HC HALTON COMMUNITY HOUSING CORPORATION Date f issue: Dcument number: Revisin: 2 PAGE 1 OF 6 Apprval: Title: MANAGER, HOUSING OPERATIONS 1.0 Purpse The purpse f the Plicy is t prvide specificatins and guidelines regarding internal transfers within the husing prtfli directly managed by the Haltn Cmmunity Husing Crpratin (HCHC). The specificatins and guidelines perate as plicy standards that enable staff respnsible fr tenant placement t implement apprved and required internal transfers as part f the standard resident selectin prcedure. This pertains t three categries, utlined in this plicy. The plicy als identifies prcedures fr internal transfer requests that are nt within ne f these three categries. 2.0 Prescribed requirements and categries O. Reg. 339/01, s. 11 prescribes that every husing prvider under the Scial Husing Refrm Act shall establish plicies and prcedures fr internal transfers. These plicies and prcedures must include the fllwing: 2.1 Internal transfer requests related t claims f dmestic abuse A requests frm a tenant t be added t the internal transfer list as a Victim f Dmestic Abuse must be frwarded t the lcal Access Centre (HATCH) fr review. When deemed eligible t be included in this categry (referred t as Special Pririty Plicy categry r SPP categry), HCHC must rank these eligible residents n the internal transfer list abve all ther nn-spp applicants n that list. 2.2 Overhused resident husehlds If it is assessed that a resident husehld in receipt f rent-geared-t-incme (RGI) assistance ccupies a unit that is larger than the unit size they are eligible fr (as per lcal ccupancy standards see Table under sectin 6 f this plicy), the resident husehld is verhused and must receive ntice t that effect frm HCHC. The ntice must include a statement that the husehld must mve t a unit f the apprpriate size in rder t cntinue t be eligible fr RGI assistance. If the HCHC husing prtfli includes units that are f the apprpriate size, the ntice must indicate that the resident husehld will have t be added t the internal transfer list with at least ne building chice with units f the apprpriate size. The husehld will be ranked after

If the resident husehld has nt been transferred t a unit f the apprpriate size within ne year, the file will be frwarded t HATCH (thrugh a dedicated HATCH frm) with the intent t have the husehld added t the HATCH waiting list. HATCH will cmmunicate the ensuing steps with the resident husehld and HCHC staff. Failure t cperate with this prcess will lead t cessatin f RGI assistance. The ranking date n the HATCH waiting list is the date the resident husehld riginally applied fr RGI assisted husing in Haltn Regin. The husehld may cntinue t remain active n the list after the ne year perid has elapsed. If upn determinatin f the verhused status the applicant des nt want t transfer t any f the HCHC buildings with ne r mre units f the apprpriate size, the resident must be advised that the file will be frwarded t HATCH (thrugh a dedicated HATCH frm) with the intent t have the husehld added t the HATCH waiting list. HATCH will cmmunicate the ensuing steps with the resident husehld and HCHC staff. Failure t cperate with this prcess will lead t cessatin f RGI assistance. The ranking date n the HATCH waiting list is the date the resident husehld riginally applied fr RGI assisted husing in Haltn Regin. If the HCHC prtfli des nt include units f the apprpriate size, the ntice must indicate that the file will be frwarded t HATCH (thrugh a dedicated HATCH frm) with the intent t have the husehld added t the HATCH waiting list. HATCH will cmmunicate the ensuing steps with the resident husehld and HCHC staff. Failure t cperate with this prcess will lead t cessatin f RGI assistance. A husehld that has been determined t be verhused ceases t be eligible fr RGI assistance if they refuse three ffers f an apprpriate unit r request their husehld be remved frm the List and/r the centralized waiting list. An verhused husehld will nt be required t relcate if they cnfirm in writing their intent t remain in their existing unit, paying the market rent established fr that unit. 3.0 Other categries HCHC has the discretin t create ne r mre categries within its internal transfer plicy. Fr the purpse f this plicy the fllwing additinal categries are defined: 3.1 Underhused residents The HCHC prperty management guidelines regarding bedrm ccupancy are as fllws: It wuld be mst apprpriate that n bedrm is ccupied by mre than tw husehld members Printed cpies nt cntrlled

