1 ADJOURNED MEETING TUESDAY SEPTEMBER 05, 2001 The Board of County Commissioners of Wabasha County, Minnesota, convened in Adjourned Session at the Courthouse, in the City of Wabasha, Minnesota on Wednesday September 5, 2001 at 9:00 a.m. The regularly scheduled meeting of September 4, 2001 was rescheduled to this time and date because the meeting room was required for other purposes. 09/05/01 The meeting was called to order by Commissioner Poncelet. All Commissioners were present. HARMS - RIESTER APPROVED AGENDA BE IT RESOLVED, that the Wabasha County Board of Commissioners hereby approves the agenda as amended: Harold Kinlund request to speak at 11:00 a.m. during Environmental Services appointment Each Commissioner reported on meetings they attended during the preceding weeks. Family Collaborative Executive Board members Terry Smith, Roxanne Bartsh and Tom Boe, were present to introduce the newly hired Family Collaborative Director, Cindy Zluticky. Toni Smith, Extension Educator, gave the Extension Service monthly report. Corey Schmidt, County Engineer, and Tim Beck, Maintenance Foreman, were present to discuss the following issues: MCNALLAN RIESTER BE IT RESOLVED, that the Wabasha County Board of Commissioners hereby approves Utility Permit No. 737 to Sprint of Minnesota, Inc. for a direct buried telephone cable along CSAH 4, a copy of which shall be kept in the Engineer s Office. FAMILY COLLABORATIVE EXTENSION ENGINEER APPROVED UTILITY PERMIT 737 RIESTER - NORMAN BE IT RESOLVED, that the Wabasha County Board of Commissioners hereby accepts the bid of Roy Montgomery /Ferman Lanning of Plainview, Minnesota for the Real Estate for Sale, Plainview Maintenance Facility No. 1 in the amount of $150, for the land only as per Addendum Exhibit A. MCNALLAN HARMS WHEREAS, it is deemed necessary to obtain property for the construction of a new Plainview Maintenance Facility No. 1 to replace the existing facility located in the City of Plainview, and WHEREAS, the existing facility was built in 1954 and is in poor condition due to age and foundation settlement problems, and WHEREAS; the existing facility is located in the City of Plainview in an area that due to surrounding high traffic volumes, the County maintenance trucks conflict with the local traffic. ACCEPTED THE BID OF R MONTGOMERY FOR THE PLAINVIEW MAINTENANCE FACILITY NO 1 AGREED TO PURCHASE 5 ACRES FROM D DOANE FOR THE NEW PLAINVIEW MAINTENANCE FACILITY sep0501.bdm 1

2 NOW THEREFORE BE IT RESOLVED, that an agreement be entered into with David Doane to purchase 5-acres of land located on CSAH 27 near the intersection of TH 42 and CSAH 27 for an amount of $4,000 per acre for a total amount of $20,000. MCNALLAN NORMAN BE IT RESOLVED, that the Wabasha County Board of Commissioners hereby tables the Highway Department request to purchase a 1997 ¾ ton pickup until September 18, Mark Lowther, Mississippi Jewel Developer, was present to discuss realignment of County Road 5. MCNALLAN RIESTER BE IT RESOLVED, that the Wabasha County Board of Commissioners hereby tables the request for a resolution to realign County Road 5 until 10:00 a.m. September 18, Presentations and requests for 2002 budgets were heard from the following community organizations: SEMMCHRA $166,913 SELCO $152,478 Soil & Water Cons. $136,937 Initiative Fund $ 2,500 Historical Society $ 5,000 Three Rivers Transit $ 5,000 Fair Assoc. $ 20,000 Camp Winnebago $ 750 So MN Tourism $ 500 SEMN Area on Aging $ 2,800 Comm. Dev Corp. $ 200 Whitewater Watershed $ 3,928 TABLED THE HIGHWAY DEPT TO PURCHASE A 1997 ¾ TON PICKUP MISSISSIPPI JEWEL TABLED THE REQUEST FOR A RESOLUTION TO REALIGN COUNTY ROAD BUDGET REQUESTS FOR COMMUNITY ORGANIZATIONS The requests were taken under advisement and no action was taken. The meeting was recessed for lunch at 12:30 p.m. The meeting reconvened at 1:30 p.m. Julie Runkel, Environmental Services Director, reported the status of the Pepin Bluffs Preserve Subdivision Plat. RIESTER HARMS WHEREAS, at a regular meeting of the Board of Commissioner s held on July 3, 2001 the Pepin Bluffs Preserve Plat was approved contingent upon the herein described requirements: ENV SERVICES RESCINDED APPROVAL OF THE PEPIN BLUFFS PRESERVE PLAT The applicant must submit the following described documents to the Wabasha County Zoning Officer within 60 days of the date of adoption of this resolution (adopted July 3, 2001): A soil erosion/sedimentation control plan, which shall be reviewed and approved by the Wabasha County SWCD prior to Final Plat. The soil erosion sedimentation control plan shall include: A. No grading or filling outside the building footprint. B. Fill or excavated material must not be placed in a manner that creates an unstable slope. C. Fill or excavated material must not be placed in the bluff impact zone. D. All roads and parking areas are designed and constructed to minimize and control erosion. E. Disturbed areas must be planned and constructed in a manner that will minimize the extent of disturbed areas, runoff velocities, erosion potential, and reduce and delay runoff volumes. Disturbed areas must be stabilized and protected as soon as possible and facilities or methods used to retain sediment on site. sep0501.bdm 2

