2 2 No GOVERNMENT GAZETTE, 17TH MARCH Act No. Ii, 1971 BANTU AUTHORITIES' SERVICE PENSIONS ACT ACT To provide for the establishment, control and administration of a joint pension fund and of a joint superannuation fund for, and for the payment of pensions and other financial benefits to, persons in the service of certain authorities established by law, and to their dependants; and to provide for incidental matters. (English text signed by the State President.) (Assented to lith March, 1971.) BE IT ENACTED by the State President, the Senate and the House of Assembly of the Republic of South Mrica, as follows: 1. (l) In this Act, unless the context otherwise indicates (i) "actuary" means a Fellow of the Institute of Actuaries of England or of the Faculty of Actuaries in Scotland or of the Society of Actuaries of America; (ii) (ii) "age of retirement" means any age referred to in section 4; (xxiii) (iii) "approved employment" means employment preceding a period of service with an authority without interruption (or with such interruption as a prescribed authority may deem necessary and reasonable) which may, solely in determining a qualifying period for admission to membership of the superannuation fund, in terms of the regulations be deemed to be service with an authority; (vi) (iv) "authority" means (a) any authority or territorial board established under the Bantu Authorities Act, 1951 (Act No. 68 of 1951); (b) any executive council, tribal authority, community authority or regional authority referred to in the Development of Self~government for Native Nations in South-West Mrica Act, 1968 (Act No. 54 of 1968); or (c) any other authority or body established by or under any law, and designated by the Minister as an authority for the purposes of this Act; (xiii) (v) "child" means a child of a deceased member of the pension fund or of the superannuation fund, bom out of a customary union (as defined in section 35 of the Bantu Administration Act, 1927 (Act No. 38 of 1927» or out of a marriage (as so defined), whether or not such customary union or marriage subsisted on the day of such member's death, provided such child (a) has not contracted a marriage (as so defined). and is not a partner (as so defined) to any customary union (as so defined);

(Engelse teks deur die Staats president geteken.) (Goedgekeur op 11 Maart 1971.) DAAR WORD BEPAAL deur die Staatspresident, die Senaat en die Volksraad van die Republiek van Suid-Mrika, soos volg; 1. (I) In hierdie Wet, tensy uit die samehang anders blyk, Woordbeteken- omslr:rywida. (i) "afhanklike" die weduwee of kind van 'n oorlede lid van die pensioenfonds of van die superannuasiefonds; (viii) (ii) "aktuaris" 'n "Fellow" van die "Institute of Actu aries of England" of van die "Faculty ofactuaries in Scotland" ofvan die "Society ofactuaries ofamerica"; (i) (iii) "ander pensioenfonds of 'n voorsorgfonds u 'n pen sioenfonds of -skema of 'n voorsorgfonds of 'n onder steuningsfonds wat ingevolge 'n ander wet as hierdie Wet deur die Minister van Volkswelsyn en Pensioene uitgevoer word, enige sodauige fonds of skerna wat ingestel is ingevolge 'n pensioenwet wat uitgevoer word deur die Regering van die Transkei, in die Transkeise Grondwet, 1963 (Wet No. 48 van 1963), bedoe1, en euige ander sodanige fonds of skema deur die Minister goedgekeur vir die doeleindes van hierdie Wet; (xvi) (iv) "die gebied" die gebied Suidwes-Mrika; (xxvi) (v).. Gekonsolideerde Inkomstefonds", met betrekking tot 'n betaling wat uit daardie fonds gemaak moet word, geld wat vir die doeleindes van sodanige betaling deur die Parlement bewillig word; (vi) (vi) "goedgekeurde diens" diens wat 'n tydperk van ower heidsdiens voorafgaan sonder 'n onderbreking (of met die onderbreking wat 'n voorgeskrewe gesag nodig en redelik ag) wat, slegs by die bepaling van 'n kwalifi serende tydperk vir toelating tot lidmaatskap van die superannuasiefonds, ingevolge die regulasies geag word owerheidsdiens te wees; (iii) (vii) "hierdie Wet" ook 'n regulasie; (xxvii) (viii) "inkomste" (a) met betrekking tot (i) owerheidsdiens verrig in of in verband met 'n ondememing of bedrywigheid van, of 'n diens gelewer of,n funksie uitgeoefen deur, 'n owerheid; en (ii) 'n pensioen ten opsigte van sodanige diens betaalbaar,

4 4 No GOVERNMENT GAZETTE, 17TH MARCH, 1971 Act No.6, 1971 BANTU AUTHORITIES' SERVICE PENSIONS ACT, (b) has not attained the age of eighteen years; (c) is not self-supporting; and (d) has been designated by the Secretary as a child for the purposes of this Act; (ix) (vi) "Consolidated Revenue Fund", in relation to any payment to be made out of that fund, means moneys appropriated by Parliament for the purpose of such payment; (v) (vii) "declared department or body" means a department (as defined in section 1 (1) of the Public Service Act, 1957 (Act No. 54 of 1957), or any other institution, authority or body established by or under any law and designated by the State President as a declared department or body for the purposes of this Act; (xxvi) (viii) "dependant" means the widow or child of a deceased member of the pension fund or of the superannuation fund; (i) (ix) "employer's contribution" means an amount being regularly paid, in terms of the regulations, in respect ofeach contributor to the pension fund or to the superannuation fund, as the case may be, from revenue to the fund concerned; (xxviii) (x) "fixed date", in relation to any authority or any person employed by any authority, means the date with effect from which such authority is designated as an authority for the purposes of this Act, as contemplated in the definition of "authority"; (xxiv) (xi) "Government" means the Government of the Republic, and includes every provincial administration and the administration of the territory, but does not include the railway administration; (xix) (xii) "local authority" means any