Dankowski, Deputy Village Manager/Finance Director An Ordinance Amending Ordinance No Adopting the Annual Budget for the Year Commencing July 1, 2016 and ending June 30, 2017 BACKGROUND/DISCUSSION: Halfway through the fiscal year, expenses and revenues are analyzed. After the analysis, the budget should be amended to include revenues that have been received that were not included in the budget, as adopted, and expenses that have, similarly, been incurred that were unexpected. Budget amendments are required for spending authority. Amendments are requested in the following areas: encumbrances, Board directives, grants, adjustments and other initiatives. These items were discussed at the six month review on February 25. Additional items not listed at the review have been bolded. Encumbrances At the end of a fiscal year, departments are asked to identify those projects or funds that were approved by the Board, but not expended. In order to ensure that the funds are available in the next budget, they are assigned. These funds are noted as an assigned fund balance on page 29 of the Village audit. The process recommended by the Village auditors is for the Board to approve the current year expenditure of these funds by Budget amendment. The following list details those expenditures that were assigned at June 30, 2015 in the General Fund. 4 Grants Fire Department The Village has received two Enbridge Grants for $1,000. The Department has received these grants for the last seven years. Capital $2,000 Grant Revenue $2,000 The Fire Department has been awarded a Firefighter Grant to pay for self contained breathing apparatus. Capital $240,855 Federal Grant $240,855 The Fire Department has also been awarded a Grant to replace the fire prevention education trailer. Police Capital $106,166 Federal Grant $106,166 The Police department received a traffic safety grant. Salaries $17,917 State Grant Revenue $17,917 The Police Department received a grant from Com Ed for defibulators. CDBG Operating Supplies $11,000 Com Ed Grant $11,000 The Village received grant notification for major cut-through work from CDBG. This grant requires matching dollars. Capital $274,
5 Star Disposal Transfer from Capital Projects $74,000 Grant Revenue $200,000 The Village has partnered with Star Disposal to receive grant funds to provide compressed natural gas pumps. These funds flow through the Village and are transferred to Star. 6 Vehicle Services There were two vehicles previously budgeted that were not expended until the current fiscal year Capital. Pensions Professional Services $15,000 The Police and Fire Pension Funds are at 44.24% and 46.20% funded. In an effort to improve funding an added transfer of support is requested. 7 Transfer to Fire Pension $114,000 The recommended transfer is proportionate to the fund balance. Aqua Center Reflect first month payment to JEMS (Aqua Center Management). Professional Services $44,830 P-T Salaries $31,627 Housing Authority Transfer funds to cover long standing receivable and payable write off. Transfer from General Fund $50,000 Transfer to Housing Authority $50,000 Fire Department The Fire Department negotiated a payment to the PEHP Plan for retiree health insurance. Summary Health Insurance $38,500 As noted in the previous discussion some operating revenues and expenditures have stabilized. A number of capital projects including parking lot resurfacing, water main replacement, storm sewer works, and Indianwood resurfacing will be a major focus through 2017/2018. 8 ORDINANCE NO 2053 AN ORDINANCE AMENDING ORDINANCE NO ADOPTING THE ANNUAL BUDGET FOR THE YEAR COMMENCING JULY 1, 2016 AND ENDING JUNE 30, 2017 WHEREAS, the Village of Park Forest, Cook and Will Counties, Illinois, is a home rule unit of government pursuant to the provision of Article VII, Section 6 of the Illinois Constitution; and WHEREAS, as a home rule unit of government, the Village may exercise any power and perform any function pertaining to its government except as limited by Article VII, Section 6; and WHEREAS, the Village of Park Forest adopted its Annual Budget pursuant to Ordinance No adopted by the Village Board of Trustees on June 20, 2016; and WHEREAS, the Village desires to amend this budget to reflect the actual financial transaction of the Village as hereinafter specified. 