3 Date f issue: Dcument number: Revisin: 2 PAGE 3 OF 6 HCHC will deem a husehld underhused if a bedrm is ccupied by tw husehld members f the ppsite sex (nt being the spuses f the husehld) whereby the ldest bedrm ccupant has reached the age f 12 years and the age difference between the tw bedrm ccupants is 5 years r mre. A husehld is nt verhused if a bedrm is ccupied by tw husehld members regardless f gender if bth bedrm ccupants are yunger than 12 years f age. Subject t apprval by the prperty manager wh is respnsible fr the building in questin, a resident husehld may submit a request in writing t be added t the internal transfer list as an underhused resident husehld. Underhused resident husehlds are ranked n the list after SPP and verhused husehlds. 3.2 Internal transfer requests fr ther reasns Fr the purpse f this plicy, the HCHC prperty management guideline is t limit internal transfers fr ther reasns as much as pssible, but still prvide resident husehlds with an pprtunity t submit such a request in writing. Request in this ther categry are subjected t the apprval f a dedicated cmmittee that cnsists f the fllwing members: Manager, Tenant and Cmmunity Relatins Scial Husing Senir Plicy Analyst Cmmunity Relatins Wrker (2) Intermediate Financial Analyst, Haltn Regin The cmmittee is mandated t review the request when at least three members are present. The cmmittee will cnvene nce a mnth if there is internal transfer requests that need t be reviewed. Requests fr a transfer in this categry must be submitted in writing t the Manager f Tenant and Cmmunity Relatins. 4.0 Cnditins 4.1 Cnditins regarding SPP applicants In rder fr an SPP request t be apprved by HATCH, requirements must be met as utlined in Ontari Regulatins 298/01. In additin, if the SPP applicant is in arrears (including rental arrears, verpaid subsidies r mneys wing due t damages) the cnditin is that the applicant may be respnsible fr 50% f these arrears and that the crrespnding amunt must be paid in full r must be captured in a repayment agreement with HCHC. 4 Date f issue: Dcument number: Revisin: 2 PAGE 4 OF 6 HATCH will assess with HCHC what the mst apprpriate curse f actin is, given the specifics f the situatin. 4.2 Cnditins regarding Overhused resident husehlds If an verhused husehld is in arrears, they still have t mve t a unit f the apprpriate size. This is prescribed in O. Reg. 298/01 and O. Reg. 339/01. Arrears include rental arrears, verpaid subsidies and mnies wing due t damages and must be addressed befre the husehld transfers t a unit f the apprpriate size. In rder t address the arrears t the satisfactin f HCHC, the resident husehld must pay the arrears in full r enter int a repayment agreement. Failure t meet these requirements culd lead t an evictin thrugh a Landlrd and Tenant Bard Order (in the case f true rental arrears and damages) r cessatin f RGI assistance (in the case verpaid subsidies). The implicatin f the latter is that the husehld becmes a market rent husehld (with 90- day ntice) and will n lnger be verhused, as this status nly applies t RGI assisted husehlds. The husehld will therefre be remved frm the internal transfer list. These varius implicatins can be explained in the ntice described in sectin 2.2. A repayment agreement will cntinue t be enfrced, regardless f the transfer. If it is anticipated that the LTB prcess will lead t an evictin within a shrt perid f time, it wuld be prudent t wait with the transfer until the utcme is clear. 4.3 Cnditins regarding Underhused resident husehlds With regard t bedrm ccupancies f mre than tw husehld members (nt being the spuses f the husehld) the prperty manager may decide t nt deem a husehld underhused if the unit specificatins are such that the ccupancy is nt urgently unacceptable, despite the guideline that a bedrm is preferably ccupied by nly tw husehld members Underhused applicants can nly refuse an ffer f transfer nce. The fllwing cnditins apply t underhused transfer requests: The husehld has lived in the current unit fr at least ne year A $ administratin fee applies The husehld has nt been given an evictin ntice within the last six mnths The husehld des nt we arrears r any ther mney t Haltn Cmmunity Husing The husehld has paid its rent n time fr the last six mnths If there is a repayment agreement in place fr frmer tenant arrears with any husing prvider, the repayment must be in gd standing Printed cpies nt cntrlled

Husehlds wh wish t mve int the units directly managed by Haltn Cmmunity Husing Crpratin frm anther Scial Husing Prvider are deemed t be external applicants, including Rent Supplement, and must apply thrugh Haltn Access t Cmmunity Husing (Centralized waiting list HATCH).
