Goewermentskennisgewing Government Notice DEPARTEMENT VAN OWERHEIDSAKE DEPARTMENT OF GOVERNMENTAL AFFAIRS No No AFKONDIGING VAN WET VAN NASIONALE VERGADERING Die volgende Wet, wat ingevolge die Prok- 1amasie op die Instelling van Wetgewende en Uitvoerende Gesag vir Suidwes-Afrika, 1985 (Proklamasie R.IOl van 1985), deur die Nasionale Vergadering aangeneem en deur die Administrateur-generaal onderteken is, word hierby afgekondig ingevolge artikel 18 van daardie Proklamasie: - No. 5 van 1986: Wet op die Beheer van die In- en Uitvoer van Suiwelprodukte en Suiwelsurrogate, PROMULGATION OF ACT OF NATIONAL ASSEMBLY The following Act, which has been adopted by the National Assembly and signed by the Administrator-General in terms of the South West Africa Legislative and Executive Authority Establishment Proclamation, 1985 (Proclamation R.l01 of 1985), is hereby published in terms of section 18 of that Proclamation: - No. 5 of 1986: Control of the Importation and Exportation of Dairy Products and Dairy Product Substitutes Act, 1986.

( ( Ajrikaanse teks deur die Administrateur-generaal onderteken op 20 Maart 1986 DAAR WORD BEPAAL deur die Nasionale Vergadering, soos volg:- 1. (l) In hierdie Wet, tensy uit die samehang anders blyk, beteken - (i) "departement" die Departement van Landbou en 5 Natuurbewaring; (iii) (ii) "gebied" die gebied Suidwes-Afrika; (ix) (ii i) "handeldryf' koop en verkoop om 'n inkomste daaruit te verkry; (xi) (iv) "hierdie Wet" ook die regulasies; (x) 10 (v) "inspekteur" 'n inspekteur in artikel 4 beoog; (v) (vi) "invoer", met betrekking tot 'n suiwelproduk of suiwelsurrogaat in artikel 2 beoog, invoer in die gebied met die doe I om so 'n suiwelproduk of suiwelsurrogaat te verkoop; (iv) 15 (v ii) "permit" 'n permit in artikel 3 beoog; (vi) (viii) "Sekretaris" die Sekretaris van Landbou en Natuurbewaring; (vii) (ix) "suiwelproduk" hotter, Cheddar-kaas, fabrieksroom, gegeurde melk, U.H.T.-melk, gesteriliseerde 20 melk, Gouda-kaas, joghurt, karringmelk, kultuur melk, maaskaas, melkpoeier, nywerheidsmelk room, vars melk of enige ander produk wat die Kabinet tot suiwelproduk verk laar het soos in subartike l (2) beoog; (i) 25

(Afrikaans text signed by the Administrator-General on 20 March 1986) BE IT ENACTED by the National Assembly, as follows:- 1. (1) In this Act, unless the context indicates otherwise- oo~initi"" ' (i) "dairy product" means butter, Cheddar cheese, fac- 5 tory cream, flavoured milk, U.H.T. milk, sterilized milk, Gouda cheese, yoghurt, buttermilk, cultured milk, cottage cheese, milk powder, industrial mi lk, cream, fresh milk or any other product which the Cabinet has declared to be a dairy product as con- 10 templated in subsection (2); (ix) (i i) "dairy product substitute" means any substance which, irrespective of whether or not any dairy product was used in its production, processing or manufacture, is made from animal or vegetable fats 15 or oils or a mixture thereof in imitation, form or semblance of a dairy product, but does not include margarine; (x) (iii) "department" means the Department of Agriculture and Nature Conservation; (i) 20 (iv) "importation", in relation to any dairy product or dairy product substitute contemplated in section 2, means importation into the territory with the intent to sell any such dairy product or dairy product substitute; (vi) 25 (v) "inspector" means an inspector contemplated in section 4; (v) (vi) "permit" means a permit contemplated in section 3; (vii)

