Departments, during last three years. 2 ANNEXURE Á TERMS & CONDITIONS OTHERS TERMS AND CONDITIONS FOR SUBMITTING TENDER FOR THE SUPPLY OF HEAVY DUTY CAR/ BUS WASHING MACHINE 1. Place of Delivery FOR destination at Manager ( Store), Central Store, C/ o Punjab Roadways Workshop, Plot No. 182/16, Industrial Area, Phase-1, Near Tribune Chowk, Chandigarh (door delivery including unloading at the above destination). 2. Excise Duty Inclusive (As applicable). Variation in Excise Duty during the scheduled delivery period will be allowed 3. Sales Tax Inclusive ( indicate in % ) 4. Packing and Forwarding Inclusive & Securely packed. 5. Eligibility Criteria Firm should be original manufacturer/ Authorized distributor and should have supplied to any State Transport Undertaking/Govt. Departments, during last three years ( attach P.O. copy) 6. Mode of Payment a) 90% payment will be made after the receipt of material in Central Store, Chandigarh. b) 10% payment will be made after the installation/ satisfactory performance report received from the depots. 7. The validity of contract will be 12 months from the date of decision/date of placing supply order. 9. Quantity The quantity mentioned in the tender in annexure C is approximate and can be increased/decreased as per requirement of the Department during the validity period of contract on the same rates and terms & conditions. 10. Performance Bank Guarantee/Security 10% of the total value of the purchase order valid for 20 months. This is liable to be revoked in case of failure to meet the contractual obligations and including not timely supply of the material.

Risk Purchase In case of Non-supply of material as per delivery schedule, the stores will be purchased of the same specifications, terms & conditions from other sources at the risk and cost of the firm. The excess cost thus incurred will be recovered from the supplier from its pending bills/emd/bg/through legal action. The procedure of risk and cost purchase will be adopted after serving registered notice to supply stores within 15 days. 12. Price Variation Price fixed for one year from placement of purchase order. 13. Test Any sample from suppliers is liable to be tested from Govt. approved source. In case of failure of sample, penalty will be imposed as decided by Managing Director, PUNBUS Latest test report /certificate is to be provided by the firm/ company. 14. Delay Penalty Delayed consignment/delivery schedule will be subjected to 2% Penalty per c consignment per month of delay recoverable on the value of stores supplied after the scheduled date. In case of delay of less than one month, part penalty in proportion will be recovered Warranty After sale Support Inspection of Factory/Machine The warranty of Heavy Duty Car/ Bus Washing Machines for One year from the date of receipt of in Central Store and free replacement will be given for any manufacturing defects found in Machine within in year. After lodging the complaint by the depots, company service Engineer will be available within 24 to 48 hours. The complaint can either be lodged over phone or Toll free number or . Inspection of Factory/ Machine will be conducted by the Departmental Technical Committee and demo also be given by the firm in Punbus depot before placing the L-1 firm purchase order. 18. Participation in e- tendering process For participating in the above e-tendering process, the tenderers shall have to get themselves registered with e-tender.punjabgovt.gov.in and get user ID, password. The digital signature is mandatory to participate in the e-tendering process. Fall Clause The firm will be subjected to fall clause, in case of supply at lower rate to any State Transport Undertaking / Government Department than offered to the Punjab Govt. / PUNBUS from the date of offering the lower rates during validity of contract or 3 months before Tender.

Mode of Purchase The purchase will be made on the basis of lowest Rates. 21 Submission of Tenders a) The tenderer are to be submitted through e-tendering system. b) All tenders to be submitted in two parts viz; (i) Technical Bid (Annexure- B ) online. (ii) Financial Bid (Annexure- C ) online iii) Submission of hard copy is optional. If any document is necessary required the same can be submitted after the close of online time i.e. between PM to PM on ( also see para No. 26) c) The Technical bids will be opened at the time and date set for opening of tenders, in the presence of the tenderers or their authorized representative, who wish to attend Tenderers authorized representative (up to two authorized persons) may attend the tender opening. Financial bids will be opened on a notified date for the bids, which are found technically qualified. d) Tenders uploaded after the time and date fixed for the receipt of tenders as set out in the invitation to tender are liable to be rejected. e) Managing Director, PUNBUS reserves the right to reject any tender which is not deposited accordingly to the instructions stipulated in the tender document. f) Tenders can be uploaded on website of PUNJAB GOVERNMENT upto noon on and will be opened at PM on the same day in the office of Director State Transport Punjab cum-managing Director, PUNBUS Jeevandeep building Sec.17 B-Chandigarh. If ( Wednesday ) is declared as holiday, the tender will be opened on the next working day at the same place & time. 22. In case bidder withdraws/modifies its offer within the validity period, submit forged /fake documents or does any unethical/un-business like activity, do not accept the supply order, do not supply First delivery schedule/do not submit Bank Guarantee, EMD of the firm will be forfeited and other departmental penal action, as deemed fit, will be taken. 23 The department/ PUNBUS reserves the right to modify/revoke the tender at any point of time without assigning any reason. 24 Any conditional terms and conditions mentioned by the firm in their covering letter or in the tender documents will not be considered and tender is liable to be rejected. 25. The firm will have to supply the evidence of Excise Duty paid along with the each invoice. 26. Hard copy of the Techinal bid if being submitted should be duly paged and photocopies of relevant documents enclosed should be duly signed and stamped by the authorized representative of firm. Original documents in support of tender or clarification can be asked for by technical evaluation committee. 27. The Manufacturing plant should be in India.

The average turnover of the firm should be a minimum of Rs lakhs during the last three financial years i. e , & certified by Chartered Accountant. 29 The Company should never have been black listed by any STU s or the Government Department. 30 Earnest Money The Tenderer must submit Rs Lacs as earnest money online By making on-line payment through NEFT, RTGS, IPG, Net Banking, OTC. The earnest money deposit ( EMD) of the successful bidders will be refunded after the receipt of Bank Guarantee 31. Jurisdiction Any dispute or difference or claim etc., shall be subject to the exclusive jurisdiction of the courts situated at Chandigarh only. No other court shall have the jurisdiction to entertain or try any matter concerning this supply tender. 32. Arbitrator All disputes and differences arising out of or concerning whatsoever, shall be referred to the sole Arbitrator or an officer appointed by the Chairman Punbus, acting as such at the time of the reference. There will be no objection to such appointment, that the Arbitrator so appointed is a Govt., servant, that he has to deal with such matters in the course of duties as Govt., servant and might have expressed views on all or any of the matters in disputes or differences. The award of such Arbitrator shall be final and binding on the parties involved. The Arbitrator shall have the powers to extend the time for making the award on request from either of the parties.
