Note: 1) Trips by Tractor with Trailer with body lifting mechanism. 2) 1/13 th Shall be deducted from the body measurement of the Tractor towards Voids and the Net Quantity will be considered for payment. 3) The removed pebbles should be transported and dumped at the place shown by the concerned mine authorities. 4) The above quantities are tentative and they may increase or decrease as per the requirement of the mines. Eligibility Criteria:- Quotations are invited from the firms having experience in similar works in SCCL or any Govt. Organizations including PSUs. Experience certificate / previous order copies should be enclosed along with quotations. Quotations will be accepted from the registered vendors of SCCL only. Tenderers are requested to mention their vendor code number on their quotations. The performance of the works awarded earlier to the Firms by SCCL will be taken into consideration while doing technical evaluation. Tenderers are requested to quote their rates in the following Quotation format only 2

Ref: Enquiry No.SR113O0478, dtd :- With reference to the above, we hereunder furnish the rates for Removal & Transportation of Pebbles from Sand Stowing Bunkers of various Mines of SRP Area for a period of Two years. Description Removal & Transportation of Pebbles from SRP Area mines as per scope of work Quantity (Approximate) Unit 27,500 Cu.M Rate per Cu.M in Rs.Ps. Service Taxes extra as applicable. Tenderer should quote only rate per unit [ Cu.Mtr ] exclusive of Service Tax. (Signature of the Tenderer) 1. I / We am/are in possession of the necessary equipment to carry out the above work. 2. I / we have gone through the terms and conditions enclosed herewith and submit this tender. I/we abide to the terms and conditions and agree for any amendments made from time to time during the period of contract. 3. I / we further agree to sign an agreement bond within two weeks from the date of receipt of LOI / Order. 4. I / we also agree to start the work within 15 days from the date of receipt of letter of intent and to carry out the work strictly in accordance with the terms and conditions. 5. 4 SCOPE OF WORK: I. Removal of Pebbles from Sand Stowing Bunkers of IK-1A, SRP-1, SRP-3 & 3A, RK-7 and RK-8 Inclines. II. Removal pebbles to be transported with ONE Kilometer lead including Loading & Unloading. III. Rate will be awarded in Rupees on the basis of Cu. Meter of pebbles removed & transported. IV. The work schedule shall be given by concerned mine authorities from time to time. TERMS AND CODITIONS: 1. PERIOD OF CONTRACT: TWO Years. 2. Tenderer shall not engage workmen below 18 years of age. Sub-contracting is not allowed. 3. The persons engaged by the contractor shall use protective wear i.e. Helmets, Shoes, Aprons, Dust Respirators, Hand Gloves etc. The contractor has to obtain these items at own cost. The SCCL may provide these items on sale account subject to availability and amount will be recovered from the contractor s bills at the rates prevailing on the date of issue. 4. All the persons to be engaged shall be trained at MVTC and medically examined. The charges for providing vocational training and medical check up will be levied on contractor at the prescribed fee. 5. The contractor and all the persons working under the Contractor shall follow all the statutory rules and Regulations under mines Act and other specified Acts/Law from time to time. Contract should pay the Worker / Staff employed by him minimum wages as per act, allowances including other benefits such as workmen compensation, Provident Fund, 10% Quarterly Bonus, Profit sharing Bonus and any other claims arising out of employment under Law / Awards from time to time. 6. INSURANCE: Contractor shall take Group Accident Insurance Policy for workmen engaged by him on the work as per the payment of wages Act and Labour Act in force. After awarding of work, before commencing the work the Contractor shall submit a copy of the above documents to the General Manager, Srirampur Area. 7. If the contractor fails to deploy the manpower, the proportionate amount will be deducted from the bills for not engaging the persons as stated above and a penalty of Rs.200/- per head per day also will be deducted from the bills. 8. The contractor has to furnish Identity Cards to all their working personnel in proof of their identification. They must wear it during their deployment at work spot. 9. Any compensation to be paid for personnel or machinery due to accidents shall be paid by the Contractor only and all the SCCL remains absolved of the responsibility of payment of such compensation. 10. PRICE VARIATION CLAUSE: Prices are FIRM till complete execution of entire order. 11. The contractor shall hold the license under the Contract Labour Act and submit a copy of the license to General Manager, Srirampur Area before commencing the work as per the applicability. 