institution, councilor body referred to in section 84 (1) (f) of the Republic of South Africa Constitution Act, 1961 (Act No. 32 of 1961), or any other institution, council or body recognized by the Minister as a local authority for the purposes of this Act; (xviii) (xiii) "Minister" means the Minister of Bantu Administration and Development; (x) (xiv) "municipal pension fund" means any superannuation, pension or provident fund or scheme (other than an insurance scheme) established by a local authority for the benefit of its employees, or by or under any ordinance for the benefit of the employees of one or more local authorities; (xi) (xv) "ordinance" means any ordinance of any province or the territory and includes any proclamation issued by the Administrator of the territory; (xii) (xvi) "other pension fund or a provident fund" means any pension fund or scheme or provident fund administered by the Minister of Social Welfare and Pensions in terms of any law other than this Act, any such fund or scheme as may be established in terms of a pension law administered by the Government of the Transkei referred to in the Transkei Constitution Act, 1963 (Act No. 48 of 1963), and any other such fund or scheme approved by the Minister for the purposes of this Act; (iii) (xvii) "pension" means any annuity, gratuity or other benefit; (xv) (xviii) "pensionable age" means the age referred to in section 4 (5); (xvii) (xix) "pension fund" means the Authorities' Service Pension Fund established by section 2 (1); (xvi) (xx) "prescribed" means prescribed by regulation; (xxv) (xxi) "regulation" means any regulation made and in force in terms of this Act; (xx)

5 STAATSKOERANT, 17 MAART 1971 No WET OP PENSIOENE VIR BANTOE-OWERHEIDSDIENS, Wet No. (it 1971 geld wat deur die betrokke owerheid beskikbaar gestel word; (b) met betrekking tot (i) owerheidsdiens deur iemand verrig terwyl hy vir diens by 'n verklaarde departement of liggaam afgestaan is; en (ii) 'n pensioen ten opsigte van sodanige diens betaalbaar, geld wat ingevolge 'n ooreenkoms tussen die Regering en die betrokke owerheid beskikbaar gestel word uit 'n bron in sodanige ooreenkoms vermeld; (e) met betrekking tot die betaling van 'n pensioen ten opsigte van diens wat deels onder die omstandighede in paragraaf (a) en deels onder die omstandighede in paragraaf (b) beoog, verrig is, geld wat ingevolge 'n ooreenkoms tussen die Regering en die betrokke owerheid uit 'n bron in sodanige ooreenkoms vermeld, beskikbaar gestel word; (d) met betrekking tot die betaling uit inkomste, ingevolge die regulasies, aan of ten opsigte van 'n lid van die pensioenfonds of van die superannuasiefonds of aan of ten opsigte van 'n persoon wat in die diens is van 'n owerheid of 'n verklaarde departement of liggaam, maar ingevolge die regulasies nie bevoeg is om sodanige lid te word nie, van 'n pensioen vir diens ten opsigte waarvan sodanige lid of persoon nie tot die pensioenfonds of tot die superannuasiefonds of tot 'n ander of 'n voorsorgfonds bygedra het p~nsioenfonds me (i) ten opsigte van 'n tydperk van sodanige diens (as daar is) waarin sodanige lid of persoon in die diens van die Regering was, die Gekonsolideerde Inkomstefonds, die Poskantoorfonds, die Bantoe-onderwysrekening, die provinsiale inkomstefonds van die betrokke provinsie of die Inkomstefonds van die gebied, na gelang van die geval; (ii) ten opsigte van 'n tydperk van sodanige diens waarin sodanige lid of persoon as 'n onderwyser in die diens wat bedoel word in paragraaf (a) van die omskrywing van "nieblanke werknemer" in artikel I van die Wet op Pensioene vir Nie-blanke Regeringswerknemers, 1966 (Wet No. 42 van 1966), was, die Bantoe-onderwysrekening; en (iii) ten opsigte van 'n tydperk van sodanige diens waarin sodanige lid of persoon in owerheidsdiens was of by 'n owerheid of verklaarde departement of liggaam in diens was, inkomste, soos in paragrawe (a), (b) en (e) omskryf; (xxii) Ox) "kind" 'n kind van 'n oorlede lid van die pensioenfonds of van die superannuasiefonds, gebore uit 'n gebruiklike verbinding (soos in artikel 35 van die Bantoeadministrasie Wet, 1927 (Wet No. 38 van 1927), omskryf) of uit 'n huwelik (soos aldus omskryf), hetsy sodanige gebruiklike verbinding of huwelik op die dag van sodanige lid se dood bestaan het al dan nie, mits sodanige kind (a) me in die huwelik (soos aldus omskryf) getree het nie, en nie 'n deelgenoot (soos aldus omskryf) in 'n gebruiklike verbinding (soos aldus omskryf) is me; (b) nie die leeftyd van agtien jaar bereik het me; (e) me selfonderhoudend is nie; en (d) deur die Sekretaris vir die doeleindes van hierdie Wet as 'n kind aangewys is; (v)

6 6 No GOVERNMENT GAZETTE, 17TH MARCH Ad No. 6, 1'71 BANTU AUTHORITIES' SERVICE PENSIONS ACT, (xxii) "revenue" (a) in relation to (i) service with an authority performed in or in connection with any undertaking or activity of, or any service rendered or any function exercised by, an authority; and (ii) any pension payable in respect of such service, means moneys made available by the authority concerned; (b) in relation to (i) service with an authority performed by any person while seconded for service with a declared department or body; and (ii) any pension payable in respect of such service, means moneys made available in terms of an agreement between the Government and the authority concerned, from any source referred to in such agreement; (e) in relation to the payment of a pension in respect of service performed partly in the circumstances contemplated in paragraph (a) and partly in the circumstances contemplated in paragraph (b), means moneys made available in terms of an agreement between the Government and the authority concerned from any source referred to in such agreement; (d) in relation to the payment, out of revenue in terms of the regulations, to or in respect of a member of the pension fund or of the superannuation