11 AGENDA BRIEFING DATE: March 14, 2017 TO: FROM: RE: Mayor Ostenburg Board of Trustees Hildy L. Kingma, AICP, Director of Economic Development and Planning Ordinance Related to Chapter 6 (Alcoholic Beverages) of the Code of Ordinances BACKGROUND/DISCUSSION: The attached Ordinance addresses three items, including 1) the addition of a class A/tavern liquor license for a video gaming café at 200 Main Street, 2) the addition of a class M liquor license for wine manufacturing, and 3) the addition of a liquor license for a class M/wine manufacturing liquor license for a new wine manufacturing business at 290 Victory Drive. Mr. Fadi Mohammad has submitted an application to the Village for a liquor license at 200 Main Street to operate Gold Pot Entertainment (DBA Millys). The proposed business is a video gaming café with five gaming machines, a sit-down area for eating and a bar for liquor service. Light sandwiches and desserts will be served. Mr. Mohammad was interviewed by the Liquor Commissioner, Village Manager, Police Chief and Village Attorney on February 27, and he passed a background check as required by the Village s ordinance. Therefore, the Liquor Commissioner has recommended the issuance of a class A/Tavern liquor license. Mr. Rick Nesbitt has submitted an application to open Vintrendi Wines at 290 Victory Drive. This will be a business that mixes wines to create new, unique wine flavors and blends. Mr. Nesbitt plans to sell his product through mail order and internet sales. He will also have a small tasting business and offer occasional events at his location. If more than 6 ounces of wine will be served to any individual customer, light refreshments will be served. Mr. Nesbitt was interviewed by the Liquor Commissioner, Village Manager, Police Chief and Village Attorney on February 27, and he passed a background check as required by the Village s ordinance. Therefore, the Liquor Commissioner has recommended the issuance of a class M/wine manufacturing liquor license. In order to permit Mr. Nesbitt s proposed business, a new liquor license classification must be created. The proposed class M license allows manufacturing of wines consistent with State Statute. It also limits the amount of wine that can be served on-premises without the serving of food. Class M licensees will be able to obtain a class A/tavern or class G/restaurant license at no additional cost. The attached Ordinance has been reviewed and approved by the Village Attorney. SCHEDULE FOR CONSIDERATION: This item will appear on the Regular Board meeting agenda of March 20, 2017, for First Reading, and the Special Rules Board meeting agenda on the same night for discussion.
12 ORDINANCE AN ORDINANCE RELATED TO CHAPTER 6 ( ALCOHOLIC BEVERAGES ), ARTICLE II ( LICENSES), SECTION 6-43 ( CLASSIFICATION ) AND SECTION 6-49 ( NUMBER LIMITED ) OF THE CODE OF ORDINANCES, VILLAGE OF PARK FOREST, COOK AND WILL COUNTIES, ILLINOIS WHEREAS, Section 6-49 of the Code of Ordinances, Village of Park Forest, Cook and Will Counties, Illinois ( Village Code ) provides that the number of licenses in effect at any one time for the sale of liquor shall not exceed four (4) for Class A licenses; and WHEREAS, there are currently four (4) Class A licenses in the Village of Park Forest ( Village ); and WHEREAS, Fadi Mohammad on behalf of Gold Pot Entertainment (DBA Millys), ( First Applicant ), has applied for a Class A liquor license ( First Application ) for the premises commonly known as 200 Main Street, Park Forest, Illinois ( First Premises ), which Application is incorporated herein as though fully set forth; and WHEREAS, the Village seeks to amend the number of Class A liquor licenses in the Village to five (5) so as to accommodate the opening of the business for the sale of alcoholic liquors at the First Premises pending the issuance of all applicable licenses and other necessary approvals; and WHEREAS, Section 6-43 of the Code of Ordinances, Village of Park Forest, Cook and Will Counties, Illinois ( Village Code ) establishes the type of alcoholic liquor licenses that may be issued by the Village of Park Forest; and WHEREAS, Rick Nesbitt on behalf of Vintrendi Wines ( Second Applicant ), has requested consideration for a liquor license to allow for manufacture and sale of wines, to be located at 290 Victory Drive ( Second Premises ) which request is incorporated herein as though fully set forth; and WHEREAS, the Village seeks to amend Section 6-43 of the Code of Ordinances to allow for a liquor license classification, to be known as class M, that permits the manufacture of wines in limited amounts; and WHEREAS, the Village seeks to amend the number of Class M liquor licenses in the Village to one (1) so as to accommodate the opening of the business for the manufacture and sale of wines at the Second Premises pending the issuance of all applicable licenses and other necessary approvals. NOW, THEREFORE, BE IT ORDAINED by the Mayor and Board of Trustees of the Village of Park Forest, Cook and Will Counties, Illinois, in the exercise of the Village s home rule powers, as follows:
