The following Commissioners were present: Harms, McNallan, Norman, Riester and Windhorst. 3 Sheriff Bartsh and Chief Deputy Dather shared information with the Commissioners on the efforts of Dispatcher Charles Gearhart to save the life of an infant. Gearhart received a 911 call and helped a mother whose infant was not breathing. The Sheriff presented a certificate of appreciation to Gearhart and the Board commended him on his efforts. GEARHART COMMENDATION Roxanne Bartsh, Court Services Director provided an update to the Commissioners on departmental activity. Her presentation covered topics in the following primary areas: Out-of-Home Placements, Drug Court Planning Initiative, Training Updates, Legislative Updates, and Budget Updates. Following the update, Judith Schotzko and Katherine Swanson shared information on their grant programs that work with youth. HARMS NORMAN BE IT RESOLVED, that the Wabasha County Board of Commissioners hereby designates November as Restorative Justice Month in Wabasha County. COURT SERVICES UPDATE RESTORATIVE JUSTICE MONTH PROCLAMATION RIESTER HARMS BE IT RESOLVED, That the Wabasha County Board of Commissioners hereby amends the resolution passed on January 21, 2003 which approved the proposal of Alliant Engineering, Inc. for professional engineering services for the design of S.A.P in the amount of $59, and directed the County Auditor/Treasurer to issue a warrant from the County General Fund. BE IT FURTHER RESOLVED, That the Wabasha County Board of Commissioners hereby approves the proposal of Alliant Engineering, Inc. for professional engineering services for the design of S.A.P in the amount of $59, and authorizes to advance said amount from the County General Fund to the Road and Bridge Fund. Said amount is to be paid back to the County General Fund after the project has been let and the Wabasha County Highway Department has received money from the Regular State Aid Construction Account for these engineering costs. PAYMENT TO ALLIANT ENGINEERING TRANSFER FUNDS TO ROAD AND BRIDGE, FROM GENERAL REVENUE WINDHORST NORMAN BE IT RESOLVED, That the Wabasha County Board of Commissioners hereby authorizes the Auditor/Treasurer s Office to issue a warrant for final payment to Roberson Lime and Rock, Inc. in the amount of $1, for the completion of Project SAP , Minor Grading, Aggregate Surfacing and Culvert Replacement on Glasgow Township Road T-70 in Wabasha County. PAYMENT TO ROBERSON LIME AND ROCK NORMAN WINDHORST BE IT RESOLVED, That the Wabasha County Board of Commissioners hereby authorizes the Auditor/Treasurer s Office to issue a warrant for final payment to Minnowa Construction, Inc. in the amount of $16, for the completion of Projects SAP , SAP , SAP , SAP and SAP ; bridge replacements on Oakwood Township Road T-131 and CSAH No. 11 in Wabasha County. 4 REISTER HARMS BE IT RESOLVED, That the Wabasha County Board of Commissioners hereby authorizes Tom Mosher, Solid Waste/Recycling Coordinator, to attend the Recycling Association of Minnesota Conference at the Double Tree Park Place Hotel in St. Louis Park, Minnesota, November 4 5, MOSHER TO ATTEND CONFERENCE Discussed the distribution of Municipal Funds to Cities in Wabasha County. These funds are used primarily for plowing/hauling snow and minor maintenance work on designated Municipal County State Aid Highways. The County has decided to pass along the 23.5% decrease in funds to the Cities. REDUCTION IN MUNICIPAL FUND PAYMENTS TO CITIES Tom Mosher, Solid Waste and Recycling Coordinator, was present to discuss fee collection for the hauling of waste from Wabasha County homes and businesses. As SCORE funding is being reduced, there are a couple options to provide a funding source and maintain recycling and solid waste programs. One option is for the County to assess the expense through property tax statements, the second option is to have waste haulers assess a fee that would be reimbursed to the County. COMMITTEE TO REVIEW WASTE MANAGEMENT FEE OPTIONS The issue has been referred to a committee that will report back to the full Board in February 2004 with their recommendation. The committee members are: Commissioners Riester & Harms, Tom Mosher, and Loren Benz. NORMAN HARMS WHEREAS, the County Attorney is involved in a mediation of an ADA complaint, that he has requested a statement from the Commissioners showing strong support to make the Courthouse accessible, that the Commissioners believe the County is already in the process to construct an elevator following the completion of the County Services Building 2 nd Floor, and that the Commissioners are moving forward to make the Courthouse accessible, CONSTRUCTION OF ELEVATOR A HIGH PRIORITY BE IT RESOLVED, the Wabasha County Board of Commissioners acknowledges the next new building construction project with the highest priority for the County is the construction of an elevator. That the efforts to begin a review of elevator construction plans and financing will commence upon the completion (occupation) of the County Services Building 2 nd Floor. Voting For: Harms, Norman, Riester & Windhorst Voting Against: McNallan WINDHORST RIESTER BE IT RESOLVED, that the Wabasha County Board of Commissioners hereby appoints Commissioners Harms and McNallan, County Attorney James Nordstrom, Mike Klennert (citizen), three county employees (K. Blood, S. Huebner & P. Tullio) to develop written policies and procedures for Wabasha County Personnel to address the needs of individuals with disabilities who use the Wabasha County Courthouse complex. The first meeting of the committee shall be on or before November 14, COMMITTEE APPOINTMENT TO DEVELOP ACCESS POLICIES BE IT FURTHER RESOLVED, that when said policies and procedures are officially adopted by the Wabasha County Board of Commissioners, the enforcement of said policies shall be the responsibility of the Wabasha County Administrator. oct2103.bdm.doc 4