fund or to or in respect of any person employed by an authority or a declared department or body but disqualified in terms of the regulations from becoming such member, of a pension for service in respect of which such member or person has not contributed to the pension fund or the superannuation fund or to any other pension fund or a provident fund (i) in respect of a period of such service (if any) in which such member or person was in the service of the Government, means the Consolidated Revenue Fund, the Post Office Fund, the Bantu Education Account, the provincial revenue fund of the province concerned or the Revenue Fund of the territory, as the case may be; (ii) in respect of a period of such service in which such member or person was employed as a teacher in service referred to in paragraph (a) of the definition of "non-white employee" in section 1 of the Government non-white Employees' Pension Act, 1966 (Act No. 42 of 1966), means the Bantu Education Account; and (iii) in respect of a period of such service in which such member or person was in service with an authority or was employed by an authority or a declared department or body, means revenue as defined in paragraphs (a), (b) and (e); (viii) (xxiii) "Secretary" means the Secretary for Bantu Administration and Development; (xxi) (xxiv) "service with an authority" means employment (other than employment as a casual employee) in the service ofand on or supernumerary to the establishment of an authority, whether such service is performed by the person concerned in or in connection with any undertaking or activity of, or any service rendered or

7 STAATSKOERANT, 17 MAART 1971 WET OP PENSIOENE VIR BANTOE-OWERHEIDSDIENS, (x) "Minister" die Minister van Bantoe-administrasie en -ontwikkeling; (xiii) (xi) "munisipale pensioenfonds" 'n superannuasie-, pensioen-, ondersteunings- of voorsorgfonds of -skema (uitgesonderd 'n assuransieskema) deur 'n plaaslike bestuur ten voordele van sy werknemers, of by of kragtens 'n ordonnansie ten voordele van die werknemers van een of meer plaaslike besture, ingestel; (xiv) (xii) "ordonnansie" 'n ordonnansie van 'n provinsie of die gebied en ook 'n proklamasie deur die Administrateur van die gebied uitgevaardig; (xv) (xiii) "owerheid" (a) 'n owerheid of 'n gebiedsraad kragtens die Wet op Bantoe-owerhede, 1951 (Wet No. 68 van 1951). ingestel; (b) 'n uitvoerende raad, stamowerheid, gemeenskapsowerheid of streeksowerheid in die Wet op die Ontwikkeling van Selfbestuur vir Naturellevolke in Suidwes-Afrika, 1968 (Wet No. 54 van 1968). bedoel; of (e) 'n ander gesag ofliggaam by of kragtens die een of ander wet ingeste1, en deur die Minister vir die doeleindes van hierdie Wet as 'n owerheid aangewys; (iv) (xiv) "owerheidsdiens" diens (maar nie diens as 'n los werker nie) in die diens van en op of botallig by die diensstaat van 'n owerheid, hetsy sodanige diens deur die betrokke persoon verrig word in of in verband met 'n onderneming of bedrywigheid van, of 'n diens gelewer, of 'n funksie uitgeoefen deur, 'n owerheid of terwyi so iemand vir diens by 'n verklaarde departement of liggaam afgestaan is en aldus dien; (xxiv) (xv) "pensioen" 'n jaargeld, 'n gratifikasie of 'n ander voordeel; (xvii) (xvi) "pensioenfonds" die Owerheidsdienspensioenfonds by artikel 2 (1) ingestel; (xix) (xvii) "pensioenleeftyd" die leeftyd in artikel 4 (5) vermeld; (xviii) (xviii) "plaaslike bestuur" 'n instelling, raad of liggaam in artikel 84 (1) (f) van die Grondwet van die Republiek van Suid-Afrika, 1961 (Wet No. 32 van 1961), bedoel of 'n ander instelling, raad ofliggaam deur die Minister vir die doeleindes van hierdie Wet as 'n plaaslike bestuur erken; (xii) (xix) "Regering" die Regering van die Republiek en ook elke provinsiale administrasie en die administrasie van die gebied, maar nie ook die spoorwegadministrasie nie; (xi) (xx) "regulasie" 'n regulasie wat ingevolge hierdie Wet nitgevaardig en van krag is; (xxi) (xxi) "Sekretaris" die Sekretaris van Bantoe-administrasie en -ontwikkeling; (xxiii) (xxii) "superannuasiefonds" die Owerheidsdienssuperannuasiefonds by artikel2 (2) ingestel; (xxv) (xxiii) "uitdienstredingsleeftyd" 'n leeftyd in artikel4 bedoel; (ii) (xxiv) "vasgestelde datum", met betrekking tot 'n owerheid of iemand in diens by 'n owerheid, die datum met ingang waarvan sodaoige owerheid soos in die omskrywing van "owerheid" beoog, as 'n owerheid vir die doeleindes van hierdie Wet aangewys word; (x) (xxv) "voorgeskrewe" by regulasie voorgeskryf; (xx) (xxvi) "verklaarde departement of liggaam" 'n departement (soos in artikell (1) van die Staatsdienswet, 1957 (Wet No. 54 van 1957) omskrywe),of'nanderinrigting, gesag of liggaam by of kragtens die een of ander wet ingestel en deur die Staatspresident vir die doeleindes van hier- No.3022 Wet No. 6, un 7

8 8 No GOVERNMENT GAZETTE, 17TH MARCH, 1971 Act No.6, 1m BANTU AUTHORITIES' SERVICE PENSIONS ACT, function performed by an authority, or while such person is seconded for service with a declared department or body and so serves; (xiv) (xxv) "superannuation fund" means the Authorities' Service Superannuation Fund established by section 2 (2); (xxii) (xxvi) "the territory" means the territory of South-West Africa; (iv) (xxvii) "this Act" includes any regulation; (vii) (xxviii) "widow" means (a) the surviving woman who was associated with a deceased member of the pension fund or of the superannuation fund in a marriage (as defined in section 35 of the Bantu Administration Act, 1927 (Act No. 38 of 1927) subsisting at such member's death; or (b) the surviving female partner (as so defined) of every customary union (as so defined) between her and such member, subsisting at his death. (xxvii) (2) Notwithstanding the provisions of section 2 (3) of this Act and section 18 of the Government Service Pensions Act, 1965 (Act No. 62 of 1965), the Secretary may at his discretion