2 Black Dog Watershed Management Commission I. Approval of Agenda Agenda enclosed. Agenda Background September 20, 2017 Action Requested: A motion be considered to approve the Agenda. II. Approval of Minutes from the July 19, 2017 Meeting Minutes enclosed. Action Requested: A motion be considered to approve the Minutes of the July 19, 2017 meeting. III. Approval of Accounts Payable Accounts payable list enclosed. Action Requested: A motion be considered to approve the accounts payable list as submitted by staff. IV. Review of Budget Performance Reports Current Budget Performance Reports enclosed. Action Requested: No formal action required. V. Approve City of Burnsville Water Resources Management Plan At the July meeting Barr Engineering provided a memo and comments on the initial review of the Burnsville Water Resources Management Plan. That memo was sent to the City of Burnsville and after making some changes to the plan based on the comments from the Black Dog WMO they resubmitted it for review and approval. Barr Engineering has reviewed the updated plan and included another memo in this packet with their recommendation. Barr staff will go over the memo at the meeting. Action Requested: Approve the Burnsville Water Resources Management Plan as reviewed by Barr Engineering. VI. Presentation on Starry Stonewort Dr. Muthukrishnan with the University of Minnesota will provide a presentation on the invasive species Starry Stonewort. Action requested: No formal action required. Approval of Minutes from the May 17, 2017 Meeting Motion by Helms, second by Hughes, to approve the May 17, 2017 Minutes as presented. Approval of Accounts Payable Motion by Enestvedt, second by Helms, to approve payments to Barr Engineering in the amount of $9, for services from April 29, 2017 through June 30, 2017; and, to Campbell Knutson in the amount of $ for May 2017 General Consulting Services.

Review Budget Performance Reports Daryl Jacobson, BDWMO Administrator, reported that the 2017 invoices have been issued and sent out. Updates are need to the 2017 Cash Activity Report correcting the vendor name for check #1637 to Barr Engineering; and, correcting the vendor name for check #1638 to Campbell Knutson. No Formal Action Required V. Approve Black Dog WMO Response Letter to PRAP Report A copy of the draft PRAP response letter was provided to the Commission for review prior to the meeting. Daryl Jacobson and Karen Chandler reviewed the recommended actions and Commissions responses. Motion by Helms, second by Thureen, to approve the response letter as presented, and to send it to the Board of Soil and Water Resources. Ayes Baldwin, Enestvedt, Helms, Hughes, Thureen Nays None Motion Carried Unanimously VI. Review City of Burnsville Water Resources Management Plan Update On May 26, 2017 the City of Burnsville submitted their Water Resources Management Plan for agency review. Barr Engineering reviewed the plan for consistency with the Black Dog WMO Plan. A copy of the memo from Barr Engineering outlining the comments and requested commission actions was provided to the Commission for review prior to the meeting. Motion by Thureen, second by Hughes, to approve the memo and comments be sent to the City of Burnsville, and its consultants, along with a cover letter as described in the memo. Ayes Baldwin, Enestvedt, Helms, Hughes, Thureen Nays None Motion Carried Unanimously VII. Miscellaneous 1. Karen Chandler, Barr Engineering, requested the Commission express their interest in educational opportunities. The Commission s suggestions include a presentation on Starry Stonewart education, detection and treatment; and, an update on the Keller Lake Improvement project; and, a tutorial on processing grant applications. 2. Curt Courdron updated the Commission that there were 18 project applications, of which six projects are completed and 12 projects are underway. 3. The next BDWMO Commission meeting is scheduled for Wednesday, August 16, 2017.

24 Memorandum To: Black Dog Watershed Management Organization Commissioners From: Karen Chandler and Greg Williams Subject: Black Dog WMO Review of the revised City of Burnsville Water Resources Management Plan Date: September 11, 2017 Project: The City of Burnsville revised their Water Resources Management Plan (2017 WRMP) to meet the requirements of the NPDES MS4 permit program, Minnesota Statutes 103B, Minnesota Rules 8410, and the Black Dog Watershed Management Organization Watershed Management Plan (BDWMO Plan). In July 2017, Barr reviewed the agency review draft of the 2017 WRMP for consistency with the BDWMO Plan and provided comments that were transmitted to the City via a letter and attachments dated July 25, Comments provided by Barr and Metropolitan Council requiring revisions to the 2017 WRMP were limited to the City s implementation program (Table 33 in the 2017 WRMP). Other comments included recommended, minor revisions. The City provided a revised draft of the 2017 WRMP in September At the request of the BDWMO, Barr has reviewed the revised 2017 WRMP and determined that the City has sufficiently addressed all comments provided in the July 25, 2017 letter. The revised 2017 WRMP is consistent with Minnesota Rules 8410 and the BDWMO Plan, and meets the requirements placed on Cities in that plan. Comments and required revisions provided by the Metropolitan Council and BDWMO are listed below, followed by a brief summary (in italicized text) of how the comment is addressed in the revised 2017 WRMP. Requested Commission Action: 1. Review summary of revisions to comments. 2. Direct Barr to prepare cover letter and send this memorandum to the City of Burnsville and its consultants, indicating the BDWMO approval of the City s 2017 Water Resources Management Plan. Metropolitan Council Comments and Required Revisions 1. The Capital Improvement Program needs to include information for the years Table 33 was revised to included implementation program items assigned to years 2023 through 2027, covering the full 10-year lifespan of the WRMP.

The Plan needs to include funding sources for the capital improvement program projects. Revised text in Section 7.0 notes that the City s stormwater utility is the primary funding source for all items in the City s implementation program. BDWMO Comments and Required Revisions 1. Update the WRMP implementation table (Table 33) to include implementation actions extending through the entire time period. Alternatively, the City could add text to the WRMP introduction and implementation sections noting that the implementation table (Table 33) is intended to cover a 5 year period and will be updated at least every 5 years as part of a scheduled plan amendment subject to WMO review. Table 33 was revised to included implementation program items assigned to years 2023 through 2027, covering the full 10-year lifespan of the WRMP. 2. The WRMP implementation table (Table 33) should contain proposed funding sources for each project. Additional, optional information could be included in the table, such as cooperating partners and the source of the project (e.g., TMDL study). Revised text in Section 7.0 notes that the City s stormwater utility is the primary funding source for all items in the City s implementation program. BDWMO Suggested Minor Revisions (additional detail provided in attached table) 3. Consider identifying the BDWMO strategic waterbodies in a table, bulleted list, or in the narrative description of each waterbody in section The narrative description of each waterbody in section identifies whether the waterbody is a BDWMO strategic waterbody. 4. Consider adding text to Appendix C referencing low impact development in relation to the City code and performance standards. Additional text to this effect has been added to Appendix C. 5. The BDWMO recommends strengthening of Policy 10.3 to state that the City will update the BDWMO regarding management actions and projects performed on BDWMO strategic waterbodies or MDNR public waters within the BDWMO. Policy 10.3 has been revised to say shall instead of may. 6. Consider adding text or a policy noting the BDWMO s authority to review City regulatory documents that affect resources under BDWMO jurisdiction. Text to this effect is included in Section Consider adding a policy or additional text to Appendix C Development Standards noting that the City may restrict stormwater discharge rates when the capacity of the downstream system is limited. The BDWMO recommends the City consider noting/emphasizing the cooperative relationship between the City of Burnsville and other cities in managing their intercommunity waterbodies (e.g., Keller Lake, Lac Lavon). Cooperative efforts on TMDL implementation are now noted in section The BDWMO recommends the City consider revising policy 1.10 to address cooperative City- WMO water quality improvement projects more generally, possibly including TMDL load reduction projects as an example.
