4 WEST AFRIA REGIONAL FISHERIES PROGRAM P IDA REDIT No SE RESTRUTURING PAPER A. SUMMARY 1. The West Africa Regional Fisheries Program aims to support the countries from Mauritania down to Ghana to sustainably increase the economic returns generated for the region by the rich marine fish resources. To achieve this, the Program is a series of overlapping adaptable program loans (APLs) that include national investments to strengthen the capacity of the countries to collaborate around the management of the fish resources and greater value addition locally, with regional coordination by the Sub-Regional Fisheries ommission (SRP). The first APL in the series included the countries of ape Verde, Liberia, Senegal and Sierra Leone, becoming effective in However the Senegal component of the APL was found to be Moderately Unsatisfactory in May 2012, on both the PDO and implementation progress, due to a decrease in implementation progress in the country starting in August This reduction in progress was due to weaknesses in the management of the project nationally in Senegal, as well as a wide spread of sector activities, from strengthened governance to new infrastructure investments. As a result, the new Government replaced the management team in June 2012, and the scope of project activities in Senegal is being reduced to the country s (and region s) key priority to rebuild the resource base. More specifically, component 1 (Good Governance and Sustainable Fisheries Management) activities in Senegal will be modified to include operation and completion of the successful community pilot initiatives in local empowerment from the recently closed Integrated oastal and Maritime Resource Management Project (GIRMa) and the Sustainable Management of Fish Resources Project (GDRH) in Senegal, as regional demonstration models. At the same time, component 3 (Increased Value Added to Fish Products) activities to establish a fishing landing site cluster in Kafountine will be dropped. This sharpened focus of the project will allow the Government of Senegal to concentrate on the key priority in the sector to increase economic benefits from the fisheries, and to reduce complexity in implementation. B. PROJET STATUS 2. The credit was approved by the Board on October 20, 2009 as part of the first APL in the West Africa Regional Fisheries Program, became effective on June Page 4 of 19

5 22, 2010 for an amount of US$ 15 million and is expected to close on December 15, The development objective of the WARFP is to: (i) strengthen the country s capacity to sustainably govern and manage its fisheries; (ii) reduce illegal fishing; and (iii) increase local value added to fish products. To date, SDR 1.8 million (US$2.76 million equivalent) have been disbursed (a percent disbursement rate). The IDA credit still has SDR 7.9 million in undisbursed funds and the overall objectives will continue to be achievable with the implementation of the proposed changes in the next section below. 3. This national element of the WARFP in Senegal was rated Moderately Unsatisfactory in May 2012, on both the PDO and IP, due to a decrease in implementation progress in the country starting in August This reduction in progress was due to weaknesses in the management of the project nationally in Senegal, as well as a wide spread of sector activities, from strengthened governance to new infrastructure investments. As a result, the new Government replaced the management team in June 2012, and the scope of project activities in Senegal is being re-focused around the country s (and region s) key priority to rebuild the resource base. 4. At this stage of project implementation to strengthen governance of the country s fisheries (omponent 1: Good Governance and Sustainable Fisheries Management), according to the indicators clear principles and policies to increase the wealth from fisheries through strengthened rights and equitable allocation of these rights which balances economic efficiency and social benefits have not yet been established. However, in terms of small-scale vessel registration, 85 percent of the artisanal fleet has now been registered in Senegal and a Decree to freeze further registration has been issued by the Government (with positive benefits for the entire region, given the unaccounted activities of this fleet throughout West Africa). Regarding the reduction of demersal industrial fleet vessel in the country, the independent auditor who would help set the prices of the vessels has been recruited and the Government is undertaking the next steps for the purpose of this buy-back to reduce the fishing fleet to more sustainable levels. To enforce compliance with strengthened governance, component 2 (Reduction of illegal fishing) activities have achieved the target of 200 total patrol days in coastal waters for the year 2011 and a satellite-based fishing vessel monitoring system (VMS) is in place and is functioning. However, the component 3 (Increasing the contribution of the marine fish resources to the local economies) activities to invest in more infrastructure to add greater value locally have not advanced, as the pilot