order that any pension or a portion thereof which is payable to any person in terms of this Act, shall be paid to some other person designated by the Secretary from time to time, under such conditions as to its administration for the benefit of such first-mentioned person as the Secretary may determine. Eatablishment of pension fund and superannuation fund. Membership of pension fund and superannuation fund. 2. (1) There is hereby established a fund to be known as the Authorities' Service Pension Fund, which shall consist of (a) the amounts which are paid to that fund in terms of the regulations by persons who have become liable to contribute to that fund; (b) the employer's contributions which are paid to that fund; (c) any other amounts which are to be credited to that fund. (2) There is hereby established a fund to be known as the Authorities' Service Superannuation Fund, which shall consist of (a) the amounts which are paid to that fund in terms of the regulations by persons who have become liable to contribute to that fund; (b) the employer's contributions which are paid to that fund; (c) any other amounts which are to be credited to that fund. (3) For the purposes of the Government Service Pensions Act, 1965 (Act No. 62 of 1965), or any other law relating to a pension fund or scheme administered by the Minister or by the Minister of Social Welfare and Pensions or designated by the Minister, the superannuation fund shall be deemed to be a pension fund within the meaning of that Act or such other law, and this Act shall be deemed to be a law relating to a pension fund or scheme administered by the Minister of Social Welfare and Pensions. 3. (1) Every person who, on the fixed date, is in service with an authority in a permanent capacity or on probation and is not a member of any other pension fund or a provident fund, shall, subject to the regulations, on that date become a

9 STAATSKOERANT, 17 MAART 1971 No WET OP PENSIOENE VIR BANTOE-OWERHEIDSDIENS Wet No. 6, 1971 die Wet as 'n verklaarde departement of liggaam aangewys ; (vii) (xxvii) "weduwee" (a) die oorlewende vrou wat met 'n oorlede lid van die pensioenfonds ofvan die superannuasiefonds in 'n huwelik (soos in artike135 van die Bantoe-administrasiewet, 1927 (Wet No. 38 van 1927), omskryf) wat by sodanige lid se dood bestaan het, verbind was; of (b) die oorlewende vroulike deelgenoot (soos aldus omskryf) van enige gebruiklike verbinding (soos aldus omskryf) tussen haar en sodanige lid wat by sy dood bestaan het; (xxviii) (xxviii) "werkgewersbydrae" 'n bedrag wat gereeld, ooreen komstig die regulasies, ten opsigte van eike bydraer tot die pensioenfonds of tot die superannuasiefonds, na ge lang van die geval, uit inkomste aan die betrokke fonds betaal word. (ix) (2) Ondanks die bepalings van artike12 (3) van bierdie Wet en artikel18 van die Regeringsdienspensioenwet, 1965 (Wet No. 62 van 1965), kan die Sekretaris na goeddunke gelas dat 'n pensioen of 'n deel daarvan wat ingevolge bierdie Wet aan 'n persoon betaalbaar is, aan 'n ander persoon wat die Sekretaris van tyd tot tyd aanwys, betaal word op die voorwaardes betreffende die beheer daarvan ten voordele van sodanige eersgenoemde persoon wat die Sekretaris bepaal. 2. (1) Daar word bierby 'n fonds ingestel wat bekend staan as Inste.Uing van die Owerheidsdienspensioenfonds, en wat bestaan uit- :g:.:::~:m~en (a) die bedrae wat ooreenkomstig die regulasies deur per- fonds. sone wat onder verpligting gekom het om tot daardie fonds by te dra, aan daardie fonds betaal word;. (b) die werkgewersbydraes wat aan daardie fonds betaal word; (e) enige ander bedrae waarmee daardie fonds gekrediteer moet word. (2) Daar word bierby 'n fonds ingestel wat bekend staan as die Owerheidsdienssuperannuasiefonds, en wat bestaan uit (a) die bedrae wat ooreenkomstig die regulasies deur persone wat onder verpligting gekom het om tot daar die fonds by te dra, aan daardie fonds betaal word; (b) die werkgewersbydraes wat aan daardie fonds betaal word; (e) enige ander bedrae waarmee daardie fonds gekrediteer moet word. (3) By die toepassing van die Regeringsdienspensioenwet, 1965 (Wet No. 62 van 1965), of 'n ander wet betreffende 'n pensioenfonds of -skema wat deur die Minister of deur die Minister van Volkswelsyn en Pensioene uitgevoer word of deur die Minister aangewys word, word die superannuasiefonds geag 'n pensioenfonds binne die bedoeling van die Wet of sodanige ander wet en hierdie Wet geag 'n wet betreffende 'n pensioenfonds of -skema wat deur die Minister van Volkswelsyn en Pensioene uitgevoer word, te weese 3. (2) Every person who, on the fixed date, is in service with an authority otherwise than as contemplated in subsection (1), is not a member of any other pension fund or a provident fund, and before that date has completed a prescribed qualifying period in such service or in approved employment, shall, subject to the regulations, on that date become a member of, and with effect from that date contribute to, the superannuation fund in terms of the regulations. (3) Every person who on the fixed date is in service with an authority in a permanent capacity or on probation, and on the day immediately prior to that date was by law liable to contribute to any other pension fund or a provident fund, or on or after the said date is appointed or transferred to service with an authority and assumes duty in such service in a permanent capacity or on probation, shall (a) with effect from the said fixed date or the date on which he is so appointed or transferred, as the case may be, and subject to the regulations, become a member of and contribute to the pension fund; and lb) contribute, subject to the regulations, with effect from that fixed date or the date on which he is so appointed or transferred, as the case may be, to the pension fund in respect of his previous pensionable service (if any) with any