1 Shell Rock River Watershed District Regular Meeting Minutes September 12, 2017 Managers present: Dan DeBoer, Gary Pestorious, Brad Kramer, Al Bakken, Joe Pacovsky, and Mick Delger Managers absent: Mike Hanson Chairman DeBoer called the Regular Meeting to order September 12, 2017 at 8:30 a.m. at the Freeborn County Board Room, 411 Broadway S., Albert Lea, MN Manager Bakken offered the following motion: Move to approve the agenda with changes: extract item 7a and add item 8d. Manager Pacovsky offered the following motion: Move to approve the July 28, 2017 Advisory Committee meeting minutes. Manager Kramer offered the following motion: Move to approve the August 8, 2017 regular board meeting minutes. Manager Delger seconded the motion. Manager Bakken offered the following motion: Move to approve the August 2017 Treasurer s Report, subject to audit. Manager Pestorious seconded the motion. Manager Bakken offered the following motion: Move to approve the August 2017 Project Fund Treasurer s Report, subject to audit. Laura Cunningham, Lakes Foundation Committee, gave an update: 1

2 The Albert Lea Floats event was a huge success and 480 people used the equipment on Albert Lea Lake. The next meeting has been scheduled for September 20, 2017 at 4 p.m. at the Albert Lea Convention and Visitors Bureau. Brett Behnke, District Administrator, invited the board of managers and SRRWD staff to attend the Board of Water and Soil Resources (BWSR) Academy and the Minnesota Association of Watershed District (MAWD) Annual Meeting. Andy Henschel, Director of Field Operations, gave an update on the Best Value Bidding Committee. Under the direction of Briggs & Morgan, the attorneys for the SRRWD were taken off the committee, Andy Henschel and Brett Behnke were added and Al Bakken and Dan DeBoer were named board manager alternates. Manager Delger offered the following motion: Move to approve Final Best Value Bidding Evaluation Committee: Andy Henschel, Brett Behnke, Gary Pestorious, Mick Delger, Mike Hanson, Todd Lewis, and Andrew Millspaugh. Al Bakken and Dan DeBoer will be board manager alternates. Manager Pacovsky seconded the motion. Andy continued his update by discussing transporting the dredge to new leased premise. The cost transportation cost for moving the dredge and pumps is less than $10,000 so it does not require competitive bidding. The offered price by Pro Trucking is as low as or lower than the price at which the commodity or service could be obtained elsewhere. Manager Delger offered the following resolution: Move to approve Resolution as follows: Resolution Shell Rock River Watershed District Conflict of Interest - DeBoer Transporting District Dredge WHEREAS, The Shell Rock River Watershed District ( SRRWD ) owns a dredge, three pumps, and pipe, WHEREAS, the dredge and pumps are presently located at th Ave, Albert Lea, Minnesota 56007; WHERAS, the dredge and pumps needed to be relocated to the new lease premises at th Street, Albert Lea, Minnesota 56007; WHEREAS, Dan DeBoer is the owner and president of Pro Trucking; 2

3 WHEREAS, Dan DeBoer is also a Board Manager for the Shell Rock River Watershed District Board and the current Board Chair; WHEREAS, the District was in immediate need of transporting capabilities and equipment to move the dredge and pumps from the present leased premises to the new leased premises; WHEREAS, the transportation costs for moving the dredge and pumps, at a cost of less than $10,000, does not require competitive bidding and may be made in the discretion of the governing body on either a quote or the open market; WHEREAS, the District received a quotation from T.J. Potter Trucking Inc. for $8, to move the dredge and pumps; WHERAS, the District received a quotation from Pro Trucking for $5, to move the dredge and pumps; WHEREAS, the offered price by Pro Trucking is as low as or lower than the price at which the commodity or service could be obtained elsewhere; WHEREAS, Manager DeBoer has filed an affidavit stating: a. His name and the office held; b. An itemization of the commodity or services provided; c. The quoted price for the work; d. The reasonable value; e. His interest in the contract; and f. That to the best of his knowledge and belief the contract price is as low as, or lower than, the price at which the commodity or services could be obtained from other sources. WHEREAS, having Pro Trucking transport the dredge and pumps from the present leased premises to the new leased premises is in the District s best interests. NOW THEREFORE, in furtherance of the Shell Rock River Watershed District Watershed Management Plan and disclosure of potential conflicts of interest, be it hereby Resolved by unanimous vote, Manager DeBoer abstained from voting and recused himself from discussion of this issue, as follows: Section 1:. The District hereby authorizes payment of the claim for the service of Pro Trucking to the benefit of the District in transporting the dredge and pumps from the current leased premises to the new leased premises in the amount of $5, Manager Kramer seconded the resolution: After discussion, a roll call vote was taken: 3

Andy continued by discussing the new leased premises for the dredge at Albert Lea Diesel and Chrome LLC. Manager Pestorious offered the following motion: Move to approve lease agreement for dredge storage. Manager Pacovsky seconded the motion. After discussion, a vote was taken and the motion was unanimously approved Andy discussed the temporary easement with the City of Albert Lea to gain access to the Goose Lake Fish Barrier for the work that will be done this fall to correct the function of the barrier. WSB and Smith-Root will perform the work and cover the cost. Manager Pestorious offered the following motion: Move to approve Goose Lake Fish Barrier Easement. Andy gave an update on the Fountain Lake Restoration. The SRRWD has received 11 out 12 permits needed from the Department of Natural Resources (DNR). The final permit, the waters permit, was issued but in limit draft form. The SRRWD and the DNR will continue to work through the issues regarding that permit. The SRRWD cannot issue a bid for dredging until the permit issues have been finalized. Andy gave an update on the Confined Disposal Facility (CDF). The berms and weir structure are complete. Final grading and seeding still need to be done. If any managers would like a tour of the site, please contact Andy. Courtney Christensen, Resource Technician, updated the board about funding the SRRWD received from Freeborn County to continue Aquatic Invasive Species (AIS) efforts. These efforts include tagging carp with Passive Integrated Transponders (PIT) and radio transmitters to test the efficiency of the fish barriers and electro fishing surveys to determine the biomass.