integrated fish landing site cluster in Kafountine (Region of Zinguinchor) has not been established yet.. PROPOSED HANGES 5. This restructuring paper has as a main objective to streamline the national elements of the program around the priority of strengthening governance of the sector, in order to help rebuild the resource base and achieve the PDO. 6 specifically, certain components of the Project will be restructured to include activities that were initially not financed by the IDA, and which were are included in the Project Appraisal Document. All the activities that are added to the components are not new in that they were appraised and the due diligence as to social safeguard policies was undertaken as part of the Project appraisal. omponent one activities will focus on scaling up the principles of local empowerment and allocation of secure rights to reduce open access (the main constraint of the fisheries sector) (omponent 1) while continuing to improve surveillance of fisheries (omponent 2), while the component on infrastructure (omponent 3) has been greatly reduced as a later priority. For component 1, the activities will be modified to reduce a number of broader research efforts while at the same time adding the operation and completion of the successful community pilot initiatives from the GIRMa and GDRH. For component 3, the investments for establishing a fishing landing site cluster in Kafountine will be dropped for a later priority. 6. Thus, the following changes (added/modified/dropped activities) will be provided for the restructured WARFP (with reference to the Project Description in the Financing Agreement): Part A (1)(Good Governance of fisheries)(added): Freeze of the artisanal and industrial fishing fleets, via completion and maintenance of registration of all artisanal fishing boats, and maintenance of the current regulation freezing new industrial licenses; Part A (1)(Good Governance of fisheries)(added): onsolidation and strengthening of coastal fisheries o-management in the 12 pilot sites from GIRMa and GDRH, via provision of technical assistance, goods and Training and carrying out of works in view of: i. onsolidation (in the four initial pilot sites) and replication (in the 8 other sites) of co-management initiatives including capacity building of LPs and provision of support for the implementation and evaluation of LP sub-projects, ii. Development and implementation of local level monitoring, control and surveillance measures for fisheries in the 12 pilot sites, including, inter alia, the participatory monitoring of fish catches, surveillance and enforcement of regulations and fishing rights. Part A(1)(Good Governance of fisheries) (added): Public investment in fish resource rehabilitation, as a result of marine protected areas and artificial reefs including: i. Establishment of protected Fishing Zones (ZPPs): Designation of ZPPs; carrying out awareness campaigns on the management and benefits of ZPPs; building capacity of stakeholders for the co-management of ZPPs; conducting Page 6 of 19

7 baseline evaluations of sites and assessments of fish resources and fishing practices. Preparation of co-management plans for ZPPs. arrying out feasibility studies on sustainable financing mechanisms for ZPPs. Development of standards and instruments for monitoring, evaluation and surveillance of ZPPs. ii. Immersion of artificial reefs: arrying out of feasibility studies for the selection of sites for immersion of artificial reefs and based on the findings of such studies and their inclusion in the o-management Agreements and the ZPP Management Plans, immersion and management of the artificial reefs in the ZPPs. Provision of technical assistance to the Ministry of the Recipient in charge of fisheries for implementation of the national artificial reef immersion program. arrying out of feasibility studies on sustainable financing mechanisms for artificial reefs. The investments under the restructured project are expected to support the Government to deliver on the long-overdue vision of addressing the open access constraints to the fisheries via secure rights, and thereby allowing the resources to rebuild and economic returns to increase. Hence, this level II restructuring will enable the WARFP to get back on track in Senegal towards achieving its objectives, and help raise the PDO and IP ratings..1. Results/indicators 8. Based on the proposed changes above, new intermediate outcome indicators will be added and the intermediate outcome indicator related to the implementation fishing cluster (in Kafountine) will be dropped accordingly. The achievement of these intermediate results will result firstly in limiting open access and allocating long term and transferable fishing access rights to fishermen/fishing communities, and secondly in enhancing the fisheries surveillance which should lead to the compliance to fishing rights and management regime. onsequently, in the medium and long term, the stock of fisheries will be able to recover progressively and the economic returns from these fisheries will increase as a result. In this way, the achievement of these