other pension fund or a provident fund preceding his pensionable service under this Act without interruption of the continuity of his employment or after such interruption of such continuity as a prescribed authority may consider necessary and reasonable. (4) Every person who (a) is on the fixed date in service with an authority or is appointed or transferred to such service on or after that date; (b) is employed in such service otherwise than as contemplated in subsection (1); and (c) has on the said fixed date or on the other date on which he is appointed or transferred in terms of paragraph (a), not completed a prescribed qualifying period in such service or in approved employment, shall, subject to the regulations, become a member of the superannuation fund on the day after the date on which he completed such qualifying period and shall on that day become liable to contribute to the said fund: Provided that if any such person has been so appointed or transferred (without interruption of the continuity of his employment or after such interruption of such continuity as a prescribed authority may consider necessary and reasonable) from employment in respect ofwhich he contributed to any other pension fund or a provident fund (i) he shall be deemed to have completed such qualifying period on the day preceding the date of such appointment or transfer; and (ii) he shall, on the date of such appointment or transfer, become liable to contribute to the superannuation fund, in terms of prescribed conditions, in respect of his pensionable service as a member of any such other fund. (5) Any person who for a prescribed qualifying period (without interruption of the continuity of such period or with such interruption of such continuity as a prescribed authority may consider necessary and reasonable) has performed casual labour with an authority or a declared department or body or in approved employment, shall, if the said prescribed authority so directs, become a member of the superannuation fund, on the prescribed conditions, and shall contribute to that fund in terms of the regulations, and any

(2) BIke persoon wat op die vasgestelde datum anders as in subartikel (1) beoog in owerheidsdiens is, nie 'n lid van 'n ander pensioenfonds of 'n voorsorgfonds is nie, en voor daardie datum 'n voorgeskrewe kwalifiserende tydperk in sodanige diens of in goedgekeurde diens voltooi het, word, behoudens die regulasies, op daardie datum 'n lid van, en dra met ingang van daardie datum ooreenkomstig die regulasies by, tot die superannuasiefonds. (3) BIke persoon wat op die vasgestelde datum in 'n permanente hoedanigheid of op proef in owerheidsdiens is, en op die dag onmiddellik voor daardie datum volgens wet verplig was om tot 'n ander pensioenfonds of 'n voorsorgfonds by te dra, of op of na genoemde datum in owerheidsdiens aangestel of na sodanige diens oorgeplaas word en in sodanige diens in 'n permanente hoedanigheid of op proef diens aanvaar (a) word met ingang van genoemde vasgestelde datum of die datum waarop hy aldus aangeste1 of oorgeplaas word, na gelang van die geval, en behoudens die regulasies, 'n lid van en dra by tot die pensioenfonds; en (b) dra, behoudens die regulasies, met ingang van dies vasgestelde datum of die datum waarop hy aldus aan gestel of oorgeplaas word, na gelang van die geval, by tot die pensioenfonds ten opsigte van sy vorige pen sioengewende diens (as daar is) by 'n ander pen sioenfonds of 'n voorsorgfonds wat sy pensioen gewende diens ingevolge hierdie Wet voorafgaan sonder onderbreking van die deurlopendheid van sy diens of na die onderbreking van sodanige deurlopend heid wat 'n voorgeskrewe gesag nodig en redelik ago (4) BIke per soon wat (a) op die vasgestelde datum in owerheidsdiens is, of op of na daardie datum in sodanige diens aangestel of daarheen oorgeplaas word; (b) in sodanige diens anders as in subartikel (1) beoog, dien; en (c) op genoemde vasgestelde datum of op die ander datum waarop hy ingevolge paragraaf (a) aangestel of oorge plaas word, nie 'n voorgeskrewe kwalifiserende tydperk in sodanige diens of in goedgekeurde diens voltooi hetnie, word, behoudens die regulasies, 'n lid van die superannuasiefonds op die dag na die datum waarop hy sodanige kwalifiserende tydperk voltooi het en kom op daardie dag onder verpligting om tot daardie fonds by te dra: Met dien verstande dat indien so iemand aldus aangestel of oorgeplaas is (sonder onderbreking van die deurlopendheid van sy diens of na die onderbreking van sodanige deurlopendheid wat 'n voorgeskrewe gesag nodig en redelik ag) uit diens ten opsigte waarvan hy tot 'n ander pensioenfonds of 'n voorsorgfonds bygedra het (i) hy geag word sodanige kwalifiserende tydperk op die dag v~~r die datum van sodanige aanstelling of oorplasing te voltooi het; en (ii) hy op die datum van sodanige aanstelling of oor plasing onder verpligting kom om, ingevolge voor geskrewe voorwaardes, ten opsigte van sy pensioen gewende diens as 'n lid van so 'n ander fonds, tot die superannuasiefonds by te dra. (5) Iemand wat vir 'n voorgeskrewe kwalifiserende tydperk (sonder onderbreking van die deurlopendheid van sodanige tydperk of met die onderbreking van sodanige deurlopendheid wat 'n voorgeskrewe gesag nodig en redelik ag) los werk by 'n owerheid of by 'n verklaarde departement of liggaam of in goedgekeurde diens verrig het, word, indien bedoelde voorgeskrewe gesag dit ge1as, lid van die superannuasiefonds en wei op die voorgeskrewe voorwaardes en moet ooreenkom

