Technical Bid as per the requirement given in the Annexure-II will have to be submitted in separate envelope superscribing as the envelope as Technical Bid. Similarly in Annexure-III may be filled up, which is called Financial Bid to be submitted in separate sealed cover superscribing as financial bid. The envelope for Technical & financial Bid should be kept in a large envelope which should reach at this office within the due date mentioned in the tender paper. Tender paper may be had from the office on every working day during office hours i.e A.M. to P.M. & P.M. to P.M. at a cost of (Non-refundable) and (Non-refundable) by post in shape of Demand draft drawn on any Nationalized Bank in favour of ICAR-UNIT-IIWM, payble at Bhubaneswar from to up to P.M. (The sanitary items like brooms, brushes, Buckets, Acid, Phynile, Harpic naphthalene balls and moping materials are to be supplied by the agencies. The rate quoted for the item should be inclusive of material cost. 03 CONSTRUCTION i) Attending the electrical repair works at various locations in the ICAR- IIWM main campus, Office building, Street lights, Guest House and Residential quarter at Sailashree Vihar. ii)attending the plumbing work of ICAR- IIWM main campus, office building, Guest House and Residential quarter at Sailalshree Vihar N.B: Monthly basis on all working days Monthly basis on all working days i) Before quoting the rate, the site may be inspected in consultation with the Estate Officer in charge of this Institute to know the quantum of the work to be undertaken on Job Contract Basis, if required. ii) After physical inspection of the site, very detailed assessment/requirements of personnel for providing the above service at ICAR-IIWM Campus, Chandrasekharpur, Bhubaneswar-23 and its residential quarters at Sailashree Vihar, Chandrasekharpur, Bhubaneswar-21 shall have to be furnished alongwith the Tender. However, the Tenders should indicate only the lump-sum amount in respect of all the services covered under this contract. 7 Annexure-V TERMS AND CONDITIONS: 1. The ICAR-IIWM is a unit of Indian Council of Agricultural Research is invited two bid tenders for providing the service of house keeping, maintenance of Lawn, office premises etc. at Main Campus on Job Contract Basis as per Annexure-I. 2. Mode of Payment The agency shall submit monthly bills alognwith the proof of depositng Service Tax and EPF & ESI contribution for the personnel enagaged at the site for the job peformed during the preceding month on the first wroking day and the ICAR-IIWM shall make payment by means of crossed cheque / RGTS in favour of the agency. However, taxes which are as per the rules of Govt. of India shall be deducted at source from monthly bills of the successful tender. The agency shall make payment to their employe through cheque only in the presence of Estate Officer. 3. Termination This contract can be terminated by giving one month s notice on either side and that any notice required to be served shall be sufficiently served on the parties if delivered to them personally or dispatched at the address herein given under registered post. The ICAR-IIWM will not have any responsibility towards this for any damage/loss caused and it cannot be challenged in any court of law. 4. The contractor is advised to do a complete survey on his own of both the building and its farm surrounding area before offering rates. 5. In case of any dispute arising, decision of Director, ICAR-IIWM will be final and binding. 6. An amount equivalent to 5% of the estimated value of contract is to be deposited by the selected/successful tenderer as a security deposit only after receiving a communication from the ICAR-IIWM. In the event of non-deposition of the same, the earnest money will be forefeited. 7. Service tax or any other tax applicable or made applicable after awarding the contract in respect of this contract shall be payable by contractor and ICAR-IIWM will not entertain any claim whastsover in this respect. However, the service taxes or any other tax which is as per the rules of the Govt. of India shall be deducted at source from monthly bills of the successful tendrer, as per rules/instructions made applicable from time to time by government. 8. Director ICAR-IIWM reserves the right to reduce or terminate the period of contract or to extend its duration in the interest of the Council for any justificable reasons, not mandatory to be communicated to the tenderer. 9. The following documents / vouchers are required to be enclosed with the tender forms which are the terms and conditions of the tender documents. Minimum turnover of the firm should not be less than lakhs (ten lakhs only) during the last 3 financial year of housekeeping/sanitation work and masonary works etc. Last three years continuous experience of the firm in the field of providing such services in central govt./state govt./govt. establishment/ Autonomous bodies of govt of India/ Corporations of govt. of India/ reputed public or private organizations. Provide the details in tabular form. Certificate balance sheet of the firm for last 3 year of the service contract by the Chartered Accountants. Duly certified copies of the satisfactory services where the tender is providing the service for the last three years. Employees EPF registration certificate issued by local govt. etc. Employees ESI registration certifiacate issued by locat govt. etc. The contractor/agency must have a registatation with the contract labour (Regualtion and Abolition) Act The contractor shall obtain the valid labour license under this Act.