intermediate results will contribute to the achievement of the PDO. 2 While the restructured project will focus on introduction of clear fishing rights for the fishermen and fishing communities, the focus will be put on the LPs (Local ommittee of fisheries) (local private Associations of fishermen) for the enhancement of the co-management and the allocation of fishing rights. Moreover, the LPAs have not been able to be operational by the Government till now so the restructured project will not focus on this structure to achieve the PDO. 3 Idem as above foot note (2). So, the following intermediate outcome indicators will be dropped or added in the results framework table in Annex 1: a) The intermediate outcome indicator for component 3: One pilot integrated fish landing site clusters established by the Program and operating in Kafountine will be dropped; b) The following new intermediate results indicators for the added activities in component 1 will be included in the results framework with revised targets, namely: Legally established co-management communities (LP) which are allocated fishing rights (TURF) (including the ones co-managing the ZPP and ZIRA) (number) Registered small-scale fishing vessels operating within the coastal waters of Senegal that obtain the current general fishing permit (Permis de Pêche) (% of total). Registered small-scale fishing vessels that are allocated and enforced with defined and specified individual fishing/access rights (new and specified fishing license for small-scale fisheries) (% of total) 10. Some of the indicators have zero baselines in the results framework as the related activities will begin to be implemented and the results to be achieved only under the project implementation..2. Safeguards: 11. As the added activities in component 1 of the WARFP consist on operation and completion of the successful community pilot initiatives from the GIRMa and GDRH, these added activities were originally included as part of these original projects and were appraised as part of the projects as presented to the Board. The GIRMa and GDRH were community-focused project and the WARFP focuses on communities and communities rights to manage natural resources. All three projects have aimed to implement a process that empowers communities to more sustainably co-manage the fisheries, and where necessary to help restore the fish stocks, most of the activities of these projects are expected to have positive impacts on environment. These projects have been designed to help implement policies and institutional frameworks for fisheries resources management, and to enhance the livelihoods of poor fishing communities as a result. So, they have the same social and environmental safeguard category and consequently the new activities added to the WARFP have not any implications as to the safeguards category. The AFTSG has confirmed that the Safeguard Documents (_E2197) will not require to be updated since all the activities that are added to various Page 9 of 19

10 components were appraised as part of the previous Projects that has just closed and are included in their disclosed Safeguard Documents. So these activities have been appraised and safeguards are consistent with current provisions, and essentially they will enhance the Borrower s ability to meet the currently agreed objectives and results targeted in the WARFP..3. Institutional arrangements: 12. The Directorate for Marine Fisheries (DPM) will continue to house the national project implement unit (PIU) for Senegal, within the Ministry of Maritime Economy, working with the regional coordination unit housed in the SRP. This PIU will have full fiduciary responsibility for the Senegalese element of the West Africa Regional Fisheries Program investments and will be responsible for dayto-day project coordination and implementation, including: planning of activities and monitoring and evaluation, carrying out project financial and procurement management for the Senegal component of the WARFP, developing a communication strategy and establishing and maintaining the Project Management Information System for Senegal. The three Directorates (DPM, DPSP, and DITP) within the Ministry will continue to be responsible for implementation of different parts of the credit according to the Financing Agreement..4. So, the first step towards the allocation of clear fishing rights (via specified fishing license) will be to allocate the current fishing permits to all the fishermen in the fleet and then the next step will be the replacement of this current permits with the introduction and allocation of specified and legally recognized fishing license for small-scale fisheries as form of clear fishing rights. The objective is to allocate clear, specified, long-term fishing rights through this more specified fishing license to limit the access to the fisheries (to tackle the key issue of de facto open access to the resources). 9 As per the footnote (8) above, this specified and legally recognized fishing license should substitute the current fishing permit in order to allocate clear fishing rights to fishermen/communities.