(6) Any person who, in terms of this section, has become a member of either the pension fund or the superannuation fund, as the case may be, and any person whose membership has in terms of the regulations been transferred from the one said fund to the other, shall, subject to the regulations, remain a member of such fund or of the last such fund of which he so became a member, as the case may be, while he remains in service with an authority in any capacity without interruption of the continuity of his employment, and if, on the termination of his service with an authority for any reason other than the attainment of the age for retirement, ill-health or misconduct, he is, without interruption of the continuity of his employment or after such interruption of such continuity as a prescribed authority may consider necessary and reasonable, re-appointed to service with an authority in the same or any other capacity, the continuity of his employment shall be deemed not to have been interrupted, and he shall, subject to the regulations, remain a member of the fund to which he contributed before his service was so terminated. (7) If any authority or declared department or body takes over any undertaking or activity of a local authority or any power or function of a local authority in connection with the rendering of any service or the administration of any area, any person who is a member of a municipal pension fund and immediately prior to the date on which such undertaking, activity, power or function is so taken over, is in the service of such local authority in or in connection with such undertaking or activity or the rendering of such service or the administration of such area, shall, by virtue of such taking over, become liable to become a member of and to contribute to the pension fund, if his appointment or transfer to service with an authority is in a permanent capacity or on probation, or to become a member of and to contribute to the superannuation fund if such appointment or transfer occurs in any other manner, and, notwithstanding anything to the contrary contained in any law (including the provisions of the ordinance or rules governing such municipal pension fund) (0) the period of such person's service recognized in terms of such ordinance or rules as pensionable service, shall be included in such person's pensionable service for the purposes of the pension fund or ofthe superannuation fund, as the case may be; (b) an amount equal to the transfer value which would have been payable in terms of such ordinance or rules if such person had been transferred or directly appointed to the service of any other local authority having a different municipal pension fund or associated with a different municipal pension fund, shall be paid out of the municipal pension fund concerned to the pension fund or to the superannuation fund, as the case may be; (c) interest at the rate of four and one-half per cent per annum, compounded annually on the thirty-first day of March and calculated from the date on which such person becomes liable to contribute to the pension fund or the superannuation fund, as the case may be, up to the date of payment of such amount, shall be added to an amount payable in terms of paragraph (b). (8) Where a class or category of persons who, while in the service of the Government, or in service with an authority prior to the fixed date, performed work of such a kind as to become members of any other pension fund or a provident fund of which the benefits are substantially more favourable than the benefits payable in terms of the regulations in corresponding circumstances out of the pension fund

(7) As 'n owerheid of'n verklaarde departement ofliggaam 'n onderneming of bedrywigheid van 'n plaaslike bestuur of 'n bevoegdheid of werksaamheid van 'n plaaslike bestuur in verband met die lewering van 'n diens of die administrasie van 'n gebied oomeem, kom iemand wat 'n lid is van 'n munisipale pensioenfonds en onmiddeuik voor die datum waarop sodanige onderneming, bedrywigheid, bevoegdheid of werksaamheid aldus oorgeneem word, in die diens is van sodanige plaaslike bestuur in of in verband met sodanige ondememing of bedrywigheid of die lewering van sodanige diens of die administrasie van sodanige gebied, nit hoofde van sodanige oomame onder die verpligting om, indien sy aanstelling in of oorplasing na owerheidsdiens in 'n permanente hoedanigheid of op proef is, 'n lid te word van en by te dra tot die pensioenfonds, of indien sodanige aanstelling of oorplasing anders'geskied, 'n lid te word van en by te dra tot die superannuasiefonds, en word ondanks andersluidende wette (met inbegrip van die bepalings van die ordonnansie of reels op sodanige munisipale pensioenfonds)- (a) die tydperk van so iemand se diens, wat ingevolge soda nige ordonnansie of reels as pensioengewende diens erken word, by sy pensioengewende diens vir die doel eindes van die pensioenfonds of van die superannuasie fonds, na gelang van die geval, ingeslnit; (b) nit die betrokke munisipale pensioenfonds aan die pen sioenfonds of aan die superannuasiefonds, na gelang van die geval, 'n bedrag betaal wat gelyk is aan die oor dragwaarde wat kragtens sodanige ordonnansie of reels betaalbaar sou gewees het as so iemand oorge plaas was na, of regstreeks aangestel was in, die diens van 'n ander plaaslike bestuur wat 'n ander munisipale pensioenfonds het of met 'n ander munisipaiepensioen fonds geassosieer is; (c) by 'n bedrag ingevolge paragraaf (b) betaalbaar, rente gevoeg teen vier en 'n half persent per jaar, jaarliks saamgestel op die een-en-dertigste dag van Maart en bereken vanaf die datum waarop so iemand onder ver pligting kom om by te dra tot die pensioenfonds of die superannuasiefonds, na gelang van die geval, tot op die datum van betaling van sodanige bedrag. (8) Waar 'n klas of kategorie persone wat, terwyl hulle in die diens van die Regering was of voor die vasgestelde datum in owerheidsdiens was, so 'n soort werk verrig het dat hulle lede van 'n ander pensioenfonds of 'n voorsorgfonds geword het waarvan die voordele wesenlik gunstiger is as die voordele wat ingevolge die regulasies onder ooreenstemmende omstandighede nit die pensioenfonds betaalbaar is