(viii) (2) Die Kabinet kan na goeddunke vir die doeleindes van hierdie Wet en by kennisgewing in die Offlsiele Koerant enige produk wat in die omgang as 'n suiwelproduk bekend is maar nie in die omskrywing van "suiwelproduk" in sub- 15 artikel (I) genoem word n ie, tot suiwelproduk verklaar. O.fflsiele Koerant die invoer in of die uitvoer uit die gebied van 'n suiwelproduk of suiwelsurrogaat in die kennisgewing genoem, of van aile s uiwelprodukte of aile suiwel- 20 surrogate, verbied, en kan in sodanige kennisgewing 'n tydperk bepaal vir die duur van sodanige verbod. (1) Die Kabinet kan, op aansoek deur 'n groothandelaar of die eienaar van 'n suiwelverwerkingsaanleg, en op die voorwaardes wat die Kabinet bepaal, 'n permit vir die invoer in die gebied van 'n genoemde hoeveelheid van 'n suiwelproduk of 'n suiwe lsurrogaat ten opsigte waarvan 'n 30 verbod op invoer in die gebied kragtens artikel 2 van krag is, uitreik indien hy tot sy bevrediging vasgestel het dat - (a) (i) 'n suiwelproduk of suiwelsurrogaat van ge lyke gehalte nie in die gebied vervaardig of geproduseer word nie en nie binne die korttermyn tegnies 35 of ekonomies in die gebied vervaardig of ge produseer kan word nie; of (i i) plaaslike vervaardigers of produsente nie genoeg van die betrokke suiwelproduk of suiwelsurro gaat vervaardig of produseer om in die plaaslike 40 vraag te voorsien nie; en (b) die hoeveelheid van die suiwelproduk of suiwelsurrogaat waarvoor die permit verlang word 'n realistiese hoeveelheid vir die gebied is; en

5 No Official Gazette Extraordinary 14 April CONTIWL Of THE IMPORTATION AND EXPORTATION OF DAIRY PRODUCTS AND DAIRY PRODUCT SU BSTITUTES ACT, 1986 Act No. 5, 1986 (vii) "Secretary" means the Secretary of Agriculture and Nature Conservation; (viii) (viii) "sell" includes. to offer, advertise, keep, expose, transmit, convey or deliver for sale and an ex- 5 change or any disposal for any consideration whatever; (xi) (ix) "territory" means the territory of South West Africa; (i i) (x) "this Act" includes the regulations; (iv) 10 (xi) "trading" means buying and selling in order to derive an income therefrom. (iii) (2) The Cabinet may at its discretion for the purposes of this Act and by notice in the Official Gazette, declare any product that is generally known as a dairy product but is 15 not mentioned in the definition of "dairy product" in subsection (I), to be a dairy product. 2. (I) The Cabinet may at any time by notice in the Official Gazette prohibit the importation into or the exportation from the territory of any dairy product or dairy product 20 substitute and for such purposes specified in the notice, or of all dairy products or dairy product substitutes, and may in such notice determine a period for the duration of such prohibition. (2) The Cabinet may at any time by notice in the Official 25 Gazelle amend or revoke the prohibition referred to in subsection ( 1). 3. (I) The Cabinet may, on application by a wholesaler or the proprietor of a dairy products processing plant, and on the conditions the Cabinet may determine, issue a permit 30 for the importation into the territory of a specific quantity of a dairy product or dairy product substitute in respect of which a prohibition on importation into the territory under section 2 is in force, if it has ascertained to its satisfaction that - Permits for the importa tio n or exportation of dairy products or dairy prod uct substitutes. 35 (a) (i) a dairy product or dairy product substitute of equal quality is not being manufactured or produced in the territory and cannot technically or economically speaking, be manufactured or produced in the territory over the short term; or 40 (i i) loca I manufacturers or producers do not manufacture or produce enough of the dairy product or dairy product substitute concerned to provide in the local demand; and (b) the quantity of the dairy product or dairy product 45 substitute for which the permit is required is a realistic quantity for the territory; and

(2) Die Kabinet kan, op aansoek deur 'n groothandelaar of die eienaar van 'n suiwelverwerkingsaanleg, en op die voorwaardes wat die Kabinet bepaal, 'n permit vir die uit- 5 voer uit die gebied van 'n genoemde hoeveelheid van 'n suiwelproduk ofsuiwelsurrogaat ten opsigte waarvan 'n verbod op uitvoer uit die gebied kragtens artikel 2 van krag is, uitreik indien hy tot sy bevrediging vasgestel het dat - (a) die suiwelbedryf in die gebied dit kan bekostig om die 10 bepaalde hoeveelheid van die betrokke suiwelproduk of suiwelsurrogaat af te staan sonder om 'n vraag daarvoor plaaslik te laat ontstaan; en (b) dit in belang van die suiwelbedryf in die gebied is dat so 'n uitvoer plaasvind. 15 ln spcktcurs. 4. ( 1) Die Sekretaris kan, hetsy op 'n vaste grondslag hetsy vir 'n spesiale geval wat onder sy aandag gekom het, iemand in sy departement as 'n inspekteur aanwys vir die ondersoek van 'n moontlike oortreding van 'n verbod kragtens artikel (2) 'n Inspekteur ingevolge subartikel (I) aangewys moet voorsien word van 'n magtigingsbrief deur die Sekretaris onderteken en wat sertifiseer dat bedoelde persoon as m -;pekteur ingevolge hierdie Wet gemagtig is. (2) 'n Inspekteur of 'n persoon in subartikel (4) beoog wat aldus 'n perseel betree of 'n gebou binnegaan, kan - 40 (a) sodanige perseel of gebou inspekteer of deursoek en enige deur, kas of houer oopmaak; (b) inligting aangaande enige suiwelproduk of suiwelsurrogaat, wat gevind word, vereis van iemand in wie se besit of beheer dit is of van die eienaar of persoon 45 in beheer van sodanige perseel of gebou;