5 HARMS WINDHORST BE IT RESOLVED That the Wabasha County Board of Commissioners hereby directs the Auditor/Treasurer s Office to create an account designated for the Wabasha County Sheriff s Department Safe Driving Class in which there will be a $75.00 fee per participant. This account will be used for training or equipment for the Department. SAFE DRIVING CLASS ACCOUNT DESIGNATION HARMS RIESTER BE IT RESOLVED that the Wabasha County Board of Commissioner s hereby authorizes Jason Bade to use the credit card in the name of Wabasha County for travel expenses incurred while training with the K-9 dog. Mr. Bade is only an authorized signature on the credit card for the dates of November 1, 2003 thru November 17, On November 18, 2003 the credit card and all receipts must be turned into the Wabasha County Administration. ONE-TIME USE OF CREDIT CARD BY DEPUTY BADE HARMS WINDHORST BE IT RESOLVED, that the Wabasha County Board of Commissioners rescinds a previous Motion (10/07/03) authorizing the purchase of a squad car for the Sheriff s Department. RESCIND MOTION TO PURCHASE VEHICLE HARMS RIESTER WHEREAS, The County Sheriff and staff have advised the need to replace existing squad cars in the Department, that the cost to purchase acceptable vehicles will increase in 2004, that the Department is able to purchase 2004 Dodge Intrepid at a cost of $16,000 per vehicle, that delivery of these vehicles would occur in December, that payment will be due in January 2004, and that staff recommend approval of this purchase; APPROVE PURCHASE OF 3 VEHICLES FOR SHERIFF S DEPT. BE IT RESOLVED, that the Wabasha County Board of Commissioners authorize the purchase of 3 squad cars at a cost of $16,000 per vehicle, and that the Auditor/Treasurer s Office be directed to issue an Auditor s Warrant for the purchase of these vehicle in such timeliness that payment is made on or before January 8, Discussed the potential to change the meeting time for the Regional Rail Authority meetings. Currently these meetings begin at 1:00 PM on the first Board meeting day of each month. A decision was made to change the starting time of this meeting. Effective January 2004, the Regional Rail Authority meeting will begin at 9:15 AM at the first County Board meeting of each month. REGIONAL RAIL MEETING TIME CHANGE oct2103.bdm.doc 5

8 HARMS RIESTER WHEREAS, Finance Director Patrick Moga has reviewed the fixed asset policies for Wabasha County, that changes are required to be compliant with GASB 34 requirements, that definitions for roads, bridges and right of way have been created, and that the changes to County fixed asset policy have been recommended by Patrick Moga, BE IT RESOLVED, that the Wabasha County Board of Commissioners hereby approves the changes to the fixed asset policy as presented. (A copy of the policy is available from the Finance Director) FIXED ASSET UPDATE ROAD DEFINITIONS CLOSED SESSION FOR UNION NEGOTIATIONS DISCUSSION HARMS- NORMAN BE IT RESOLVED, that the Wabasha County Board of Commissioners hereby closes the regular session of the meeting to discuss labor negotiations. WINDHORST HARMS BE IT RESOLVED, that the County Board of Commissioners close the closed session and resume the regular session of this Board meeting. RE-OPENED MEETING The purpose of the closed session was to discuss labor negotiations with the Highway Department. The first negotiation session has been set for October 23 rd at 10:30 AM in the Commissioner s Room. Further discussion on action taken previously to resume a feedlot officer position. Specific questions to be resolved: FEEDLOT OFFICER DISCUSSION Are there any restrictions on who can be hired for this position, given the position was discontinued earlier during 2003? Is there a listing from MPCA on how the funds can by used? If so, the listing should be made available to the Commissioners. Are there any legal issues involving Equal Opportunity Employment if the feedlot officer position was filled by an Extension Services employee? HARMS - WINDHORST BE IT RESOLVED that the Wabasha County Board of Commissioners accepts, with regrets, the resignation of Rich Swanson, GIS Coordinator, effective at the end of the working day of December 1, RESIGNATION OF RICH SWANSON oct2103.bdm.doc 8
9 RIESTER HARMS BE IT RESOLVED, that the Wabasha County Board of Commissioners accepts the recommendation to contract services for parcel mapping and Metadata. Cost of said contract services is to not exceed $4,430. HARMS WINDHORST Being no further business to come before the Board at this time, motion was made and duly carried to adjourn until 11:00 a.m. October 28, 2003 in the Wabasha County Courthouse. This will be a special meeting of the Board.