14 14 No GOVERNMENT GAZETTE, 17TH MARCH, 1971 Ad No.6, :197:1 BANTU AUTHORITIES' SERVICE PENSIONS ACT, (a) become liable to contribute to the pension fund In terms of subsection (3); and (b) continue to perform the said kind of work in service with an authority, the Minister may direct that special benefits shall, subject to the regulations, be paid to such persons or, if deceased, to their dependants, and such benefits shall not be less favourable than the benefits which would, in corresponding circumstances, have been payable, from the other pension fund or provident fund concerned of which those persons were members, to such persons or dependants, had such persons remained members of such pension fund or provident fund. Ages for retirement. 4. (1) Subject to the provisions of subsection (2), a member of the pension fund or of the superannuation fund, as the case may be, shall have the right to retire on pension and shall be retired on pension on attaining an age prescribed by or under any law determining the conditions of his service with an authority: Provided that if no age has, in relation to any authority, been so prescribed, any member of the pension fund or the superannuation fund in the service of such authority shall have the right to retire on pension and may be retired on pension when he attains the pensionable age. (2) Notwithstanding the provisions of any such law (a) no age under fifty-five years may be so prescribed; (b) different ages may be so prescribed for different classes or categories of persons or by or in respect of different authorities; (c) provision may be made by or under any such law for persons of a class or category designated by or under such law, retiring on pension and being retired on pension at such alternative ages as may be prescribed by or under such law. (3) Notwithstanding the provisions of this section or of any law, a member of the superannuation fund (a) who, not less than one month before the date on which he attains the pensionable age, gives written notification to the head of the authority or declared department or body with which he is serving of his desire to retire on pension, shall be retired on pension on such date; (b) who, on or after the said date, so gives notification, shall be retired on pension on the first day of the month immediately following the month in which such notification is received; (c) who, on or after the said date resigns voluntarily or for any reason, other than his misconduct, is retired or discharged, shall be deemed to be retired on pension in terms of paragraph (b). (4) Notwithstanding anything to the contrary in any law contained, but subject to the approval of a person or body. ted for the purpose by or under any law governing the con s of service of persons in service with an authority, any member of the pension fund or of the superannuation fund who has attained the age of fifty-five years may be retired on pension. (5) Notwithstanding the provisions of subsections (1), (2), (3) and (4) or of any law referred to in subsection (1), a member of the pension fund or of the superannuation fund shall be deemed to have attained the pensionable age when he attains the age of sixty years. (6) Notwithstanding any provision to the contrary in any law contained, but subject to the provisions of subsection (3), no person shall retire or be retired on any day other than the

(1) Behoudens die bepalings van subartikel (2), het 'n lid l!!~dienstredingsvan die pensioenfonds of van die superannuasiefonds, na ge- l"",tyc. lang van die geval, die reg om met pensioen af te tree en word hy met pensioen afgedank wanneer hy 'n leeftyd bereik wat voorgeskryf word by of kragtens 'n bepaling van die een of ander wet wat die voorwaardes van sy owerheidsdiens bepaal: Met dien verstande dat indien geen leeftyd met betrekking tot 'n owerheid aldus voorgeskryf is nie, 'n lid van die pensioenfonds of die superannuasiefonds wat in die diens van sodanige owerbeid is, die reg bet om met pensioen af te tree en met pensioen afgedank kan word wanneer hy die pensioenleeftyd bereik. (2) Ondanks die bepalings van so 'n wet (0) mag geen leeftyd onder vyf-en-vyftig jaar aldus voorge skryf word nie; (b) kan verskillende leeftye aldus voorgeskryf word vir ver skillende klasse of kategoriee persone of deur of ten opsigte van verskillende owerbede; (c) kan voorsiening by of kragtens so 'n wet daarvoor ge maak word dat persone van 'n klas of kategorie wat by of kragtens sodanige wet aangewys word, op die alter natiewe Ieeftye wat by of kragtens sodanige wet voor geskryf word, met pensioen aftree en met pensioen afgedank word. (3) Ondanks die bepalings van hierdie artikel ofvan die een of ander wet, word 'n lid van die superannuasiefonds (0) wat minstens een maand voor die datum waarop by die pensioenleeftyd bereik aan die boofvan die owerbeid of die verklaarde departement ofliggaam waarby by dien, skriftelik kennis gee van sy begeerte om met pensioen af te tree, op sodanige datum met pensioen afgedank; (b) wat op of na bedoelde datum aldus kennis gee, met pensioen afgedank op die eerste dag van die maand wat onmiddellik volg op die maand waarin sodanige kennis gewing ontvang word; (c) wat op of na bedoelde datum vrywiilig bedank of om enige rede, uitgesonderd sy wangedrag, afgedank of ontslaan word, geag ingevolge paragraaf (b) met pensioen afgedank te wees. (4) Ondanks andersluidende bepalings van die een of ander wet, maar onderworpe aan die goedkeuring van 'n persoon of liggaam vir die doel by of kragtens 'n wet op die diensvoorwaardes van persone in owerbeidsdiens aangewys, kan 'n lid van die pensioenfonds ofvan die superannuasiefonds, wat die leeftyd van vyf-en-vyftig jaar bereik bet, met pensioen afgedank word. (5) Ondanks die bepalings van subartikels (1), (2), (3) en (4) of van 'n wet in subartikel (1) bedoel, word 'n lid van die pensioenfonds of van die superannuasiefonds geag die pensioenleeftyd te bereik bet wanneer by die leeftyd van sestig jaar bereik. (6) Ondanks andersluidende bepaungs van die een of ander wet, maar beboudens die bepalings van subartikel (3), tree niemand af en word niemand afgedank op 'n ander dag as die