5 12. The contractor should follow all rules, if any imposed by local/state/central authorities with regard to safety of the persons engaged by the contractor. 13. Contractor should indemnify the company (SCCL) from any liability befalling on SCCL due to any commission/omission by himself or by any third party in execution of contract. If the company (SCCL) is made liable for such claims by the court or authority, the same should be reimbursed to the company (SCCL) by the contractor as if the company (SCCL) has paid on their behalf. 14. During the course of execution of work, if any accident occurs whether major or minor, the Contractor or his supervisory staff should inform the same immediately without any delay to the concerned authorities to take steps in accordance with the Mines Act and other relevant laws. Otherwise Contractor or his supervisory staff will be prosecuted for violation of the Mines Act and other relevant laws. 15. SECURITY DEPOSIT: The successful tenderer has to submit 2% of the order value towards Security Deposit before commencement of the contract. The SD of the successful Contractor will be returned within 3 months from the date of expiry of the contract and on satisfactory completion. It bears no interest. 16. If the contractor fails to fulfill the contract conditions and services are stopped due to their failure, Security Deposit will be forfeited and contract will be terminated without any prior notice. 17. TAXES AND DUTIES: The quoted rates will be considered as inclusive of all Taxes and Duties including Cess and Royalties imposed by Local, Municipal, Provincial, State and Central Authorities and if payable at a later date will be to your account only. 18. PAYMENT: Payment through cheque will be released within 15 days from the date of certification by the concerned authorities. 19. FORCE MEJEURE CONDITIONS: The following shall be treated as force majeure conditions: Strikes, lockouts, law & order problem. Natural calamities, rains, flood, War, fire Non availability of diesel. 20. The force majeure conditions shall be considered subject to documentary evidence. The force majeure conditions shall be recorded in "site register" maintained by the concerned authorities at the beginning and at the end of force majeure conditions and signed by the contractor and concerned authorities. Otherwise such a plea of force majeure cannot be agreed. The force majeure conditions are considered for extension of time for completion of work and shall not be considered for exemption. In case SCCL stops the work in the event of violation of any statutory rules such period of stoppage shall not come under force majeure condition. 21. RISK PURCHASE CLAUSE: In case the Contractor fails to execute the work within the prescribed Work Completion Schedule as mentioned in the order, and SCCL if forced to get the job done by any other contractor at a higher price, the different amount will be recovered from the defaulted Contractor including liquidated damages from pending bills anywhere at SCCL. 22. Price Fall Clause: The Contractor shall pass on the benefit to the SCCL, in case the firm/contractor executes similar work to a public or private concern within a period of 6 months from the date of receipt of order at price less than the price offered to SCCL. 6 23. All damages, losses such as theft, damage to the equipment, loss of equipment at the site incurred during the execution of the work shall be to Contractor s account. 24. Financial liabilities towards wages of employees, Provident Fund, accommodation, medical assistance, local transport, handling of equipment etc., shall have to be looked after by the contractor at his own cost. 25. Income Tax deduction will be regulated as per IT Act and relevant Section and as per rules announced by Government Authorities from time to time. Any other taxes, which are applicable, shall also be deducted as per rules in force without any prior intimation. 26. Not withstanding any thing mentioned above/herein, the Company (SCCL) reserves the right to terminate the contract, with immediate effect without assigning any reasons, if the Company (SCCL) is of the opinion that the works are not being conducted/carried out to its satisfaction and the Company (SCCL) will be the sole judge in this regard. Due to imposition of any law/change in law by the government/court decision, if the work is to be stopped the work will be terminated and payments will be made only for the portion of the works executed on the principle of quantum merit. No payments will be made for shifting of equipment or personnel. 