Documentary proof of vouchers is required to be attached. Service tax registration certificate issued by Govt. etc. Successful tenderers will have to enter into a detailed contract agreement with ICAR-IIWM on non-judicial stamp paper of (Rupees one hundred only). Only those firms will be considered for financial bid who will qualify in the technical bid. The technical bids and financial bids may be submitted in separate envelops to be sealed and put in a main cover. The personnel engaged by the agency for this job contract will not be an employee of the council and there will be no employer-employee relationship between the council and the personnel so engaged by the contractor. The agency shall be wholly responsible for making payment of monthly salaries and other admissible allowances to the personnel under minimum wages act and the council shall in no way be responsible for meeting any kind of expenditure on salaries etc. to these personnel. The ICAR-IIWM shall not directly or indirectly engage any personnel of the agency duirng the period of contract. 10. Evaluation of the quotation The ICAR-IIWM will evaluate and compare the quotation determined to be substantively responsive i.e. which are properly signed, fulfilled all the eligibility conditions, conform to the terms and conditions and met the minimum wages criteria and other statutory requirement. The ICAR-IIWM will award the contract to the responsive bider whose total cost for all the items put together is the lowest. 11. Terms of the Contract 1. Initially the terms of the contract will be for one year. On the expiry of the contract or on its termination, the ICAR-IIWM reserves the right to renew the contract on quarterly/half yearly/yearly basis on the terms and conditions that may then be mutually agreed upon. 2. The Income tax etc. as applicable will be deducted from the claim of the contractor at source. 3. Before awarding of the contract, successful bidder will have to execute an agreement on nonjudicial stamp paper after which final work order will be issued (Format of agreement enclosed. 4. The tender should be sent in a sealed cover superscribing Tender for providing the service of house keeping, maintenance of Lawn, office premises etc. at Main Campus on Job Contract Basis upto P.M. on The tenderer should enclose the Income Tax/Service Tax Certificate alongwith the experience certificate, if any. 6. All the statutory rules with regard to labour management and other liabilities have to be adhered to by the contractor. 7. The contractors are also to abide with the rules of ICAR/Govt. of India. 8. The Technical Bid will be opened on at A.M. The tenderers or their authorized representatives may make it convenient to be present at the schedule time and date if they so wish. The financial bid of the firms those who qualified in Technical Bid will be opened later under intimation to technically qualified bidders. 9. The tender should be accompanied with the attested copy of the valid labour license & Registration number. 10. All the labour liabilities in respect of the labourers engaged by the contractor as per labour law rest with the labour contractor. The rate may be quoted after taking into account all the statutory payment as per labour laws i.e. EPF, ESI, Leave and Service Charges etc.