13 Section 1. Recitals Incorporated. The above recitals are incorporated herein as though fully set forth herein. Section 2. Code of Ordinances. Chapter 6 ( Alcoholic Beverages ), Article II ( Licenses ), Section 6-43 ( Classification ) and Section 6-49 ( Number Limited ) of the Code of Ordinances of the Village of Park Forest, Cook and Will Counties, Illinois, are hereby amended by adding the following underlined words and deleting the stricken language to read as follows: ARTICLE II. LICENSES Section Classification. (13) Class M license. A class M license shall authorize the manufacture, bottling, wholesale and retail sale of up to 50,000 gallons of wine by the bottle or case. Retail sales may be for consumption on or off the licensed premises. Any sale of wine for off-premise consumption shall be in a sealed container. Any sale for on-premises consumption shall be no more than six (6) ounces to any individual when food is not served. Class A and class G licensees shall be eligible to obtain a class M license for the same premises at no charge. Nothing in the issuance of a class M license shall be considered to relieve the licensee of any responsibility for complying with all applicable state and federal regulations relating to the manufacture and/or sale of wine or other alcoholic beverages and with all applicable business and other regulations of the Village. ARTICLE II. LICENSES Section Number Limited (a) Except as otherwise provided in section 6-55, the number of licenses in effect at any one time for the sale of liquor shall be as follows: Class Number of licenses (1) Class A licenses 4 5 (2) Class B licenses 0 (3) Class C licenses 0 (4) Class D licenses 2 (5) Class E licenses 1

If any provision of this Ordinance, or the application of any provision of this Ordinance, is held unconstitutional or otherwise invalid, such occurrence shall not affect other provisions of this Ordinance, or their application, that can be given effect without the unconstitutional or invalid provision or its application. Each unconstitutional or invalid provision, or application of such provision, is severable, unless otherwise provided by this Ordinance. All ordinances, resolutions or orders, or parts thereof, in conflict with the provisions of this Ordinance are to the extent of such conflict hereby repealed. Section 4. Effective Date. 15 AGENDA BRIEFING DATE: March 14, 2017 TO: FROM: RE: Mayor John Ostenburg Board of Trustees Robert Gunther Director of Recreation & Parks Urban Forestry Operations BACKGROUND/DISCUSSION: Urban Forestry operations contracts approved by the Board in 2015 include the option to renew them annually for two additional years, per approval of both parties. The contracts for urban forestry operations were awarded to two companies. AAA Tree Service was awarded the pruning contract and Homer Tree Service was awarded the tree removals contract. Staff has been satisfied with the performance of each company during the 2015 and 2016 seasons, has spoken with representatives of both companies and each is willing to renew the original contracts, under the same terms and conditions. Staff recommends continuing the tree removal contract with Homer Tree Service, Inc. for an average cost per tree of $ Staff also recommends continuing the pruning maintenance contract with AAA Tree Service, Inc. with an average cost per tree of $3.75. An average size tree in Park Forest is 20 DBH (diameter at breast height) costing $385 to remove this tree or $75.00 to prune it. Attached are letters from each company agreeing to a contract renewal. 