27. As the time is the essence of the contract, incase the Contractor lags behind in his work, to keep up the schedules, the company (SCCL) reserves the right of awarding the residual work either in whole or part to any other contractor(s) and difference in value will be recovered. 28. Contractor shall deploy additional manpower, if required to meet the targets. 29. The terms and conditions if any, that will be stipulated from time to time by authorities concerned, including the office of Inspectorate, Hyderabad, will be binding on the contractor. 30. If the tenderer does not mention in writing regarding acceptance of terms and conditions as per the enquiry, SCCL assumes that Tenderer has accepted for these terms as per enquiry. 31. PENALTY FOR DELAY IN WORKS: If work is not commenced within 15 days from the date of receipt of LOI/Order, a penalty of 1% per week of the monthly work value 63 Cu.M /day for 26 days will be levied, subject to force majeure conditions. If Work is not commenced within one month from the date of receipt of order, it can be cancelled. However, the minimum qty./ day is variable as per the qty. actually existing as per the certification of Concerned mine authorities. 32. Enquiry/Order in part or in full can be cancelled at any time without assigning any reason. 33. The validity of offer shall be for a period of minimum of 6 months from the date of opening of tender. 34. The tenderer shall submit their quotation in the format enclosed. 35. Our enquiry number and date as well as the date fixed for opening the tender shall invariably be marked on your tender and also on sealed envelop in which it is sent. 36. The SCCL reserves the right to reject any/all tender(s)or accept any offer or part thereof without giving any reasons. Its decision in this matter will be final and binding on all the tender(s). 37. The SCCL will not be responsible for in any postal delay. Signature of the tenderer with name date & office seal. 6

7 38. Tenders received after stipulated time and date will not be considered whatsoever reasons thereafter. 39. Quotation must be on a paper / Letter head only as per the enclosed format, identifying the firm with telephone number, office seal etc. They should be in ink/type-written and should be free from corrections / erasing. 40. The quantity i.e. 63 Cu.M /day and period Two years are tentative and may increase/decrease as per requirement. 41. The average quantity of the pebbles to be removed & transported will be above 63 Cu.M approximately per day. The minimum quantity of pebbles to be removed & transported shall be 40 Cu.M / day. If pebbles removal is not effective due to negligence of workmen or due to other factors, which results in hampering of progress of work, penalties will be imposed at the following rates for non fulfilling the minimum quantity as per the following details. The Quantity of pebbles removed Cu.M / day CuM PENALTY NIL. Greater than or equal to 20 and less 40 Cu.M Below 20 CuM Rate of penalty will be levied on the difference of minimum and actual quantity removed 5% of the ordered rate / CuM 10% of the ordered rate / CuM In case if any variation in percentage of pebbles removed, levying the penalty will be judged by GM, SRP. 42. The Contractor or his representative shall personally report to the concerned Incharge at Mines on all working days at the beginning of the shifts to take instructions and arranging for the work. Also the person must be available throughout the work period supervising and coordinating the works. 43. Removal & Transportation of pebbles from sand stowing bunkers at mines shall be done in general shift and on all working days. 44. For loading, transportation of the removed pebbles to dump yards i.e. within a distance of One Kilometer driver, persons and tractor trailer / tipper must be deployed by the contractor at his own cost. The stocked material will be measured every 15 days and stocking height shall not be more than 2 mtrs. 45. In case if the contractor does not engage labour on any day, SCCL may make alternate arrangements and the expenses thus incurred including liquidated damages if any will be deducted from the bills of the contractor. 46. Any contravention by the contractor or any person employed by him or acting on his behalf or any of the terms of contract or any of the provisions or any Act, Rules, Regulations or Company s Standing Order or any Rules regarding conduct and discipline as formulated by the Company would be communicated in writing to the contractor or to the person acting on their behalf by concerned officer. After having been informed of such contravention, if the successful contractor fails to be appropriate action, the concerned officer has the right to refuse entry to the person responsible for such contravention, to the premises of the office or any other company s establishments till the cause of such contravention is removed or inform in writing of the corrective action taken by the successful contractor with an assurance about non-recurrence of such contravention. 