The Director, ICAR-IIWM, Bhubaneswar reserves the absolute right and power of revoking or cancellation of the Job Contract Basis with one month notice without assigning any reason whatsoever. 12. The contractor shall pay the minimum wages as per Central Govt. rate to the persons to be engaged by him as per labour laws. 13. The Agency having valid firm registration number and subsequently obtaining labour license if required as per head can only take part in this tender. 14. Contractor shall be responsible to comply with various provisions of contract labour Act.1970 and such other Act as may be applicable for such works. In the event of unsatisfactory performance during the contract period the contract can be rescinded by giving one-month notice by the authority. The persons those will be engaged by the successful agency/contractor for the above maintenance work on Job contract Basis will have no right for employment in future at ICAR-IIWM, Bhubaneswar and all the labour liabilities rest with the contractor. 15. Incomplete tender or not complying with the above conditions is liable to be rejected. Overwriting or figures written in such style that it can be read in more than one way may lead to cancellation of tender. 16. The quotations will be subject to any further terms and conditions as may be fixed by the Govt. of India/ICAR/Director, ICAR-IIWM, Bhubaneswar if required. 17. The rate to be quoted by the Agency should be inclusive of all statutory payments as per labour laws. 18. Service tax or any other tax applicable or made applicable after awarding the contract and shall be payable by contractor in respect of this contract and ICAR-IIWM will not entertain any claim whatsoever in this respect. However the service taxes or any other tax which is as per the rules of the Govt. shall be deducted at source from monthly bills of the successful bider, as per rules/instructions made applicable from time to time by Government of India. 19. The tender received after due date and time will not be entertained. The enclosed envelope should contain the name and address of the tenderer in complete manner. 20. Tender will remain open for acceptance upto 90 days from the date of opening. The Director, ICAR-IIWM, Bhubaneswar at his discreation may extend this date by a fortnight and such extention shall be binding by the tenderers. 21. If the date upto which the tenders is open for acceptance is declared to be a holiday the tenders shall be deemed to remain open for acceptance till the next working day. 22. Earnest money deposit of 40, (Rupees forty thousand only) to be deposited in the form of Bank Draft in favour of ICAR-UNIT-IIWM payable at Punjab National Bank, Chandrasekharpur Branch, Bhubaneswar or any Nationalized Bank alongwith the tender paper which will be refunded after finalization of tender. 23. No interest will be paid against EMD and Security deposit. 24. The housekeeping and sanitation services are to be provided as detailed in charter & schedule of services from 7.30 a.m. to 3.30 p.m. uninterruptedly and schedule of material use in all working days. The agency will provide services equivalent to one man day from 3.30 p.m. to 4.30 p.m. It is to be ensured by the contractor that these services on each floor are provided and supervised. 25. All cleaning tools and materials will be arranged by the agency. The agency has to use following brand of materials for Housekeeping and Sanitation sercices as shown under. Sr.No. Items Brand 1. The rate may be quoted after visiting the work site and clarification if any to carry out the work on Job contract basis, the Estate Officer of ICAR-IIWM main campus may be consulted during the working days if necessary. 27. The 2 nd party is to follow the provision of all labour laws applicable to this establishment including statutory payments and other liabilities/eventuality of labourers from time to time and will be solely responsible. The 1 st party will not have any responsibility in this regard in any case/eventuality. 28. If a tenderer does not accept the offer, after issuing of letter of award by ICAR-IIWM within 15 days, the offer made shall be deemed to be withdrawn without any notice & earnest money will be forfeited. 29. Wages to be paid to the contractor to deploy the manpower will be as per the direction of Ministry of Labour & Employment issued from time to time. 30. The Director, ICAR-IIWM, Bhubaneswar reserves the right to cancel any or all tenders without assigning the reason thereof. 31. The contractor/agency shall make payment of remuneration/wages to its personnel before 7th of every month. After making the payment, the Contractor shall raise the bill in the ICAR-IIWM for payment of the settled amount. They will submit to the ICAR-IIWM a copy of the payment vouchers duly signed by the workers for each month. 32. Risk Clause: ICAR-IIWM reserves the right to discontinue the service at any point of time, if the services are found unsatisfactory by giving a show-cause to be replied within a week and also has the right and award the contract to any other agency at the risk and cost of current agency and excess expenditure incurred on account of this can be recovered from performance Security Deposit or pending bills or by rising a separate claim. 33. The personnel provided shall be under the direct control a supervision of the Contractor/Agency. However, the contractor shall comply with the oral and written instructions given on day to day basis, by the officer(s) authorized by the ICAR-IIWM from time to time. 34. The tender document duly signed on all pages shall be submitted along with technical bid, failing which the technical bid shall not be considered. Outsider firms shall not be considered for bids. 11 AGREEMENT This agreement is made at Bhubaneswar on between the Director, ICAR-IIWM, Bhubaneswar (hereinafter called Institute) through (designation of the competent authority in the Instts.) which term shall include its successors, assignees etc. on the first part and (hereinafter called the Firm) which term shall include its authorized representatives, successor, assignees etc. on the other part. Whereas the (Institute) has decided to assign for at ICAR- IIWM, Bhubaneswar to the firm on the terms and conditions hereinafter contained. NOW IT IS HEREBY AGREED by and between the parties hereto as follows: 1. This agreement shall come into force w.e.f. and will remain in force for a period from to but can be terminated by the Director, ICAR-IIWM, Bhubaneswar (name of the Instts.) by giving one calender month's notice in writing of its intentions to terminate the Agreement. The Agreement can be renewed on mutually agreed terms. 