLINGTON WOODS BOARD OF DIRECTORS - MARCH 1997 NOTE: The Master fire/liability policy will cover the building structure. If you unit is destroyed by fire, the carrier will pay to rebuild the unit. BE SURE TO CHECK WITH YOUR CARRIER REGARDING COVERAGE OF THE ASSOCIATION'S DEDUCTIBLE Non-common and/or interior plumbing, electrical and sewer repairs are ALWAYS the responsibility of the unit owner. GARAGE DOOR MAINTENANCE To insure proper operation the following maintenance should be performed twice a year. 1. Lubricate all moving parts and coat torsion springs with regular grade machine oil. 2. Check for loose or missing fasteners 3. Check moving parts for signs of wear 4. Check door and track supports for proper spacing and alignment 5. Check balance of door (If electrically operated, disconnect operator first). 6. Check for proper seal against jambs, header and floor 7. Check that all safety warning labels and tags are in place 8. Do not remove red bolts attaching bottom bracket or spring support while springs are under tension. Periodic Cleaning: Use a mild detergent to wash door; do not use abrasive cleansers.