(2) The Cabinet may, on application by a wholesaler or the proprietor of a dairy products processing plant, and on 5 the conditions the Cabinet may determine, issue a permit for the exportation from the territory of a specific quantity of a dairy product or dairy product substitute in respect of which a prohibition on exportation from the territory under section 2 is in force, if it has ascertained to its satisfaction 10 that - (a) the dairy industry in the territory can spare the particular quantity of the dairy product or dairy product substitute involved without creating a demand therefor locally; and 15 (b) it is in the interest of the dairy industry in the territory that such export should take place. 4. (1) The Secretary may, either on a permanent basis or '"'"""'"" for a special case that has come to his attention, designate any person in his department as an inspector for the inves- 20 tigation of any possible contravention of a prohibition under section 2. (2) An inspector designated in terms of subsection (1) shall be provided with a letter of authority signed by the Secretary and certifying that the said person has been 25 authorized as an inspector in terms of this Act. S. (1) An inspector or any person contemplated in sub- p,,. " ' "' "" ;,' """'"' section ( 4) may at all reasonable times enter upon any land, or enter any building - (a) which is occupied by any person trading or presumed 30 to be trading in some dairy product or dairy product substitute in respect of which a prohibition under section 2 is in force; or (b) upon which or in which any dairy product or dairy product substitute is being stocked, sold, manufac- 35 tured, produced; processed, treated, prepared, graded, classified, packed, distributed or marked, or is presumed to be so stocked, sold, manufactured, produced, processed, treated, prepared, graded, classified, packed, distributed or marked. 40 (2) An inspector or any person contemplated in subsection (4) so entering upon land or entering a building, may - (a) inspect or search such land or bui lding and open any door, cupboard or container; (b) demand information regarding any dairy product or 45 dairy product substitute that is found, from any person in whose possession or charge it is or from the proprietor or person in charge of such land or building;

8 8 Wet No. 5, 1986 Buitengewone Offisiele Koerant 14 April 1986 No WET OP DIE BEHEEI~ VAN DIE IN- EN UITVOEn VAN SU IW ELPllODUKTE EN SUIWELSUnnOGATE, 1986 (c) enige suiwelproduk of suiwe lsurrogaat, of bestanddeel of houer daarvan, wat gevind word, weeg, tel, meet of merk ; (d) enige boek, staat, etiket of ander stuk wat gevind word en wat vermoedelik betrekking het op 'n suiwel- 5 produk, suiwelsurrogaat of bestanddeel daarvan, ondersoek of afskrifte daarvan of uittreksels daaruit maak, of van die eienaar of persoon in beheer van die perseel of gebou ' n verklaring vir die bestaan of inhoud daarvan vereis; 10 (e) bes lag le op enige suiwelproduk of suiwelsurrogaat, of op enige voorwerp, etiket, boek, staat of stuk wat bewys skyn te!ewer van 'n oortreding van 'n verbod kragtens artikel 2. (3) 'n lnspekteur moet die skriftelike magtiging uit 15 hoofde waarvan hy as inspekteur gemagtig is, toon aan iemand wat geraak word deur die uitoefening of verrigting van 'n bevoegdheid, plig of werksaamheid van sodanige inspekteur kragtens hierdie Wet. (4) Die bevoegdhede, pligte en werksaamhede van 'n in- 20 spekteur kragtens hierdie Wet kan ook uitgeoefen of verrig word deur 'n lid van die Suidwes-Afrikaanse Polisie of deur 'n inspekteur aangestel kragtens artikel 10 van die Ordonnansie op Voedingsmiddels, Skoonheidsmiddels en Ontsmettingsmiddels, 1979 (Ordonnansie 18 van 1979). 2S M isdrywc en strawwc. 6. (1) 'n Persoon wat - (a) 'n verbod oortree wat kragtens artikel 2 opgele is; of (b) versuim om te voldoen aan ' n voorw aarde wat in 'n permit, uitgereik ingevolge artikel 3, opgele is ; of (c) 'n inspekteur of 'n persoon in artikel 5(4) beoog, 30 belemmer of hinder by die verrigting van sy pligte of die uitvoering van sy bevoegdhede ingevolge hierdie Wet, is skuldig aan 'n misdryf. (2) By skuldigbevinding van 'n persoon - 35 (a) aan die in paragraaf (a) van subartikel (1) bedoelde misdryf, is sodanige persoon strafbaar met 'n boete van hoogstens R2 000 of gevangenisstraf van hoogstens een jaar, of met sowel sodanige boete as sodanige gevangenisstraf; 40 (b) aan die in paragraaf (b) van subartikel (1) bedoelde misdryf, is sodanige persoon strafbaar met 'n boete van hoogstens R of gevangenisstraf van hoogstens ses maande, of met sowel sodanige boete as sodanige gevangeni sstraf; of 45