2. The firm shall be responsible for the job work contract for providing the service of on job contract basis at ICAR-IIWM, Bhubaneswar (location). 3. The firm will provide full particulars of every worker deployed by it for providing the services and get their character and antecedents verified from the Police Authorities. 4. All personnel posted at premises shall all times and for all purpose be deemed to be employee of the firm and the ICAR-IIWM, Bhubaneswar shall have no liability on this account in any manner. 5. That the Firm shall ensure that all persons deployed at Director, ICAR-IIWM, Bhubaneswar premises are of good character, well behaved and otherwise competent and qualified to perform the work for which they are deployed. 6. The Director, ICAR-IIWM, Bhubaneswar shall have the right to ask for the removal from the Director, ICAR-IIWM, Bhubaneswar considered by the Director, ICAR-IIWM, Bhubaneswar to be incompetent, disorderly or any other reason and such person shall not again be deployed without the consent of the Director, ICAR-IIWM, Bhubaneswar. 7. The manpower deployed by the Agency should work as per the working days and timings of the Director, ICAR-IIWM, Bhubaneswar. No extra wages will be paid for attending office on weekends, holidays and late - sitting.

12 8. Monthly consolidated charges for job/ work contract for is as per terms and conditions specified and scope of work as per Annexure-III(A) in the tender document including all the taxes viz. Service tax and other taxes as applicable will be paid to the firm by the ICAR- IIWM. The firm will raise a bill of this amount on 5 th working day of following month and the payment released by the ICAR-IIWM in the form of crossed cheque/e-payment to the firm subject to satisfactory performance / delivery of contracted job / work/ services. Copies of documents such as deposit challan alongwith list of persons showing deposit of ESI, EPF with the concerned agencies are also to be deposited with the bill. 9. The deduction of income tax from the bills of the Agency will be made at source as per rates applicable from time to time. 10. In case of dispute between the parties, the matter shall be referred to the sole Arbitrator appointed by the ICAR-IIWM, Bhubaneswar. The decision of the sole arbitrator shall be final and binding in any respect of any dispute between the parties. 11. That the Firm shall issue uniforms to all their employees engaged, which they shall wear while on duty (optional). 12. That the firm shall issue identity card to each of the workers engaged for entry into ICAR-IIWM, Bhubaneswar premises. 13. That the Firm shall ensure the successful implementation of the terms and conditions of the agreement by proper control and supervision of the work. 14. That in case the Firm fails to perform any of the terms and conditions of this agreement or commits any breach of the contract, the (name of the Instt.) may cancel the contract. 15. That the Firm agrees to discharges all their legal obligations in respect of their workers in respect of their wages and services conditions and shall also comply with all the rules and regulations and provisions of law in force that may be applicable to them from time to time, viz. obligations under Contract labour (Regulation & Abolition) Act. 1970, workmen's Compension Act, 1943, E.P.F., E.S.1. Act, 1947 etc. Firm agrees to indemnify and keep indemnified Indian Institute of Water Management, Bhubaneswar on account of any failure to comply with the obligations under various laws or damage to ICAR-IIWM, Bhubaneswar due to acts/omissions of Firm. 16. It is also agreed that under no circumstances, the volunteers and/ or the employees/ workmen of the Firm shall be treated, regarded or considered or deemed to be the employees of the ICAR- IIWM, Bhubaneswar and the Firm alone shall be responsible for their remuneration, wages and other benefits etc. Firm shall indemnify and keep indemnified the... ICAR-IIWM, Bhubaneswar against any claim that it may have to meet towards the employees/ workmen of the Firm. Firm's employees/ workmen shall have no claim to absorption/ regularization and financial benefits etc. that are admissible to regular employees in the office of Indian Institute of Water Management, Bhubaneswar. 17. The contract is subject to the conditions that the firm shall comply with all the laws and by laws of Central Govt. as applicable relating to this contract. 18. In case of any loss or damage to the property of the ICAR-IIWM at which is attributable to the firm, the full damages will be recovered from the firm. 19. The Firm shall not transfer its right or sub-contract to anyone else. 20. The Firm or its workers shall not misuse the premises allotted to them for any purpose other than for which contract is awarded. 21. The Firm shall devote its full attention in service to ensure highest quality in all aspects and discharge its obligations under the contract with trust, deligently and honestly. 22. In case of any accident/loss of life of the workers during discharging duties compensation to be given to the workers, the same shall he borne by the Firm. 23. There will be surprise checking by an Officer. Shortcomings, if any pointed out by him shall be restored by the contractor within 24 hours of its bringing to his notice.

