1 COUNTY CLERK S TICE OF GENERAL ELECTION TO BE HELD IN RANDOLPH COUNTY, MISSOURI TUESDAY, VEMBER 6, 2012 Notice is hereby given that the General Election will be held in the County of Randolph State of Missouri on Tuesday, November 6, 2012, as certified to this office by the Honorable Robin Carnahan Secretary of State of Missouri. STATE OF MISSOURI Secretary of State IN TESTIMONY WHEREOF, I hereunto set my hand and affix the Great Seal of the State of Missouri, done at the City of Jefferson, this 28 th day of August, Robin Carnahan Secretary of State The ballot for the Election shall be in substantially the following form: OFFICIAL BALLOT GENERAL ELECTION RANDOLPH COUNTY, MISSOURI November 6, 2012 DEMOCRATIC PARTY (DEM) REPUBLICAN PARTY (REP) LIBERTARIAN PARTY (LIB) CONSTITUTION PARTY (CST) INDEPENDENT (IND) INSTRUCTIONS TO VOTERS: To vote, darken the oval completely next to your choice. OFFICIAL BALLOT RANDOLPH COUNTY Shall the County of Randolph impose a local use tax on out of state purchases at the same rate as the total local sales tax rate, currently 1.000%, provided that if the local sales tax rate is reduced or raised by voter approval, the local use tax rate shall also be reduced or

2 raised by the same action? A use tax return shall not be required to be filed by persons whose purchases from out of state vendors do not in total exceed two thousand dollars in any calendar year. The purpose of the proposal is to eliminate the current sales tax advantage that Non-Missouri vendors have over Missouri vendors. City of Clark Shall the City of Clark, Missouri impose a local use tax on out of state purchases at the same rate as the total local sales tax rate, (currently totaling Two Percent) provided that, if any local sales tax is repealed, reduced or raised by voter approval, the respective local use tax also shall be repealed, reduced or raised by the same action? A use tax return shall not be required to be filed by persons whose purchases from out of state vendors do not in total exceed two thousand dollars in any calendar year. The purpose of the proposal is to eliminate the current sales tax advantage that Non- Missouri vendors have over Missouri vendors. City of Huntsville Shall the City of Huntsville, Missouri impose a local use tax on out of state purchases at the same rate as the total local sales tax rate, currently at a rate of One percent (1%) provided that if the local sales tax rate is repealed, reduced or raised by voter approval, the local use tax rate shall also be repealed, reduced or raised by the same action? A use tax return shall not be required to be filed by persons whose purchases from out-of-state vendors do not in total exceed two thousand dollars in any calendar year. The purpose of the proposal is to eliminate the current sales tax advantage that Non-Missouri vendors have over Missouri vendors.

3 City of Moberly Shall the City of Moberly, Missouri in an attempt to eliminate the current sales tax advantage that Non-Missouri vendors have over Missouri vendors, place a local use tax on Out-of-State purchases? This would be at the same rate as the local sales tax, currently 2.5%. If any local sales tax is repealed, reduced or raised by voter approval, the respective local use tax also shall be repealed, reduced or raised by the same action. Use tax shall not be required to be paid by persons whose purchases from Out-of-State vendors do not total more than two thousand dollars in any calendar year. VILLAGE OF RENICK Shall the Village of Renick increase property taxes to 80 cents per $ of assessed value? CONSTITUTIONAL AMENDMENT Constitutional Amendment No. 3 Proposed by the 96 th General Assembly (Second Regular Session) SJR 51 Shall the Missouri Constitution be amended to change the current nonpartisan selection of supreme court and court of appeals judges to a process that gives the governor increased authority to: Appoint a majority of the commission that selects these court nominees; and

4 Appoint all lawyers to the commission by removing the requirement that the governor s appointees be nonlawyers? There are no estimated costs or savings expected if this proposal is approved by voters. STATUTORY MEASURES Proposition A Proposed by Initiative Petition Shall Missouri law be amended to: Allow any city not within a county (the City of St. Louis) the option of transferring certain obligations and control of the city s police force from the board of police commissioners currently appointed by the governor to the city and establishing a municipal police force: Establish certain procedures and requirements for governing such a municipal police force including residency, rank, salary, benefits, insurance, and pension; and Prohibit retaliation against any employee of such municipal police force who reports conduct believed to be illegal to a superior, government agency, or the press? State governmental entities estimated savings will eventually be up to $500,000 annually. Local governmental entities estimated annual potential savings of $3.5 million; however, consolidation decisions with an unknown outcome may result in the savings being more or less than estimated. STATUTORY MEAUSRES Proposition B Proposed by the Initiative Petition Shall Missouri law be amended to:

5 Create the Health and Education Trust Fund with proceeds of a tax of $ per cigarette and 25% of the manufacturer s invoice price for rollyour-own tobacco and 15% for other tobacco products: Use Fund proceeds to reduce and prevent tobacco use and for elementary, secondary, college, and university public school funding; and Increase the amount that certain tobacco product manufacturers must maintain in their escrow accounts, to pay judgments or settlements, before any funds in escrow can be refunded to the tobacco product manufacturer and create bonding requirements for these manufacturers: Estimated additional revenue to state government is $283 million to $423 million annually with limited estimated implementation costs or savings. The revenue will fund only programs and services allowed by the proposal. The fiscal impact to local governmental entities is unknown. Escrow fund changes may result in unknown increase in future state revenue. STATUTORY MEASURES Proposition E Proposed by the 96 th General Assembly (Second Regular Session) SB 464 Shall Missouri law be amended to prohibit the Governor or any state agency, from establishing or operating state-based health insurance exchanges unless authorized by a vote of the people or by the legislature? No direct costs or savings for state and local governmental entities are expected from this proposal. Indirect costs or savings related to enforcement actions, missed federal funding, avoided implementation costs, and other issues are unknown.