3 A certificate of compliance prepared by a Minnesota licensed installer shall be submitted for Lot 4 ISTS to Wabasha County Environmental Services. The existing water supply in Lot 4 be tested and conform to the Minnesota Department of Health and Wabasha County Water Quality Ordinance standards. County Engineer approved platted roadway drawings and all written specifications and requirements, and WHEREAS, the described 60 day period expired on September 1, 2001, and WHEREAS, it has been determined that the existing water supply in Lot 4 has been tested and does not conform to the Minnesota Department of Health and Wabasha County Water Quality Ordinance standards. NOW THEREFORE, BE IT RESOLVED, that the Wabasha County Board of Commissioners hereby rescinds approval of the Pepin Bluffs Preserve Plat. Russell Meyer, Theilman resident, described safety issues concerning County Road 4 at the Theilman intersection and requested improved signage. The Board directed the County Engineer to study the described safety concerns, install necessary signage and propose corrective actions to improve safety at the intersection. Julie Runkel, Environmental Services Director, requested the following actions: RIESTER MCNALLAN BE IT RESOLVED, that the Wabasha County Board of Commissioners hereby approves participation in 319 Clean Water Partnership Grant for Feedlots, and BE IT RESOLVED, that the Wabasha County Board of Commissioners hereby approves use of the 319 Clean Water Partnership Grant for Feedlots to pay expenses of the feedlot inventory program including salaries of Rodger Meyer, Feedlot Officer, retro active to his date of hire, June 11, R MEYER ENV SERVICES APPROVED PARTICIPATION IN 319 CLEAN WATER PARTNERSHIP GRANT FOR FEEDLOTS MCNALLAN NORMAN BE IT RESOLVED, that the Wabasha County Board of Commissioners hereby accepts the resignation of Joe Guenther, Planning and Zoning Officer, effective September 14, 2001, and BE IT RESOLVED, that the Wabasha County Board of Commissioners hereby approves internal posting and advertising to fill the position of Planning and Zoning Officer. Julie Runkel explained that the department could experience considerable staff overtime hours during the vacancy of the Planning and Zoning Officer position. By consensus of the Board, she was directed to present estimates of overtime and potential costs at the September 18, 2001 meeting. Julie Runkel and Bill Pfeilsticker requested purchase of a 1990 Ford pickup from the Highway Dept for $6,000 and a used snow plow from Ferguson Truck Center for $1,800 (installed). Courthouse maintenance staff and Environmental Services would use the vehicle. $10,000 was allocated for this purpose in the 2001 budget. By consensus of the Board, the request was tabled. ACCEPTED THE RESIGNATION OF J GUENTHER AS PLANNING AND ZONING OFFICER AND APPROVED POSTING AND ADVERTISING THE POSITION J RUNKEL J RUNKEL AND W PFEILSTICKER sep0501.bdm 3

4 Al Holtan and Brenda Wodele, Co-Emergency Management Directors, requested the following action: RIESTER NORMAN BE IT RESOLVED, that the Wabasha County-wide Emergency Operations Plan comes before the Wabasha County Board of Commissioners for its four year County Board review. BE IT FURTHER RESOLVED, that the Wabasha County Board of Commissioners hereby approves the Wabasha County-wide Emergency Operations Plan with its revisions and updates. EMERGENCY MANAGEMENT APPROVED THE WABASHA COUNTY-WIDE EMERGENCY OPERATIONS PLAN Rod Adams, County Sheriff, and representatives from the City of Elgin proposed that the County and the City of Elgin enter into a police protection services contract. By consensus of the Board, Sheriff Adams was directed to prepare a contract for consideration at the meeting scheduled for September 18, MCNALLAN HARMS BE IT RESOLVED, that the Wabasha County Board of Commissioners hereby approves the Minnesota Public Facilities Authority Wastewater Infrastructure Project Grant Agreement for the Reads Landing sewer project and authorizes the Chairman of the Board and the County Administrator to sign said agreement. By consensus, the Board of Commissioners authorized the County Administrator to apply for a credit card in the name of Wabasha County to be used for travel expenses only.