13 24. The firm shall provide a Co-ordinator for immediate interaction with the organization. 25. The terms and conditions as stipulated in the tender documents and enclosed herewith, shall be part of the agreement. PENALTY CLAUSE: LIQUIDATED DAMAGES CLAUSE: 26. An amount of will be levied as liquidated damages per day. Whenever and wherever it is found that the work is not up to the mark in any Section. It will be brought to the notice of the supervisory staff of the firm by (Name of the Institute) and if no action is taken within one hour liquidated damages clauses will be invoked. 27. Any misconduct/ misbehavior on the part of the manpower deployed by the agency will not be tolerated and such persons will have to be replaced immediately. 28. If the required number of workers are less than the minimum required as a penalty of per worker per day will be deducted from the bill. 29. The decision of Director, ICAR-IIWM, Bhubaneswar shall be final and binding on the contractor/agency in respect of any clause covered under the contract and any matter incidental to the contract. 30. Monthly package amount shall be paid only on submission of monthly bill of service rendered to the satisfaction of first party or his/ her authorized officer. Second party will submit bill on the fifth of the following month and first party will arrange to make payment upto 15 th of the following month. 31. First party based on quality and efficiency of services rendered in the preceding year, may on its discretion, revise the consolidated package by an amount not exceeding 10% of preceding year's package amount for the ensuing year. 32. (i) Any misconduct on the part of the second party, if proven, after an enquiry by first party shall entitle first party to terminate services of second party. (ii) Any unauthorized or willful absence from duty for a period of 7 days would entitle second party to terminate contract without any notice. 33. (i) The contract can be terminated with notice of one month on either side or by depositing/ paying one month's package /contract amount in lieu of notice. (ii) First party or any authority approving contractual appointment with second party shall be competent authority for termination of contract etc. (iii) The agreement/contract period shall stand terminated automatically on expiry of stipulated period if not extended prior to stipulate date. Second party will not be entitled for any claim for services rendered after expiry of stipulated date of contract. 34. The second party shall carry out the assignment in accordance with the highest standard of professional and ethical competence and integrity, having due regard to the nature and purpose of the assignment and will conduct itself in a manner consistent herewith otherwise will be liable to action under the agreement. 35. This contract is issued on the understanding that all the information given by the second party in his/her application form and during the interviews is correct, true and complete, if it is found at any time that the information given when seeking appointment is not complete and true and/or any significant information has been knowingly suppressed, the first party will have the right either to withdraw the letter before second party joins or terminate appointment at any time the second party has taken up services with the first party without any notice or compensation. 36. The Firm should submit monthly bill wise separate challan for EPF, ESI, SERVICE TAX challan with details of contribution & computerized receipt pertaining to this Institute. The amount involved in the challan/receipt should be exclusively for the bill amount, otherwise the bill will not be entertained. No combined/consolidated Service Tax deposit challan mixed with other organisation will be accepted.