18 AGENDA BRIEFING DATE: March 14, 2017 TO: FROM: RE: Mayor John Ostenburg Board of Trustees Robert Gunther Director of Recreation & Parks Landscape Maintenance Contract Renewal BACKGROUND/DISCUSSION: Mowing contracts approved by the Board in 2015 include the option to renew them annually for two additional years, per approval of both parties. Last season s mowing was divided into two contracts and awarded to two companies. Propst Lawn Maintenance was awarded Areas 1 10, which includes the municipal buildings and other high visibility locations and Suburban Landscaping was awarded Areas which includes vacant lots and various commercial properties. Overall staff was satisfied with the performance of each company during the 2015 and 2016 season and has spoken with representatives of both companies and each is willing to renew the original contracts, under the same terms and conditions. Staff recommends that the contract for mowing Areas #1- #10 be awarded to Propst Lawn Maintenance. Weekly cost to be $1, with a $41, anticipated season cost. Staff also recommends that the contract for Areas #12 - #18 be awarded to Suburban Landscaping. Weekly cost to be $2,406.4 and an anticipated season cost of $36, Anticipated seasonal cost for all areas combined is $77,276.30, depending on the total number of weeks. Attached are letters from each company agreeing to a contract renewal. 21 AGENDA BRIEFING DATE: March 15, 2017 TO: FROM: RE: Mayor John Ostenburg Board of Trustees Nicholas Christie Assistant Village Engineer - DPW Renewal of the Residential Water Shut Off Valve Replacement Contract BACKGROUND/DISCUSSION: On June 20, 2016, the Village entered into a contract with Calumet City Plumbing, located in Calumet City, IL, for its Residential Water Shut Off (B-Box) Replacement Annual Maintenance Contract. Under this contract, Calumet City Plumbing replaced residential water service shut off valves per month at locations provided by the Village. Village staff was satisfied with the Contractor s work and the program has been successful. However, there continues to be many more valves that need to be replaced and staff would like to continue the program into the next fiscal year. Page 20 of the contract contains the following language: Upon written agreement of both parties no later than April 1, 2017 and 2018, the contract may be renewed by the Village of Park Forest for a period of one successive year under the same terms and conditions as in the original contract subject to approval by the Village Board (July 2017-June 2018 and July 2018-June 2019) Given the above terms of the original contract, both Village staff and Calumet City Plumbing would like to renew this contract for the 2018 fiscal year, the first of two optional renewals. See the attached signed agreement by the Contractor including the price tabulation indicating the contract unit costs with an estimated Fiscal 2018 quantity. RECOMMENDATION: Renew the Residential Water Shut Off (B-Box) Replacement Annual Maintenance Contract with Calumet City Plumbing from Calumet City, IL, and authorize the Village Manager to enter into said contract in the amount of $99, with a contingency for any additional work as determined by the Village Engineer for a total cost not to exceed $125,000. While the contract proposes to replace 143 valves over the Fiscal year, the contingency reflects that it is in the interest of the Village to replace as many as possible within the constraints of the Budget. MOVED, that the Village Manager is authorized to extend the tree removal contract with Homer Tree Service, Inc. for an average cost per tree of $19.25; and also be authorized to continue the pruning maintenance contract with AAA Tree Service, Inc. with an average cost per tree of $3.75. An average size tree in Park Forest is 20 DBH (diameter at breast height) costing $385 to remove this tree or $75.00 to prune it. 2. MOVED, that the Village Manager is authorized to extend a contract for mowing Areas #1- #10 with Propst Lawn Maintenance. Weekly cost to be $1, with a $41, anticipated season cost; also authorized to re-contract for Areas #12 - #18 with Suburban Landscaping. Weekly cost to be $2,406.4 and an anticipated season cost of $36, Anticipated seasonal cost for all areas combined is $77,276.30, depending on the total number of weeks. 3. MOVED, that the Village Manager is authorized to approve the Renewal of a Residential Water Shut Off (B-Box) Replacement Annual Maintenance Contract with Calumet City Plumbing, Calumet City, IL in the amount of $99,815 with a contingency for any additional work as determined by the Village Engineer for a total cost not to exceed $125,000.