9 No Official Gazette Extraordinary 14 April 1986 CONTIWL OF THE IMPORTATION AND EXPORTATION OF DAIRY PRODUCTS AND DAIRY PRODUCT SUBSTITUTES ACT, Act No. 5, 1986 ( 5 10 (c) weigh, count, measure or mark any dairy product, dairy product substitute, ingredient or container thereof that is found; (d) examine, or make copies of or take extracts from, any book, statement, label or document that is found and that presumably has a bearing on any dairy product, dairy product substitute or ingredient thereof, or demand from the proprietor or the person in charge of the land or building an explanation for the existence or contents thereof; (e) seize any dairy product or dairy product substitute, or any object, label, book, statement or other document which appears to provide proof of a contravention of a prohibiton under section (3) An inspector shall produce the written authority by virtue of which he is authorized as an inspector to any person affected by the exercise or performance of any power, duty or function of such inspector under this Act. ( 4) The powers, duties and functions of an inspector un- 20 der this Act may also be exercised or performed by a member of the South West African Police or by an inspector appointed under section 10 of the Foodstuffs, Cosmetics and Disinfectants Ordinance, 1979 (Ordinance 18 of 1979) (1) Any person who - Offences and penalties. (a) contravenes a prohibition imposed under section 2; or (b) fails to comply with a condition imposed in a permit issued in terms of section 3; or 30 (c) obstructs or hinders an inspector or a person contemplated in section 5(4) in the performance of his duties or the exercise of his powers in terms of this Act, shall be guilty of an offence. (2) On the conviction of any person - 35 (a) of the offence referred to in paragraph (a) of subsection (I), such person shall be I iable to a fine not exceeding R2 000 or imprisonment for a period not exceeding one year, or to both such fine and such imprisonment; 40 (b) of the offence referred to in paragraph (b) of subsection (1), such person shall be liable to a fine not exceeding R1 000 or imprisonment for a period not exceeding six months, or to both such fine and such imprisonment; or

10 10 Wet No. 5, 1986 Buitengewone Offisiele Koerant 14 April 1986 No WET OP DIE BEHEER VAN DIE IN- EN UITVOER VAN SUIWELPRODUKTE EN SUIWELSURROGATE, 1986 (c) aan die in paragraaf (c) van subartikel (1) bedoelde misdryf, is sodanige persoon strafbaar met 'n boete van hoogstens R500 of gevangenisstraf van hoogstens drie maande, of met sowel sodanige boete as sodanige gevangenisstraf. 5 Vcrm oedc. 7. Wanneer 'n persoon in besit gevind word van 'n hoeveelheid van 'n suiwelproduk of suiwelsurrogaat ten opsigte waarvan 'n verbod op invoer kragtens artikel 2 van krag is en wat nie afkomstig is van 'n produsent of vervaardiger in die gebied nie, word daar, tensy die teendeel bewys 10 word, vermoed dat sodanige persoon die betrokke suiwelproduk of suiwelsurrogaat in die gebied ingevoer het. Die Kabinet kan regulasies maak, met betrekking tot - (a) die vorm waarin 'n aansoek om 'n permit moet wees en die inligting wat sodanige aansoek moet bevat; 15 (b) die vorm waarin 'n permit moet wees; (c) in die algemeen, enige aangeleentheid wat hy nodig of dienstig ag om voor te skryf sodat die doeleindes van hierdie Wet bereik kan word. De legering van bcvoegdhede. Kort titel. 9. Die Kabinet kan 'n bevoegdheid by artikel 3 aan hom 20 verleen, te eniger tyd aan die Sekretaris delegeer. 10. Hierdie Wet heet die Wet op die Beheer van die Inen Uitvoer van Suiwelprodukte en Suiwelsurrogate, 1986.

When a person is found to be in possession of a quantity of a dairy product or dairy product substitute in respect of which a prohibition on importation under section 2 is in force and which has not originated from a producer or 10 manufacturer in the territory, it shall be presumed, unless the contrary is proved, that such person has imported the said dairy product or dairy product substitute into the territory. 8. T he Cabinet may make regulations in relation to - Act No. 5, 1986 Prcsumpt ion.