8 47. In all cases of disputes, the decision of the company shall be final. However, in case the dispute still persists, the matter may be referred to any of the Civil Courts within the jurisdiction of Mancherial (Adilabad Dist, in the state of Andhra Pradesh) only to deal with and decide any legal matter of dispute. 48. EMD: EMD amount Rs. 40, (Rupees Forty Thousand only) shall be submitted along with the offer in the form of DD / Pay Order, drawn in favour of The Singareni Collieries Co. Ltd, payable at SBH, Srirampur / Mancherial or Andhra Bank, CCC. Offers without EMD will be summarily rejected. EMD of successful tenderers shall be converted into Security deposit and shall be returned after successful completion of contract. EMD in respect of unsuccessful tenderers will be refunded after finalization of the contract. a. Exemption for submission of EMD: The following are exempted from submission of EMD: All Government Undertakings. Firms registered under Micro, Small and Medium Enterprises Development (MSMED) Act for enquired items. Ancillary Units / Subsidiaries of SCCL. The Tenderer exempted from submission of EMD shall indicate as Eligible for Exemption in the quotation format against EMD payment details column and submit documentary proof. Otherwise, the offer is liable for rejection. b. Forfeiture of EMD: EMD of the Tenderer will be forfeited in the following circumstances: Withdraws the offer during validity / extended validity period. Changes the terms and conditions of the offer during validity / extended validity period. Does not accept the LOI / order placed within the offer validity period / extended validity period, in accordance with terms & conditions of NIT, offer & negotiations. Breach of contract during execution. The information/documents submitted by the Tenderer proved to be false/ incorrect. 49. 9 GENERAL TERMS AND CONDITIONS: 1. Note: Tenderers are requested to submit their Offers as indicated hereunder on 3 Part Basis : Part A -Technical offer (in one cover) I. Order copies for work done to reputed concerns or Govt. undertakings II. Performance reports. III. Any other relevant technical details Part B -Commercial terms (in one cover) i) Validity, EMD, work complete period, applicability of taxes and duties, LD Penalty, warranty/ guarantee. ii) Specimen copy of Part C without prices. Part C -Price bid (in one cover) Basic price quoted, PVC formula, if any, duty, taxes and other commercial terms viz credit rebate etc. To avoid inadvertent opening of the cover, all the Three covers should be distinctly marked with the following on its left hand top corner: i) Enquiry Number & Date and name & address of the bidder ii) Cover No. i.e. Part A / Part B / Part C as the case may be and name & address of the bidder iii) Closing & opening date of the tender and name & address of the bidder All the Three covers are to be individually sealed and superscribed as mentioned above and shall be kept in another sealed cover superscribing enquiry No. due date of the submission of the tender and due date of opening of tender and name & address of the bidder along with Vendor Code. Without which the Offers will not be considered. Part -A & B shall be opened on the due date of the tender opening and Part-C shall be opened after completing technical & commercial evaluation & firming up with NIT conditions with advance intimation to qualified bidders. 2. Last date of receipt of tenders is noon of the due date and the tenders will be opened on the date mentioned above during evening working hours. Tenders received after noon on the closing date will not be accepted. Tenders received late for whatsoever reason will not be considered under any circumstances. 3. In all case of disputes the decision of Company shall be final. Failing this, the matter will be referred to Arbitration in accordance with the Indian Arbitration Act. Any dispute or difference or any matter arising out of contract or purchase order on incidental there to under this enquiry shall be subject to jurisdiction of a competent court in Andhra Pradesh alone and not at other places. 4. Quotation should be kept valid for a minimum period of 120 days from the date of opening the tenders. 5. Your offer should consist of Tax details i.e., Service Tax / Work Contract Taxes, otherwise it will be treated as cancelled. 6. The Company does not bind itself to accept the lowest tender or assign any reason for non acceptance. No correspondence will be entertained in this regard with suppliers. 9

10 7. The company does not bind itself to place order for the entire quantity enquired for and reserves the right to distribute the orders for any or all of the items on more than one firm. 8.