RopJations. 5. (1) The Minister may, in consultation with the Minister of Finance, from time to time make regulations (a) for the management and control of the pension fund and the superannuation fund; (b) providing for the payment of contributions to the said funds and of benefits from such funds or from revenue, or from such funds and from revenue, to or in respect of members of those funds on their retirement, discharge, resignation or death; (c) in regard to any matter which under this Act is required or permitted to be prescribed by regulation, and generally for the better carrying out of the objects and purposes of this Act. (2) Without prejudice to the generality of the provisions of subsection (1) such regulations may (a) prescribe the classes or categories of persons who, notwithstanding the provisions of section 3, shall be disqualified from membership of the pension fund or of the superannuation fund; (b) provide for the determination ofthe nature and duration of a qualifying period of service (if any) required for admission to membership of the superannuation fund; (c) prescribe the periods which shall or may be reckoned as pensionable service in determining a benefit payable to or in respect of any person who contributed to the pension fund or the superannuation fund, as the case may be, and the conditions for the inclusion in such pensionable service of any previous periods of pensionable service in respect of which such person contributed to the one or the other of such funds or to any other pension fund or a provident fund or to the Consolidated Revenue Fund, or to any other fund or any account established by law, and provide for the determination of the amount required by the pension fund or by the superannuation fund, as the case may be, in respect of the recognition of any previous period for inclusion in the pensionable service of the person concerned; (d) prescribe the conditions on which a member of the pension fund may be permitted to include any period not referred to in paragraph (c), in his pensionable service, and the authority by whom such permission may be granted, and provide for the calculation of the amount required by that fund in respect of such inclusion; (e) provide for the payment out of revenue on the retirement or death of any person who has contributed to the pension fund or the superannuation fund, of a benefit in respect of the periods in which such person was in the whole-time service of the Government or of an authority and which are, or by law are deemed, to be continuous with such person's pensionable service, but which, in terms of any law, are not included in such pensionable service, and prescribe conditions for the payment of such benefit; (I) prescribe the rate or scale (determined on the basis of emoluments payable or on such other basis as may be specified in the regulations) according to which any person becoming liable, in terms of section 3, to contribute to either the pension fund or to the superannuation fund, as the case may be, shall so

(2) Sonder om afbreuk te doen aan die algemene aard van die bepalings van subartikel (1) kan bedoelde reguiasies (0) die klasse of kategoriee persone voorskryf wat, ondanks die bepalings van artikel3, rue bevoeg is vir lidmaatskap van die pensioenfonds of die superannuasiefonds nie; (b) voorsiening maak vir die bepaling van die aard en duur van 'n kwalifiserende tydperk van diens (as daar is) wat vir toelating tot lidmaatskap van die superannuasiefonds vereis word; (c) die tydperke wat as pensioengewende diens gereken moet of kan word by die bepaling van 'n voordeel wat betaalbaar is aan of ten opsigte van 'n persoon wat bygedra bet tot die pensioenfonds of die super annuasiefonds, na gelang van die geval, en die voor waardes vir die insluiting by sodanige pensioengewende diens van enige vorige tydperk van pensioengewende diens ten opsigte waarvan sodanige persoon bygedra bet tot die een of die ander sodanige fonds of tot 'n ander pensioenfonds of 'n voorsorgfonds of tot die Gekonsolideerde Inkomstefonds, of tot 'n ander fonds of 'n rekening wat by wet ingestel is, voorskryf en voorsiening maak vir die bepaling van die bedrag wat deur die pensioenfonds of deur die superannuasie fonds, na gelang van die geval, vereis word ten opsigte van die erkenning van 'n vorige tydperk vir insluiting by die pensioengewende diens van die betrokke per soon; (d) die voorwaardes waarop toestemming aan 'n lid van die pensioenfonds verleen kan word om by sy pensioen gewende diens 'n tydperk nie in paragraaf (c) be doel nie, in te sluit, en die gesag deur wie sodanige toestemming verleen kan word, voorskryf, en voor siening maak vir die berekening van die bedrag wat daardie fonds ten opsigte van sodanige insluiting vereis; (e) voorsiening maak vir die betaling uit inkomste by die uitdienstreding of afsterwe van iemand wat tot die pensioenfonds of die superannuasiefonds byge dra bet, van 'n voordeel ten opsigte van die tydperke waarin so iemand in die beeltydse diens van die Regering of van 'n owerbeid was en wat aaneenloop of by wet geag word aaneen te loop met so iemand se pensioengewende diens, maar wat ingevolge die een of ander wet nie by sodanige pensioengewende diens ingesluit is nie, en voorwaardes voorskryf vir die be taling van sodaruge voordeel; (f) die koers of skaal (vasgestel op die grondslag van betaalbare besoldiging of op die ander grondslag wat in die regulasies uiteengesit word) waarvolgens iemand wat ingevolge artikel 3 onder verpligting kom om by te dra Of tot die pensioenfonds of tot die superannuasiefonds, na gelang van die geval.
